Abstract

Religious authority plays a central role in shaping the religious life of society. This article examines the phenomenon of religious authority from the perspectives of sociology of religion and sociology of knowledge, focusing on how such authority is constructed, legitimized, and maintained within social contexts. Through a qualitative approach employing literature review and theoretical analysis, this research reveals that religious authority is a social construction influenced by various factors such as knowledge, institutions, charisma, and power contexts. The findings indicate that in the modern era, religious authority undergoes significant transformation due to the democratization of knowledge, digital media, and religious pluralism. This article contributes to the understanding of religious authority dynamics in contemporary society and its implications for religious life.

Abstract

The preservation of religious culture amidst the increasingly modern era faces significant challenges, as many religious values and traditions are beginning to fade, especially in rural areas of Minangkabau. One of the activities that has persisted and continues to be preserved is Musabaqah Tilawatil Qur’an (MTQ), or the Qur’anic recitation competition. In Situmbuk Village, Salimpaung District, Tanah Datar Regency, MTQ is not only seen as a competitive event, but also as a way for the community to maintain and pass on Islamic traditions that have been inherited for generations. Through MTQ, the village community strives to instill a love for the Qur’an among children and teenagers. Participants are not only taught how to recite correctly and beautifully, but also encouraged to understand the meaning of the sacred verses and apply them in their daily lives. Furthermore, MTQ becomes a moment of togetherness that strengthens relationships among residents, fosters unity, and builds a spirit of mutual cooperation in organizing the event. This research was conducted by students of Universitas Negeri Padang (UNP) as part of the 2025 Community Service Program (KKN). During the program, students were actively involved in various MTQ-related activities, from training participants and assisting the organizing committee to documenting the events. Their involvement not only provided valuable experience but also helped strengthen the relationship between the university and the local community. Observations revealed that MTQ in Situmbuk serves three major functions, as a platform for religious development, a medium for social bonding, and a means of preserving local Islamic culture. Beyond the competition itself, the event is enlivened by a parade, Islamic poetry performances, and distinct local traditions embedded in its execution. Through MTQ, the people of Situmbuk demonstrate that Islamic traditions, rich in values, can survive—and even flourish—when supported by the active participation of the entire community, especially the younger generation. Activities like this must continue to be encouraged so that religious culture remains a living tradition, not merely a memory of the past.

Abstract

This study aims to analyze the philosophy and wisdom of Islamic insurance (takaful) from the perspective of values and maqāṣid al-syarī‘ah as the normative and philosophical foundation of the Islamic financial system. Using a descriptive qualitative approach through library research, this study examines academic literature and scholarly journal articles published between 2020 and 2025. The findings reveal that Islamic insurance serves as a practical manifestation of maqāṣid al-syarī‘ah, particularly in safeguarding life (ḥifẓ al-nafs) and wealth (ḥifẓ al-māl). The system not only provides financial protection but also embodies spiritual and social dimensions through the principles of ta‘āwun (mutual assistance), ‘adālah (justice), and maslahah (public welfare). Therefore, Islamic insurance can be viewed as a financial instrument that integrates economic benefit with ethical and social well-being in alignment with the ultimate objectives of maqāṣid al-syarī‘ah.

Abstract

This study aims to analyze the concept of Ijtihad, Mujtihad, and muqollid in the development of Islamic law. The development of Islamic law cannot be separated from Ijtihad, Mujtihad and Muqollid. Ijtihad is an intellectual effort of an Islamic legal expert in exploring and establishing the law from all its main sources, namely the Qur’an and Hadith, through rational and conceptual reasoning methods in this process Mujtahid plays a role as the main subject who has deep scientific competence. The ability to istinbath law, as well as high moral integrity. Meanwhile, Muqollid is a party who follows the opinions or results of the ijtihad of the Mujtahids without conducting legal reasoning independently.The relationship between Mujtihad and Muqollid forms an epistemological structure that maintains the balance and stability of Islamic law amidst changing times. Therefore, the understanding of Ijtihad, Mujtihad, and Muqollid is crucial for understanding how Islamic law aligns with the Qur’an and Hadith, and how Islamic law is developed dynamically without losing its normative foundation. This understanding emphasizes that Ijtihad is the adaptation of Islamic teachings to the changing times and the needs of the community. A Mujtihad is someone who possesses a high level of scholarly capacity in sharia, Arabic, Usul al-Fiqh, and tafsir, enabling them to conduct ijtihad. A Muqollid follows the Mujtihad’s opinion, as they are unable to conduct ijtihad themselves; they instead refer to the results of prior ijtihad from scholars or madhhabs. In The development of Islamic law in these three are is interconnected:Ijtihad, Mujtihad and muqollid.

Abstract

This study examines the concept of polygamy in the normative framework of Islamic law as stated in the Qur’an and Hadith, comparing it with its practice in modern social reality. Normatively, Islam permits polygamy with a maximum of four wives, under the essential condition that the husband must uphold justice in both material and emotional aspects. In practice, however, polygamy often deviates from this principle of justice, influenced by patriarchal culture, partial religious understanding, and weak legal enforcement. Moreover, the modern implementation of polygamy rarely reflects the example of Prophet Muhammad (peace be upon him), whose marriages were based on humanitarian, social, and da‘wah purposes rather than personal desire. Therefore, the practice of polygamy should be guided by the principles of maqāṣid al-syarī‘ah—justice, welfare, and human dignity. This research concludes that polygamy is not merely a man’s privilege but a heavy moral responsibility, justifiable only when conducted in accordance with the Prophet’s example of fairness and compassion.

Abstract

Artikel ini membahas hukum taklifi dan hukum wadh’i sebagai dua instrumen utama dalam ushul fiqh yang menata hubungan manusia dengan syariat. Kajian diarahkan pada relevansinya dalam menjawab permasalahan kontemporer, khususnya yang muncul di era digitalisasi, pandemi global, serta perkembangan transaksi ekonomi modern. Penelitian menggunakan metode kualitatif deskriptif dengan pendekatan kepustakaan melalui analisis literatur klasik dan kontemporer. Hasil kajian menunjukkan bahwa hukum taklifi berperan sebagai norma dasar yang mengikat, sedangkan hukum wadh’i menjadi instrumen yang menentukan sah atau tidaknya suatu perbuatan hukum. Dalam konteks modern, keduanya terbukti masih relevan, baik dalam bidang ibadah maupun muamalah, seperti praktik akad digital, kewajiban menjaga kesehatan publik, dan legalitas transaksi berbasis teknologi. Penelitian ini menegaskan pentingnya pemahaman integratif atas hukum taklifi dan hukum wadh’i agar hukum Islam tetap responsif terhadap perubahan zaman tanpa kehilangan prinsip syariah.

Abstract

This research aims to conduct a comprehensive review of the construction of Islamic legal epistemology (ushul fiqh) by positioning the Qur'an as the primary source of law. This study focuses on five fundamental aspects that form the authority and methodology of legal interpretation sourced from the Qur'an. First, the definitional aspect which examines the essence of the Qur'an as a revelation from Allah SWT both linguistically and terminologically. Second, the aspect of authority (hujjiyah) which proves the position of the Qur'an as an absolute, definite, and undoubtedly valid source of law (qath'i al-tsubut). Third, an analysis of the classification of its legal content into qath'i (definite) and zhanni (interpretative) verses from the perspective of textual indication (dalalah), which forms the basis for the dynamics of ijtihad. Fourth, an exploration of the characteristics of the Qur'an's legal explanation method (bayan), which includes forms such as bayan al-taqrir, bayan al-tafsir, bayan al-tasyri', and bayan al-tabdil. Lastly, this study examines the theological and juridical consequences for those who deny the authority of the Qur'an as a source of law, which has implications for their faith status and punishment. The research method used is qualitative with a library research approach that analyzes primary texts of ushul fiqh and tafsir. The conclusion of this study confirms that the Qur'an is not only an authentic source of law, but also has a clear, systematic, and hierarchical epistemological structure, which allows it to be an eternal (shalih li kulli zaman wa makan) and dynamic legal guide through the mechanism of ijtihad in the zhanni verses.

Abstract

This research deeply analyzes the functional and substantial correlation between Cultural Da'wah (Da’wah Kultural) as internalized in Tafsir Al-Ibrīz by K.H. Bisri Musthofa and the Humanization Concept in Islamic Religious Education (PAI). Tafsir Al-Ibrīz is a masterpiece of tafsīr bi al-ra’yi written in Javanese Pegon script, reflecting an adaptive, inclusive, and highly contextual da'wah approach to Javanese culture (Musthofa, 2011). This approach is essentially a practice of sharī'ah humanization that prioritizes taysīr (facilitation) and raf’u al-ḥaraj (avoiding hardship), aligning perfectly with the principles of Nusantara Islam (Wahid, 2006). The Humanization Concept in PAI, conversely, focuses on developing human dignity (karāmah insāniyyah), critical reasoning, and rejecting dogmatic and authoritarian teaching methods (Misrawi, 2010; Freire, 2103). Using qualitative content analysis and comparative methods, this study identifies three main correlation points: (1) Contextualization of Language and Locality (X1), (2) Dialogical and Empathetic Methodology (Ukhuwwah) (X3), and (3) The Ethical Goal of Tolerant Insān Kāmil (Y3). The results demonstrate a positive and significant correlation (r = 0.89) between variable X (Cultural Da’wah of Al-Ibrīz) and variable Y (Humanization Principles of PAI). This correlation proves that Tafsir Al-Ibrīz is a rich pedagogical prototype for designing a humanistic, inclusive PAI curriculum capable of responding to the challenges of radicalism while upholding universal humanitarian values.

Abstract

Ketidakstabilan emosi pada mahasiswa sering muncul akibat tuntutan akademik dan tekanan sosial sehingga diperlukan strategi yang mudah diakses untuk mengelola afek negatif. Penelitian ini bertujuan menggambarkan peran zikir, khususnya pengulangan istighfar, sebagai mekanisme regulasi afektif dalam mereduksi bad mood pada mahasiswa. Penelitian menggunakan desain studi kasus kualitatif dengan teknik pengumpulan data berupa wawancara mendalam, observasi praktik zikir, dan dokumentasi terhadap sepuluh partisipan yang dipilih melalui purposive sampling. Instrumen utama terdiri atas pedoman wawancara semi-terstruktur dan lembar observasi, sedangkan analisis data dilakukan melalui pendekatan tematik. Hasil penelitian menunjukkan bahwa praktik zikir yang konsisten membantu menurunkan ketegangan emosional, kejenuhan, dan pikiran negatif, sekaligus meningkatkan ketenangan, kejernihan kognitif, dan kesadaran spiritual. Zikir berfungsi tidak hanya sebagai ibadah ritual, tetapi juga sebagai proses psikospiritual yang memulihkan keseimbangan batin. Temuan ini menunjukkan bahwa zikir dapat dijadikan strategi regulasi diri yang efektif untuk mengatasi bad mood pada mahasiswa di lingkungan perguruan tinggi keagamaan.

Abstract

Pregnancy outside of marriage is a social phenomenon that raises legal, moral, and religious issues. From an Islamic legal perspective, pregnancy resulting from adultery is considered a major sin, but Islam still provides room for repentance and protection of dignity for women who experience it. In Indonesia, cases of pregnancy outside of marriage are often resolved through marriage, but the legal status of such marriages and the status of the children born from them often cause debate. This study applies a normative-descriptive method with a literature review approach that refers to laws and regulations, fatwas (religious edicts) issued by Islamic scholars, Constitutional Court decisions, and various relevant academic studies. The results of the study show that according to Islamic law, women who become pregnant outside of marriage still have the right to marry, either to the man who impregnated them or to another party who is willing to take responsibility. However, the child's lineage remains with the mother. In the Indonesian positive legal system, Article 43 paragraph (1) of Law Number 1 of 1974, reinforced by Constitutional Court Decision Number 46/PUU-VIII/2010, stipulates that children born outside of marriage have a civil relationship with their mother and biological father, provided that the relationship can be proven through scientific means. Thus, both Islamic law and national law emphasize the importance of protecting women and children born out of wedlock through legal means.
