Abstract

Misappropriation of corporate operational funds may cause financial losses and give rise to legal liability for individuals, directors, and corporations. The case at PT. Global Hotma Abadi involved the Human Resources Department through visa cost mark-ups, fictitious employee additions, manipulation of overseas workers’ salary allowances, and unauthorized expense claims. This study aims to analyze the forms, processes, and legal liability arising from such misappropriation using theories of legal liability and corporate theory. The research employs a normative legal method with statutory, conceptual, and case approaches. The findings indicate that weak internal supervision, the absence of periodic audits, and ineffective control systems were the main factors enabling the misconduct. The actions fulfill the elements of unlawful acts under Article 1365 of the Indonesian Civil Code, resulting in civil liability in the form of compensation for the perpetrators, while directors may also bear responsibility for negligence in supervision. The study recommends strengthening internal audits, implementing risk-based supervision, and developing whistleblowing systems within the company.

Abstract

The rapid development of mobile telecommunications services has made internet access a primary necessity. However, the practice of forfeiting unused internet data quotas raises legal issues concerning consumers’ legal position, legal protection, and the liability of telecommunications service providers. This study employs contract law theory, legal protection theory, and legal interpretation and construction theory, using a normative juridical method with statutory and conceptual approaches. The findings indicate that although consumers are formally bound by valid contractual agreements, their substantive position remains unequal due to the dominant role of service providers in determining service terms and conditions. The forfeiture of unused data quotas prevents consumers from fully benefiting from services they have already paid for, thereby conflicting with the principles of balance and good faith in contract law. Furthermore, legal protection remains ineffective because no adequate compensation mechanism is provided, despite the existence of actual consumer losses that satisfy the elements of legal liability. Therefore, stricter regulations and improved service policies are necessary to ensure fairness, accountability, and effective consumer protection.

Abstract

The development of information technology in the healthcare sector has encouraged the transformation of conventional medical records into Electronic Medical Records (EMRs) integrated through the Satu Sehat application. However, this digitalization has raised legal issues concerning the leakage of sensitive electronic medical record data. This study aims to analyze the legal liability of the parties involved, particularly hospitals and Electronic System Operators (ESOs), for data breaches occurring within the system. The study employs the theories of legal protection and legal liability as analytical frameworks. The research method used is normative legal research with statutory and conceptual approaches. The findings indicate that legal liability for electronic medical record data breaches should be determined based on a causality model distinguishing between human error and system failure. Data breaches resulting from weaknesses in electronic systems place ESOs as the predominantly liable party, whereas breaches arising from internal management errors place hospitals as the predominantly liable party. Therefore, the most appropriate liability model within the Satu Sehat application is shared liability. This study concludes that a clear allocation of responsibilities between hospitals and ESOs is necessary. Accordingly, it is recommended that the government strengthen regulatory frameworks and supervisory mechanisms, while the Ministry of Health enhance the security of the Satu Sehat application system.

Abstract

Kebijakan administratif di tingkat daerah sering kali tidak lahir sebagai instrument teknokratis yang netral, melainkan menjadi arena tawar menawar kepentingan para elite penguasa. Penelitian ini bertujuan untuk menganalisis pengaruh konfigurasi politik terhadap pembentukan produk kebijakan administratif dalam pengelolaan APBD di Provinsi Kalimantan Timur, mengeksplorasi relasi kekuasaan aktor birokrasi, serta mengkaji respons sosial terhadap kebijakan penggunaan anggaran yang dinilai elitis. Menggunakan metode kualitatif dengan pendekatan socio-legal, data primer dikumpulkan melalui observasi respon publik dan pernyataan pejabat, sementara data sekunder diperoleh melalui dokumen APBD, regulasi, serta pemberitaan media. Hasil penelitian menunjukan bahwa pengadaan mobil dinas Gubernur senilai Rp.8,5 miliar dan anggaran laundry rumah jabatan sebesar Rp.450 juta mencerminkan karakteristik konfigurasi politik otoriter, di mana legalitas administratif digunakan untuk melegitimasi kebijakan yang tidak rasional dan kurang berpihak pada kebutuhan publik. Hal ini memicu pergolakan berupa demonstrasi ribuan mahasiswa dan warga sipil akibat dinilai sebagai bentuk pemborosan di tengah perlambatan pembangunan daerah. Namun, tekanan publik yang massif bersama dengan pengawasan KPK akhirnya berhasil mendorong pembatalan pengadaan mobil dinas mewah tersebut. Fenomena ini menegaskan bahwa kontrol sosial dan media digital memiliki peran vital sebagai penyeimbang guna membatasi dominasi kekuasaan eksekutif. Penelitian ini merekomendasikan perlunya reformasi pengawasan oleh pemerintah pusat, pengaruh partisipasi publik yang inklusif, serta transformasi konfigurasi politik daerah demi mewujudkan tata kelola anggaran yang transparan, akuntabel, dan responsif terhadap kesejahteraan masyarakat.

Abstract

Twenty-first century security threats are increasingly hybrid and multidimensional, demanding defense governance that no longer rests solely on modernization of weapon systems, but on synergy between strategic leadership and accountable civil-military relations. Following the 1998 Reformasi, Indonesia laid the normative foundation for objective civilian control through Law No. 3/2002 and Law No. 34/2004; nevertheless, consolidation remains overshadowed by structural rigidities and sociocultural residues from the New Order. This article analyzes the urgency of synergy between strategic leadership and defense governance in constructing an ideal civil-military relations model in Indonesia, employing a narrative literature review that thematically curates and synthesizes literature by interrelated sub-topics. Findings indicate that defense governance effectiveness remains constrained by bureaucratic fragmentation, inter-service sectoral ego, and residual militaristic autonomy that impede substantive civilian control, even where the regulatory framework is adequate. As a resolution, the article recommends transitioning from coercive control toward collaborative security governance, with integration of joint civil-military leadership education at institutions such as Lemhannas and the Indonesian Defense University as a strategic instrument to build shared strategic language and cross-sectoral trust. The findings affirm that accountable civilian supremacy and military professionalism are absolute prerequisites for Indonesia's national defense resilience.

Abstract

Deforestation resulting from the expansion of oil palm plantations remains one of the main challenges in efforts to mitigate climate change in Indonesia. Indonesia has ratified various international legal instruments, including the United Nations Framework Convention on Climate Change (UNFCCC), the Kyoto Protocol, and the Paris Agreement, and has enacted various national regulations in the fields of environmental protection, forestry, and plantations. However, the rate of deforestation continues to demonstrate a disparity between national regulations and international standards. This study aims to analyze the conformity of national regulations with UNFCCC standards in preventing and addressing deforestation resulting from the expansion of oil palm plantations, as well as to formulate the necessary legal reforms by taking into account the principles of due diligence and traceability as regulated under the European Union Deforestation Regulation (EUDR). The research employs a normative juridical method using both statutory and conceptual approaches through an analysis of various national and international legal instruments. The findings indicate that, normatively, national regulations have accommodated the principles of sustainable development and climate change mitigation. Nevertheless, several weaknesses remain, including the legalization of oil palm plantations within forest areas through administrative mechanisms, disharmony among sectoral regulations, weak supervision and enforcement, and the lack of an optimal transparency and traceability system within the palm oil supply chain. Therefore, regulatory reform is required through strengthening the preventive function of Environmental Impact Assessments (AMDAL) and public participation, adjusting the definition of forests, clarifying the classification of oil palm, and integrating due diligence obligations, traceability, and the principle of zero deforestation into the Indonesian Sustainable Palm Oil (ISPO) certification system. Such reforms are expected to strengthen forest protection, enhance the credibility of Indonesian palm oil commodities in the global market, and support the achievement of emission reduction targets and sustainable development.

Abstract

Partnership arrangements in Indonesia's industrial relations landscape have frequently been weaponized as instruments of legal evasion (fraus legis), concealing subordinate employment relationships behind formally valid contractual structures. This study examines that phenomenon through a case study of the Cooperation Agreement (PKS) between PT HEJ as service user and PT DWP as driver labor supplier, signed on February 6, 2023, for a three-year period. Although the PKS explicitly declared the relationship to be neither an employment relationship nor outsourcing, investigation by the Tangerang Regency Manpower Office (Dinas Ketenagakerjaan) revealed that PT HEJ in practice issued direct daily work instructions, set operational schedules, enforced standard operating procedures, unilaterally altered the wage system from per-trip payments to a fixed monthly salary, and supervised drivers directly. Since the three cumulative elements of an employment relationship namely work, wages, and commands under Article 1 paragraph 15 of Law No. 13 of 2003 as amended by Law No. 6 of 2023 on Job Creation were satisfied, the relationship must be legally classified as employment. This study employs a sociological-juridical method with descriptive-analytical specifications. Data were collected through in-depth interviews with PT HEJ management, PT DWP's Director, driver-workers, and the Manpower Office mediator, supplemented by document analysis of the PKS and PKWT. Findings confirm that the PKS constitutes a pseudo-partnership embodying fraus legis, and that PT HEJ's unilateral wage amendment constitutes breach of contract in violation of Article 54 paragraph (2) of the Manpower Law and Article 8 of Government Regulation No. 35 of 2021. Mediation facilitated by the Manpower Office produced a Collective Agreement dated January 13, 2026, which converted the relationship into a lawful outsourcing arrangement with PKWTT status recognized for all drivers. The study concludes that the Job Creation Law lacks sufficiently explicit provisions against disguised partnerships, necessitating stronger regulation and proactive oversight to protect workers' normative rights.

Abstract

Reproductive health services play an essential role in supporting students’ well-being and safeguarding their reproductive health rights. As young adults, university students face various reproductive health challenges that require accessible, confidential, and non-discriminatory services. However, the governance and implementation of reproductive health services in higher education institutions remain limited due to inadequate institutional policies, restricted access, and concerns regarding confidentiality and social stigma. This study aimed to assess the governance of reproductive health services and examine the protection of students’ rights in accessing reproductive health care. A sequential explanatory mixed-methods design was employed. Quantitative data were collected from 150 students selected through proportional stratified random sampling using a structured questionnaire, while qualitative data were obtained through in-depth interviews, focus group discussions, and document reviews involving students, campus health personnel, and university administrators. Quantitative data were analyzed using descriptive statistics, whereas qualitative findings were examined through thematic analysis. The findings revealed that although most students recognized the importance of reproductive health services, service utilization remained relatively low. The main barriers included limited awareness of available services, concerns about confidentiality, perceived social stigma, and the absence of comprehensive institutional policies. Existing campus health services primarily focused on general health care and had not adequately integrated reproductive health programs into routine service delivery. The qualitative findings further emphasized the need for stronger governance, clearer service protocols, and greater institutional commitment to protecting students’ reproductive health rights. In conclusion, strengthening institutional policies, improving service accessibility, ensuring confidentiality, and integrating reproductive health programs into campus health governance are essential to enhance the protection of students’ reproductive health rights and increase the utilization of reproductive health services in higher education institutions.   Pelayanan kesehatan reproduksi merupakan komponen penting dalam mendukung kesejahteraan mahasiswa sekaligus melindungi hak-hak kesehatan reproduksi mereka. Sebagai kelompok usia dewasa muda, mahasiswa menghadapi berbagai permasalahan kesehatan reproduksi yang memerlukan layanan yang mudah diakses, menjaga kerahasiaan, dan bebas dari diskriminasi. Namun, tata kelola pelayanan kesehatan reproduksi di perguruan tinggi masih belum optimal karena keterbatasan kebijakan institusi, akses layanan yang belum memadai, serta adanya kekhawatiran terhadap kerahasiaan dan stigma sosial. Penelitian ini bertujuan untuk menganalisis tata kelola pelayanan kesehatan reproduksi serta perlindungan hak mahasiswa dalam mengakses layanan kesehatan reproduksi. Penelitian menggunakan desain sequential explanatory mixed methods. Data kuantitatif dikumpulkan dari 150 mahasiswa yang dipilih melalui teknik proportional stratified random sampling menggunakan kuesioner terstruktur. Data kualitatif diperoleh melalui wawancara mendalam, diskusi kelompok terarah, dan telaah dokumen yang melibatkan mahasiswa, tenaga kesehatan kampus, serta pengelola perguruan tinggi. Data kuantitatif dianalisis secara deskriptif, sedangkan data kualitatif dianalisis menggunakan analisis tematik. Hasil penelitian menunjukkan bahwa meskipun sebagian besar mahasiswa menyadari pentingnya pelayanan kesehatan reproduksi, tingkat pemanfaatan layanan masih rendah. Hambatan utama meliputi rendahnya pengetahuan mengenai ketersediaan layanan, kekhawatiran terhadap kerahasiaan, adanya stigma sosial, serta belum tersedianya kebijakan institusi yang komprehensif. Layanan kesehatan kampus masih berfokus pada pelayanan kesehatan umum dan belum mengintegrasikan program kesehatan reproduksi secara menyeluruh. Temuan kualitatif juga mengungkapkan perlunya penguatan tata kelola, penyusunan prosedur layanan yang lebih jelas, serta peningkatan komitmen institusi dalam melindungi hak kesehatan reproduksi mahasiswa. Dengan demikian, penguatan kebijakan institusi, peningkatan aksesibilitas layanan, jaminan kerahasiaan, serta integrasi program kesehatan reproduksi ke dalam tata kelola layanan kesehatan kampus menjadi langkah penting untuk meningkatkan perlindungan hak kesehatan reproduksi dan pemanfaatan layanan oleh mahasiswa.

Abstract

Kementerian Pelindungan Pekerja Migran Indonesia (KP2MI) yang dibentuk untuk menyelenggarakan suburusan pelindungan Pekerja Migran Indonesia mempunyai kewenangan untuk memastikan Pekerja Migran Indonesia mendapatkan pelindungan salah satunya melalui program Jaminan Sosial Kesehatan yang menjadi hak seluruh warga negara Indonesia. Implementasi jaminan sosial Kesehatan mulai dari diterbitkannya UU 18 Tahun 2017 sampai dengan saat ini belum ada regulasi yang diterbitkan untuk melaksanakan jaminan sosial Kesehatan sehingga belum dapat dimanfaatkan secara optimal. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normatif dengan 5 (lima) pendekatan, yakni pendekatan peraturan perundang-undangan, konseptual, kasus, historis, dan p perbandingan dengan beberapa negara pengirim Pekerja Migran. Hasil dari penelitian diperlukannya perubahan beberapa ketentuan dalam UU PPMI khususnya terkait definisi “Menteri” yang harus didefinisikan sebagai Menteri P2MI agar memiliki dasar kewenangan yang kuat dari sisi yuridis dan perubahan norma agar jaminan kesehatan dapat diberikan juga selama bekerja di luar negeri, serta perubahan norma di PP 59/2021 agar selaras dengan pengaturan dengan UU PPMI. Selain itu juga diperlukan terobosan dalam pelaksanaan jaminan kesehatan melalui mekanisme reimbursment ataupun metode lain yang dapat memberikan kepastian kepada Pekerja Migran Indonesia.

Abstract

         Historically, women were deliberately excluded from political power and participation in democracies. Various studies have revealed the women's participation in various countries, the results of which, the equality of women's participation in politics is of the concern to many countries. Studies found that there are still inequalities in political participation between women and men. The strong tradition of most community members who discredit women by regarding women as second persons. Meanwhile, political reform which occurred in Indonesia has certainly given great opportunity to women to participate. In addition, the globalization era has brought about the changes in the development, so do in women. Local Government Election, specifically in East Kalimantan was taken as a case study in this study. The study employed a qualitative approach as well as interviews with relevant key informants. The study analyzed political participation opportunities of women activists in the governor election in the term of voting, campaign, political discussion and contacting perspective. The regional head elections in East Kalimantan especially, Indonesia in general still found challenges regarding the lack of women's political participation. Especially political discussion and contacting still limited to access by women activist.  Women often face numerous constraints for increasing their political participation.
