Abstract

The provision of polygamy as regulated in Law Number 1 of 1974 states that a husband who is going to polygamy must meet alternative and cumulative requirements. Without the fulfillment of the two conditions mentioned, the application for polygamy will be rejected by the judge. But in reality, the Bukittinggi Religious Court differed in ruling two polygamy cases which both met cumulative requirements and did not meet alternative conditions. In the first case case Number 081 / Pdt.G / 2013 / PA.Bkt the judge has accepted the request for polygamy, while in the second case case Number 0328 / Pdt.G / 2015 / PA.Bkt. the judge did not accept (NO) the case. The implementation of Law Number 1 of 1974 concerning polygamy permits in the Bukittinggi Religious Court is not absolute, the consideration of judges who receive and examine cases Number 081 / Pdt.G / 2013 / PA.Bkt is the emergence of mudharat if the case is rejected even though the alternative conditions are not met . Whereas the judge examining case 0328 / Pdt.G / 2015 / PA.Bkt was based on the provisions of article 4 of Law Number 1 of 1974 rejecting the case because it did not meet alternative conditions. Due to the non-fulfillment of alternative conditions by the Petitioner, the request for polygamy permit had a formal defect. For this reason, the panel of judges no longer needs to examine the subject matter.

Abstract

The title of this research is "The Efforts of a Husband and Wife with Disabilities in Forming a Sakinah Family (Case Study in Cdung District, Agam Regency)." The author, Abul Khair, discusses the sakinah family, which includes understanding each other, exercising rights and obligations, providing peace, love and happiness among family members. This study aims to determine the efforts of married couples with disabilities in creating a sakinah family. The research method used was field research in Cdung District, Agam Regency, with data collection techniques in the form of observation, interviews, and documentation. The results of the study showed that five couples with disabilities succeeded in creating a sakinah family. In forming a sakinah family, several important factors were found, including compatibility between husband and wife, partnership, complementing each other's weaknesses, accepting each other's strengths and weaknesses, supporting each other, and carrying out God's commands. Even though they have physical limitations, marriages between people with disabilities bring the same spirit of struggle in building a family life. This encourages married couples with disabilities to create a sakinah family, because they feel that they have physical equality and equality in deficiencies, thus proving that harmony in a marriage does not depend on physical conditions, can be one word or compound words.

Abstract

In discussing Islamic Law in the midst of National Law, the focus will be on the position of Islamic Law in the National Law system. The Indonesian legal system, as a result of its historical development, is plural. It is called that because until now in the Republic of Indonesia several legal systems have been implemented which have their own style and structure. In fact, Islamic law has become the living law in Indonesian society since the arrival of Islam to the archipelago. Many legal cases, especially those referred to in the Criminal Code as negligence that causes the loss of another person's life, can be resolved amicably by compensating for losses. Resolving the crime of taking another person's life by means of peace is similar to the qishas-diyat provisions in Islamic criminal law. The Problem Formulation (1) How is restorative justice implemented in resolving cases of the crime of illtreatment based on the Republic of Indonesia Attorney General's Regulation Number 15 of 2020? and (2) How to resolve criminal acts through a restorative justice approach to criminal acts of abuse from the perspective of Islamic Criminal Law. The conclusions of this research are: (1) The Prosecutor's Office as the agency that holds control over prosecution or Dominus Litis has a very important role in upholding justice in society, especially in implementing Restorative Justice. Restorative Justice is considered as a renewal of justice enforcement that is oriented towards restoring or restoring a person's condition as a victim of a crime. To ensure legal certainty in the implementation of Restorative Justice, Prosecutor's Regulation Number 1 of 2020 concerning Termination of Prosecution Based on Restorative Justice was issued. With this Perja, giving prosecutors the authority to stop prosecutions based on restorative justice is a breakthrough in resolving criminal acts. Since the publication of Prosecutor's Regulation Number 15 of 2020, the number of cases successfully resolved using the Restorative Justice approach is 4,443 cases. In detail, in 2020, 192 cases were approved using Restorative Justice and 44 were rejected. (2) The restorative justice approach provides attention and protection to victims or their families. Perpetrators of criminal acts can be held responsible for their actions and compensate for losses and future relationships can be restored. This also has similarities with the qishas-diyat provisions in Islamic Criminal Law. Criminal qishas (equivalent) and diyat (compensation) are the rights of the victim or their heirs, so that they can provide amnesty (forgiveness) to the perpetrator. If you forgive, then the crime of qishas will be extinguished, replaced with diyat (compensation), even without diyat at all.

Abstract

The Inter-traditional marriages have long been occurring in Minangkabau, such as in Pariaman and Luhak 50 Kota. In Pariaman it is known as the bajampuik system, that is the prospective husband asks for a certain amount of money from the prospective wife who comes from another tradition. Meanwhile in Luhak 50 Koto it is known as the maisi sasuduik system or the prospective wife's party asks the prospective husband's party to provide all the contents of the bridal chamber. This system certainly needs to be reviewed for its suitability with Islamic Law because it sometimes escapes the attention of researchers. Through qualitative research with data sources of observation, interviews and documentation, it is known that the Inter-customary marriage as mentioned is following Indonesian law. In addition, inter-customary marriage in Pariaman and Luhak does not violate Islamic law or 'Urf as agreed by experts. However, the decision to carry out or not the marriage is in the hands of each customary ruler

Abstract

Anak adalah amanah yang diberikan Allah SWT kepada manusia. Kehadirannya selalu dinantikan oleh setiap pasangan. Oleh karenanya orang tua berkewajiban untuk melindungi dan menjaga anaknya secara fisik dan fisikis sehingga terwujud rasa aman pada diri si anak. Disamping itu orang tua juga berkewajiban mendidik anaknya sehingga bisa mengantarkan anaknya menjadi insan kamil. Namun akhir-akhir ini rasa keamanan si anak kembali terusik dengan maraknya kasus penculikan terhadap si anak itu sendiri, mulai dari yang berumur balita sampai belasan tahun. Bahkan kuantitasnya selalu meningkat tahun demi tahun. Menurut Ketua Umum Komnas Anak, Arist Merdeka Sirait mengatakan: “bahwa pada tahun 2014 terjadi sebanyak 51 Kasus. Pada tahun 2015, kasus penculikan anak yang masuk ke lembaganya sebanyak 87 kasus. Untuk tahun 2016, jumlah kasus penculikan anak menjadi 112 kasus. Menurut Seto Mulyadi ada beberapa motif penculikan anak, di antaranya adalah: karena uang, pemerasan, mungkin juga dendam, mungkin masalah politik, mungkin juga eksploitasi seksual kemudian perdagangan anak sampai kepada diambil organ tubuhnya untuk diperdagangkan. Bagi Penculiknya menurut hukum Islam harus dikenai hukuman ta’zir baik berupa pidana penjara, denda, dan lain-lain.

Abstract

The effectiveness of Law Number 25 of 2009 on Public Services in improving services at the Tigo Baleh Community Health Center (Puskesmas) through the implementation of a digital system, specifically the Mobile JKN application. While designed to enhance efficiency and reduce queues with online registration, this research reveals a gap between expectations and reality. The method used in this research is field research, and the data ushed are in the form of primary data were collected through interviews and direct observation of service users and Puskesmas staff, supplemented by secondary data from relevant literature and documents. Qualitative data analisis indicates low Mobile JKN adoption stems from several factors, including a lack of public understanding of the application and insufficient socialization. Furthermore, the study identifies obstacles in implementing the principles of public service as stipulated in Law No. 25 of 2009, particularly regarding participatory principles and transparency as well as the principles of speed, simplicity, and accessibility. A review of Fiqh Siyasah reinforces these findings, highlighting the unmet principle of justice and utility in its application in service delivery. In conclusion, the effectiveness of Law No. 25 of 2009 in improving public services at the Tigo Baleh Puskesmas through digital systems requires improvement. This study recommends a more comprehensive strategy to enhance community digital literacy, simplify application usage, and ensure optimal implementation of public service principles for more effective and efficient healthcare services.

Abstract

This study examines the transformation of Islamic criminal law across three Muslim-majority countries Indonesia, Malaysia, and Sudan within the context of narcotics regulation. Employing a qualitative comparative approach that integrates legal document analysis, expert interviews, and secondary data on drug abuse prevalence, this study identifies structural differences, points of consistency, and key factors influencing regulatory effectiveness. The results yield a Sharia-based regulatory framework model that can be adapted by other nations with similar Islamic legal systems. These findings contribute to the literature on Islamic criminal law and offer an empirical foundation for more coherent and sustainable narcotics policy reform.

Abstract

The customary tradition of manjapuik sumando after the death of a wife in Minangkabau society has received attention in various studies, yet research that specifically analyzes this tradition from the perspective of maslahah mursalah remains limited. This study aims to explore the implementation of the customary tradition of manjapuik sumando after the death of a wife in Nagari Koto Gadang, Baso Subdistrict, Agam Regency, and to analyze its relevance from the perspective of maslahah mursalah. This study used a qualitative approach with a field research and case study design. The research informants included customary leaders, niniak mamak, bundo kanduang, Islamic religious scholars, nagari officials, and community members selected through purposive sampling and snowball sampling techniques. Data were collected through interviews, Focus Group Discussions (FGDs), observation, and documentation, and were then analyzed using the Miles, Huberman, and Saldaña model through the stages of data reduction, data display, and conclusion drawing. The results show that the tradition of manjapuik sumando is still maintained as a form of respect for the sumando, a mechanism for preserving kinship relations, and a means of maintaining social harmony in Minangkabau customary society. This tradition is viewed as bringing social benefit and not conflicting with the basic principles of Islamic law, so it can be understood as a form of ‘urf shahih. This study contributes to the development of Islamic legal studies, particularly regarding the relationship between custom and Islamic law in Minangkabau matrilineal society. The implications of this study include theoretical contributions to the development of maslahah mursalah studies and practical implications for customary leaders, Islamic religious scholars, and nagari governments in maintaining harmony between the preservation of local culture and Islamic values.

Abstract

Persoalan sampah di Kecamatan Mandau berdasarkan data yang diperoleh, volume sampah dari tahun 2023-2024 semakin meningkat, dari angka 29.200 ton meningkat ke 94.300 ton. Data harian menunjukkan bahwa terdapat sekitar 7 hingga 8 ton sampah yang dihasilkan setiap hari di Kecamatan Mandau. Dengan rumusan masalah Bagaimana Peran Pemerintah Kecamatan Mandau dalam Pengelolaan Sampah berdasarkan Perda Kabupaten Bengkalis No. 2 Tahun 2015 Pasal 8 Ayat (3) dan Bagaimana Perspektif Siyasah Tanfidziyah dalam Peran Pemerintah Kecamatan Mandau dalam Pengelolaan Sampah berdasarkan Perda Kabupaten Bengkalis No. 2 Tahun 2015 Pasal 8 Ayat (3). Penelitian ini menggunakan metode kualitatif dengan menggunakan pendekatan penelitian lapangan (field research) dan penelitian pustaka (library research). Adapun sumber data dalam penelitian ini terdiri dari sumber data primer. Berdasarkan hasil penelitian, dapat disimpulkan bahwa Pemerintah Kecamatan Mandau telah menjalankan perannya sesuai Perda tersebut tetapi kendalanya ialah kurangnya kesadaran masyarakat terhadap sampah. Dalam perspektif Siyasah Tanfidziyah, peran pemerintah kecamatan termasuk dalam bentuk pelaksanaan kebijakan publik yang bertujuan untuk kemaslahatan masyarakat.

Abstract

Islamic criminal law (fiqh jinayah) faces serious challenges in the modern era due to social change, technological advancement, and universal human rights demands. The tension between Islamic legal tradition and modernity raises fundamental questions regarding the conceptualization, urgency, and forms of legal reform, as well as the roles of society and government. This article aims to address these four issues through normative-juridical analysis and comparative legal studies of Muslim-majority states. The findings indicate four primary points. First, Islamic criminal law reform (tajdid) is not a total replacement but a contextual reconstruction grounded in maqashid al-syari’ah. Second, the urgency of this reform stems from historical-sociological, philosophical, and juridical dimensions to maintain legal relevance amidst changing times. Third, reform manifests through legal codification, contemporary ijtihad, reinterpretation of hudud provisions, and the adoption of relevant international legal concepts. Fourth, successful reform requires strategic synergy between the government as the legislative authority and societal elements-including scholars, academics, NGOs, and media—as epistemic and advocacy actors. Overall, this article asserts that the future transformation of Islamic criminal law depends on balancing sacred principles with contemporary human needs. Through an integrative approach, Islamic criminal law can evolve into a dynamic, just, and responsive legal system within global civilization without losing its fundamental religious identity.
