Abstract

Decision Number 1953/Pdt.G/2025/PA.Bks at the Bekasi Religious Court discusses a marriage isbat petition filed by Asmalih bin Matal Siman against his siblings, Asmat bin Matal Siman and Halimah binti Matal Siman, regarding the validation of their parents’ marriage, namely the late Matal Siman bin Siman and the late Asmaroh binti Jaya, which was conducted on January 10, 1963, in accordance with Islamic law but was not registered at the Office of Religious Affairs (KUA) of West Bekasi District. This petition was submitted based on the need for legal administrative purposes and certainty of heir status due to the absence of official marriage registration. This research aims to analyze the legal considerations of the panel of judges in granting the petition and its implications for the validity of unregistered marriages. The research method employs a normative juridical approach by examining the court decision and relevant statutory provisions. The results show that the panel of judges considered that the marriage of the deceased fulfilled the pillars and requirements of marriage under Islamic law, was validly conducted with a guardian and witnesses, and had never been legally challenged. The legal considerations were based on Article 7 of the Compilation of Islamic Law and Article 49 of Law Number 7 of 1989 concerning Religious Courts and its amendments, thereby granting the court jurisdiction to adjudicate the case. The final judgment granted the Petitioner’s request, declared the marriage valid, and imposed court fees of IDR 302,000.00.

Abstract

This study looks into how relevant K.H. Abdurrahman Wahid's (Gus Dur's) ideas on pluralism are for responding to these modern challenges, especially from the viewpoint of Civic Education (PPKn). The research uses a literature review, pulling data from academic journals, books, and other related documents. It focuses on three main questions: (1) How Gus Dur's life experiences formed his pluralistic outlook; (2) How diversity and pluralism are understood within Civic Education; and (3) Which specific parts of Gus Dur's pluralism can be used in today's digital world. The findings show that Gus Dur's thinking—especially on universal humanism, the "indigenization of Islam," and his concept of separating religion and state (though not complete secularism)—provides a strong basis for building a new digital citizenship. This new ethical framework is meant to encourage attitudes that are tolerant, critical, and open, all of which reflect the core values of Pancasila.

Abstract

In the rapidly evolving digital era of 2025, Islamic Religious Education (PAI) in Indonesia faces significant challenges in shaping resilient Islamic character among students who spend considerable time on digital devices. This study aims to develop a PAI curriculum model based on Islamic character that integrates religious values, contextual approaches, and digital technology to address the challenges of secular and materialistic values. Employing a library research method, this study analyzes literature from curriculum development theories, Islamic character education, and digital technology utilization. The findings indicate that enhancing teacher competencies through professional training and digital literacy, innovating teaching methods such as project-based and cooperative learning, and integrating character values through intracurricular, cocurricular, extracurricular, and religious habituation pathways can improve the effectiveness of PAI learning. Challenges such as limited facilities, teacher resistance, and negative social media influences can be addressed through collaborative strategies involving parents and communities, as well as leveraging educational technology. This curriculum supports the formation of individuals with noble character, relevant to the needs of the digital era, and aligned with national education goals. The study contributes to developing PAI strategies that are responsive to social and technological dynamics.

Abstract

Marriage under Indonesian law must be based on the consent of both prospective spouses, as stipulated in Article 6 paragraph (1) of Law Number 1 of 1974 on Marriage. However, in practice, marriages are still conducted under coercion from family members. This study aims to analyze the judicial considerations in the Decision of the Religious Court of Palembang Number 360/Pdt.G/2025/PA.PLG concerning the annulment of marriage due to parental coercion imposed on one of the parties. The research method applied is normative juridical with a case approach. The findings show that the marriage between the Plaintiff and the Defendant did not meet the legal requirements of validity because it was not founded on free will but rather influenced by familial pressure. The panel of judges considered witness testimonies, written evidence, and psychological examination results to establish that the marriage had been conducted without the Defendant’s full consent. This ruling is consistent with Article 71 letter (f) and Article 73 letter (b) of the Compilation of Islamic Law, which provide the legal basis for annulment in cases of coercion. In conclusion, the judges emphasized the principle of substantive justice through the fiqh maxim dar’ul mafasid muqaddamun ‘ala jalbil mashalih, meaning that preventing harm takes precedence over attaining benefit. The implication of this decision underscores the urgency of free consent as the foundation of marriage and highlights the need for legal protection of individuals harmed by forced marriage practices.

Abstract

A harmonious family is an ideal concept in Islam that emphasizes peace, love, and affection within the household. Generally, this concept is built on the basis of a husband-wife relationship, but in social reality, many families are run by a single parent due to divorce, the death of a spouse, or other reasons. This study examines how the values of harmonious family can be applied in single-parent families. Using a descriptive-qualitative approach, this paper describes the meaning of harmonious family in the context of single parenthood and relevant strategies for actualization, such as a strong foundation of faith, open communication, and structured life management. The results indicate that single-parent families can still achieve true peace and harmony as long as Islamic values are the foundation of their upbringing and daily lives.

Abstract

This study examines the construction of traditional and modernist Muslim identities in Indonesia within contemporary social, cultural, and religious contexts. The central problem of the research concerns how historical dynamics, education, modernization, and globalization have shaped the distinctive characteristics and interactions between these two groups. The objective of this study is to identify the defining features of each group, the factors influencing shifts in religious identity, and their respective contributions to the development of Islam in Indonesia. This research employs a library-based methodology with descriptive qualitative analysis, utilizing scholarly documents, academic literature, and historical sources as primary data. The research subjects include the social representations of traditional and modernist Muslim groups in Indonesia, particularly those affiliated with pesantren networks and modernist Islamic organizations across the archipelago. The findings indicate that traditional Muslims serve as custodians of religious tradition, cultural heritage, and spiritual continuity, whereas modernist Muslims function as agents of transformation through rationality, modern education, and reinterpretation of religious texts. The interaction between these two groups generates a dialectical process that enriches the diversity of Indonesian Islam while fostering the emergence of a more moderate, adaptive, and inclusive religious expression. The study concludes that these identity constructions complement one another in strengthening the dynamic, plural, and progressive development of Islam in Indonesia.

Abstract

Halal certification has become a crucial instrument in ensuring product safety and compliance for Muslim consumers, given the growing public awareness of the halal nature of products in accordance with Sharia principles. The purpose of this study is to analyze the role of halal certification in protecting Muslim consumers, ensuring producer compliance with regulations, and increasing consumer trust in products. The research method used was descriptive qualitative, with a literature review approach based on regulations, national journals, and literature related to halal certification and Muslim consumer behavior. The results indicate that halal certification not only serves as a sign of legal compliance but also serves as moral and spiritual protection for Muslim consumers, helping them avoid products with questionable halal status (syubhat), and increasing consumer trust and loyalty. In conclusion, halal certification plays a dual role as a guarantee of product safety and a consumer protection instrument, while also supporting business actors in complying with regulations and maintaining their business reputation in accordance with the principles of faith.

Abstract

This article aims to analyze the cultural foundations of Muhammadiyah from the perspective of Progressive Islam (Islam Berkemajuan) through a library research approach. The study was conducted by examining scholarly literature published within the last ten years related to the cultural dynamics within the Muhammadiyah movement. The findings indicate that Muhammadiyah’s cultural foundation is an integral part of the purification and modernization processes that have been in place since the era of K.H. Ahmad Dahlan. The main findings reveal that the dialectic between normative theology and local culture has shaped a movement characterized by rationality, ethical values, and progressive orientation. Progressive Islam strengthens this dialectical pattern through three core principles: religious rationality, universal human ethics, and practical social engagement. This study fills a gap in previous research, which has not comprehensively examined the relationship between theology and culture within the framework of Progressive Islam. The implications of this article demonstrate that Muhammadiyah’s cultural foundation serves as an epistemological basis for developing an Islamic paradigm that is inclusive, moderate, and oriented toward civilizational advancement.
