Abstract

The government issued a discourse on granting mass clemency due to the overcrowded conditions of the Penitentiary. The discourse raises pros and cons in the community. In handling prisoners in the Penitentiary, a policy strategy is implemented, namely coaching to improve their readiness to return to the community. This study aims to determine the philosophical juridical perspective of clemency for prisoners. This research uses normative legal research methods with secondary data sources in the form of primary legal materials, namely related laws and regulations, which are collected using literature studies. The results of the study show that clemency is a pardon in the form of changes, relief, reduction, or abolition of criminal execution, to convicts or prisoners granted by the President. Because clemency is a pardon for convicts, the only party interested in clemency is the convict himself, who is free to use or not use his right to apply for clemency, in addition to the convict, namely the legal counsel and his family. The reasons for clemency are the interests of the family of the convicted person, the convicted person has contributed to society, the convicted person suffers from an incurable disease, and the convicted person has behaved well while in prison. Similarly, clemency can be used as a way out for a convict who is in such a heartbreaking situation that it is impossible for him/her to survive in Penitentiary.

Abstract

Penelitian ini mendalami isu krusial terkait pemenuhan hak pelayanan kesehatan bagi narapidana dengan fokus pada analisis dari perspektif standar pelayanan dasar perawatan kesehatan. Di dalam lembaga pemasyarakatan, narapidana memiliki hak yang dijamin oleh undang-undang untuk menerima perawatan kesehatan yang layak. Namun, realitas di lapangan seringkali menimbulkan banyak permasalahan yang memengaruhi pemenuhan hak ini. Penelitian ini bertujuan untuk mengungkapkan sejauh mana standar pelayanan dasar perawatan kesehatan terwujud dalam konteks narapidana dan menganalisis hambatan serta tantangan yang menghambat pemenuhan hak pelayanan kesehatan mereka. Hasil penelitian ini memberikan pemahaman yang lebih dalam tentang bagaimana pemenuhan hak pelayanan kesehatan bagi narapidana dapat ditingkatkan melalui peningkatan implementasi standar pelayanan dasar perawatan kesehatan. Penelitian ini berpotensi menjadi sumber rujukan bagi pembuat kebijakan, praktisi kesehatan, dan pihak yang peduli terhadap hak asasi manusia dalam upaya meningkatkan kualitas pelayanan kesehatan bagi narapidana di lingkungan lembaga pemasyarakatan.

Abstract

Escaping from correctional institutions is one of the problems of disrupting security and order, so it is necessary to consider implementing prevention, one of which is using prisoner activity monitoring bracelets. This research aims to determine the implementation of prisoner activity monitoring bracelets and the barriers to their use. This research uses qualitative research methods using interviews and observations and regulations as primary data. This research took place at the Class IIB Ciangir Open Prison and took place from April to October 2023. The use of monitoring bracelets was implemented based on legal grounds and has a useful mechanism for knowing the position of prisoners while carrying out independence development and preventing prisoner escapes. This is related to policy implementation theory and situational crime prevention theory. When using prison activity monitoring bracelets, some obstacles can affect the function of the bracelet, namely natural factors, damage to the device, and humans.
