Abstract

Along with its development, the category of sexual gratification emerged which received a lot of attention from the public and law enforcement officials. This sexual satisfaction is different from the satisfaction we know in general. The difference lies in the object. Sexual gratification is a form of degrading women's dignity. In Indonesia, sexual gratification has not been explicitly regulated. Therefore, this research will discuss the regulation of sexual gratification based on positive law in Indonesia and the evidence. From the results of the analysis it is known that sexual gratification can be included in the provisions of Article 12 B paragraph 1 of Law 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes. This can be found in the phrase "other facilities" where "facilities" themselves are defined as the means used to facilitate an implementation. Therefore, the use of sexual service facilities with the aim of achieving all desires is the intention of the party providing satisfaction. Proof of the existence of sexual gratification in eradicating corruption in Indonesia is based on criminal procedural law which refers to the Criminal Procedure Code (KUHAP) in Article 184 paragraph (1) and Article 26A of Law Number 20 of 2001 Jo. Law Number 31 of 1999 uses a reverse or balanced evidentiary system where the burden is on the Public Prosecutor and the defendant to provide evidence of the criminal act of sexual gratification for which the defendant is charged.

Abstract

Indonesia’s Islamic fintech leadership necessitates aligning digital finance with Sharia governance and compliance. This study evaluates doctrinal conformity in Indonesia’s Sharia fintech ecosystem, focusing on spiritual-financial obligations (zakat, infaq, sadaqah) and commercial transactions. Through qualitative analysis of MUI fatwas, laws, and operational frameworks, systemic gaps are identified between maqāṣid al-sharīʿah (Islamic legal objectives) and current practices. Three critical deficiencies emerge: (1) ambiguous aqd (contract) standardization for P2P lending, (2) inadequate consumer data safeguards under OJK oversight, and (3) fragmented coordination between DSN-MUI and fintech operators. The research proposes a value-driven regulatory model integrating Islamic legal philosophy—prioritizing justice (‘adl), welfare (maṣlaḥah), and ethical risk-sharing—into governance structures. Such reforms could position Indonesia as a global benchmark for harmonizing faith-based economic principles with fintech innovation, ensuring legal certainty and advancing financial inclusion. By bridging jurisprudential expectations with technological advancement, this paradigm fosters sustainable Sharia compliance while strengthening inclusive digital finance ecosystems.

Abstract

Abstract

The new regulations on the concept of layoffs (PHK) are perceived as increasingly critical and detrimental to some workers. While the old regulations were deemed non-binding, the new regulations reintroduce the issue of termination of employment due to disharmony within the company. This research, conducted normatively, analyzes how the concept of termination of employment (PHK) is defined in existing regulations and legislation. In this era of globalization, human resource issues within a company require greater attention. No matter how sophisticated the technology used in a company and how much capital is invested, it is ultimately the employees who will carry out the work. This demonstrates that without the support of high-quality employees in carrying out their duties, even with sophisticated capital and technology, it is impossible to achieve optimal results. Termination of employment due to disharmony is certainly not a valid reason, as employment regulations stipulate several conditions governing the termination of an employment contract.

Abstract

The banking sector in Indonesia plays a highly strategic role in the economy. Economic activity is a series of diverse legal acts. One of the most prominent forms of economic activity occurring in banking is the agreement between the customer as a consumer and the bank. Credit is currently in high demand among people with varying motives and consumption needs. Driven by increasingly pressing economic pressures, credit is an alternative way to obtain capital or funds needed for various community needs. Credit agreements granted by banks to customers are not without risk, as any risk may occur. The most common risk is the risk of failure or default in bank loan repayment. A new loan can only be issued after a written agreement has been reached between the debtor and the creditor, with the creditor acting as the lender and the debtor as the recipient of the loan. This written agreement is contained in a standard credit agreement. The credit agreement outlines the terms and procedures for applying for a loan with collateral and the obstacles in implementing the loan agreement. This research is an applied normative research with a descriptive approach. The problem-solving approach used is a normative juridical approach. The data used are primary and secondary data, consisting of primary legal materials, secondary legal materials, and tertiary legal materials. In summary, a standard bank agreement is valid as long as it does not violate the law and maintains a balance between the rights and obligations of customers. The basis for this standard agreement is Article 1320 of the Civil Code.

Abstract

This study analyzes the implications of club licensing regulations established by the Football Association of Indonesia on the bankruptcy risk of clubs participating in Liga 1 Indonesia, using a legal coaching approach as an instrument of preventive law. Club licensing regulations generally emphasize administrative and financial compliance; however, their effectiveness in mitigating bankruptcy risk remains limited due to the lack of systematic integration of internal legal risk management. This research adopts a normative juridical and conceptual approach, employing a legal model-building technique. The findings indicate that club licensing in Indonesia remains largely verificative in nature and has not yet functioned as a mechanism of risk governance. Accordingly, this article formulates the Sport Corporate Legal Coaching Framework (SCLCF) as an integrative model that combines licensing regulations with an internalized legal risk management system. The primary contribution of this study lies in integrating corporate law into professional sport governance, while also providing a learning framework for club managers, regulators, and academics to develop sustainable and resilient sport governance systems against bankruptcy risk

Abstract

Currently, many people work in the construction sector, whether they work independently or collaboratively, regarding protection in employment relationships, or working for others for their services. This research uses a normative legal approach coupled with a phenomenon-based approach. Obstacles and efforts include a lack of awareness of the importance of worker health and safety in the workplace, and a lack of compliance with company-provided safety regulations. Efforts must be made by construction companies that handle high-rise buildings, which have high risk factors, requiring maximum occupational safety and health protection and ensuring worker safety. The company's good faith in providing occupational safety and health facilities is crucial in the work activities of a construction project. Provision of safety facilities and infrastructure is necessary to prevent workplace accidents. Furthermore, training and knowledge of occupational accidents and risks must be frequently addressed to reduce the rate of workplace accidents in the construction sector.

Abstract

Vocational High School (SMK) education plays a crucial role in preparing students to enter the workforce. However, despite the provision of technical education and vocational skills, the primary challenge faced by SMK graduates is their readiness to face the demands of the workforce, particularly regarding character and soft skills. Today's workforce prioritizes not only technical skills but also interpersonal skills, discipline, and a strong work ethic. Therefore, character development for SMK students is crucial to increasing competitiveness in the job market. Character education is a crucial aspect of education. A mature SMK student's character can be invaluable capital for entering the workforce. However, this character-building process does not occur solely in the classroom; it requires a holistic approach integrated with various activities and experiences outside the formal curriculum. Therefore, character development needs to be strengthened through more practical and applicable educational programs that can help students understand the importance of values such as responsibility, hard work, and a positive attitude at work. In fact, employment agreements can be made not only in writing but also verbally. However, for fixed-term employment, the agreement must be made in writing to prevent negative consequences at the end of the employment agreement, such as workers demanding reemployment even though the employment agreement has expired, thereby harming the employer. For indefinite-term employment agreements, the employment agreement can also be made verbally, which applies to permanent workers.

Abstract

The issue of family law based on Islamic law, concerning marriage, inheritance and so on which can not be equated with non-Muslims, is one reason for the importance of Islamic Family Law itself. The enactment of Law Number 1 of 1974 concerning Marriage and KHI (Compilation of Islamic Law) is the answer to the problem of the uncertainty and the demands of the Muslim community to be a guide, and a reference in overcoming problems surrounding family law. In this paper, we will discuss the Political Concept of Islamic Family Law Legislation. This is important, because every policy or law issued by the government, at the same time there is a long political process so that the policy reaches the people. As it is known that not all juridical products are in line with the aspirations of the people. There are juridical products that are considered by the community to be contrary to the enforcement of democracy. One of the causes is the intervention of political interests in the internal power.
