Abstract

This research problematizes the law of interfaith marriage in Indonesia and its application. By presenting some cases of interfaith marriages that occurred during 2022, through literature searches and media reports, this research shows the tendency of violations of human rights, particularly the right to freedom of religion or belief (FoRB), especially by using the argument of the Marriage Law No. 1, 1974. This study found that marriage law in Indonesia does not provide legal certainty for interfaith marriages, thus allowing certain groups to discriminate against interfaith couples accessing legal marriages. Furthermore, this research argues that one way to make marriage law in Indonesia inclusive is to use the human rights paradigm as the basis for formulating marriage law.

Abstract

This article contains an anthropological review of Islamic law on traditional marriages in the Kaili community which carry out marriage rituals by requiring the practice of mogigi. Mogigi is the process of shaving the fine hairs around the eyebrows without changing the original structure of the eyebrows which is done on both bride and groom. Based on this custom, this study aims to describe the process of implementing the mogigi tradition in traditional marriages of the Kaili community and to explain the anthropological review of Islamic law on this tradition. This research is a qualitative research (field research) with an anthropological approach to Islamic law which accumulates the principles of Fiqhiyyah, Urf and the theory of Symbolic Interpretivism by Clifford Geertz. The data sources used by researchers consist of primary data (interviews) and secondary data in the form of books, journals and manuscripts. The results of this study concluded that the mogigi tradition is a traditional symbol of the Kaili tribe which has a symbolic meaning as a manifestation of the willingness, obedience, and belief of the bride and groom to leave all their past deeds, and be ready to face the future with fortitude. After conducting in-depth research on all aspects of adat in the mogigi tradition, it can be seen that the mogigi tradition does not conflict with Islamic law, because a taghyir (Adaptive-reconstructive) process has taken place between the local culture of the Kaili indigenous people and Islamic law resulting in the mogigi tradition. which contain cultural values ​​and Islamic values. This research has implications for the existence of the mogigi tradition in the traditional wedding procession of the Kaili tribe which has experienced a mixture of religious and cultural values.

Abstract

Muhammad Arkoun, as one of the contemporary Islamic thinkers, is the subject of examination in this writing, where the author seeks to explore Arkoun's ideas on the humanization of religious knowledge and its relevance to the development of astronomy in the present era. To achieve this objective, the author employs the library research method, which is literature-based. Arkoun's notions of deconstruction and rethinking Islam constitute key concepts presented in his critique of Islamic societies that tend to sanctify the views of past scholars without considering their relevance to the current context. According to Arkoun, this tendency often results in Islamic thought becoming stagnant, hindering the ability to address contemporary issues due to a fixation on the perspectives of earlier scholars. This problem extends to the realm of knowledge development, as seen in cases such as the rejection of reorienting the qibla direction in certain mosques. The argument is based on the belief that the qibla direction in these mosques is a legacy from past scholars of the region and, therefore, should not be altered. However, Arkoun contends that, in the field of astronomy, calculations reveal that the qibla direction in these mosques deviates, necessitating a correction in their positioning.

Abstract

Penelitian ini menginvestigasi peran dan signifikansi sertifikat Elsimil dalam konteks administrasi perkawinan di Kantor Urusan Agama (KUA) Kota Selatan, Gorontalo, Indonesia. Dengan mengadopsi pendekatan sosiologis, penelitian ini menggunakan wawancara mendalam dengan calon pengantin, petugas KUA dan tokoh agama setempat, serta analisis dokumen terkait kebijakan dan regulasi. Temuan penelitian menunjukkan bahwa sertifikat Elsimil memiliki peran strategis dalam pencegahan stunting, memberikan pendampingan kepada calon pengantin, dan memastikan kelayakan untuk melangsungkan pernikahan. Namun, tantangan implementasinya adalah kurangnya informasi yang merata di masyarakat dan rendahnya pemahaman calon pengantin menunjukkan perlunya penyuluhan yang lebih massif dan intensif. Implikasinya mencakup perlunya perubahan regulasi administrasi perkawinan, tata kelola administrasi perkawinan, dan peningkatan penyuluhan efektif di masyarakat. Penelitian ini menjadi referensi bagi masyarakat terhadap evaluasi kebijakan dan program edukasi guna mendukung hak dan kewajiban calon pengantin demi kesejahteraan generasi mendatang.

Abstract

The majority of scholars agree that the recipients of zakat are those who have been mentioned in the Qur'an and not to others such as infrastructure, irrigation, bridges and other public facilities because theoretically this is not included in the mustahik zakat. A contemporary scholar named Yūsuf al-Qaraḍāwī looked at every problem carefully, prioritized the element of benefit, and adjusted to the development of the times and circumstances, including classifying the public interest as mustahik zakat. The purpose of this research is to find out Yūsuf al-Qaraḍāwī's thoughts on the public interest as mustahik zakat, which is analogous to riqāb, muallaf, gārimīn, fī sabīlillāh, and ibn sabīl, and to find out what the basis of this interpretation is. This study uses a qualitative research method by examining various sources related to the object being studied based on library research. The data collection method is carried out by looking for literature sources that are relevant to the study and then reviewing and analyzing them. The results of the study show that Yūsuf al-Qaraḍāwī interpreted that the public interest included in the part of the zakat recipients is the result of analogies in riqāb, muallaf, gārimīn, fī sabīlillāh, and ibn sabīl. Yūsuf al-Qaraḍāwī's interpretation of mustahik zakat by classifying it into two categories, namely the first four and the last four. Yūsuf al-Qaraḍāwī is of the view that the last four mustahik zakat include general benefits that are in accordance with the development of the times.

Abstract

This paper explores the integration of local laws and cultural values as a strategy to reduce violence against children in the districts of Polewali Mandar and Majene. The study emphasizes the importance of aligning formal legal frameworks with traditional customs, social norms, and cultural practices to enhance the effectiveness of child protection initiatives. By incorporating local values into these frameworks, communities can better engage with and support efforts to ensure the well-being and safety of children. Through case studies and interviews with local leaders, legal experts, and community members, the research demonstrates the positive outcomes of culturally sensitive legal integration. The findings indicate that respecting and incorporating local values into child protection policies significantly decreases instances of violence against children. Abstract

This study aims to describe the concept of a happy family in the Gayo tribe community with local wisdom values ​​in the form of family resilience in preventing children's deviant behavior. The research method used in this research is qualitative. Sources of data in the form of primary and secondary data sources. Data collection techniques using observation and interviews. After the data was collected, it was analyzed using qualitative data analysis with four stages, namely 1) data collection, 2) data condensation, 3) data display, and 4) conclusion drawing/verifying. The results of the study show that the concept of a happy family in Gayo society begins before marriage, each of them must know their partner, then after marriage, they must try to maintain family resilience. The pattern of family resilience in the Gayo community consists of physical and mental elements. Elements of birth include economic adequacy, education, availability of housing, and availability of transportation. While the Inner/Spiritual element is in the form of cultivating religious and customary values. Syariet berules, edet berules, agama kin senuwen, edet kin peger which means that Shari'a is carried out according to customary law, religion as the plant, custom as the fence.

Abstract

Tradisi Saro Badaka merupakan kebiasaan masyarakat kabupaten Kepulauan Sula yang selalu dilakukan sebelum akad nikah dalam perkawinan. Saro Badaka ini memiliki tahapan yang cukup panjang dan melibatkan kedua orang tua perempuan agar mendampingi calon mempelai untuk melaksanakan adat tersebut. Penelitian ini menggunakan jenis penelitian kualitatif dengan pendekatan `urf. Jenis dan sumber data terdiri dari data primer dan data sekunder yang peneliti peroleh melalui observasi, wawancara dan dokumentasi. Hasil penelitian menunjukan bahwa tradisi Saro Badaka telah hidup di tengah masyarakat secara turun temurun sebagai tradisi yang dikenal baik yang mana juga disebut dengan al-ma’ruf. Dalam tradisi Saro Badaka sendiri dikenal sebagai tradisi positif yang diyakini mendatangkan kemaslahatan berupa kesejahteraan rumah tangga sehingga rumah tangga yang akan ditempuh menjadi harmonis. Maka, tradisi Saro Badaka dalam masyarakat kabupaten Kepulauan Sula jika diamati termasuk kategori `urf Shahih, sehingga tradisi ini diperbolehkan karena praktik Saro Badaka berdasarkan analisis `urf bahwa ia tidak melampaui syariat dari ajaran Islam. Baik dilihat dari segi bentuknya tradisi Saro Badaka termasuk kategori `urf amali, karena tradisi tersebut merupakan kebiasaan masyarakat yang dilakukan berupa perbuatan yang konkrit atau transparan. Sedangkan jika ditinjau dari segi cakupannya, tradisi Saro Badaka termasuk kategori `urf am karena berlaku pada mayoritas masyarakat kabupaten Kepulauan Sula. Untuk itu dalam analisis `urf tradisi Saro Badaka dapat dilaksanakan.

Abstract

Hareuta peunulang is a gift presented to a daughter getting married in Aceh as an immovable object. In practice, however, it is also given to the son. Some described it as a grant; on the other hand, others referred to it as an inheritance, resulting in legal inequality. This study aims to identify the problem of Islamic Law views on the giving and the practice of giving hareuta peunulang, which can be risk management for daughters in Aceh. It used an empirical method with a descriptive approach. Collecting data through interview techniques was conducted with 7 (seven) informants who were granted hareuta peunulang. The results show that it was determined that the practice was not contrary to favorable Islamic laws. The provisions of the limit of 1/3 of the assets described in KHI result from scholars' (Ulama) opinions based on benefit. The provision does not determine whether a grant is valid or not. Parental gifts can be considered as inheritance. In customary law, granting hareuta peunulang is a way to protect and provide welfare to women to avoid poverty and other risks. Acehnese has local wisdom to safeguard daughters, which is not contrary to Islamic law.

Abstract

The financial sector is crucial to economic stability but remains vulnerable to violations such as digital fraud and money laundering. These challenges require robust law enforcement mechanisms grounded in both traditional and modern governance principles. This study aimed to analyze regulatory frameworks, supervisory mechanisms, and preventive governance in Indonesia’s financial sector using Sadd al-Dharai’. A qualitative approach with normative juridical methods was employed, focusing on secondary data analysis. The research identified regulatory comprehensiveness, institutional effectiveness, and preventive governance as key dimensions. While Indonesia’s legal frameworks are strong, gaps in addressing technological and global challenges remain. Sadd al-Dharai’ emphasizes proactive measures to mitigate financial risks. Practically, the study recommends updating regulations, enhancing institutional collaboration, and integrating advanced technologies. Theoretically, it highlights the relevance of Islamic principles like Sadd al-Dharai’ in addressing contemporary financial challenges, providing a foundation for future research in preventive governance.
