International Waterways Transport Journal (IWTJ) is a journal which handled by Inland Water and Ferries Transport Polytechnic of Palembang (Poltektrans SDP Palembang) of record for the towing and barge industry on the inland waterways of the Palembang, Indonesia chiefly the watershed of the Musi River and its tributaries and the Gulf Intracoastal Waterway. Our customers are the barge companies, ports, terminals, fleets, shipyards, refuelers, shippers, suppliers and marine contractors that form the inland waterways transportation industry.

Abstract

The main objective of each port is to meet the needs of port customers. In general, port service customers need facilities and services for ships, goods, goods, passengers, and land transportation can be carried out effectively and efficient. So there is a close connection between ports and ships as a service user, because the port is a working environment where ships can dock safely and cheaply, avoiding the dangers threatening the ship engulfed by waves, wind and so on, deep carry out activities to unload goods, animals and passengers. A port can be said to be effective and efficient if the ship does not wait long at sea, it can loading and unloading quickly and smoothly and supported by facilities adequate equipment or facilities and infrastructure, because it is very important for shipping companies. It is the duty of ports to contribute foreign exchange to the State.

Abstract

Piracy on the high seas, both by foreign ships and by domestic vessels in international waters, has recently caused unrest for international shipping. The prosecution of the high sea piracy crime is based on the enactment of international law relating to piracy in the high seas. The problems raised in this research are how to regulate piracy on the high seas based on international law, how is the MV Jahan Moni piracy and how are the efforts to deal with piracy problems on the high seas in the case of the MV Jahan Moni ship? The research method is carried out by normative legal research or literature law research conducted by examining library materials and empirical legal research. The legal research used is normative legal research or also known as library research with secondary data collection from magazines, books, journals, newspapers, online websites, and other library documents. Based on the explanation that has been described in previous chapters, it can be concluded that the following actions are piracy in the high seas initially and generally are motivated by economic factors. However, in its development and in today's situation, the phenomenon of piracy is in the context of acts of violence in the wider high seas. This is due to the increasing possibility of the threat of acts of terrorism in the two Strait with the background of non-economic problems, where it is very possible that these actions were also carried out on the high seas, as well as ships at sea. Piracy arrangements on the high seas are based on international law, namely based on the 1982 UN Convention on the Law of the Sea.

Abstract

This study aims to determine the responsibility of the transporter due to seaworthiness and to determine the implementation of the responsibility relationship between the carrier and the passenger who does not pay the ticket. This research is empirical with data collection techniques carried out through interviews with parties related to the research topic. In addition, the author also conducts library research through data and books related to the research topic. Furthermore, the data obtained were analyzed qualitatively which was then presented descriptively. The results of this research are: 1) the ship provided by the carrier must meet safety requirements (seaworthy). Ship safety requirements are determined through ship classification in order to determine the designation and route of certain ships, The number of passengers must be in accordance with the capacity of the ship's cargo, and the ship's crew who have met the requirements stipulated in the law, as well as ship equipment that is in accordance with the applicable laws and standard operating procedures. 2.) Based on the internal regulations of PT. Pelayaran Indonesia (PELNI) has several actions that can be taken for passengers who do not have tickets or illegal passengers such as being dropped off at the nearest port, ordered to pay or have their luggage confiscated, being employed to the port of destination, and put in a ship's cell.

Abstract

As a border on the island of Sumatra, the city of Batam and Natuna sea is the link between Indonesia-Singapore-Malaysia & Thailand. For all of these, safeguards are needed, especially for shipping in the territory of Indonesia, because maritime safety greatly affects sustainable development efforts, especially marine transportation activities. Batam City is included in the Riau Islands province. The Riau Islands Province is located in a very strategic location considering that it is in the border area between countries, neighboring one of the world's business centers (Singapore) and is supported by the existence of an international sea transportation network with busy traffic. In otherside, Kota Bharu and Golok River MalaysiaThailand were included in the crossing system beside the sea transportation in Batam, and South China Sea/Natuna sea. Sea transportation plays a very important role in a maritime country like Indonesia, whose territory is an archipelago. Regarding sea transportation, there are 3 aspects that are interrelated with each other, namely sea traffic and transportation facilities, ports, shipping safety and security. Act No. 17 of 2008 concerning shipping, in its general provisions states that the safety and security of shipping is a condition where safety and security requirements are fulfilled in waters, ports and the maritime environment. Therefore, all parties related to shipping activities must fulfill predetermined requirements. Through concrete steps, compliance with shipping safety and security regulations will create a high level of safety and security. Therefore, it is hoped that the guarantee of safety and security in the field of sea transportation can synergize the pattern of periodic supervision of meeting the safety and security aspects that have been determined.

Abstract

This research is motivated by the importance of a service PT. ASDP Indonesia Ferry at Penajam Port, North Penajam Paser Regency. The people's oblique view of the long crossing in line, from the time of entering the ship, the loading and unloading process and the travel time to the lack of additional infrastructure for port development. This paper aims to determine the implementation of PT. ASDP Indonesia Ferry in providing services to service users/passengers with ferry transportation services at the port of Penajam, Penajam Paser Utara Regency in accordance with Indonesian Act No. 17 of 2008, including several things, namely transportation and port services. The method used in this research is descriptive qualitative method, using data collection techniques through interviews, observation and documentation. As for the technical data analysis, the authors use an interactive model which is a series of data collection processes, data reduction, data presentation and data conclusion/verification.

Abstract

Transportation in general in Indonesia is facing many challenges, but all possibilities that will occur can be anticipated by structuring a more resilient national transportation system. This study aims to determine and understand the application of the ISM-Code to be used as legal protection from the use of ships that are not of marine standards. The research method used is the normative research method, which is a legal writing method that aims to obtain library legal materials by collecting and analyzing legal material related to the problem. The results of this study are, first. In the application of the ISM-Code it is used as a legal protection from the use of ships that are not standard marine standards. There are still many shipping companies that issue policies that are not standard ISM-Code or do not meet the elements of Article 9 of the Minister of Transportation Number 45 of 2012 concerning Ship Safety Management Systems. And secondly the ISM-Code Required as Legal protection from the use of ships that do not meet maritime standards is the form of legal protection contained in the ISM-Code.

Abstract

This study aims to analyze the technicalities of public shipping from the aspects of ship construction and stability, to analyze non-technical factors that cause accidents, to find efforts to improve shipping safety in supporting policies and strategies related to the roadmap to zero accidents. The research method used to calculate stability and strength is a quantitative empirical method equipped with interviews and questionnaires. The research locations are Makassar, Jakarta, Semarang, Surabaya, Kupang, Sampit, and Jambi. The sample for the empirical method is the ship 100-150 GT which predominantly has an accident, while for interviews and questionnaires used 140 respondents. Data were analyzed by factor analysis and SWOT. The results showed that the vessel stability arm, stability arch area, and metacentra height (MG) met the criteria of the International Martim Organization (IMO) and were above the required conditions. Phinisi fleets are seaworthy from the aspect of stability. Ships have high feasibility to sail. The factor analysis found seven non-technical factors, namely duties and responsibilities, competence in the field of human resources in the field of ship safety, company commitment, shipping navigation equipment, crew competence, ship maintenance and loading systems, as well as recruitment and training. Therefore, the strategy to improve safety includes intensifying the ship skills and maintenance training program, improving shipbuilding quality standards, performance of ship navigation facilities, and seeking to implement technical standards for ship safety.

Abstract

This study was conducted to find a revitalization model that will serve as a reference in the development of river transportation in the city of Bnajarmasin in the future. As is known, Banjarmasin has long played a strategic role in inter-island trade traffic, because it is located at the confluence of the Barito and Martapura rivers, which are broad and deep. So that the rivers can be navigated by large ships and the ships can dock as far as Banjarmasin City. Despite this the peculiarity of the number of rivers that are naturally used as transportation infrastructure, their role is gradually eroded by land transportation modes. Therefore, if the above conditions are not anticipated early on, the development of river transportation facilities and infrastructure will continue to undergo degradation physically and in function. This is certainly not beneficial for the future development of Banjarmasin City, because river transportation infrastructure is naturally available and the geography of Banjarmasin City still allows the river transportation system to be maintained and developed. The results of this study indicate that the revitalization of river transportation has the potential to be developed as an alternative urban transportation that is integrated with existing urban land transportation. because river transportation infrastructure is naturally available and the geography of Banjarmasin City still allows the river transportation system to be maintained and developed. Abstract

Environmental pollution is currently a disturbing issue for the survival of life, including in shipping and port activities, therefore the Ministry of Transportation issued PM Number 39 of 2021 and PM Number 24 of 2022. Based on conditions in the field, it is known that these regulations have not been complied with, such as pollution control tools and materials, port personnel competence, and fulfillment of pollution prevention on ships as evidenced by a Certificate approved by a classification body recognized and appointed by the Minister. The purpose of writing this mandatory working paper is none other than to determine the suitability of conditions in the field with existing regulations. The study used the method gap analysis that compares existing conditions with expected conditions according to regulations. Based on the results of data analysis and discussion of the problems, it was concluded that the prevention of water pollution at the Bitung Ferry Port is still not in accordance with PM Number 39 of 2021 and PM Number 24 of 2022, so that proposals are needed in efforts to prevent pollution in the waters, namely to procure pollution prevention tools and materials, improve the competence of pollution prevention for personnel, and fulfill pollution prevention by ships as evidenced by a certificate.
