Abstract

Penelitian ini membahas mengenai bentuk pelindungan yang diberikan hukum kepada perempuan yang menjadi korban dari kekerasan rumah tangga (KDRT) yang tentunya dilihat dan ditinjau dati perpestif Hukum Islam dan Hukum Pidana di Indonesia. Penilitian ini tentu menjadi hal yang dapat disoroti karena begitu relevan dengan hal – hal yang terjadi saat ini, beberapa hal yang menjadi tujuan yakni agar mampu memahami mengenai pembahasan kekerasan dalam rumah tangga (KDRT) menurut Hukum Islam dan Hukum Pidana. Selain itu juga agar memberikan akses perlindungan dalam membangun rumah tangga agar menjadi keluarga yang harmonis dan saling mengayomi. Dalam terjadi kekerasan dalam rumah tangga (KDRT) tentu terdapat motif yang mendasari hal tersebut sehingga keluarga menjadi tidak harmonis dan berantakan, hal-hal ini banyak disebabkan komunikasi yang baik, permasalahan ekonomi, perbedaan pendapat, budaya dan culture. Selain itu juga yang menjadi faktor pendorong yang cukup besar mengenai perselingkuhan. Setiap perbuatan tentu memiliki dampak yang menjadi akhir dari masalah yang terjadi dan hal terssebut bukan hanya memiliki dampak jangka pendek tetapi juga tentunya akan memiliki dampak jangka panjang juga. Jenis penelitian yang digunakan ialah penelitian normative menggunkan pendekatan teologis, yuridis, dan juga pendekatan sosiologis. Bentuk perlindungan yang yang diberikan undang-undang diatur dalam perlindungan sementara dari kepolisian, perlindungan pengadilan serta penempatan korban di “rumah aman”. Namun berdasarkan hasil penelitian dilihat melalui putusan Pengadilan Negeri maupun informan, menunjukkan bahwa bentuk perlindungan korban KDRT masih dominan melalui tindakan represif (hukuman pidana penjara) kepada pelaku, sedangkan perlindungan sementara dan perlindungan tetap dari pengadilan kurang diperhatikan.

Abstract

The authority given to the village government to manage village funds brings many benefits, especially in village development. Supervision of village funds is also very necessary to prevent criminal acts of corruption. The research method used in this research is descriptive analytical which describes in detail the social phenomena at the heart of the problem using empirical research and using qualitative data analysis. The results of the research show that village heads prevent criminal acts of corruption by recognizing the modus operandi of corruption in village funds, improving the quality of village officials, monitoring the management of village funds and strengthening cooperation with village assistants. Obstacles encountered and solutions implemented in preventing criminal acts of corruption in village funds are the low quality of human resources in managing village funds with the solution of providing technical guidance, low integrity of village officials in managing village funds with the solution of providing integrity culture outreach and low community participation in supervision. managing village funds with the solution of providing information to the community by socializing the use of village funds. The criminal act of corruption in village funds is any action that is detrimental to the state and villages, destroying the economic system, democratic system, political system, legal system, government system and social order. Efforts to prevent criminal acts of corruption in village funds can be carried out by monitoring the use of village funds.

Abstract

This study aims to evaluate the urgent need to restore the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates (UUA) to position Sharia advocates as the exclusive legal representatives in religious courts. The research uses a normative juridical method, focusing on the examination of legal norms, rules, and relevant literature. Data were collected through a comprehensive review of legal documents, statutes, and academic sources, and analyzed qualitatively to interpret and critique the legal provisions and their implications. The findings reveal that the current lack of specificity in the advocate profession, particularly in religious courts, has led to the involvement of advocates who may lack the necessary background in Sharia law, potentially harming the legal interests of Muslim clients. The conclusion emphasizes that restoring the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates to recognize only Sharia advocates in religious courts aligns with the nature of these courts and does not violate human rights. This restoration is vital for protecting the legal interests of Muslims and enhancing the professionalism of Sharia advocates in religious courts, including preparing students of the Faculty of Sharia for specialized legal roles. By promoting legal reforms, the study improves the efficiency of religious courts and ensures better access to justice for Muslim communities.

Abstract

This research analyzes the judicial considerations in Decision Number 555/Pid.Sus/2023/PN STB, which acquitted the former Regent of Langkat, TRPA, in a human exploitation case. The study evaluates whether the judges' reasoning aligns with the legal provisions of Law Number 21 of 2007 on the Eradication of Human Trafficking and Law Number 39 of 1999 on Human Rights. This study employs a normative juridical approach, focusing on court decisions, statutory regulations, and relevant legal theories in criminal law and human rights. The analysis is conducted through doctrinal research, examining the legal reasoning behind the verdict and its conformity with established legal principles. The findings indicate that the court ruled the indictment’s elements were not legally and convincingly proven. The judges based their decision on the principle of presumption of innocence, emphasizing the lack of sufficient evidence to establish the defendant’s direct involvement. The absence of mens rea (malicious intent), material benefits from exploitation, and direct participation in acts of violence further supported the acquittal. Additionally, accountability for the crime had already been attributed to another perpetrator in a prior ruling. This study contributes to the discourse on evidentiary standards and judicial reasoning in human exploitation cases. It offers a critical assessment of the challenges in prosecuting high-ranking officials and the legal gaps that may affect accountability in similar cases. The findings highlight the need for a more robust evidentiary framework in human exploitation trials, particularly in cases involving structural actors. The study suggests that legal reforms and enhanced prosecutorial strategies are necessary to prevent loopholes that could hinder justice in crimes of exploitation and human trafficking.

Abstract

 The Supreme Court is the pinnacle of (legal) efforts in seeking justice through the judicial process, both as a cassation court and a court for judicial review. The Supreme Court in carrying out its judicial function does not always meet the expectations of justice seekers in particular, and the public in general. The method used in this writing is the normative legal approach method where the research conducted is by examining existing library materials (library research), which are related to the title being studied. The results of this study indicate that the Supreme Court's Cassation Decision No. 2205 K/Pid.Sus/2022, stated that it rejected the cassation from the Cassation Applicant/Public Prosecutor to the Corruption Eradication Commission, with the consideration that the Cassation Applicant/Public Prosecutor could not prove that the judex facti decision did not meet the provisions of Article 253 paragraph (1) letters a, b, c of Law Number 8 of 1981 concerning Criminal Procedure Law. The Public Prosecutor at the KPK filed an appeal in case number 2205k/Pid.Sus/2022, namely that 1) the reason for the Public Prosecutor's appeal was because the judex facti (District Court) was wrong in applying the law, the judex facti had tried the Defendant in the a quo case not in accordance with the applicable criminal procedure law, and the judex facti did not exceed its authority, 2) That the reason for the Public Prosecutor's appeal was basically regarding the judex facti not applying the law or applying the law improperly because the judex facti stated that the Defendant was proven to have committed a crime as charged by the Public Prosecutor.

Abstract

This study discusses the problems of the legal system in the implementation of health services for the community in Indonesia. The main focus of this study is on the discrepancy between the applicable regulations and the implementation, which has an impact on the non-optimal health services. Factors such as weak coordination between agencies, limited human resources and health facilities, and lack of supervision over the implementation of regulations are the main obstacles. The research method used is a normative juridical approach by reviewing laws and regulations. The results of the study show the need for regulatory harmonization and strengthening of the supervision system to ensure fair and equitable health services. In addition, improving the quality of human resources and health infrastructure is a crucial factor in realizing optimal health services.

Abstract

This research aimed to analyze the legality of abortion by medical professionals for rape victims in Indonesia through the perspective of maqashid sharia. This study adopts a normative legal research approach, utilizing statutory interpretation (legal approach) and conceptual analysis (conceptual approach). The results of this study suggest that maqashid sharia emphasizes that abortions should not be performed arbitrarily and are only permissible in urgent situations that fulfill sharia objectives. This includes scenarios where the mother's life is at risk or serious medical conditions prevent the continuation of pregnancy. Such decisions should be made carefully, considering maslahah and mafsadat and involving consultations with medical experts and religious authorities. The maslahah principles elucidated by al-Tufi expand the flexibility in legal interpretation, allowing for Islamic law adaptation to contemporary needs and conditions. This is particularly relevant in abortion cases, where explicit guidance may not always be found in religious texts. Overall, the maqashid sharia approach to abortion underscores the importance of principles of justice, balance, and humanity in Islamic law. By considering all these aspects, Islamic law can provide relevant and adaptive guidance in addressing contemporary issues like abortion while remaining faithful to the primary objectives of sharia to achieve collective good and avoid harm. Penelitian ini bertujuan untuk menganalisis legalitas aborsi oleh tenaga medis bagi korban perkosaan di Indonesia melalui perspektif maqasid syariah. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan peraturan perundang-undangan (legal approach) dan pendekatan konseptual (conceptual approach). Temuan penelitian ini menunjukkan bahwa ada ketegangan antara norma hukum yang ketat dan prinsip-prinsip maslahat dalam maqasid syariah yang mengutamakan kesejahteraan dan perlindungan terhadap korban perkosaan. Hasil penelitian ini menunjukan bahwa maqasid syariah menekankan bahwa aborsi tidak boleh dilakukan sembarangan dan hanya diperbolehkan dalam situasi mendesak dan memenuhi tujuan syariah. Ini termasuk situasi di mana kelangsungan hidup ibu terancam atau kondisi medis yang serius tidak memungkinkan kehamilan berlanjut. Keputusan tersebut harus diambil dengan hati-hati, dengan mempertimbangkan maslahah (barang publik) dan mafsadat (bahaya), dan melibatkan konsultasi dengan para ahli medis dan otoritas agama. Prinsip-prinsip mashlahah yang dijelaskan oleh al-Tufi memperluas fleksibilitas dalam interpretasi hukum, memungkinkan adaptasi hukum Islam dengan kebutuhan dan kondisi kontemporer. Ini sangat relevan dalam kasus aborsi, di mana tidak selalu ada panduan eksplisit dalam teks-teks agama. Secara keseluruhan, pendekatan maqasid syariah terhadap aborsi menggarisbawahi pentingnya prinsip-prinsip keadilan, keseimbangan, dan kemanusiaan dalam hukum Islam. Dengan mempertimbangkan semua aspek ini, hukum Islam dapat memberikan panduan yang relevan dan adaptif dalam menangani isu-isu kontemporer seperti aborsi, sambil tetap setia pada tujuan utama syariah untuk mencapai kebaikan bersama dan menghindari bahaya.

Abstract

This study aims to determine the development of criminal law aspects within the framework of business competition law in Indonesia after the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of the Job Creation Law into Law, Government Regulation Number 44 of 2021, and Presidential Regulation Number 100 of 2024 concerning the Business Competition Supervisory Commission (KPPU). These regulatory reforms have brought significant changes to the competition law enforcement mechanism, especially in clarifying the position of criminal and administrative sanctions against business actors who engage in monopolistic practices and unfair business competition. This study examines the extent to which criminal norms in business competition law are accommodated in the latest regulations and their implications for the effectiveness of law enforcement by the KPPU. This study uses a normative juridical method with a statutory and conceptual approach. Data sources were obtained through literature studies of laws and regulations, legal literature, and relevant KPPU decisions. The analysis was carried out qualitatively to examine the appropriateness and effectiveness of the regulation and application of criminal sanctions within the framework of Indonesian business competition law. The results of the study show that although the enforcement of competition law is still dominated by administrative sanctions, strengthening the criminal aspect is needed as a form of deterrent effect and protection of a fair and healthy business climate.

Abstract

This study aims to analyze law enforcement against online gambling crimes in the North Sumatra Regional Police area, as well as to identify the legal strategies implemented by the police in dealing with these crimes. In addition, this study also aims to examine the active participation of the North Sumatra Regional Police in efforts to prevent and eradicate online gambling through preventive measures, public education, and cross-sectoral cooperation. By using a normative legal approach and qualitative methods, this study is expected to provide a comprehensive picture of the dynamics of online gambling law enforcement and the challenges faced by the police during the 2021–2024 period. The method used is a normative legal approach with data collection techniques through interviews with police officers and review of relevant legal documents. The results of the study show that the North Sumatra Regional Police implement preventive, educational, and repressive strategies in a sustainable manner. These strategies include blocking gambling sites, cyber patrols, public education, and taking firm action against perpetrators. The challenges faced include limited cross-country digital regulations and the rampant promotion of online gambling on social media. Therefore, collaboration between agencies is key to tackling online gambling. Effective law enforcement is expected to provide protection and a sense of security to the community and reduce the number of digital crimes in the North Sumatra region.

Abstract

General Background: Illegal gold mining has long served as a vital economic lifeline for communities in Lingga Bayu District, Mandailing Natal Regency. Specific Background: Despite its deep-rooted presence and socio-economic significance, such mining activities persist without formal governmental authorization, creating tension between legal norms and community livelihoods. Knowledge Gap: Existing legal enforcement often emphasizes punitive action, yet overlooks the structural socio-economic challenges faced by traditional miners. Aims: This study examines the implementation of criminal law enforcement against illegal gold mining and evaluates the fairness and justice outcomes of Decision Number 153/Pid.Sus/2023/PN Mdl by the Mandailing Natal District Court. Results: Findings indicate that while law enforcement adheres to normative legal standards and ensures legal certainty, it falls short in delivering substantive justice and long-term legal benefits for local miners. Novelty: The study highlights the misalignment between repressive legal mechanisms and the socio-cultural realities of community-based mining practices, advocating for a shift from a purely legalistic approach to one that is humanistic and transformative. Implications: The research suggests a need for integrative legal reform, including affirmative policies for people's mining legalization, to achieve holistic and sustainable justice for marginalized mining communities.
