Abstract

This article examines the persistence of the sangkal tradition within Madurese Muslim communities, exploring how customary hegemony influences women’s agency and interacts with local religious authority. The tradition is rooted in a cultural narrative that prohibits women from refusing the first marriage proposal (tako’ sangkal), with noncompliance believed to bring misfortune upon them. Although it lacks any foundation in Islamic jurisprudence (fiqh), the tradition continues to function as a powerful social norm influencing pre-marital decision-making. Employing a socio-legal approach, this field research draws on in-depth interviews with women who accepted or rejected their first proposals, as well as local religious leaders in Klompang Timur, Pamekasan. The study identifies four mechanisms that simultaneously sustain the sangkal tradition: the genealogical authority of ancestral custom, internalization of misfortune narratives, symbolic pressures tied to family honor, and limited religious literacy that enables customary norms to overshadow the principles of khiṭbah (marriage proposal) in fiqh. Women’s responses range from compliance to strategic negotiation, such as symbolic acceptance, to overt resistance through refusal or temporary self-displacement. Local religious leaders acknowledge that tako’ sangkal has no sharīʿah legitimacy and may be detrimental to women; yet, such recognition rarely materializes into public critique or reform. This article argues that the endurance of the sangkal tradition is driven not by religious legitimacy but by the hegemonic power of custom, the social production of fear, and the narrow space for women’s agency within family and community structures. [Artikel ini menelusuri kebertahanan tradisi sangkal dalam masyarakat muslim Madura dengan menelaah bagaimana hegemoni adat membentuk ruang agensi perempuan dan berinteraksi dengan otoritas keagamaan setempat. Tradisi ini bertumpu pada narasi kultural bahwa perempuan tidak diperkenankan menolak lamaran pertama (tako’ sangkal), dan ketidakpatuhan diyakini mendatangkan kemalangan baginya. Meskipun tidak memiliki dasar hukum dalam fikih Islam, tradisi ini tetap berfungsi sebagai norma sosial yang kuat dalam proses pengambilan keputusan pra-nikah. Melalui pendekatan sosio-legal, penelitian lapangan ini berbasis wawancara mendalam dengan para perempuan yang menerima dan menolak lamaran pertama serta tokoh agama di Klompang Timur, Pamekasan. Penelitian menemukan empat mekanisme yang secara simultan menopang tradisi sangkal: otoritas genealogis adat leluhur, internalisasi narasi kemalangan, tekanan simbolik terkait kehormatan keluarga, dan minimnya literasi keagamaan yang memungkinkan adat mendominasi prinsip lamaran (khiṭbah) dalam fikih Islam. Respons perempuan hadir dalam bentuk kepatuhan, strategi negosiasi seperti penerimaan simbolik, hingga resistensi terbuka melalui penolakan atau pengungsian sementara. Para tokoh agama setempat mengakui bahwa tako’ sangkal tidak memiliki legitimasi syariah dan berpotensi merugikan perempuan, tetapi pengakuan tersebut jarang berwujud dalam kritik publik sampai upaya reformasi. Abstract

This study departs from a compilation of women-themed hadiths that were interpreted progresively by Faqihuddin in his book “60 Hadis Hak-Hak Perempuan Dalam Islam:Teks dan Interpretasi”. Another starting used to study this topic is because women-themed hadiths tend to affrim men’s superiority over women. Of the sixty hadith that have been interpreted, the researcher only chose a few hadiths, which are categorized in four major themes; the principle of male and female relations, women’s dignity, women’s choices and rights, and the relations of husband and wife. This study tries to learn and analyze how Faqihuddin applies the theory of qira’ah mubadalah (reading reciprocally) to these selected hadiths. The approach of this study are conceptual approach and content analysis approach. This study finds that qira’ah mubadalah is a progressive interpretation theory that relies on two things, the universal value of Islam and the substantial understanding of a text. Dialecting both things will be able to produce interpretations that carry the value of equality holistically. In the application level, Faqihuddin has internalized Islamic universalism in facilitating the substance of the text. When interpreting the hadith, Faqihuddin uses three types of interpretation; grammatical interpretation, historical interpretation and sociological interpretation. The first two types of interpretations are used to find the main text; the ground idea of the text. Meanwhile, sociological interpretations are used to reduce main thoughts and expand the meaning egalitarian. Kajian ini berangkat dari kompilasi hadis-hadis bertema perempuan yang diinterpretasikan secara progresif oleh Abdul Kodir dalam bukunya 60 Hadis Hak-Hak Perempuan Dalam Islam:Teks dan Interpretasi. Titik tolak lain yang digunakan untuk mengkaji topik ini adalah karena hadis-hadis bertema perempuan cenderungmeneguhkan superioritas laki-laki atas perempuan. Dari enam puluh hadis pilihan yang telah diinterpretasikan, peneliti hanya memilih beberapa hadis, yang terkategorikan dalam empat tema besar, yaitu prinsip relasi laki-laki dan perempuan, martabat perempuan, posisi dan hak-hak perempuan, dan relasi suami istri. Kajian ini bertujuan untuk mengetahui bagaimana Abdul Kodir mengaplikasikan teori qira’ah mubadalah-nya terhadap hadis-hadis pilihan. Pendekatan yang digunakan adalah pendekatan konseptual (conceptual approach) dan analisis isi (content analysis). Kajian ini menemukan bahwa qira’ah mubadalah adalah teori interpretasi progresif yang  bertumpu pada dua hal, nilai universal Islam dan gagasan substansial sebuah teks. Mendialektikan keduanya akan mampu menghasilkan interpretasi yang mengusung nilai kesetaraan secara holistik. Dalam tataran aplikasi, Abdul Kodir telah mengintegrasikan universalisme Islam dalam memahami substansi teks.

Abstract

This article aims to explore the process of decolonization of Islamic family law in Indonesia by tracing its historical transformation, policy changes, and the continuity of its legal practices from the colonial period to the post-reform era. Through a conceptual, historical, and legislative approach, this article analyzes how the colonization of Islamic family law took place in Indonesia. This article argues that the decolonization of Islamic family law in Indonesia did not occur in a single manner, but instead in two primary forms. First, accommodative decolonization, which was realized through post-independence state policies, such as the theories of receptie exit and receptio a contrario, the Religious Court Law, the Compilation of Islamic Law, and various policies of the Supreme Court and the Ministry of Religious Affairs, which negotiated fiqh traditions with the need for modern legal protection, especially for women and children. This pattern aligns with Khaled Abou El Fadl's view, which regards legal reform as an inherent part of the Islamic legal tradition. Second, conservative decolonization is reflected in fatwas and classical fiqh discourse developed by Islamic boarding schools and religious organizations, in line with Wael B. Hallaq's criticism of colonial legal modernity. This article argues that the decolonization of Islamic family law in Indonesia is an ongoing process involving the state and religious scholars, and that it does not merely aim to erase the colonial legacy but also to create a contextual, just, and responsive Islamic family law system for vulnerable groups.

Abstract

This article interrogates how Islamic marriage registration is governed in practice by examining the relational dynamics between the penghulu (marriage registrar) and the modin (village religious official) in Pasuruan Regency, East Java, within the broader project of bureaucratizing Islamic family law in Indonesia. Although state law formally centralizes marriage registration authority in the penghulu as the embodiment of legal-rational authority, empirical evidence reveals a layered socio-legal configuration shaped by limited state capacity, the enduring cultural legitimacy of the modin, and the practical demands of public service provision. Employing a socio-legal methodology, this field study draws on structured interviews with 19 informants across three sub-districts, non-participant observation, and analysis of relevant regulatory frameworks. The findings demonstrate that marriage administration operates through a pattern of structural interdependence between the penghulu and the modin, reflecting an interaction between legal-rational and traditional authority. Under conditions of bureaucratic constraint, the modin functions as a gatekeeper, a preliminary verifier, and an administrative intermediary, while the penghulu retains final authority over validation and formal marriage registration. This relational configuration not only sustains the operation of Islamic legal governance at the local level but also generates ongoing negotiations between formal legality and socially embedded legitimacy. The article argues that the bureaucratization of Islamic family law does not displace traditional authority; rather, it reconstitutes it within an interdependent governance framework. In doing so, the study contributes to contemporary scholarship on Islamic law and legal pluralism by demonstrating how legal-rational and traditional authority are mutually constituted within everyday administrative practice. [Artikel ini mengkaji bagaimana tata kelola pencatatan perkawinan Islam dijalankan dalam praktik dengan menelaah dinamika relasional antara penghulu dan modin di Kabupaten Pasuruan, Jawa Timur, dalam kerangka birokratisasi hukum keluarga Islam di Indonesia. Meskipun hukum negara secara formal memusatkan kewenangan pencatatan perkawinan pada penghulu sebagai representasi otoritas legal-rasional, realitas empiris memperlihatkan konfigurasi sosio-legal yang berlapis, dipengaruhi oleh keterbatasan kapasitas negara, kuatnya legitimasi kultural modin, serta tuntutan pragmatis pelayanan publik. Dengan menggunakan pendekatan sosio-legal, penelitian lapangan ini dilakukan di tiga kecamatan melalui wawancara terstruktur terhadap 19 informan, observasi non-partisipan, serta analisis terhadap kerangka regulasi yang relevan. Temuan penelitian menunjukkan bahwa administrasi perkawinan berjalan melalui pola ketergantungan struktural antara penghulu dan modin, yang merefleksikan interaksi antara otoritas legal-rasional dan otoritas tradisional. Dalam konteks keterbatasan birokratis, modin berfungsi sebagai gerbang awal, verifikator pertama, dan perantara administratif, sementara penghulu tetap memegang otoritas final dalam validasi dan pencatatan pernikahan resmi. Konfigurasi relasional ini tidak hanya menopang keberlangsungan tata kelola hukum Islam di tingkat lokal, tetapi juga memperlihatkan negosiasi berkelanjutan antara legalitas formal dan legitimasi sosial yang mengakar. Artikel ini berargumen bahwa birokratisasi hukum keluarga Islam tidak menyingkirkan otoritas tradisional, melainkan merekonstitusikannya dalam kerangka tata kelola yang bersifat interdependen. Dengan demikian, penelitian ini berkontribusi pada pengembangan kajian hukum Islam dan pluralisme hukum dengan menunjukkan bahwa otoritas legal-rasional dan tradisional dalam praktik administratif sehari-hari tidak bekerja secara terpisah, melainkan saling membentuk dan menguatkan.]

Abstract

Polygamy can be granted if it meets one of the alternative conditions and the absolute cumulative condition. However, sometimes alternative terms are used as wrappers for other reasons to look ridiculous, such as humanity. This paper examines three polygamy rulings at the Pasuruan Religious Court in 2019 using the three Indonesia Women Ulama Congress (KUPI) fatwa approaches ma’ruf, mubadalah, and ultimate justice. The article finds that the reason for public justice is used to wrap up humanitarian reasons. In the ma’ruf approach, the standard of public justice as the basis for judges' consideration needs to be more precise because it does not refer to the global public experience. These standards are not in harmony with the decent logic of women in general. The Mubadalah approach ensures a balanced interpretation and interplay of public justice and humanity. The judge’s reasoning for considering standards of public justice and humanity based on patriarchal paradigms deserves to be criticized. The ultimate justice approach illustrates that the judge's reasoning is not based on women's biological, sociological, and anthropological life experiences in the case of polygamy. Abstract

Digital platforms have become pivotal in shaping religious legal discourse. This study examines the construction of legal humanism in the digital fatwas of Buya Yahya regarding LGBT issues on YouTube. Analyzing fourteen videos from Al-Bahjah TV, the research employs a maqāṣid al-sharī‘ah framework, specifically focusing on ḥifz al-nafs (protection of life). The analysis reveals that while Buya Yahya views LGBT as a curable illness, he vehemently rejects social exclusion. Instead, he advocates for a compassionate approach, emphasizing healing, family preservation, and inclusive embracement over condemnation. This stance prioritizes humanity, acting as a counter-narrative to rigid conservative religious views often found online. This study concludes that Buya Yahya effectively utilizes digital media to mainstream legal humanism, transforming public perception by presenting an Islamic jurisprudence that safeguards human dignity. These findings highlight the potential of digital fatwas in fostering a more humane and moderate religious atmosphere in Indonesia.
