Abstract

Law Number 37 of 2004 was designed to balance creditors’ rights with debtor rehabilitation in insolvency processes in the fair resolution of bankruptcy disputes. This normative legal research uses statutory and conceptual approaches that apply. This study identifies judicial mechanisms in the commercial court regarding the criteria for breach of contract when insolvency occurs, which may allow abuse through bankruptcy filings by debtors carried out by creditors to pursue additional objectives, which can result in the liquidation of companies.

Abstract

Import regulation is a crucial instrument within national economic policy, playing a significant role in controlling the inflow of foreign goods while safeguarding the sustainability of domestic industries. From the perspective of Indonesian economic law, import policies are not solely aimed at fulfilling domestic market demands but are also designed to maintain a balance between trade liberalization and national interests. This study seeks to examine the legal framework governing import activities as well as the various forms of protection provided to domestic products. The research employs a normative juridical method, utilizing both statutory and conceptual approaches, supported by a comprehensive review of legal literature and secondary data sources. The findings indicate that the Indonesian government has implemented a range of protective measures, including tariff-based instruments such as import duties, as well as non-tariff measures like quotas, technical standards, and the Domestic Component Level (TKDN) policy. These mechanisms are intended to strengthen the competitiveness of local industries and reduce dependency on imported goods. However, in practice, several challenges persist, including regulatory inconsistencies across sectors, weak enforcement mechanisms, and external pressures from global trade regimes that emphasize market openness. These issues highlight the need for more adaptive, integrated, and sustainable policies to ensure a proper balance between protecting domestic industries and fulfilling international trade commitments.

Abstract

The rapid advancement of Artificial Intelligence (AI) has significantly transformed various aspects of human life, including the field of criminal law. AI technology is no longer limited to functioning as a supporting tool; it is increasingly capable of operating in a semi-autonomous or fully autonomous manner through machine learning systems. This development raises new legal challenges, particularly concerning criminal liability when AI systems are involved in actions that constitute criminal offenses. The primary issue lies in determining the appropriate legal subject to be held accountable, given that the Indonesian criminal law system remains predominantly centered on human actors (natural persons). This study aims to examine the challenges of criminal liability arising from the use of AI in Indonesia and to explore relevant legal concepts that may address these emerging issues. The research employs a normative juridical method, utilizing both statutory and conceptual approaches. The legal materials analyzed include legislation, scholarly publications, and prior studies related to AI and criminal law. The findings indicate that AI has not yet been recognized as a legal subject within the Indonesian legal framework, and therefore cannot be held criminally liable. As a result, liability is still attributed to human actors, including developers, users, and corporations that deploy AI technologies. Nevertheless, the increasing autonomy of AI systems calls for a re-evaluation and adaptation of existing criminal law doctrines to ensure legal certainty, fairness, and adequate protection for society in the digital era.

Abstract

Restorative justice is an approach to dispute resolution that emphasizes the restoration of relationships between conflicting parties rather than prioritizing punitive outcomes or adversarial judgments. In the context of civil law, this approach offers a more humane, participatory, and solution-oriented alternative, focusing on achieving mutually beneficial and sustainable agreements. This article aims to examine and analyze the application of restorative justice in civil disputes as part of the development of a progressive legal paradigm in Indonesia. The research employs a normative legal method using both conceptual and statutory approaches, supported by a comprehensive review of relevant academic literature. The analysis is conducted qualitatively to explore the relevance of restorative justice principles in civil law practices and their contribution to achieving substantive justice. The findings indicate that the implementation of restorative justice in civil disputes holds significant potential to enhance the effectiveness of dispute resolution mechanisms. It not only provides legally acceptable outcomes but also helps preserve social relationships between the parties involved. Furthermore, this approach aligns with the principles of progressive law, which prioritize justice, fairness, and social benefit over rigid procedural formalities. However, its implementation still faces several challenges, including the lack of explicit regulatory frameworks, limited understanding among legal practitioners, and low public awareness regarding non-litigation dispute resolution mechanisms. Therefore, strengthening both regulatory support and practical implementation is necessary to optimize the role of restorative justice within Indonesia’s civil law system.

Abstract

Sleep hygiene is a habit that supports healthy sleep, such as maintaining a sleep routine and creating a comfortable sleeping environment. Sleep hygiene plays a role in sleep quality and psychological conditions, including anxiety, especially in patients with diabetes mellitus (DM). DM patients often experience sleep disorders that can increase anxiety., This study aims to determine the relationship between sleep hygiene and anxiety in DM patients at the Dungingi Health Center. The study used a quantitative method of cross-sectional design, with a population of 56 and involving 35 patients selected by purposive sampling. Sleep hygiene is measured by the Sleep Hygiene Index (SHI) and anxiety levels by the State-Trait Anxiety Inventory (STAI). The results showed that 57.1% of respondents had poor sleep hygiene, and 62.9% were in the category of moderate to high anxiety. There was a significant association between sleep hygiene and anxiety (p = 0.000), which suggests that sleep hygiene is not good in relation to increased anxiety in DM patients. and The conclusion of this study is that there is a significant relationship between poor sleep hygiene and increased anxiety levels in patients with diabetes mellitus

Abstract

In the elderly, there is regression and morphological changes in muscles and bones, so that the elderly are at high risk of falling. Methods that can be applied to prevent the impact of falls are physical exercises, one of which is balance exercises with tandem exercises. This study aims to find out how the Effect of Balance Training on the Risk of Falls in the Elderly in Mongolato Village, Telaga District. The quantitative method with the research design used in this study is pre-experiment, one group pre-post test design, where the sample was selected through the purposive sampling method, with a sample of 39 elderly respondents in Mongolato Village. The results of the study showed that there was an effect of Balance Training on the Risk of Falls in the Elderly in Mongolato Village, Telaga District with a p. value of 0.000 < 0.05. Balance exercises are very important in preventing and as a treatment to reduce the risk of falls in the elderly.

Abstract

Sleep is a fundamental physiological process for the recovery of body organs and the optimization of children's cognitive function. However, many children experience sleep disorders, which are conditions that disrupt normal sleep patterns, both in terms of duration, quality, and sleep time. One of the triggers is poor sleep hygiene, which is a series of behavioral habits and environmental settings designed to support healthy sleep. This study aims to analyze the relationship between sleep hygiene and sleep disorders in students in grades 5-6 at SDN 11 Telaga Biru. The study used a quantitative method with a cross-sectional design involving 44 students as a sample (total sampling). Data were collected using the Sleep Hygiene Index (SHI) and Sleep Disturbance Scale For Children (SDSC) questionnaires, then analyzed bivariately using the Fisher's Exact Test. The findings showed that the majority of respondents had moderate hygiene (50%) and experienced severe sleep disorders (59.1%). The results of the statistical test obtained a p-value of 0.000 (p < 0.05), which proves that there is a significant relationship between sleep hygiene and sleep disorders. The worse the implementation of healthy sleep habits, the higher the risk of children experiencing severe sleep disorders. There is a real link between daily sleep behavior and the appearance of sleep disorders in children.

Abstract

The increasing use of smartphones among teenagers has the potential to cause dependency and psychological disorders, one of which is nomophobia anxiety (no mobile phone phobia). This study aims to determine the relationship between smartphone dependence and nomophobia anxiety in students of SMA Negeri 1 Tapa, Bone Bolango Regency. This study uses a crosssectional design. The sample amounted to 52 students who were selected using the proportionate stratified random sampling technique. The instruments used were the Smartphone Addiction Scale (SAS) and the Nomophobia Questionnaire (NMP-Q). The results showed that most of the respondents experienced smartphone dependency in the high category, namely 46 students (82%), while the low category was 6 students (12%). This study concludes that wise management of smartphone use is necessary to prevent nomophobia anxiety in adolescents.

Abstract

Anxiety disorders not only impact an individual's psychological state, but also affect social functioning, productivity, and quality of life. One of the psychotherapy approaches that is developing to overcome anxiety is Acceptance and Commitment Therapy (ACT). This study aims to determine the effect of Acceptance and Commitment Therapy (ACT) on the level of anxiety of patients at Limboto Health Center. This study uses a quasi-experimental method with a one group pre-test and post-test design approach. The population in this study is all adult patients who experience anxiety at the Limboto Health Center, with a sampling technique using purposive sampling, so that a sample of 18 respondents was obtained. Data analysis was carried out using the Wilcoxon test because the data was abnormally distributed. The results showed that before the intervention, there were 6 respondents with mild anxiety and 12 respondents with moderate anxiety. After being given ACT therapy, the number of respondents with mild anxiety increased to 17 people, while moderate anxiety decreased to 1 person. The Wilcoxon test showed a significance value of p = 0.000 (p < 0.05), which indicates a significant effect of ACT therapy on reducing anxiety levels. This study concluded that Acceptance and Commitment Therapy (ACT) was effective in lowering anxiety levels.

Abstract

Stroke survivors generally experience profound emotional changes, such as depression affecting well-being in terms of the patient's quality of life. The purpose of the study was to analyze the relationship between depression rate and quality of life in non-hemorrhagic stroke patients at M.M DUNDA Limboto Hospital. The design of correlational quantitative research with the cross sectional method. The population is all non-hemorrhagic stroke patients at the M.M Dunda Limboto Hospital and samples are taken using purposive sampling techniques and the number of respondents is 32 people. Data analysis was conducted using the Chi square test with a significance level (< 0.05). The results of the study showed that there was a relationship between the level of depression with. Quality of Life in Non-Hemorrhagic Stroke Patients at M.M Dunda Limboto Hospital with p value = (0.000 < 0.05). It can be concluded that the higher the level of depression in non-hemorrhagic stroke patients, the higher the risk of patients experiencing a decrease in quality of life.
