Abstract

The Anti-Corruption Convention has mandated participating countries to confiscate assets resulting from corruption without punishment. This aims to further optimize recovery of state losses due to corruption. Difficulties that may be encountered when confiscation of assets is carried out after the verdict is that the confiscation of assets fails to be carried out because the judge's decision states that the defendant is not guilty or the assets resulting from corruption have been confiscated by the defendant. This article will discuss the importance of implementing asset confiscation without punishment (or also called Non-Conviction Based Asset Forfeiture) as an effort to optimize recovery of state losses. The research method used in this writing is the normative legal research method. The approach used is a conceptual approach. The results of this research are that the Non-Conviction Based Asset Forfeiture mechanism is a form of shift from material truth regarding corrupt behavior carried out by the defendant to formal truth regarding the legality of assets controlled by the corruptor. The focus of this mechanism is not on the fault of the defendant who has committed corruption, but on the illegal assets under his control.

Abstract

This study aims to understand religious moderation education for early childhood at Tadika Al-Fikh Orchard Malaysia. The research uses a qualitative method with data collection techniques of observation, interviews, and documentation. The data analysis used is the Miles and Huberman model, which includes data reduction, display, and verification. The results show that early religious moderation education is needed to prevent children's behavior that does not align with religious teachings in the educational environment. The education is carried out by instilling awareness about religious diversity, teaching the values of religious tolerance, using engaging learning media, conducting practical religious moderation activities in the classroom, and encouraging parental participation. Strengthening religious moderation in early childhood includes four aspects of religious moderation: instilling national commitment, strengthening tolerance, anti-violence, and introducing and preserving local culture. Strengthening religious moderation needs to be taught to children from an early age so that they can develop moderate traits from a young age.

Abstract

The principle of formal legality promoted by the WvS-NI translation of the Indonesian Criminal Code (Old Criminal Code) has laid down statutory regulations (written law) as the only basis for implementing criminal law provisions. The principle of formal legality has closed the existence of the living law of Indonesian society which has existed since the Indonesian state was still in the form of kingdoms. The purpose of writing this article is to analyze the integration of living law into criminal law in updating the principle of legality, which was originally only a formal legality principle, but now also includes a material legality principle. This article was written using a normative legal research method with a conceptual approach. The result of this research is that the integration of living law as a source of criminal law to implement criminal law provisions is a positive step to provide space for the application of the original laws of the Indonesian nation. However, in its implementation, comprehensive regulations are needed, especially regarding the institutionalization of living law because its nature is local, while criminal law is national. Apart from that, there is also a need for a common perception regarding the measures of justice so as to create legal certainty regarding the application of living law in criminal law.

The type of research carried out by the author in this research is qualitative with a strict case study. The data analysis process includes data reduction, data presentation, drawing conclusions or verification. The research results show that three activities that do not provide added value can be eliminated or combined with other or previous activities. In this case we assume the daily production cost is Rp. 2,000,000 x 7.5% water requirements = IDR 150,000.-. So, you can save water needs (electricity costs due to groundwater use) with just one process of IDR 150,000,-.

The research method used is qualitative. The location of the research was carried out at the Regional Administration Bureau and Government of the Regional Secretariat of Toli-toli Regency with 5 informants. Data collection is carried out by conducting interviews, observation, and documentation. The data analysis technique uses Miles and Huberman's Interactive Model. The main theory that is used as a reference in this study is Edward III's theory (1980-9) which explains that there are 4 aspects that can be used as measurements of policy implementation, namely communication factors, resources, dispositions, and bureaucratic structures. Based on the results of the research, it shows that the Implementation of the Policy for Providing Additional Income Allowances for ASN at the General Section of the Regional Secretariat of Toli Toli Regency, has not been running effectively, seen from several aspects, namely: ( 1) policy communication has several dimensions, namely the dimensions of transmission, clarity, and consistency, but everything is not going well. Communication carried out by the leadership and implementing staff at the General Section of the Regional Secretariat of Toli Toli Regency, showed results that were not optimal. (2) human resources in carrying out administration are already in the professional category and budgetary resources and facilities are adequate, (3) The disposition of staff placement is in accordance with their areas of expertise, (4) The SOP structure is clear and implemented effectively by monitoring or supervision and strict sanctions against ASN who commit violations. The conclusion is that communication, resources, disposition, and bureaucratic structure can be implemented effectively.

Abstract

Stunting is a chronic nutritional problem in children under five years of age characterized by being shorter than their peers. Children who suffer from stunting will be more vulnerable to disease and as adults are at risk of developing degenerative diseases. The impact of stunting is not only in terms of health but also affects the level of children's intelligence. Children are the assets of the nation in the future. It can be imagined, what will be the condition of Indonesia's human resources in the future if many Indonesian children are currently suffering from stunting. It is certain that this nation will not be able to compete with other nations in facing global challenges. To prevent this, the government launched an integrated stunting prevention intervention program that involves cross-ministries and institutions. There are 2 (two) main targets that must be met immediately, namely 1) the availability of Specific Intervention services with 9 (nine) indicators, and 2) the availability of Sensitive Intervention services with 11 (eleven) indicators.

Abstract

Evaluation is one of the important components in the learning process, including in the subject of Islamic Religious Education (PAI). Evaluation helps teachers measure the achievement of learning objectives and identify the weaknesses and strengths of the teaching and learning process. The development of evaluation tools that are appropriate and in accordance with the characteristics of PAI subjects is a necessity to obtain accurate evaluation results and describe students' abilities comprehensively. From this background, the purpose of this study is to provide an explanation of the development of evaluation tools in PAI learning. This research is a type of library research that uses a qualitative approach with descriptive methods, the data collection technique is in the form of literature study, and the data analysis uses the content analysis method. The results showed that in this study, evaluation tools were developed in the form of authentic assessment instruments by considering the cognitive, affective, and psychomotor aspects contained in PAI subjects. This authentic assessment instrument includes project assessment, portfolio, written test, observation, and self-assessment. The development of this instrument is based on the analysis of core competencies, basic competencies, and relevant PAI materials. After going through the stages of expert validation and field trials, the authentic assessment instrument developed showed valid, practical, and effective criteria for use in measuring student learning outcomes in PAI subjects. The results of this study are expected to contribute to improving the quality of PAI learning evaluation and provide a more comprehensive picture of student achievement in cognitive, affective, and psychomotor aspects.
