Abstract

In 2020, Law Number 11 of 2020 concerning Job Creation was introduced. From this Job Creation Act, a new agency was born, namely the Land Bank Agency, which is a special institution that manages land. Whereas previously there was a National Land Agency in charge of land affairs. With the existence of two institutions that regulate the same thing, it is feared that there will be overlapping powers. After the issuance of the Job Creation Act, in April 2021 the government issued a derivative rule Number 64 of 2021 concerning the Land Bank Agency. However, in November 2021 it turned out that the Constitutional Court issued Decision Number 91/PUU-XVIII/2020. However, despite the issuance of Decision Number 91/PUU-XVIII/2020, the president still issues presidential decrees, namely presidential regulation number 113 of 2021 concerning The Structure and Administration of The Land Bank. This is contrary to the previous decision of the constitutional court. The purpose of this study is to determine the indications of equal authority between the Land Bank Agency and the National Land Agency and how the existence of the Land Bank Agency after the Constitutional Court Decision Number 91/PUU-XVIII/2020 This research uses normative research or commonly referred to as library research. This research approach uses a law approach, a conceptual approach and a philosophical approach.Indications of the same authority between the Land Bank Agency and the National Land Agency are Land Procurement and Land Utilization Control, for the Land Bank Agency itself to obtain Management Rights so that the difference in the task area between the two institutions is visible. However, with the issuance of Presidential Decree Number 113 of 2021, it is a violation and the existence of the Land Bank Agency can be null and void by law.

Abstract

Environmental pollution can occur due to activities carried out by corporations. The increasing number of development activities has an impact on the environment, pollution and environmental damage. The impact of environmental pollution is very  dangerous for the lives of living things and the comfort of the environment in the future. The state of Indonesia has prepared a regulation in an effort to protect the environment as in law number 32 of 2009 conceming prorection and management of the environment. With the issuance of law number 11 of 2020 concerning job creation using the omnibus law model, the main theme of this law is to create jobs and investment. To make it easier to achieve this goal, a simplification of a permit was carried out. Therefore, law number 32 of 2009 conceming prorection and management was also affected by to permits and several articles that were changed, replaced, and abolished. This research was conducted to find out how the legal regulation of environmental pollution in law number 11 of 2020 concerning job creation and how the form of corporate responsibility as perpetrators of environmental pollution according to law number 11 of 2020 concerning job creation. The mothod used in this study is normative. The source of the legal material used is primary secondary legal material. The results of this study discuss the simplification of licensing and revisions to a number of articles in law number 32 of 2009 concerning environmental protection and management due to the issuance of law number 11 of 2020 concerning job creation and shifting criminal sanctions into administrative sanctions in the job creation act is one the weaknesses in environmental law enforcement against corporations that are perpetrators of pollution environment.

Abstract

The objectives to be achieved in this research are to find out how the regulation regarding the level of compliance with turning on the motorcycle headlights during the day and how the effectiveness of the motorcycle headlights obligation during the day reduces the number of motorcycle accidents. The research method used is an empirical legal research method which is also called field research by interviewing informants and knowing respondents' perceptions which are then compared to draw conclusions. The results of the study show that the regulation regarding compliance with turning on the motorcycle headlights and how the effectiveness of the motorcycle's headlight obligation during the day reduces the number of motorcycle accidents. Based on the results of research conducted by researchers, it can be concluded that, in Law Number 22 of 2009 concerning Road Traffic and Transport Article 107 paragraph (2) regarding compliance with turning on the main lights during the day for two-wheeled drivers to reduce the number of accidents in the jurisdiction of the City Police. Banjarmasin is not effective even though the number of violations of compliance with turning on the main lights during the day for two-wheelers is decreasing.

Abstract

Aside from the rise of environmental issues regarding mining activities, especially in the context of reclamation and post-mining activities, there have been changes in the regulations governing them. The reclamation program for ex-mining land is a mandatory program that must be carried out by every company, both private and non-private. Reclamation is an activity carried out throughout the mining business stages to organize, restore, and improve the quality of the environment and the ecosystem so that they function again according to their designation. The placement of post-mining guarantees by companies should not eliminate the company's obligation to carry out post-mining activities. If the company has a shortage of reclamation planning costs, placement of reclamation guarantees, implementation of reclamation, or release or disbursement of reclamation guarantees to complete post-mining activities under the stipulated guarantee, it remains the company's responsibility.

Abstract

Tujuan dari penelitian ini adalah selain untuk mengkaji landasan filosofis, sosiologis dan yuridis dalam Perda Nomor 1 Tahun 2024 tentang Pajak danNRetribusi Daerah, juga untuk memmahami konsekuensi dari adanya penyerahan urusan pemerintahan kepada daerah yang diselenggarakan berdasarkan asas otonomi. Pemberian kewenangan menggali sumber-sumber pendapatan asli daerah  harus seimbang dengan beban atau Urusan Pemerintahan yang diserahkan kepada Daerah. Pengukuhan Indonesia sebagai negara hukum dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 memberi pesan adanya keinginan kuat bahwa negara menjamin terselenggaranya persamaan kedudukan dalam hukum, yang antara lain ditandai dengan terciptanya suatu keadaan dimana hak setiap orang untuk mendapatkan perlakuan yang sama di depan hukum serta jaminan kepada setiap orang yang berhak mendapatkan akses keadilan (justice for all). Untuk mewujudkan terselenggaranya gagasan negara hukum tersebut, maka negara perlu campur tangan karena hal itu menjadi kewajiban negara untuk menjamin hak setiap orang mendapatkan keadilan. Melalui metode penelitian normatif, maka dilakukan pendekatan terhadapnundang-undang dan konsep yang memiliki keterkaitan erat dengan pajak dan retribusi daerah, sehingga dapat menemukan konsep bahwa perwujudan hak setiap orang dalam mendapatkan keadilan yaitu negara harus mengatur  terselenggaranya pungutan pajak daerah dan retribusi daerah yang menjamin keadilan dan kesejahteraans terhadap setiap warga negara sehingga tidak ada yang luput dari akses keadilan yang merupakan amanat konstitusi.

Abstract

Inheritance disputes in Banjar communities continue to increase as families confront controversies over unwritten norms, generational change, and rising land value, creating a growing need for culturally grounded solutions. These disputes reflect a broader trend in Indonesia where communities prefer non-court settlement when judicial rulings risk disrupting social cohesion. Within this plural legal landscape, families must navigate overlapping expectations from customary norms, Islamic law, and state regulations. This study addressed a key gap by examining how restorative justice principles operate within Banjar inheritance practices. Using a qualitative normative method, the research analyzed primary legal materials, documented customary procedures, court decisions, and academic literature. The findings showed that adat badamai integrated restorative values through open dialogue, inclusive deliberation, and relational repair among heirs. The study concluded that adat badamai provides an effective culturally rooted model of restorative justice and recommends stronger legal recognition and enhanced mediator training.
