Abstract

This study aims to analyze islamic legal philosophy as a conceptual framework that explains the nature, objectives, and relevance of islamic law in addressing the challenges of modern society. The research employs a library research method with a qualitative-descriptive and analytical approach through the examination of classical and contemporary literature on islamic law, legal theory (uṣūl al-fiqh), and maqāṣid al-sharī‘ah. The findings reveal that islamic legal philosophy is a reflective discipline integrating the ontological, epistemological, and axiological dimensions of islamic law. Its primary objectives are embodied in the concept of maqāṣid al-sharī‘ah, which seeks to protect religion, life, intellect, lineage, and property, while promoting public welfare and justice. The study further demonstrates that islamic legal philosophy remains highly relevant in responding to contemporary issues such as human rights, democracy, and digital technological development through adaptive and contextual ijtihād. Therefore, islamic legal philosophy may be positioned as a dynamic, rational, and future-oriented paradigm for legal development.

Abstract

Domestic violence (DV) is a social problem that continues to increase and has serious impacts on women, children, and the structure of modern families. In the context of Islamic studies, several Qur’anic verses such as Q.S. An-Nisā’ 34, Q.S. Al-Baqarah 231–232, Q.S. An-Nisā’ 19, and Q.S. At-Taḥrīm 6 are often misunderstood as justifications for acts of domestic violence. This study examines these verses using the thematic exegesis method through the stages of verse arrangement, contextual analysis (asbāb al-nuzūl and munāsabah), concept integration, and a comprehensive study that combines all relevant scriptural texts. The results of the analysis show that these verses do not legitimize violence, but rather function as corrective and preventive instruments to protect families from Jahiliyyah practices characterized by gender inequality. The principle of tadarruj in Islamic law plays a role in gradually restructuring social order from a culture of violence toward more just and civilized family relations. Supporting evidence from the Prophet’s hadiths and the narrations of the Companions further emphasizes that Islam rejects harmful physical abuse and prioritizes conflict resolution based on dialogue, moral education, and protection. Therefore, a thematic understanding of these verses produces a relevant and contextual perspective for preventing domestic violence in contemporary society.

Abstract

The cognitive load problem was experienced by 2nd grade students of Madrasah Diniyah Pondok Pesantren An-Nur 2 Malang, showed by a decrease in the quality of Juz 'Amma memorization due to physical and mental fatigue. This study aims to analyze psychological problems in the process of memorizing Juz 'Amma and examine the effectiveness of psycho-pedagogical interventions in solving problems. This research method uses a qualitative approach with a case study method. The data source was determined through the purposive sampling technique, which involved students and tahfizh teachers. Data collection techniques were carried out comprehensively through participant observation, in-depth interviews, and documentation studies. Furthermore, the data were analyzed using interactive models (Miles, Huberman, and Saldana) which included the stages of data condensation, data presentation, and conclusion drawn, and tested for validity using triangulation of sources and techniques. The results of the study show that the difficulty in memorizing students purely stems from cognitive fatigue which triggers a decrease in motivation. To overcome this, psycho-pedagogical synergy has proven to be effective through external scaffolding of teachers (Talaqqi and Sim'i methods) and internal strategies of students (Wahdah method). In conclusion, memorization barriers are an accumulation of psychological and neurobiological factors that require adaptive handling. This study recommends a paradigm shift towards Differentiated Learning through the provision of halaqah zones and silent zones so that pedagogical interventions are more humane and on target.

Abstract

This study examines the practice of Kincai Kawai Seanok customary marriage in Koto Tuo Pulau Tengah Village, Kerinci Regency, as a traditional marital system that continues to be practiced across generations. This custom regulates marriages between couples who share certain kinship ties, with a primary requirement known as “cross lineage,” meaning that the parents of both parties must be related through different genealogical lines (e.g., paternal and maternal lines). The objective of this study is to analyze the practice of this custom and evaluate its compatibility with Islamic law through the perspective of ʿurf (customary practice). This research employs a qualitative approach with an empirical method. Primary data were collected through direct interviews with traditional leaders and local community members, while secondary data were obtained from books and scholarly articles related to marriage and Islamic law. The analysis uses the concept of ʿurf to determine whether the custom falls under ʿurf ṣaḥīḥ (valid custom) or ʿurf fāsid (invalid custom). The findings reveal that the Kincai Kawai Seanok custom requires a cross-lineage marriage pattern and prohibits certain types of marriages that are actually permissible in Islamic law, such as cousin marriage. This prohibition is based on customary rules that contradict Islamic provisions regarding mahram. From the perspective of ʿurf, this practice is categorized as ʿurf fāsid because it conflicts with Islamic legal principles, which allow cousin marriage. Therefore, a re-evaluation of this customary practice is necessary to ensure alignment with Islamic values while preserving local cultural identity.
