Abstract

In the insurance industry in Indonesia, claim settlement is an important process that influences policyholders' trust in insurance companies. The principle of freedom of contract is the basis for the existence of standard agreements that regulate the legal relationship between insurers and consumers in insurance companies. However, the application of this principle requires that the parties entering into an agreement have an equal position so that the rights, obligations and provisions in the agreement take into account the interests of all parties. Insurance is an agreement between the insurer and the insured who bind each other in an agreement using the principle of freedom of contract in a legal contract that is made. This research uses analyzing the legal protection of policy holders with a normative juridical approach regarding the number of insurance companies that make agreements with exoneration clauses which are regulated in the Civil Code (KUHPerdata), Law Number 40 of 2014 concerning Insurance, and Service Authority Regulations. Finance (OJK) which is relevant to the protection of insurance policy holders. The aim of this research is to find out how the implementation of the principle of freedom of contract is related in insurance law and how protection is provided for the insurer and the insured in contract law.

Abstract

The distribution of personal data is not only related to misuse of data in banking cases. Currently there are many posts on social media related to videos or photos of other people for the benefit of personal accounts, organizations or companies, as well as the distribution of documentation in social media groups without the consent of the person concerned, so that someone in the photo or video experiences a violation of their personal rights and right to privacy. Seeing the phenomenon of people who are still not fully aware of the personal rights and privacy rights of other people, it is very interesting to research related to maintaining privacy in the digital era. This research will be carried out using the Juridical-Normative research method, which has the character of a perspective or applied science, Legal Science as Sui Generis. Researchers use a statutory approach and a comparative approach.Awareness of the right to privacy and protection of personal data increases every year but is still relatively low when compared to electronic media users. The development of digital technology, social media, and the use of online platforms in everyday life has had a significant impact on people's understanding and awareness of the importance of protecting privacy and personal data. On the other hand, despite increasing awareness, there is still ignorance, a lack of understanding of the law, and a lack of attention to the potential risks of personal data breaches in the digital world. Factors that influence public awareness of the protection of privacy rights and personal data protection in Indonesia are the lack of understanding and education regarding digital literacy from the perspective of privacy rights and protection of personal rights.

Data collection techniques through documentation studies and data analysis using Charles Sanders Peirce's semiotic analysis method, which identifies meaning through a triadic model that includes representamen/sign, object, and interpretant. The results showed that BCA's “Don't Know? Love No!” successfully educates the public about online fraud awareness through humor and Indro Warkop, which enhances the emotional connection with the audience. The positive response from the audience shows that the combination of entertainment and an important message about personal data protection is very effective, making it one of the best educational ads of 2023. Abstract

The need for more public knowledge about using local materials encourages an educational approach to introduce sediment as an alternative material for construction materials, either as a substitute for clay in making bricks or as a filling material. This study aims to analyze the needs of the Ilohungayo Village community regarding educational models that can improve their understanding and skills in utilizing dredged sediment from Lake Limboto, as well as evaluating its potential use as an alternative material for basic brick materials and other construction materials. The method used is a preliminary study with a quantitative descriptive approach. The study results showed that only 18.33% of respondents knew or had used sediment, while 81.67% needed to learn sediment utilization. The low utilization of sediment is due to the need for more knowledge and training in the community.
