Abstract

Penghijauan merupakan program nasional yang dilaksanakan melalui sinergitas masyarakat dengan mahasiswa. Sinergitas ini harus mampu menguatkan spirit masyarakat terhadap lingkungannya. Tujuan dari pengabdian ini adalah menstimulir Power in Community untuk penguatan spirit masyarakat terkait manfaat dari aksi penghijauan untuk menjaga keasrian dan kehijauan lingkungan di Kelurahan Malamso Distrik Malaisimsa Kota Sorong. Metode yang digunakan dalam Power in Community: Penguatan Spirit Masyarakat Akan Aksi Program Penghijauan Di Kelurahan Malamso Kota Sorong melalui stimulasi penguatan kesadaran masyarakat akan aksi penghijauan dilakukan dalam bentuk kegiatan Colaboratif Action dengan model pendekatan persuasif dan andragogi. Hasil dari aksi pengabdian pada masyarakat ini untuk memberikan pemahaman dan motivasi serta penguatan spirit masyarakat mengenai pentingnya melestarikan lingkungan. Aksi penghijauan yang dilakukan di Kelurahan Malamso yakni dengan melaksanakan penanaman sejumlah pohon, dimana melalui aksi kegiatan penghijauan ini bertujuan untuk mengatasi permasalaahan lingkungan dari kegersangan menuju kerindangan.

Abstract

Penelitian ini bertujuan untuk Mengetahui Penerapan sanksi dalam melaksanakan prosedur yang  telah ditetapkan dalam peraturan perundang-undangan yang korelasi yuridisnya berkaitan dengan  tugas  dan  fungsi  kinerja  BKSDA  sebagaimana  tertuang dalam Undang-Undang No  5  Tahun  1990, dengan kajian dan analisa mendalam terhadap penerapan  sanksi  pidana  dan  penghambat keberhasilan pelaksanaan BKSDA, serta  pandangan  masyarakat terhadap kinerja BKSDA kota Sorong.Penelitian  ini  di  laksanakan  di  BKSDA  Kota  sorong  dengan  mengambil  sampel  pegawai BKSDA  Kota sorong,  yang dilakukan dengan pengamatan secara mendalam mengenai gejala  yang  diteliti.  Di  samping  wawancara  terstruktur  dengan  responden,  dengan  lokasi  yang berbeda–beda, sehingga peneliti dapat menelaah rasionalitas dan akurasi implementasi atau pelaksanaan penerapan sanksi yang dilakukan oleh BKSDA Kota sorong, dan  rating  ekspektasi publik  terhadap  bobot  pelaksanaan penerapan sanksi terhadap eksploitasi pada kawasan  hutan konservasi di Kota sorong.Temuan yang diperoleh dalam penelitian diantara lain adalah: (1) Mengetahui penghambat penerapan sanksi pidana terhadap pelaku tindak pidana penambangan liar terbuka di dalam kawasan hutan konservasi. (2) BKSDA Kota sorong  mampu  untuk  menerapkan  sanksi  pidana  terhadap  penyelenggara eksploitasi di Kota  sorong  yang  pada  aspek  hukum  terhadap  tindak  pidana pelaku penambangan liar terbuka di dalam  kawasan  konservasi  hutan dan  mampu  untuk  bisa  terealisasi  dengan  baik  yang  telah ditetapkan  pada  peraturan perundang–undangan yang mengatur tentang  terkait  Balai Besar Konservasi Sumber Daya Alam pada kawasan Hutan.Sebagai bahan informasi  bagi masyarakat mengenai  potensi  sumber  daya  hutan  serta  cara  pengelolaannya di Kota sorong, sehingga mampu untuk dijadikan sebagai salah satu bahan pada bagian stakeholder, pemerintah, maupun swasta dalam pengambilan keputusan dan berkaitan dengan penggunaan dan pemanfaatan Sumber Daya Alam yang terdapat pada kawasan hutan konservasi Agraria kehutanan yang berada pada wilayah Kota sorong sebagai Zona yang memiliki kawasan hutan yang begitu besar dan sangat bermanfaatkan bagi masyarakat Kota Sorong.

Abstract

Marriage in the view of Article 26 of the Civil Code is only limited to civil relations. This means a relationship that only involves one person in terms of the outer bond between a man and a woman and is separated from spiritual or religious elements. In contrast to the case with customary law in general, Indonesia views marriage as a kinship bond of neighbours. Children outside of marriage are still a child who will live together as a family in society, so that they have the same protection rights as a child born in a legal marriage, even if in a legal marriage. In certain contexts, children outside marriage are considered a despicable event in people's lives. This research is empirical research, namely legal research by using field data as primary data sources, such as the results of interviews, observations and documentation. Then it is supported by secondary data, namely articles, journals and previous research. The results of this study indicate that: 1). The position of children born out of wedlock according to the Tehit Tribe and Positive Law Children born outside only have a relationship with their mother and their mother's family. 2). Legal protection for children out of wedlock in terms of the Tehit Tribe and positive law A woman and her child are given the opportunity by law to prosecute and fight for the rights of children out of wedlock to have a civil relationship with their father.

Abstract

Penelitian ini bertujuan untuk mengetahui penyebab terjadinya sengketa tapal batas di Distrik Moraid Papua Barat.  Kecenderungan masyarakat Adat Distrik Moraid dalam aktivitas sehari hari dan dalam pelbagai hal termasuk proses penerimaan pelayanan dan pengurusan surat menyurat tentang kependudukan sebagian masih dilayani oleh Pemerintah Daerah Kabupaten Sorong sebagai Kabupaten Induk. Menggunakan Pendekatan yuridis sosiologis (Z.Ali,2014) adalah dengan tujuan melihat dan menganalisis aspek aspek hukum yang terjadi dalam masyarakat serta mengidentifikasi masalah yang terjadi.  Hasil penelitian ini menunjukkan bahwa sengketa tapal batas di Distrik Moraid adalah menjadi beban dan tanggung jawab Dewan Adat yang harus diselesaikan secara transparan dan terbuka kepada masyarakat tanpa ada kepentingan dan intervensi dari Pemerintah Daerah kedua wilayah, sehingga dalam keputusan Dewan Adat dapat menjadi rujukan perdamaian dan solusi bagi pihak pihak yang bertikai    sesuai dengan kaidah hukum adat dan nilai nilai kearifan lokal yang berlaku. Atau jika belum memenuhi harapan maka dapat melakukan gugatan melalui  Pengadilan Tata Usaha Negara dan Mahkamah Konstitusi.

Abstract

The program to enrich the community's knowledge about local food is an effort to increase families' knowledge and awareness of nutritional needs, as this program provides education that focuses on the importance of consuming a variety of nutritious, balanced foods, utilizing the potential of local food to support family resilience and nutrition. The objective of this activity is to enrich the knowledge of communities living around forests about the revitalization of local foods in supporting food security for communities in Arus Village, Maybrat Regency. This community service approach uses a participatory approach in the form of socialization and Focus Group Discussions (FGD). The community is now more open to utilizing local food in their daily diet, which contributes to their health and well-being. However, challenges in the accessibility of local food ingredients still need to be addressed to ensure the sustainability of the Food Security program. Overall, this Knowledge Enrichment program not only provides knowledge but also empowers the community to implement better nutritional practices, which in turn can improve their quality of life.

Abstract

The COVID-19 pandemic has posed significant challenges to legal systems and the protection of constitutional rights globally. Restrictions on fundamental rights, such as freedom of movement, assembly, and work, imposed by governments to protect public health, have sparked debates on the extent to which constitutional rights can be limited during a global health emergency. This study aims to analyze how different legal systems in various countries address the limitation of constitutional rights during the COVID-19 pandemic, with a focus on the principles of necessity, proportionality, and non-discrimination in the framework of international human rights law. Using a qualitative approach through literature study and library research, this article examines various constitutional legal frameworks, emergency laws, and the application of relevant international human rights principles. The findings show that although many countries have constitutional provisions allowing for the restriction of certain rights during emergencies, the application of the principles of proportionality and necessity varies. The study also highlights the critical role of judicial oversight to ensure that rights limitations are not excessive and are applied fairly, and the importance of aligning national laws with international human rights standards. The implications of this research suggest the need for long-term legal reforms to ensure just and non-discriminatory limitations of rights in future global health emergencies.

Abstract

Abstrak Penyuluhan hukum yang dilaksanakan di Kabupaten Sorong telah berhasil meningkatkan pemahaman masyarakat tentang mekanisme penyelesaian sengketa tanah yang melibatkan hukum positif dan hukum adat. Berdasarkan evaluasi pre-test dan post-test, terlihat adanya peningkatan signifikan dalam pemahaman peserta mengenai kedua sistem hukum tersebut. Sebelum penyuluhan, hanya 30% peserta yang memahami mekanisme hukum positif, namun setelah penyuluhan, angka ini meningkat menjadi 85%. Selain itu, kesadaran masyarakat tentang pentingnya legalitas tanah juga meningkat, di mana pada post-test, 78% peserta menyadari pentingnya memiliki sertifikat tanah, dibandingkan hanya 40% pada pre-test. Meskipun demikian, masih terdapat tantangan terkait ketidakjelasan batas wilayah tanah yang sering menjadi sumber sengketa. Sebelum penyuluhan, hanya 34% peserta yang menyadari masalah batas wilayah, namun setelah penyuluhan, angka ini meningkat menjadi 56%. Keterbatasan akses informasi bagi masyarakat di daerah terpencil juga menjadi hambatan dalam memproses legalitas tanah. Oleh karena itu, perlu dilakukan upaya lebih lanjut untuk memperluas akses informasi dan mendukung masyarakat dalam mengurus sertifikasi tanah mereka. Penyuluhan hukum ini juga membuka ruang untuk harmonisasi antara hukum adat dan hukum positif, yang perlu dilanjutkan dengan memperkuat koordinasi antara kedua sistem hukum. Diharapkan, dengan adanya pelatihan berkelanjutan dan penggunaan media digital, penyuluhan ini dapat memperluas jangkauan serta memberikan solusi yang lebih efektif dan adil bagi masyarakat dalam penyelesaian sengketa tanah. Kata kunci: penyuluhan hukum; sengketa tanah; hukum positif; hukum adat. Abstract The legal education program conducted in Sorong Regency has successfully improved the community's understanding of the mechanisms for resolving land disputes involving positive law and customary law. Based on pre-test and post-test evaluations, there was a significant increase in participants' understanding of both legal systems. Before the program, only 30% of participants understood the mechanisms of positive law, but after the program, this figure increased to 85%. In addition, public awareness of the importance of land legality has also increased, with 78% of participants recognizing the importance of having a land certificate in the post-test, compared to only 40% in the pre-test. However, there are still challenges related to unclear land boundaries, which are often a source of disputes. Before the outreach program, only 34% of participants were aware of boundary issues, but after the program, this number increased to 56%. Limited access to information for people in remote areas is also an obstacle in processing land legality. Therefore, further efforts are needed to expand access to information and support the community in obtaining land certification. This legal education program also opens up opportunities for harmonization between customary law and positive law, which needs to be continued by strengthening coordination between the two legal systems. It is hoped that with ongoing training and the use of digital media, this program can expand its reach and provide more effective and fair solutions for the community in resolving land disputes. Keywords: legal education; land disputes; positive law; customary law.

Abstract

This study aims to analyze the inheritance distribution system according to the customary law of the Mare Tribe in Maybrat Regency, Southwest Papua, with a focus on the role of the kinship system and the principle of inheritance based on lineage. The method used in this study is an empirical approach with data collection through interviews and document studies. Primary data was obtained from interviews with local indigenous communities and regional officials, while secondary data was collected through literature studies covering regional regulations, books, and relevant scientific articles. Data analysis was conducted qualitatively using descriptive methods to describe the practice of inheritance distribution in the Mare tribe community. The novelty of this research lies in its in-depth focus on the customary inheritance distribution system in Southwest Papua, particularly in the Mare District, which still maintains the tradition of primogeniture and the Tua Marga principle. This system shows that the first child of the family, especially the male, has the primary right to inheritance consisting of land and natural resources. This study also reveals the importance of the patrilineal kinship system in determining heirs and the dominant role of men in the management of inheritance. The results show that the inheritance system in the Mare tribe community still adheres to old traditions, where the distribution of inheritance is carried out from generation to generation, taking into account the position of Tua Marga as the main heir. However, this system also allows women to inherit property under certain circumstances, such as when there are no male children in the family. The conclusion of this study is that the customary law of the Mare tribe remains relevant in regulating the distribution of inheritance, taking into account social status in the lineage and the role of men in the management of inherited property.

Abstract

This study aims to analyze the process of resolving customary land disputes among the Moi indigenous community and to identify the obstacles faced within the framework of legal pluralism in Indonesia. This study employs a normative legal research approach (doctrinal legal research), focusing on the analysis of legal norms, principles, and doctrines related to customary law and national law. Data were collected through literature review, including primary, secondary, and tertiary legal materials, and analyzed using a qualitative normative method with interpretive and comparative approaches. The novelty of this study lies in the development of a reimagined dispute resolution approach by integrating Moi customary law into the discourse of Indonesian legal pluralism, which highlights normative and socio-cultural dimensions. The results of the study indicate that dispute resolution among the Moi community prioritizes non-litigious mechanisms based on deliberation, the principles of restorative justice, and local wisdom values, with the Customary Institution (LMA Malamoi) playing a central role. However, this process faces significant obstacles, including emotional factors, low legal awareness, unclear land boundaries, overlapping ownership claims, and external intervention. This study concludes that while customary mechanisms are effective in maintaining social harmony, their interaction with the formal legal system poses challenges within the context of legal pluralism. Therefore, harmonization between customary law and state law, strengthening customary institutions, and enhancing public legal awareness are crucial for achieving fair, effective, and sustainable dispute resolution.
