Abstract

The interrelationship among religious communities in a particular society is complex. On many occasions, one community becomes dominant owing to several societal factors, and other communities remain on the edge. Religion in Bangladesh has a complex history. Besides, digital media as a new phenomenon has met religion recently, although this issue is often overlooked. As a result, no formal academic endeavor is seen in Bangladesh to date which focuses on the emerging digital Islamic public sphere and online religious communication. The present study tries to bridge this gap. Through careful observation of the digital public, their used contents, and produced cases of contestation, this article finds some exclusive communication patterns. First, communication among religious communities is unequal where Muslims dominate the discourse. Second, Islamic contents are more frequent in cyberspace than the contents of other religions. Third, Muslims produce digital media-based disinformation to marginalize religious minorities in both online and offline spheres.

Abstract

This article explains the legal system existing in the Pesantren, particularly in the term of takzir called perceived as non-human punishment contradictory with human rights. This research took place in Pondok Pesantren Edi Mancoro (PPEM) Salatiga with inclusive and tolerant characters, and voicing religious moderation. PPEM has had alumni becoming national figures. This study employed Lawrence Friedman’s legal system theory requiring the functioning of law in three components: legal structure, legal substance, and legal culture. This research employed qualitative method with data source obtained from field work study with depth interview technique and descriptive interpretive analysis. The result of research showed that Pesantren Edi Mancoro has legal system component as required by Friedman. In the context of takzir, there is a shift in the takzir (punishment) application method to evidently undisciplined students or those committing crime. Takzir contributes to creating personality (noble character) of santri in undertaking life post-pesantren. Takzir actually has educative values not contradictory with human rights. So, takzir in pesantren fulfills all components of legal system suggested by Friedman. Out of the three components, legal culture is the basic components of takzir functioning in pesantren, either internal or external legal culture.

Abstract

This paper aims to reveal the concept of maqasid sharia-finding method according to Tahir ibn Ashur. It argues that Ibn Ashur’s approach to search for maqasid sharia revolves around three methods. The first is inductive method. This method can be done through the induction of many ‘illat (reasons) that have the same hikmah (goals) and the induction of many dalil (provisions) that have the same ‘illat (reasons). The second is al-bayan al-nashshi method. This method refers to understanding of explicit provisions (dalil) in the Qur'an as they leave no room for alternative interpretations according to Arabic language traditions. The third is sunnah mutawatirah method. This method is divided into mutawatir ma’nawi andmutawatir 'amali. Mutawatir ma'nawi is an inference resulted from testimonies of many shahaba (the Prophet's companions) concerning a Prophet's particular action. Actions that are considered mutawatir ma'nawi include those that are clear, bright and axiomatic in nature (ma'lum min al-din bi al-dharurah), or at least close to ma'lum min al-din bi al-dharurah. Meanwhile, mutawatir ‘amali is an inference resulted from a testimony of one shahaba concerning actions always repeated by the Prophet.

Abstract

This article focuses on al-‘Aql al-Siyasi al-‘Arabi’s work and its relevance. It also touches the political phenomenon in Indonesia during 2016-2019 concerning ““NKRI Bersyariah (Sharia Republic of Indonesia Unitary State)” discourse supported by FPI and “khilafah” discourse supported by HTI. The research method employed was qualitative one involving library research viewed from Pierre Bourdieau’s perspective on habitus, field and distinction, and helped with interactive model of data analysis encompassing data reduction, data display, and conclusion drawing/verifying. The result shows that al-Jabiri views qabilah, ghanimah and aqidah as the habituated keywords since pre-Islam times. The temperament was manifested into the fighting for realizing the ideologies (aqidah) of “NKRI bersyariah” initiated by FPI qabilah, and “khilafah” (transnational) initiated by HTI qabilah. These ideologies basically are the capitalism movement trading Islam (ghanimah) to interest group. The incarnation of al-Jabiri’s terminology can be relevant to Indonesian political phenomenon.

Abstract

This paper attempted to discover the authenticity of interpretation work ordinated to Abdul Qodir Jailani. This interpretation Sufism was published by two different publishers from two separate countries; Dar alKutub al-Ilmiyah located in Beirut, Lebanon and Markaz al-Jailani li al-Buhus al-Ilmiyah in Istanbul, Turkey. This research is conducted from incredulity of ordination validity towards that interpretation work (Tafsir). By reason that the script was similar to another spread-script whose title is Fawatih al-Ilahiyah authored by Baba Ni’matullah Najwani. By comparison to two versions of Tafsir al-Jailani and one version of al-Fawatih al-Ilahiyah, this research comes to conclusion that this Tafsir (Tafsir al-Jailani) is inscription of Baba Ni’matullah Najwani, not Abdul Qodir al-Jailani. This conclusion goes against to three points; first, the name in book cover is not compatible with the name in introduction as the author had conveyed it in this Tafsir’s introduction; Second, the Author discussed many topics about Wahdat alWujud, a Sufism terminology acknowledged by Ibn Arabi who lived after Abdul Kodir al-Jailani. Third; many terms engaged in this Tafsir have not turned out into Tasawwuf Scholars discourse in Abdul Qodir Jailani’s period.

This study aimed to analyze the process of Ngeuyeuk Seureuh tradition in Sundanese wedding custom and explain the relationship between Ngeuyeuk Seureuh culture and Islam law. This field work built on the study on custom and Islam law in the context of Ngeuyeuk Seureuh tradition in Sundanese custom wedding. Methods of collecting data used were interview and library study. Techniques of analyzing data used were inductive and descriptive data analysis methods. The result of research showed that sundanese wedding custom is the expression of contact between custom and Islam law. Both of them are complementary in each of wedding procession stages, from neundeun omongan, narosan (proposing), seserahan, ngecangkeun aisan, ngaras, siraman, ngerik, to ngeuyeuk seureuh. This study indicated that wedding process related to Islam law in Ngeuyeuk Seureuh tradition is a customary sustainability preserved by Sundanese people from one generation to the next. The wedding organization in Sunda proves that Islam sharia strengthens custom, and vice versa.
