The Indonesian Journal of Islamic Jurisprudence, Economic and Legal Theory (IJIJEL) is a peer-reviewed academic journal that focuses on advancing research in Islamic jurisprudence, economics, and legal theory within the Indonesian context. Abstract

With the advancement of technology, online buying and selling now encompasses more than just everyday necessities; it also includes transactions involving online game vouchers. One example is the sale of diamonds in the game Mobile Legends. In Indonesia, online gaming enthusiasts are quite numerous, including Mobile Legends, which is currently the most popular game in Indonesia. This study aims to determine the Islamic legal perspective on the sale and purchase of Mobile Legends game vouchers (diamonds). The data used are primary data, collected through documentation and interviews. Secondary data sources include documents, books, notes, and written works relevant to the research theme. The results of this study indicate that the sale and purchase of Mobile Legends game vouchers (diamonds) is similar to other online transactions in general. However, the object is a virtual object, namely currency that can be used in the game. From an Islamic legal perspective, this sale and purchase is considered valid because it meets the pillars and requirements of a sale and does not involve any elements of fraud.

Abstract

The rule of law is a fundamental concept in the administration of government that places law as the primary foundation in regulating the life of the nation and the state. In Indonesia, the concept of the rule of law is affirmed in the 1945 Constitution of the Republic of Indonesia, which states that Indonesia is a state based on law. Meanwhile, from an Islamic perspective, the concept of the rule of law is reflected in the principles of sharia, justice, deliberation, equality before the law, and the protection of public rights. This article aims to analyze the concept of the rule of law from the perspectives of Islam and Indonesia, as well as to examine the compatibility of the values contained in both systems. This study uses a normative juridical method with statutory and conceptual approaches through library research. The results show that the concept of the rule of law in Islam and Indonesia shares similarities in placing law as the main guideline, upholding justice, and limiting power to prevent arbitrary actions. Although they have different legal foundations and sources, both aim to create order, justice, and welfare for society. Therefore, the values of the rule of law in Islam can serve as a moral and ethical foundation in strengthening the legal system in Indonesia.

Abstract

Background: Healthcare in Indonesia faces critical issues in clinical interaction, where many Healthcare Professionals (PPA) have not fully implemented Patient-Centered Care (PCC). This failure directly results in low patient satisfaction, increased complaints, and even clinical therapy failure risks. At RS UNTAN Pontianak, this challenge is amplified by suboptimal human resource readiness and an incomplete understanding of PCC concepts. Objective: To analyze the effectiveness of PCC-based training methods on improving PPA knowledge and attitudes in the inpatient ward of RS UNTAN Pontianak. Methods: A quantitative quasi-experimental pre-post test design involving 58 PPAs across three groups: Presentation+Simulation, Presentation+Video, and conventional control (Presentation only). Data were collected using a PCC knowledge questionnaire and an attitude scale, analyzed using paired t-test, ANOVA, and multiple regression (α=0.05). Results: The Presentation + Simulation method showed the highest score improvements for both knowledge (increase of 22.63 points) and attitude (increase of 12.00 points), and was significantly superior to the Presentation + Video and Conventional Presentation methods. The path coefficient for the simulation group was 1.376 for knowledge (R²=47.3%) and 1.616 for attitude (R²=65.3%). Conclusion: Interactive and experiential training, particularly simulation, is the most effective method for improving PCC competencies among PPAs. Hospitals should prioritize practice-based training methods for successful PCC implementation.

Abstract

Background: Implementation of Hospital Management Information Systems (HMIS/SIMRS) is a strategic effort to improve healthcare effectiveness and efficiency. However, the process still faces challenges including user resistance, infrastructure limitations, and human resource readiness. Objective: To comprehensively explore the perceptions, experiences, and barriers faced by Professional Care Providers (PPA) in using SIMRS (SIMGOS V2) at RS Universitas Tanjungpura, Pontianak. Methods: Qualitative research using hermeneutic phenomenology involving 9 PPAs selected via purposive sampling. Data were collected through in-depth interviews, three Focus Group Discussion (FGD) sessions, participatory observation, and document analysis. Data analysis followed the hermeneutic circle principle exploring lived experiences across four phenomenological dimensions: temporal, spatial, embodied, and relational. Validity was ensured through triangulation, member checking, and peer debriefing. Results: A paradoxical phenomenon was identified: SIMGOS V2 significantly improved operational efficiency (accelerated workflows, resource savings, reduced administrative burden) but has not fully achieved clinical effectiveness due to incomplete system integration. Fundamental transformation occurred across four dimensions: temporal (time efficiency with new systemic pressures), spatial (space virtualization with digital access gaps), embodied (literacy transformation from manual-tactile to digital-visual), and relational (information democratization with fragmentation of interpersonal warmth). Main barriers include imperfect system integration, unstable network infrastructure, and resistance as negotiation of professional identity. Conclusion: SIMRS implementation represents a fundamental socio-technical transformation requiring a holistic approach sensitive to its meaning for users. Hermeneutic phenomenology successfully uncovered hidden meaning layers in SIMRS technical evaluation.

Abstract

Reading the Qur'an with the correct makhroj is an obligation, however, non-Arabic speakers, especially Malays, often encounter difficulties in pronouncing the makhroj. This study aims to examine the effect of phonological interference of Malay accent on the articulation of makhorijul letters in reading the Qur'an. This phenomenon is commonly found in tahfiz students in Malaysia who have a Malay mother tongue background, where several Arabic phonemes such as ḥa (ح), ‘ain (ع), qaf (ق), and kha (خ) do not have direct equivalents in the Malay phonological system. This study uses a qualitative descriptive approach with data collection through observation, interviews, and analysis of reading recordings. The subjects of the study consisted of 10 students at the Darul Falah Tahfiz Boarding School, Selangor. The results show that there are systematic errors in the articulation of certain letters which are characterized by phoneme substitution, glottalization, and loss of phonetic properties of letters such as tafkhīm. The discussion is carried out through an applied linguistics approach, language transfer theory, and Arabic phonetics. This study contributes to the development of a more contextual phonetic-contrastive tajwid teaching method for Malay speakers. In addition, this study proposes the integration of classical tajwid science and modern phonetic methods in the curriculum of learning the Qur'an in non-Arab areas.

Abstract

In the era of massive digital transformation, the banking sector faces immense pressure to adopt advanced technologies to maintain market relevance. This study aims to investigate the influence of Artificial Intelligence Marketing Capabilities (AIMC) on competitive advantage by positioning Customer Agility as a mediating variable in the context of the digital banking sector. Using a quantitative approach and Structural Equation Modeling (SEM) analysis, data were collected from marketing managers and decision-makers at a leading digital bank. The results show that AIMC significantly improves banks' ability to predict customer needs, which in turn strengthens customer agility. Furthermore, customer agility is shown to mediate the relationship between AI capabilities and competitive advantage, confirming that technology alone is insufficient without an organization's ability to respond quickly to changing customer behavior. These findings provide theoretical contributions to the Resource-Based View (RBV) and provide practical implications for banking management to prioritize investment in customer-oriented AI infrastructure to win the competition in a saturated market.

Abstract

The Islamic boarding school environment, inhabited by students with diverse social, cultural, and character backgrounds, has the potential to cause conflict, both within individuals and between individuals and groups. Conflict is an unavoidable part of life's reality and can occur anytime and anywhere. Therefore, the optimal role of student mentors is needed in providing guidance, both individually and in groups, to prevent and resolve conflicts that occur in the Islamic boarding school environment. This study aims to determine the role of student mentors in resolving conflicts between students and identify the factors that cause conflict at the Idrisiyyah Putri Islamic Boarding School. This study uses a qualitative approach with a descriptive research type. Data collection techniques were carried out through observation, interviews, and documentation. Data analysis was carried out through the stages of data reduction, data presentation, and drawing conclusions, while data validity was tested using triangulation of sources, techniques, and time. Conflicts between students are influenced by internal factors, such as the inability to control emotions, irritability, the desire for recognition, and misunderstandings, and external factors originating from the family environment and peer interactions. In this context, student guardians play a crucial role as mediators in resolving conflicts fairly and wisely, as well as educators who instill moral values, tolerance, and social skills in students. Furthermore, guardians play a crucial role in creating a conducive, safe, and comfortable Islamic boarding school environment, allowing students to express their problems and find solutions together.

Abstract

Efektivitas Kebijakan Makan Bergizi Gratis (MBG) di Indonesia menghadapi tantangan serius dari sisi tata kelola pemerintah dan pemenuhan hak warga negara, terutama hak atas pangan, kesehatan, dan tumbuh kembang anak. Masalah utama penelitian ini adalah sejauh mana kebijakan MBG efektif dalam perspektif siyasah dusturiyah, kerangka hukum tata negara Islam yang menekankan keadilan, musyawarah, perlindungan hak rakyat, dan akuntabilitas penguasa. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Bahan hukum primer meliputi Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Peraturan Menteri Pendidikan dan Kebudayaan Nomor 75 Tahun 2016, serta Peraturan Presiden Nomor 72 Tahun 2021. Bahan hukum sekunder berupa literatur siyasah dusturiyah dan hasil penelitian terkait. Analisis dilakukan secara kualitatif-deskriptif. Temuan penelitian menunjukkan bahwa dari perspektif siyasah dusturiyah, kebijakan MBG secara prinsip sejalan dengan kewajiban negara melindungi hak warga negara (ri’ayah al-maslahah) dan mewujudkan keadilan distributif. Namun, efektivitas kebijakan masih rendah karena kelemahan tata kelola: perencanaan anggaran tidak memadai, koordinasi lintas sektor lemah, distribusi pangan tidak tepat waktu dan merata, serta pengawasan kualitas minim. Berbeda dengan asumsi awal, penelitian ini menemukan bahwa Indonesia telah memiliki lembaga yang secara fungsional mendekati al-hisbah, yaitu Ombudsman RI berdasarkan Undang-Undang Nomor 37 Tahun 2008. Ombudsman berwenang menerima laporan maladministrasi, melakukan investigasi, dan memberikan rekomendasi, namun kewenangannya terbatas karena tidak dapat menjatuhkan sanksi langsung dan rekomendasinya sering tidak diindahkan. Akibatnya, pemenuhan hak warga negara atas gizi (haqq al-mu’awwanah) masih parsial. Siyasah dusturiyah menuntut penguatan kewenangan Ombudsman, revisi UU Ombudsman, penerapan sanksi tegas, serta penguatan akses gugatan warga melalui PTUN dengan pendampingan Ombudsman. Tanpa reformasi ini, efektivitas MBG dalam mewujudkan kemaslahatan umum tidak akan optimal dan berkelanjutan.

Abstract

Informasi dugaan kandungan babi pada produk bakso di Barabai beredar sebelum adanya verifikasi ilmiah, sehingga menimbulkan ketegangan antara keyakinan awal masyarakat terhadap kehalalan pangan dan munculnya keraguan berbasis isu. Kondisi ini menunjukkan adanya kesenjangan antara informasi yang beredar di ruang publik dan pembuktian ilmiah yang dapat dijadikan dasar penetapan hukum. Penelitian ini berfokus pada analisis validitas informasi kehalalan pangan melalui penerapan kaidah al-yaqīn lā yuzālu bi al-syak. Metode yang digunakan adalah kualitatif dengan pendekatan deskriptif-analitis, melalui kajian normatif terhadap qawā‘id fiqhiyyah serta studi kasus terhadap peristiwa di Barabai. Data diperoleh melalui studi kepustakaan dan analisis dokumen, kemudian dianalisis secara interpretatif. Hasil penelitian menunjukkan bahwa status kehalalan yang telah diyakini tidak dapat berubah hanya berdasarkan informasi yang belum terverifikasi. Perubahan status hukum baru dapat ditetapkan setelah adanya bukti ilmiah yang pasti, seperti hasil uji laboratorium berbasis Polymerase Chain Reaction (PCR). Dengan demikian, kaidah al-yaqīn lā yuzālu bi al-syak berfungsi sebagai landasan dalam menilai validitas informasi, sekaligus menjaga kepastian hukum di tengah arus informasi yang tidak terverifikasi.

Abstract

State Civil Apparatus (ASN) holds a central role in the bureaucracy, yet they often face employment disputes that test their legal standing. This study examines the legal position of ASN in employment disputes in Indonesia, covering aspects of responsibility, protection, and resolution mechanisms. Using a normative-empirical approach, the research analyzes the regulatory framework, such as Law No. 5 of 2014, judicial practices in the Administrative Court (PTUN), and challenges like political intervention and procedural inconsistencies. The findings indicate that the legal protection of ASN highly depends on procedural certainty (due process) and the independence of the examination process. This study recommends strengthening mediation mechanisms, clarifying administrative procedures, and enhancing the external oversight role of the Ombudsman to ensure justice for ASN.
