Abstract

This study seeks to analyze and contrast the fiqh provisions and legal regulations pertaining to a wife's right to seek divorce in Indonesia and Syria, specifically in cases where the husband is absent. The author aims to employ a normative approach and comparative approaches, together with data analytic techniques like as text analysis, to identify both parallels and discrepancies between fiqh provisions and laws in Indonesia and Syria. Indonesian and Syrian state legislation predominantly aligns with the viewpoints of the Shafi'i, Hanbali, and Maliki schools of thought, which permit the possibility of challenging a divorce on the grounds of the husband's absence. From the two countries, specifically Indonesia and Syria. Indonesia has established the record for the greatest duration of being missing or unseen, spanning two continuous years. Subsequently, Syria undergoes a period of absence or invisibility lasting for one year. During the specified timeframe for assessing the divergence between the nations of Indonesia and Syria, the majority of individuals have not adhered to the teachings of the fiqh scholars. The Shafi'i, Hanbali, and Maliki schools establish a four-year time frame within which a wife may wait for her missing husband. Both Indonesia and Syria share similar provisions regarding the dissolution of a marriage due to an absent husband. Specifically, they consider an absent husband as one of the reasons that can lead to the termination of a marriage. Additionally, these countries also prohibit a wife whose husband is absent from remarrying until a court decision has been made.

Abstract

Polygamy marriage has been an ongoing worldwide debate. The regulation of polygamy marriage in Turkey, Russia, and Jordan faces challenges in addressing the complexity of social issues. This article aims to explore and evaluate the polygamy marriage regulation in these three countries, from a social and fiqh (Islamic jurisprudence) priority perspective. The fiqh priority perspective emphasizes the common good and prioritizes long-term benefits. The article outlines diverse views on polygamy, including arguments supporting polygamy as a solution to specific social problems, as well as the complex social implications of polygamous practices. Furthermore, a comparative study of polygamous regulation in Turkey, Russia, and Jordan reveals differences in approaches to governing polygamy and how it affects societies within different social, cultural, and religious contexts. Through an analysis of social perspectives and fiqh priority, this article provides a deeper understanding of the regulation of polygamous marriage in Turkey, Russia, and Jordan, along with considerations that need to be taken into account in addressing this issue.

Abstract

This research discusses the livelihood status of career women in view of Islamic law and it’s urgency in Indonesia, the epistemology of tanqih al-manat in legal reasoning, and how the application of tanqih al-manat in obligation of career woman livelihood. This research uses a qualitative approach in explaining, describing and analyzing the data and find out the results of the research. The data collection technique used is a literature study. The results of this research identify that being a career woman has become an urgent need in Indonesia, because if only men have careers it will cause an imbalance between the average income and a decent standard of living. The women have the right to work like men as long as the work requires it or she herself needs the work and the work is carried out with respect and obey the religious principles and goals. Tanqih al-manat is a method of filtering the right ‘illat from various possible properties. Through the filtering process of ‘illat, it was found that the proper ‘illat from the texts of the obligation to support livelihood is the husband's control and detention in the house so that she is unable to live independently. Therefore, this research concludes that career women do not have to be supported in livelihood by their husbands, because they are no longer confined to their homes and they are able to live independently.

Abstract

Parents must care for their children based on Islamic and positive laws in Indonesia. Indeed, parents and children have an alimentation relationship, that is, a reciprocal relationship in maintenance or bread. However, in general, in society, the understanding of income is only imposed on parents to children, so there are many cases of parental neglect. So the question arises: What is the view of Islamic law and positive law in Indonesia regarding the provision of alimentation of children to parents? This research uses qualitative, juridical-normative research as its approach and descriptive as its research nature. The Qur'an, Hadith, the opinions of imams of madhab, laws and regulations, journals, books, and encyclopedias are sources for obtaining data, so this research is classified as literature research. The findings of this study on Islamic law and positive law in Indonesia indicate that children are obligated to support their parents under specific circumstances. According to Islamic law, this obligation arises when the parents are in need, and the child possesses the means to work or owns property. In positive law, the obligation arises when parents are in financial distress, require assistance, reside in their children's homes, among other conditions.

Abstract

This study aims to scrutinize the contradictions inherent in the application of the death penalty from two distinct perspectives: the perspective of Islamic criminal law (jinayah) and the ongoing reforms in Indonesian criminal law. In Islamic criminal law, the purpose of the death penalty lies in safeguarding religion, the soul, the mind, lineage, and property. The study utilizes a qualitative approach to analyze legal sources and relevant literature, aiming to provide a comprehensive understanding of the contentious nature of the death penalty in Indonesia. The findings highlight the ongoing complexity and controversy surrounding the death penalty in Indonesia, encompassing various legal, ethical, and human rights perspectives. The text underscores the multifaceted nature of the debate, emphasizing the need for careful consideration of international standards, societal norms, and legal frameworks in shaping policies related to capital punishment. The findings contribute to the broader discourse on human rights, legal reform, and the ethical considerations surrounding the death penalty..

Abstract

The problems of Islamic family law over time, seem increasingly complex. Included in this is nusyūz which so far has been taken for granted by society in the provisions of positive law in Indonesia. This article seeks to examine the problems of nusyūz normativity based on the critical legal studies (CLS) paradigm, namely one of the substitutions for the legal school of realism that is present in the classification of the post-modern era of law. There are two main topics of discussion: First, the ratio legis of nusyūz in Indonesian legislation from a CLS perspective; and Second, the reformulation of the upcoming nusyūz law in marriage legislation in Indonesia. This article argues that the ratio legis nusyūz in Indonesian legislation in terms of the trashing, deconstruction, and genealogy approaches of CLS still has a legal construction that is not in favor of justice and social interests as well as the reformulation of the upcoming nusyūz law in marriage legislation in Indonesia based on a philosophical, sociological, and juridical foundation can be implemented through the formation of new laws in the form of laws governing marriage law or Islamic material law or by making changes or revisions to the Compilation of Islamic Law.

Abstract

The objective of this study is to ascertain the comparative analysis of religious blasphemy legislation in Egypt and Indonesia. This study also elucidates the implementation of religious blasphemy legislation in Egypt and Indonesia. This study involves comparative legal research. Comparative research was conducted to gather additional insights on the blasphemy laws in Egypt and Indonesia. This study employs library research methodology to gather both primary and secondary data. The findings of this study indicate that the legislation governing religious blasphemy in Indonesia is law number. 1/ PNPS/1965, but in Egypt it is article 98 of the Egyptian Penal Code. Additionally, this study discovered parallels in the implementation of religious blasphemy legislation in Egypt and Indonesia. The implementation of anti-blasphemy legislation in both nations frequently subjects defendants to a succession of grave human rights infringements perpetrated by both private individuals and government agents

Abstract

This study examines the intersection of gender, human rights, and international law, with a focus on the influence of gender perspectives on international legal frameworks and human rights practices. Utilizing a qualitative, literature-based methodology, the research analyzes existing legal documents, scholarly articles, and international treaties to evaluate how gender considerations impact human rights enforcement and legal interpretations. The findings reveal that incorporating gender perspectives into international law can enhance the effectiveness of human rights protections and address gender-specific injustices more comprehensively. The originality of this research lies in its critical examination of how gender dimensions are integrated into legal practices and the impact of these integrations on global human rights standards. The study's implications emphasize the need for ongoing reforms in international law to better address gender inequalities and promote more equitable human rights protections. These two conceptions can be a solution to various gender problems in national law.

Abstract

This article endeavors to conduct a comparative and gender-equality-focused analysis of legal policies safeguarding women facing domestic violence in Indonesia and Malaysia. Employing a normative juridical research approach, the study utilizes legal comparison as its methodological framework. Primary, secondary, and other relevant literature data are employed for a descriptive and analytical analysis. The study reveals that Indonesia addresses gender equality in protecting women through Law Number 23 of 2004, while Malaysia relies on the 1994 Domestic Violence Act (Act 521). These legal frameworks not only prescribe criminal sanctions for domestic violence perpetrators but also encompass provisions for victims' psychological, physical, and social recovery. Despite the existence of legal safeguards in both countries, instances of domestic violence persist. Women, often the primary victims, face barriers in reporting or seeking protection due to ingrained social structures, educational factors, economic disparities, and a prevailing patriarchal culture. This phenomenon underscores persistent gender inequality in society. The article contributes by shedding light on the societal reality of ongoing gender inequality, perpetuating domestic violence against women in Indonesia and Malaysia. It advocates for the revision of legal policies pertaining to the protection of women facing domestic violence, grounded in gender equality, to ensure comprehensive safeguarding within the realms of social structure, education, economics, and socio-cultural factors

Abstract

This article explores the relevance and challenges in implementing marriage age limits to address early marriage issues in the modern era, as stipulated in Article 7 of Law No. 16 of 2019 concerning Marriage in Indonesia. The research aims to reduce the incidence of early marriage and identify obstacles in applying marriage age limits within the Indonesian legal context. The study employs a qualitative method supported by literature review, focusing on normative law through statutory, analytical, and conceptual approaches. The findings indicate that early marriage persists due to societal support and the regulation of marriage age limits under Article 7 of Law No. 16 of 2019, which sets the minimum age for marriage at 19 years for both males and females. In contrast, Thailand sets the minimum age at 17 years for both sexes, reflecting a more egalitarian approach. Despite the age differences, both countries share similarities in technical-administrative procedures. Marriages below the specified age require written permission from the authorities, aimed at providing legal protection and ensuring the readiness of those marrying. These minimum age variations reflect cultural, social, and legal factors in each country, while procedural similarities demonstrate collaborative efforts in regulating early marriages.
