Abstract

AbstractThis research aims to examine the differences of investigation process between the book of Procedural Criminal Law Constitution (KUHAP) or the Constitution number 8 of 1981 about Positive Procedural Criminal Law and Qanun Aceh number 7 of 2013 about Jinayat Procedural Law. The method used is the yuridis normative law research method. The Identification of problem is How is the investigation process based on the book of Procedural Criminal Law Constitution (KUHAP)? How is the investigation process based on Qonun Aceh number 7 of 2013 about Jinayat Procedural Law? What is the differences of investigation process based on Positive Procedural Criminal Law and Qanun Aceh number 7 of 2013 about Jinayat Procedural Law? The Result of analysis is Investigation process in KUHAP starts of the Investigation. Enforcement, Examination, Settlement, and Submition the case file to the public presecutor, it is process of investigation that written in the Constutition number 7 of 2013 about Jinayat Procedural Law. It mentions in verse 110 until 132. The differences of investigation process based on Positive Procedural Criminal Law and Qanun Aceh number 7 of 2013 about Jinayat Procedural Law are (1)related to paradigms of investigation description that different managed, (2) related to the investigator authority, and (3) related to the direct investigation of crime/jarimah.  AbstrakTujuan penelitian ini ialah untuk mengkaji perbedaan proses penyidikan antara Kitab Undang-Undang Hukum Acara Pidana (KUHAP) atau Undang-Undang nomor 8 tahun 1981 tentang Hukum Acara Pidana Positif dengan Qonun Aceh Nomor 7 Tahun 2013 Tentang Hukum Acara Jinayat. Adapun metode yang digunakan ialah metode penelitian hukum normatif yuridis (yuridis normative). Rumusan masalahnya ialah Bagaimana Proses Penyidikan menurut Kitab Undang-Undang Hukum Acara Pidana (KUHAP)? Bagaimana Proses Penyidikan menurut Qonun Aceh Nomor 7 Tahun 2013 Tentang Hukum Acara Jinayat? Apa Perbedaan Proses Penyidikan menurut Hukum Acara Pidana Positif dan Qonun Aceh Nomor 7 Tahun 2013 Tentang Hukum Acara Jinayat? Adapun hasil dan pembahasannya ialah Proses Penyidikan menurut KUHAP ialah mulai dari Penyelidikan. Penindakan, Pemeriksaan, Penyelesaian dan serta penyerahan berkas perkara kepada Jaksa Penuntut Umum, Bahwa proses Penyidikan yang tercatum di dalam Undang-undang Nomor 7 Tahun 2013 Tentang Hukum Acara Jinayat ialah tercantum di dalam Pasal 110 sampai dengan Pasal 132. Adapun terkait Perbedaan Proses Penyidikan menurut Hukum Acara Pidana Positif dan Qanun Aceh Nomor 7 Tahun 2013 Tentang Hukum Acara Jinayat ialah (1) terkait tentang paradigma penjelasan penyidikan yang diatur berbeda, (2) terkait tentang wewenang penyidik dan (3) terkait dengan penyidikan langsung tindak pidana/jarimah.Kata Kunci: Proses, Penyidikan, Qonun, Aceh,

Abstract

Sexual violence against children is one of the most damaging problems for the future of humans and this nation. Indonesia was once an emergency of sexual violence against children, because the data from year to year always increases significantly, including in the City of Bukittinggi. For this reason, it is necessary to prevent this case. One of the roles for this prevention is the mosque as a religious institution. Mosques must be institutions that are concerned with this prevention, because mosques carry out religious and learning activities that educate their people. Such a role can be used as a medium for prevention of this case. Mosques can play a role as a place for handling, prevention and at the same time forming a character to prevent such cases.

Abstract

This study describes the domination of local custom and religion behind the tradition of Osong Kapali among Sungai Patai community in Tanah Datar, Minangkabau, Indonesia during the decease of Datuak (the leader of ethnic group). It employs a qualitative method with observation, interviews, and documentation as research instruments. It revealed, for people, that the majesty of datuak is reflected on not only the time he receive the tittle but also the time he passes away. This ceremony is intended to honor the dead datuak. The tradition begins with baretong (planning), mangkaji adaik (discussing the tradition), mancabiak kain kafan (tearing the shroud), osong kapali (putting on the traditional fabric), marocak (spreading the coin along the way to Datuak grave), pidato alam (welcoming speech), and manigo ari (praying after the funeral procession). It contains values within, such as the leader’s majesty, datuak wisdom, and symbols of broad and clean thought. In addition, it holds sharia, educational, and social values. Osong kapali tradition is a combination of custom and religion represented in the ceremonial sequences which agree with the ideology of sarak basandi kitabullah, the Quran-based tradition. Penelitian ini mendeskripsikan dominasi adat dan agama pada tradisi Osong Kapali yang dilakukan oleh masyarakat Nagari Sungai Patai kabupaten Tanah Datar di Minangkabau Indonesia ketika seorang datuak meninggal dunia. Penelitian ini menggunakan metode kualitatif melalui observasi, wawancara, dan dokumentasi sebagai instrumen penelitian. Hasil penelitian menunjukkan bahwa bagi masyarakat kebesaran seorang Datuak tidak hanya tergambar pada upacara pengangkatan gelar namun juga pada saat seorang datuak tersebut tutup usia. Upacara adat ini bertujuan untuk penghormatan kepada seorang datuak yang meninggal. Upacara Osong Kapali dimulai dengan baretong (Perencanaan), mangkaji adaik  (mendiskusikan adat), mancabiak kain kafan  (merobek kain kafan), Osong Kapali, pemasangan kain adaik  (Pemasangan kain adat), maroncak  (Menyebar koin sepanjang perjalanan ke kuburan Datuak), pidato alam  (Pidato), dan manigo hari  (berdoa setelah upacara pemakaman). Terdapat nilai nilai seperti kebesaran seorang pemimpin, kebijaksanaan seorang datuak dan symbol pemikiran yang luas dan bersih. Selain itu terdapat nilai teologi yakni nilai syari’ah, pendidikan dan sosial. Osong Kapali ini merupakan kombinasi antara adat dan agama yang terlihat dari rangkaian pelaksanaannya sesuai dengan filosofi adat ”sarak basandi kitabullah”.

Abstract

As a tourist destination, West Sumatra will certainly interact directly with foreign cultures. This interaction has the potential to result in the emergence of changes and shrinkage of the pattern of traditional community life. This study examines the enculturation of Minangkabau customs by local leaders (Tali Tigo Sapilin). The problems in this research are, first, how is the process of cultural enculturation carried out by Tali Tigo Sapilin's leadership in West Sumatra? Second, what factors influenced Tali Tigo Sapilin's leadership in the enculturation process in West Sumatra? This study uses a qualitative approach by collecting data through observation, in-depth interviews, and documentation studies, as well as with Focus Group Discussions (FGD). The results of this research indicate that the inheritance of cultural values by Tali Tigo Sapilin's leadership is carried out through alek batagak penghulu, batamat kaji/Khatam Qur'an, Malapeh paga, and badoa bajamba. The factors that influence Tali Tigo Sapilin's leadership in the enculturation process in West Sumatra are the changing role of Tali Tigo Sapilin's leadership in Development, Changes in the Role of Ninik Mamak in Land Ownership.

Abstract

This research aims to answer a problem regarding the practice of pinpri loans that have not been registered with the Financial Services Authority and how Islamic law reviews the reasons people make pinpri loans. The research method used is statute approach analysis and comparison. Based on the results of the study the practice of personal loans (pinpri) is a cash loan that has not been registered with the Financial Services Authority is the practice of lending through individuals and has not been registered or even licensed by the Financial Services Authority so that it can be said to be illegal and violates Financial Services Authority Regulation Number 77 / POJK.01 / 2016 concerning LPMUBTI, then in the practice of personal loans (pinpri) there are additional funds and have regulations that are not by the operational system listed in the cash loan rules. In terms of Islamic law, the reason why people practice personal loans (pinpri) is because of urgent needs, easy disbursement, and consumptive behavior, while this is contrary to the concept of Islamic law in qardh theory. Because in the practice of personal loans (pinpri) that have not been registered with the Financial Services Authority, several elements are not by Islamic law, namely usury, gharar, dharar, and zhulm so the law is haram and harms and brings mudharat to the community

Abstract

Skripsi ini berjudul “Pernikahan Mambalah Siba Baju Dalam Perspektif Maqashid Syari’ah Di Jorong Padang Panjang Nagari Pariangan” yang disusun oleh Muhammad Hanif, NIM 1119.177 Program Studi Hukum Keluarga Islam (Al-Ahwal Al-Syakhsiyyah) Fakultas Syariah Universitas Islam Negeri (UIN) Sjech M. Djamil Djambek Bukittinggi. Skripsi ini ditulis karena adanya larangan secara adat di Jorong Padang Panjang Nagari Pariangan untuk melaksanakan pernikahan antara dua orang yang sesuku walaupun beda rumah gadang. Hubungan kekerabatan yang sangat dekat antara dua orang yang sesuku beda rumah gadang ini atau biasa disebut dengan mambalah siba baju, membuat mereka mempunyai rasa kekeluargaan dan dilarang untuk menikah. Bila kita lihat dalam aturan fiqh maka tidak ditemukan larangan untuk menikah dengan orang yang mempunyai hubungan mambalah siba baju dengan kita. Kemudian, timbul keinginan penulis untuk meneliti alasan syari’ah (maqasid syari’ah) dalam penetapan aturan adat tersebut. Penulis bertujuan untuk menemukan perspektif yang tepat mengenai larangan pernikahan mambalah siba baju ini berdasarkan prinsip-prinsip maqashid syari’ah. Penelitian ini menggunakan metode wawancara dan observasi langsung di lapangan, namun penulis juga memanfaatkan data dari pustaka dalam bentuk literatur-literatur terkait. Sumber data primer dalam penelitian ini adalah niniak mamak dan tokoh masyarakat di Jorong Padang Panjang Nagari Pariangan, sedangkan untuk sumber sekunder adalah buku, jurnal dan berbagai sumber kepustakaan yang terkait dengan pembahasan skripsi ini. Adapun dalam menganalisis data, penulis menggunakan metode deduktif.Berdasarkan hasil penilitian dapat ditemukan bahwa terminologi mambalah siba baju di Jorong Padang Panjang Nagari Pariangan merujuk pada hubungan kekerabatan antara orang-orang sesuku yang merupakan penghuni dua rumah gadang atau lebih. Pada dasarnya mereka berasal dari satu rumah gadang yang menunjukkan bahwa mereka pada awalnya tinggal satu atap dan berasal dari satu nenek. Dalam aturan adat yang berlaku, mereka dilarang untuk saling menikah.Larangan pernikahan ini dalam perspektif maqashid syari’ah adalah bertujuan untuk menjaga keturunan (hifz an nasl). Hal yang menjadikan pernikahan itu dilarang adalah untuk menghindari lahirnya keturunan yang lemah, karena mereka merasa seperti satu keluarga, sedangkan pernikahan yang terjadi antara orang yang tidak saling merasa asing akan melahirkan keturunan yang lemah. Alasan lain dilarangnya adalah ditakutkan adanya hubungan radha’ah antara keduanya, karena mereka tinggal dalam satu rumah gadang dan sudah menjadi kebiasaan bahwa seorang anak disusui oleh perempuan yang bukan ibunya di rumah tersebut. Sehingga indikasi adanya hubungan radha’ah di antara mereka sangat rentan terjadi.

Abstract

Review of Islamic Law Regarding the Setting of the Selling and Buying Prices of Agricultural Products at the Nagari Campago Market in District V Koto Kampung Dalam, Padang Pariaman Regency, is the topic of this thesis. The writers of this publication combine library research with a form of outdoor research. where information is gathered via documentation, interviews, and observation. Permanent traders and migrant traders (urang darek) serve as the study's main sources of information. Based on the study's findings, it can be concluded that price fixing mechanism is carried out by permanent traders in Nagari Campago, namely by seeking information regarding prices that are based on other markets, besides that regular traders are also based on the previous market price. Not only that, in addition to being based on market prices on the previous Sunday, traders still apply prices from migrant traders, in the sense that traders still take goods from migrant traders A, but traders still ask the selling price of goods to newcomer traders B. Muamalah Fiqh's view regarding the determination of buying and selling prices for agricultural products that occurs at the Nagari Campago Market, V Koto Kampung Dalam District has become an Urf which means something that is no longer foreign to a community because it has become a habit and is integrated into their lives in the form of actions and words.

Abstract

This journal was written because of the difference in price fixing by lime seed sellers in Nagari Padang Ganting. Where there is a difference in pricing for buyers from within Padang Ganting and buyers outside Padang Ganting. The price difference excludes postage. Based on this, the author wants to know about the pricing carried out by sellers of lime seeds. Then how does the mu'amalah fiqh perspective look at the pricing. This research was conducted in Nagari Padang Ganting. The research method used by the author is a mixed research, namely field research and library research. Field research conducted on sellers, buyers and the local community. And the library research that the writer did used various existing literature in the library that was relevant to the problem to be studied. Research materials were collected through interviews, observation, and documentation. Based on the results of the study, it can be concluded that the price fixing by sellers of lime seeds to buyers from Padang Ganting is the same as the price of one kilogram of lime for one seed. Meanwhile, the price of one seed set for buyers from outside Padang Ganting is more than the price of one kilogram of lime. So there are differences in pricing made by sellers and there are three reasons why sellers differentiate these prices. Firstly, buyers from Padang Ganting are native so prices are lowered. Second, because there is an opportunity to take excess profits from outside buyers. Third, because the seller has been doing this price difference for a long time, so it has become a habit. If seen from the concept of pricing from a mu'amalah fiqh perspective. The difference in pricing by sellers of lime seeds in Nagari Padang Ganting has not fulfilled all the principles of pricing, because there are prices that are not fair for buyers from outside compared to buyers from within Padang Ganting. Then, from a marketing point of view, it has not been fulfilled because the seller is not open in providing information about the price difference. And taking advantage of the ignorance of buyers from outside to gain additional profits, including unjust acts. Because in marketing there are four elements, namely ar-ridha, a healthy comparison of resistance, honesty, justice and openness.

Abstract

In discussing Islamic Law in the midst of National Law, the focus will be on the position of Islamic Law in the National Law system. The Indonesian legal system, as a result of its historical development, is plural. It is called that because until now in the Republic of Indonesia several legal systems have been implemented which have their own style and structure. In fact, Islamic law has become the living law in Indonesian society since the arrival of Islam to the archipelago. Many legal cases, especially those referred to in the Criminal Code as negligence that causes the loss of another person's life, can be resolved amicably by compensating for losses. Resolving the crime of taking another person's life by means of peace is similar to the qishas-diyat provisions in Islamic criminal law. The Problem Formulation (1) How is restorative justice implemented in resolving cases of the crime of illtreatment based on the Republic of Indonesia Attorney General's Regulation Number 15 of 2020? and (2) How to resolve criminal acts through a restorative justice approach to criminal acts of abuse from the perspective of Islamic Criminal Law. The conclusions of this research are: (1) The Prosecutor's Office as the agency that holds control over prosecution or Dominus Litis has a very important role in upholding justice in society, especially in implementing Restorative Justice. Restorative Justice is considered as a renewal of justice enforcement that is oriented towards restoring or restoring a person's condition as a victim of a crime. To ensure legal certainty in the implementation of Restorative Justice, Prosecutor's Regulation Number 1 of 2020 concerning Termination of Prosecution Based on Restorative Justice was issued. With this Perja, giving prosecutors the authority to stop prosecutions based on restorative justice is a breakthrough in resolving criminal acts. Since the publication of Prosecutor's Regulation Number 15 of 2020, the number of cases successfully resolved using the Restorative Justice approach is 4,443 cases. In detail, in 2020, 192 cases were approved using Restorative Justice and 44 were rejected. (2) The restorative justice approach provides attention and protection to victims or their families. Perpetrators of criminal acts can be held responsible for their actions and compensate for losses and future relationships can be restored. This also has similarities with the qishas-diyat provisions in Islamic Criminal Law. Criminal qishas (equivalent) and diyat (compensation) are the rights of the victim or their heirs, so that they can provide amnesty (forgiveness) to the perpetrator. If you forgive, then the crime of qishas will be extinguished, replaced with diyat (compensation), even without diyat at all.
