Abstract

Illegal trade in protected wildlife is an environmental crime and the Conservation of Living Natural Resources and Ecosystems as specified in Law Number 5 of 1990 concerning the Conservation of Living Natural Resources and Ecosystems, illegal trade in protected wildlife is still rampant and it is very damaging to the environmental ecosystem. So that this research is to elaborate on the legal protection of endangered animals in sustainable management of biological natural resources, law enforcement against the trade in protected animals according to the Law on Conservation of Biological Natural Resources and Ecosystems, and the judge's consideration of decision 1360/Pid.B/Lh/2022/Pn.Lbp and decision 95/Pid.B.Lh/2022/Pn.Bj on protected animal trafficking syndicates. The method used in this thesis is the normative juridical research method carried out by means of library materials or secondary materials. So that the author uses the statutory approach method (statude approach) and case approach (case approach). The data analysis method used is qualitative. The trade of Orangutans as protected wildlife is a criminal offense as specified in Article 21 paragraph (2) in conjunction with Article 40 paragraphs (2) and (4) of Law No. 5 of 1990. In Decisions 1360/Pid.B/LH/2022/PN.Lbp and 95/Pid.B/LH/2022/PN.Bnj , the panel of judges whose cases handed down sentences against the defendants, but the criminals generally given by the panel of judges were limited to the substance of the defendants in Law No. 5 of 1990, even though what the defendants had done had harmed the environment and endemic animals that were on the verge of extinction, so the author requests the Supreme Court of the Republic of Indonesia to request a special court for handling the environment and protected animals.

Abstract

This journal discusses the phenomenon of Online Gender-Based Violence (OGBV) which is increasingly worrying in the digital era, especially related to the spread of non-consensual intimate content (NCII) or what is often referred to as "revenge porn." This study explores the factors that cause NCII, including abuse of trust, unsafe use of technology, and weak legal regulations. OGBV, as a form of gender-based violence, has profound psychological, social, and economic impacts on victims, including trauma, stigma, and career losses. In addition, this journal also discusses the prevention and protection efforts needed, such as increasing digital literacy, strengthening regulations, and collaboration between various stakeholders. It is hoped that with stronger measures, the threat of the spread of non-consensual intimate content can be minimized and protection for victims can be increased.

Abstract

Murder is one of the most serious crimes that not only violates criminal law provisions but also constitutes a fundamental violation of human rights, particularly the right to life that is inherent in every individual from conception and cannot be revoked by anyone except by God as the giver of life. The phenomenon of murder occurring in society, whether committed intentionally or unintentionally, is often triggered by motives of revenge or disputes between parties, thus requiring more serious and in-depth investigative handling compared to other criminal acts to thoroughly uncover cases. In the specific context of the legal jurisdiction of Belawan Port Police Resort, this normative legal research with a descriptive analytical and prospective approach examines the role of police in handling premeditated murder crimes, identifies inhibiting factors including the complexity of legal jurisdiction covering two jurisdictions (Medan City and Deli Serdang Regency), limited investigator experience, minimal operational budget, lack of facilities and infrastructure, and low public awareness in maintaining crime scenes, while analyzing efforts made by police to overcome these obstacles through preemptive activities in the form of legal counseling to the community, coordination with related activities. agencies for budget and infrastructure assistance, and capacity building for investigators through specialized training in handling criminal cases.

Abstract

Penelitian ini dilatarbelakangi oleh meningkatnya keterlibatan anak dalam tindak pidana, khususnya tindak pidana pengeroyokan yang mengakibatkan kematian. Fenomena ini memunculkan persoalan yuridis dan sosiologis terkait dengan perlindungan anak dalam sistem peradilan pidana, serta bagaimana penegak hukum menyeimbangkan antara kepentingan keadilan dan tujuan pembinaan terhadap anak pelaku tindak pidana. Rumusan masalah dalam penelitian ini meliputi: Pertama, Bagaimana pengaturan tindak pidana pengeroyokan yang mengakibatkan kematian yang dilakukan oleh anak? Kedua, Bagaimana relevansi sanksi pidana yang diancamkan terhadap anak pelaku tindak pidana pengeroyokan yang mengakibatkan kematian dengan tujuan pemidanaan? Ketiga, Bagaimana pertimbangan hakim dalam menjatuhkan sanksi pidana terhadap anak pelaku pengeroyokan yang mengakibatkan kematian dalam Putusan PN Sumber Nomor: 1/Pid.Sus-Anak/2022 dan PN Banjarmasin Nomor: 4/Pid.Sus-Anak/2024?. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kasus melalui studi terhadap dua putusan pengadilan anak tersebut. Data dikumpulkan melalui studi dokumen dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pengaturan mengenai tindak pidana pengeroyokan oleh anak diatur dalam Pasal 170 Kitab Undang-Undang Hukum Pidana dan disesuaikan dengan ketentuan dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, yang menekankan pendekatan keadilan restoratif dan diversi. Terdapat  perbedaan Sanksi pidana yang dijatuhkan dalam kedua putusan tersebut, hal ini karena Hakim memiliki kebebasan dalam menjatuhkan putusan, dalam hal ini kebijaksanaan Hakim  menjadi sangat penting dalam menentukan putusan terbaik bagi anak dan masa depan nya dengan mempertimbangkan faktor usia, latar belakang sosial, serta asas perlindungan anak. Kesimpulannya, pengaturan dan pelaksanaan pemidanaan terhadap anak pelaku pengeroyokan yang mengakibatkan kematian telah mengikuti prinsip perlindungan anak dan tujuan pemidanaan modern. Namun demikian, diperlukan konsistensi dalam penerapan sanksi pidana dan dukungan fasilitas rehabilitasi. Saran dari penelitian ini adalah peningkatan kapasitas lembaga pembinaan anak dan pelatihan khusus bagi aparat penegak hukum dalam menangani perkara anak.

Abstract

The rapid development of technology has resulted in the Criminal Procedure Code (KUHAP) not being able to accommodate criminal acts related to technology. In response to these conditions, the government issued Law Number 11 of 2008 concerning Electronic Information and Transactions which introduced electronic evidence as legal evidence. This recognition is also found in other special laws. However, scattered confessions have created uncertainty regarding the legal position of electronic evidence in the criminal justice system. As a result, the use of electronic evidence is less than optimal in the process of proving and resolving criminal cases. The purpose of this paper is to analyze the existence of electronic evidence as a valid form of evidence in Indonesia, then to identify obstacles to the use of electronic evidence in criminal justice in Indonesia and examine the urgency of regulating electronic evidence as a criminal law policy in criminal justice in Indonesia. The research method in this journal is normative legal research with a statutory regulation approach, comparative approach, case approach and historical approach.. The author uses secondary data sources consisting of primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques were carried out through literature study, then analyzed qualitatively. This research examines the position of electronic evidence in various special laws and its application in court decisions, then identifies obstacles related to procedures, understanding of law enforcement officials, and limited infrastructure, as well as explaining the urgency of ratifying the draft criminal procedure code (RKUHAP) to strengthen the legal basis for electronic evidence. The results of this research show that electronic evidence needs to be regulated in Indonesian criminal procedural law through updating the Criminal Procedure Code in order to provide legal certainty and facilitate the use of electronic evidence in Indonesian criminal procedural law.

Abstract

The rapid development of information technology has brought convenience to people's lives but also presents new challenges in the form of cybercrime, particularly Cyber Data breach which has serious impacts on personal data protection and individual privacy rights. Specifically, this research analyzes Cyber Data breach crimes from the perspective of Indonesian criminal law using normative juridical methods with statutory and case study approaches to Decision Number 2447/Pid.Sus/2024/PN Mdn, which shows that legal regulations regarding Cyber Data breach are still general and scattered across various regulations, especially the ITE Law and PDP Law, thus requiring crucial integration between these two laws so that prevention can be carried out comprehensively from both preventive and repressive aspects, where the panel of judges has applied the provisions of the ITE Law normatively and proportionally by using Article 30 paragraph (3) in conjunction with Article 46 paragraph (3) of the ITE Law as the legal basis for imposing imprisonment and fines on defendants who carried out unauthorized electronic information transfer.

Abstract

Tindakan pidana korupsi dalam pengelolaan anggaran Program Kartu Indonesia Pintar Kuliah (KIP-K) merupakan bentuk penyalahgunaan kewenangan yang berdampak pada tujuan pemerataan Pendidikan Tinggi di Indonesia. Penelitian ini bertujuan untuk menganalisis aspek yuridis terhadap Tindakan Pidana Korupsi berdasarkan studi kasus Putusan Nomor 81/Pid.Sus-TPK/2024/PN Mdn. Metode yang digunakan adalah yuridis normatif dengan pendekatan kasus. Hasil penelitian menunjukkan bahwa terdakwa terbukti secara sah dan meyakinkan menyalahgunakan kewenangannya, memperkaya diri sendiri, dan menimbulkan kerugian keuangan negara sebagaimana diatur dalam Pasal 2 dan Pasal 3 Undang-Undang Nomor 31 Tahun 1999 jo. Undang-Undang No 20 Tahun 2001 Tentang Pemberantasan Tindak Pidana Korupsi. Penelitian ini menyimpulkan bahwa pengawasan internal dan eksternal terhadap pengelolaan dana bantuan Pendidikan perlu diperketat guna mencegah terjadinya korupsi serupa dimasa depan.

Abstract

Credit card hacking (carding) constitutes a form of cybercrime in which offenders unlawfully access and use another person’s credit card for payment transactions without the owner’s consent or knowledge. This study aims to examine and analyze: (1) the legal framework governing the theft of credit card information that causes financial losses to customers through cyberspace; (2) the scope of criminal liability for such offenses; and (3) judicial considerations in Decision Number 240/Pid.Sus/2021/PN.Dps. The research focuses on relevant provisions in Indonesian law, specifically Article 30 paragraph (1) of Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 on Electronic Information and Transactions (ITE), which prohibits unauthorized access to another person’s computer or electronic system. In conjunction with Article 46 paragraph (1) of the ITE Law and Article 55 of the Criminal Code, these regulations form the legal basis for prosecuting carding offenses. Decision Number 240/Pid.Sus/2021/PN.Dps reflects the application of these provisions, where the court imposed penalties on perpetrators consistent with statutory mandates. This research underscores the significance of robust legal enforcement to address the evolving challenges of cybercrime and to safeguard public trust in electronic transactions.

Abstract

The University of North Sumatra (USU) as an educational institution is not free from theft crimes, but until now it has not had a specific policy in preventing these crimes. In fact, a safe and comfortable campus environment is very important for the smooth running of the teaching and learning process. This study aims to analyze the regulation of theft crime prevention at USU and the urgency of forming special regulations related to theft prevention on campus. This study uses a juridical-empirical method with a legislative approach and field studies through interviews with USU academics. The data used include relevant laws and regulations and interview results, which are then analyzed normatively-qualitatively. The results of the study show that USU does not have a specific policy in preventing theft crimes, so preventive measures are needed from internal parties and cooperation with the police. In addition, the urgency of forming prevention regulations on campus is very high in order to accommodate prevention efforts through improving facilities and infrastructure, improving the quality of security human resources, and implementing uniform SOPs. This regulation is expected to strengthen campus security and reduce crime rates in the USU environment.

Abstract

Law enforcement against children in conflict with the law (CICL) has unique characteristics compared to adults, as regulated under Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This study aims to analyze the judges' considerations in imposing sanctions on a child perpetrator of an assault crime based on Decision Number 14/Pid.Sus.Anak/2021/PN.Mdn. The research method employed is normative juridical with a statutory and case approach, focusing on the court's decision analysis. The results indicate that the judges’ considerations include juridical, sociological, and psychological aspects, such as the offender's age, family condition, the impact on the victim, and the objectives of the child's rehabilitation. The judge imposed a sentence by prioritizing the principle of the best interests of the child, restorative justice, and social reintegration efforts. However, there remain concerns regarding the consistency of the ruling with child protection principles, particularly concerning the effectiveness of rehabilitation and coaching programs. This study recommends that juvenile courts prioritize diversion as an alternative to formal court proceedings and optimize child rehabilitation institutions in accordance with applicable laws.
