Abstract

Indonesia has a unique political economy system, called the Pancasila democratic economic system. This system is clearly stated in the state constitution of the 1945 constitution, explaining how the state should regulate the state economy by dividing it into two systems: the top-up level and the bottom-up level. The top up-level is the control of strategic economic sectors by the state, but the management can be handed over to the private sector and hereinafter referred to as state-owned enterprises, this principle is intended to prevent the state of Indonesia from entering the free-market system because it is not in accordance with the principle of justice for the Indonesian nation. The bottom-up level is the management of the microeconomics sector by the community at the village level based on the characteristics of each village. However, in each regime, the economic system that is run is different from the principles of the Pancasila economic democracy system. The implementation of the principles of the economic system implemented in Indonesia is seen from the relevant laws and regulations and the implicit implications of the Indonesian state's political economy policies which form the basis of state economic management and legislators' understanding of the Pancasila democratic economic system are visible. This study uses content analysis and statistical analysis to measure legislators' understanding. The results of the study show that the laws produced by legislators do not support the implementation of the Pancasila democratic economic system and the legislator's understanding of the principles of the Pancasila democratic economic system is low.

Abstract

This research focuses on gender politics in the Islamic world. The discussion of gender politics is limited to the feminist movement in three countries: Egypt, Turkey, and Saudi Arabia. Therefore, this study uses a political theory framework to explore the implementation of power-seeking or biased policies. Gender theory discusses the position of Egyptian, Turkish, and Saudi Arabian women in the public sphere in fulfilling gender-just rights and obligations. Elite theory aims to understand government policies for society, especially women. This study uses qualitative research methods, using observation and library data collection techniques. The results show that various obstacles are encountered in the process of gender political struggles in Islamic countries. However, women's political struggles also receive support from various parties, of course, after going through a long struggle. Thus, Egypt, Turkey, and Saudi Arabia are now countries with women's movements that show progress and can be compared with other Islamic countries.

Abstract

The implementation of the decentralization system in Indonesia has intensive implications of the massive public attention to gender equality discourse. In the political aspect, the realization of the egalitarian principle between men and women has been pursued through affirmative political policies that seek to fulfill the minimum participation of women in parliament as much as 30%. But this precious hope is not easy to realize. The case study conducted in Wonosobo Regency illustrates the complex reality of gender equality, where since the 1999 elections, in the first year of the implementation of the decentralization policy until the 2019 elections, the minimum quota of 30% women's participation in local parliaments has never been fulfilled. In fact, in the 2019 elections, only one woman was elected as a member of the Regional People's Representative Council (DPRD). This study aims to analyze the factors that make it difficult to realize the principle of at least 30% women's representation in the DPRD of Wonosobo Regency, which has even been encouraged by affirmative political policies. The method used in this research is a qualitative method with a case study approach. The results of this study indicate several factors that influence the difficulty for women to occupy seats in regional parliaments, including institutional factors and political funding, religious doctrination, gender bias that is rooted in society, and leadership in political parties. The conclusions in this study illustrate the difficulty of fulfilling the principle of at least 30% women's representation in the DPRD of Wonosobo Regency caused by various factors, and not only because of the patriarchal culture that exists in society.

Abstract

The time limit in the judicial review of legislative process was first made in Constitutional Court Decision Number 27/PUU-VII/2009, in legal considerations the judge made a new law (judge making of law) by limiting the filing of formal test applications 45 today the law was published in the state gazette. This was done for the sake of legal certainty and the impact of the formal test application submitted past the 45-day deadline would be rejected by the Constitutional Court. This research uses a normative or doctrinal juridical type that focuses on library research. The purpose of this research is to find out the legal reasoning of the Constitutional Court judges in limiting the filing of formal tests and analyzing these restrictions from the aspect of justice. This research is a doctrinal research using statutory, conceptual and case approaches. The results of the study show that restrictions on the filing of formal tests are imposed in order to achieve legal certainty, so that the law requested for a formal test is more quickly known whether its status has been made legally or not, because formal testing will cause the law to be canceled from the start. Time restrictions in the Constitutional Court are not entirely contrary to the principle of justice, because in practice the Constitutional Court still provides space of justice for applicants to submit formal tests.

Abstract

This paper delineates the various policies implemented by the Japanese colonialadministration in regulating Islam in Indonesia. Utilizing a qualitative research approach, it draws upon library sources for its data. The study reveals that Japan, much like the Netherlands, aimed to exploit Indonesia's resources for its own needs. However, the policies of the two colonial powers were sometimes diametrically opposed, particularly in their approach to the Muslim population. While the Dutch sought to subdue Muslims by severing ties, isolating, and halting Islamic movements, viewing them as adversaries, the Japanese adopted a contrasting strategy. Japan endeavored to pacify Muslims by creating a calmeratmosphere, persuading, and embracing Islamic movements to position them as allies, or at least neutral entities. Although Japanese colonial rule continued to oppress and exploit Muslims similarly to the Dutch, it afforded them valuable opportunities to participate in political movements and military education opportunities that were entirely absent during Dutch colonial rule.
