Abstract

The Law on Sexual Violence constitutes a lex specialis provision in relation to the Criminal Code and other statutory instruments governing offenses of a sexual nature. Sexual offenses represent a category of crime encompassing diverse manifestations and demonstrating a continuous upward trajectory annually. The promulgation of this legislation is intended both as a mechanism to instill a preventive and punitive impact upon offenders and as a safeguard to ensure the protection of individuals subjected to sexual victimization. This inquiry employs a normative-juridical mode of legal scholarship with a descriptive-analytical orientation, utilizing a legislative framework approach in conjunction with a conceptual perspective. The research techniques applied encompass a bibliographic exploration alongside an empirical dimension, the latter undertaken through direct dialogues with members of the judiciary. From the findings and deliberations presented in this thesis, it can be inferred that legal provisions governing criminal acts of sexual violence, though previously dispersed across multiple statutory instruments, are now comprehensively consolidated under Law Number 12 of 2022 concerning Crimes of Sexual Violence. The imposition of criminal liability upon offenders of sexual crimes necessitates the fulfillment of three essential elements: the presence of fault, the capacity for accountability, and the absence of exculpatory grounds, with criminal sanctions expressly guided by the aforementioned law. Furthermore, an examination of Medan District Court Decisions No. 73/Pid.Sus/2023/PN Mdn and No. 1448/Pid.B/2023/PN Mdn shows that Law No. 12 of 2022 is not yet optimally enforced, especially in sentencing, restitution, and rehabilitation.

Abstract

Abstract: The principle of guaranteeing legal certainty and certainty of land rights is also a principle that applies in Indonesian land law. There are several modus operandi or techniques of operating methods used by land mafia perpetrators in committing crimes, including falsifying documents, illegal or unlawful occupation (wilde occupatie), seeking legality in court, engineering cases, collusion with certain officials to obtain legality, corporate crimes such as embezzlement and fraud, falsification of land rights management powers, conducting land sales and purchases that are carried out as if they were formal, and the loss of land certificates. The research method used in this writing is the normative legal research type. The research approach used is the statute approach and the case approach. Data sources in this study include primary, secondary and tertiary legal materials. The data collection technique used in this study is library research with a document study data collection tool (documentary research). To analyze all the legal materials that have been collected, this study uses qualitative data analysis. Thus, the comprehensive steps that have been taken by the Prosecutor's Office are by issuing Circular Letter of the Attorney General Number 16 of 2021 concerning the Eradication of Land Mafia. Keyword: Prosecutor, Eradication, Mafia, Land. Abstrak: Prinsip jaminan atas kepastian hukum dan kepastian hak atas tanah juga merupakan prinsip yang berlaku dalam hukum tanah Indonesia. Ada beberapa modus operandi atau teknik cara-cara beroperasi yang digunakan oleh pelaku mafia tanah dalam melakukan kejahatan antara lain melakukan pemalsuan dokumen, pendudukan ilegal atau tanpa hak (wilde occupatie), mencari legalitas di pengadilan, rekayasa perkara, kolusi dengan oknum aparat untuk mendapatkan legalitas, kejahatan korporasi seperti penggelapan dan penipuan, pemalsuan kuasa pengurusan hak atas tanah, melakukan jual beli tanah yang dilakukan seolah-olah secara formal, dan hilangnya warkah tanah. Metode Penelitian yang dipakai dalam penulisan ini yaitu jenis penelitian hukum normatid. Pendekatan penelitian yang digunakan yaitu pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Sumber data dalam penelitian ini meliputi bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah dengan studi kepustakaan (library research) dengan alat pengumpul data studi dokumen (documentary research). Untuk menganalisis seluruh bahan hukum yang telah terkumpul, dalam penelitian ini menggunakan analisis data kualitatif. Dengan demikian, adapun langkah komprehensif yang telah dilakukan oleh Kejaksaan yaitu dengan menerbitkan Surat Edaran Jaksa Agung Nomor 16 Tahun 2021 tentang Pemberantasan Mafia Tanah. Kata kunci: Kejaksaan, Pemberantasan, Mafia, Tanah.

The resultsofthe study statethattheDominusLitisprinciple in Law Number 8 of 1981 concerningCriminalProcedure Law is not regulatedatall, thereisnodirectinvolvementofprosecutors in caseexaminationssuch as examinationofsuspects, witnessesandotherevidencesothatthedominuslitisprincipleis not visible in theCriminalProcedure Code. Thisiswhatcausesthebackandforthofcaseexaminationsbecausethevisionofprosecutorsandinvestigators in examiningcriminalcasesbeinghandledis not aligned. The applicationoftheDominusLitisprinciple in thepre-prosecutionprocessconsistsof 2 obstacles, namely internal obstaclesandexternalobstacles.  Keyword:Prosecutor’s, Dominus Litis, RUUHAP  Abstrak: Dalam praktik penegakan hukum, jaksa tidak lagi bersifat dominuslitis secara aktif. Padahal, dengan terlibat aktif sejak tahap penyidikan di kepolisian, jaksa dapat dengan mudah menyusun surat dakwaan dan tuntutan, sehingga hal ini mendorong adanya revisi asas DominusLitis dalam RUUHAP. Tujuan penelitian adalah menganalisis implementasi asas DominusLitis dalam proses prapenuntutan dan konsepsi ideal asas DominusLitis dalam RUUHAP. Hasil penelitian menyatakan bahwa Asas DominusLitis dalam Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana sama sekali tidak diatur, tidak ada keterlibatan langsung Jaksa dalam pemeriksaan perkara seperti pemeriksaan tersangka, saksi dan alat bukti lainnya sehingga asas dominuslitis secara kasat mata tidak terlihat dalam KUHAP. Hal inilah yang menyebabkan terjadinya bolak-balik pemeriksaan perkara karena visi Jaksa dan penyidik dalam memeriksa perkara pidana yang ditangani belum sejalan. Penerapan asas DominusLitis dalam proses prapenuntutan terdiri dari 2 hambatan, yaitu hambatan internal dan hambatan eksternal.   Kata kunci: Jaksa, DominusLitis, RUUHAP

Abstract

Abstract: This article analyzes the construction of criminal acts of murder, comparing ordinary murder (Article 338 of the Criminal Code) with premeditated murder (Article 340 of the Criminal Code), using the Ferdy Sambo case study (Decisions No.796/Pid.B/2022/PN Jkt.Sel, No.53/Pid/2023/PT DKI, and 813 K/Pid/ 2023). Criminal law imposes varied penalties; unpremeditated murder faces 15 years, while premeditated murder can result in death, life imprisonment, or 20 years. The Ferdy Sambo case, involving the murder of Brigadier YS on July 8, 2022, was charged under Article 340 of the Criminal Code. This research uses a normative descriptive analytical method. Ferdy Sambo was sentenced to death by the District Court and High Court, but the Supreme Court's cassation revised it to life imprisonment due to a dissenting opinion. Analysis shows the Judges inadequately considered subjective elements and lacked psychological expert opinion to assess the perpetrator's mental state for the "with prior planning" element of Article 340 of the Criminal Code. Additionally, no clear legal facts supported common intent (co-participation) between the defendant and RE as required by Article 55 Paragraph 1 Point 1 of the Criminal Code.Keyword: Premeditated Murder, Article 340 Criminal Code, Ferdy Sambo, Legal Analysis, Court Decision.Abstrak: Artikel ini menganalisis konstruksi tindak pidana pembunuhan, membandingkan delik pembunuhan biasa (Pasal 338 KUHP) dengan pembunuhan berencana (Pasal 340 KUHP), menggunakan studi kasus Ferdy Sambo (Putusan No.796/Pid.B/2022/PN Jkt.Sel, No.53/Pid/2023/PT DKI, dan 813 K/Pid/ 2023). Hukum pidana memiliki sanksi bervariasi; pembunuhan tanpa rencana diancam 15 tahun penjara, berencana dapat pidana mati, seumur hidup, atau 20 tahun. Kasus Ferdy Sambo, pembunuhan Brigadir YS pada 8 Juli 2022, didakwa dengan Pasal 340 KUHPidana. Penelitian ini menggunakan metode normatif deskriptif analitis. Ferdy Sambo divonis mati di PN Jakarta Selatan dan PT DKI, namun di kasasi MA diubah menjadi pidana penjara seumur hidup karena dissenting opinion hakim. Analisis menunjukkan Majelis Hakim kurang tepat mempertimbangkan unsur subjektif dan kurangnya pandangan ahli psikologi untuk mengukur kondisi mental pelaku dalam pembuktian unsur "dengan rencana terlebih dahulu" pada Pasal 340 KUHP. Juga, tidak ada fakta hukum jelas mengenai kesamaan kehendak (turut serta) antara terdakwa dan RE sebagai syarat Pasal 55 Ayat 1 Ke-1 KUHP. Kata kunci: Pembunuhan Berencana, Pasal 340 KUHP, Ferdy Sambo, Analisis Hukum, Putusan Pengadilan.

Abstract

Implementing jinayat law enforcement in Sabang of Aceh Province experiences a dualism of settlement, which causes legal uncertainty. This can be observed in practice where the Sabang District Court instead adjudicates cases that should be under the jurisdiction of the Sabang Sharia Court. This article elaborates on the dualism in the settlement that occurs and identifies the causes of the dualism in the settlement of criminal cases using Soerjono Soekanto's law enforcement factor theory. Based on that, efforts were found that could be made to overcome this dualism. The analysis results indicate that the dualism of settlement can be observed through 6 (six) cases that should be under the jurisdiction of the Sabang Sharia Court but were adjudicated by the Sabang District Court, the majority of which are minor-related cases. There are cases where the same defendant is tried in close succession in both judicial institutions for similar acts with different victims. It happens due to various factors, such as the legal factor: inadequate provisions regarding minors at Qanun Jinayat. Law enforcer factor: other views on minor-related cases and a lack of precision in implementing existing law. Facilitating factor: unavailability of detention rooms at Sabang Sharia Court and budget for executions. Society factors: public lack of legal knowledge. Based on the results of this identification, efforts can be made to include professional law enforcement, harmonization of judicial authority through internal agency regulations, and evaluation of moral offenses in the Qanun Jinayat.

Abstract

Based on article 42 of Law Number 30 of 2002, KPK is given authority to coordinate and control investigation and prosecution of criminal cases of corruption carried out jointly by persons subject to the General and Military Court. However, KPK encounters problems in investigating TNI members together with civilians, as happened in the Basarnas case. This normative legal research uses statute approach and conceptual approach, in order to provide a view for harmonization of regulations related to the KPK's connectivity authority. The results show that it is necessary to change the definition of "military criminal offenses" in Military Court Bill, statutory regulations related to organizational structure of KPK and origin of institutions where KPK Investigators/Prosecutors come from, which can only be filled by National Police, Prosecutors, and Special Civil Servant. It is necessary for KPK to have a special Deputy for handling connectivity cases and Investigators who come from military.

Abstract

The increasing abuse of Narcotics in Indonesia is increasingly widespread and almost impossible to prevent. Therefore, it is necessary to increase understanding by all parties in eradicating the circulation of Narcotics. In the Narcotics Criminal Act emphasized the role of the community to actively participate in fighting narcotics crimes. For this reason, it is necessary to provide legal counseling to the public in providing an understanding as an effort to prevent narcotics crime, especially in Bantan Timur Village, Medan Tembung District, so that the public can understand how terrible and dangerous it is due to narcotics abuse. Community service is expected to contribute to the people of Bantan Timur Village both theoretically and practically in preventing the rampant circulation of narcotics. The approach method used in community service activities is: in the form of outreach to the community about prevention of narcotics control and a participatory approach, meaning that participants are required to be active in participating during the activity. The output of this activity, in addition to increasing public knowledge about the dangers of narcotics and efforts to prevent narcotics control in East Bintan Village, also provides valuable information and solutions that drugs, apart from having an impact on law violations, also have an impact on medical and psychological problems.

Abstract

Penyimpanan barang bukti narkotika yang telah mendapat keputusan untuk dimusnahkan menimbulkan risiko potensial seperti penyebaran kembali ke masyarakat atau penyalahgunaan oleh individu yang tidak bertanggung jawab. Terdapat fakta bahwa banyak barang bukti narkotika yang telah memiliki keputusan hukum tetap masih disimpan sementara karena berbagai kendala, termasuk keterbatasan jumlah atau hambatan lainnya. Penelitian ini mengangkat permasalahan terkait pengaturan kewenangan jaksa dalam menangani barang bukti tindak pidana narkotika, pelaksanaan peran jaksa dalam konteks tersebut, dan upaya serta hambatan yang dihadapi oleh jaksa dalam menangani barang bukti narkotika. Metodologi penelitian yang diterapkan bersifat normatif dengan dukungan data empiris dari hasil wawancara dengan pendekatan analisis deskriptif, dengan fokus pada aspek perundang-undangan. Pengumpulan data dilakukan melalui studi kepustakaan serta wawancara sebagai tambahan informasi. Dalam ranah hukum Indonesia, kewenangan jaksa terhadap barang bukti narkotika diatur dalam Pasal 270 hingga 276 KUHAP, Pasal 30 ayat (1) huruf b UU No. 11 Tahun 2021 tentang Kejaksaan RI, dan Pasal 91 Ayat 1 UU No.35 Tahun 2009 tentang Narkotika yang memberikan wewenang dalam menentukan status barang narkotika. Peran jaksa dalam penanganan barang bukti narkotika dijelaskan dalam SOP Kejaksaan RI No. 2 Tahun 2022 pada Bab III yang meliputi pencatatan, penelitian, penyimpanan, pemeliharaan, pengamanan, penyediaan, pengembalian, dan penyelesaian barang rampasan. Hambatan yang dihadapi melibatkan faktor internal dan eksternal, namun upaya preventif dan represif telah ditempuh untuk mengatasinya. Upaya ini difokuskan pada penyelesaian faktor internal dan eksternal dalam penanganan barang bukti narkotika. Penelitian ini menyoroti pentingnya peran jaksa dalam menangani barang bukti narkotika, sambil menekankan perlunya upaya yang lebih efektif dalam mengatasi hambatan demi perbaikan penanganan di masa depan.

Abstract

Abstract: Legal protection for children is all activities to guarantee and protect children and their rights so that they can live, grow, develop, participate optimally in accordance with human dignity and receive protection from violence and discrimination. This study aims to answer the problems of How is legal protection for children as perpetrators of criminal acts of abuse in the Indonesian Child Criminal Justice System, How is the implementation of legal protection for children as perpetrators of criminal acts of abuse in the Medan Police Headquarters Jurisdiction, and What are the obstacles encountered by investigators at the Medan Police Headquarters in providing legal protection for children as perpetrators of criminal acts of abuse. The method used in this thesis research is an empirical research method, namely legal research that obtains its data from primary data or data obtained directly from the community. This research is descriptive, and the data analysis method used is descriptive qualitative. The results of the research on legal protection for children as perpetrators of crimes in the Juvenile Criminal Justice System can be seen from the legal process, starting from the investigation stage, arrest and detention, prosecution, trial, and guidance. In the implementation of providing protection, the concept of diversion is prioritized to achieve restorative justice that applies to children under 12 (twelve) years old and does not commit repeat crimes (recidivism). In this case, the obstacles encountered by investigators in providing protection are law enforcement who are not equipped with an understanding of child cases, legal factors that have not provided alternatives regarding mechanisms in implementing diversion and factors of facilities and infrastructure that are inadequate. Keyword: Legal Protection, Children as Perpetrators, Abuse, Investigation Abstrak: Perlindungan hukum terhadap anak adalah segala kegiatan untuk menjamin dan melindungi anak dan hak-haknya agar dapat hidup, tumbuh, berkembang, dapat berpartisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan serta mendapat perlindungan dari kekerasan dan diskriminasi. Dalam penelitian ini bertujuan untuk menjawab permasalahan Bagaimana perlindungan hukum terhadap anak sebagai pelaku tindak pidana penganiayaan dalam Sistem Peradilan Pidana anak di Indonesia, Bagaimana pelaksanaan perlindungan hukum terhadap anak sebagai pelaku tindak pidana penganiayaan di Wilayah Hukum Polrestabes Medan, dan Apa saja hambatan-hambatan yang ditemui oleh Penyidik di Polrestabes Medan dalam memberikan perlindungan hukum terhadap anak sebagai pelaku tindak pidana penganiayaan. Metode yang digunakan di dalam penelitian tesis ini adalah metode penelitian empiris yaitu penelitian hukum yang memperoleh datanya dari data primer atau data yang diperoleh langsung dari masyarakat. Penelitian ini bersifat deskriptif, dan metode analisa data yang digunakan adalah deskriptif kualitatif. Hasil penelitian perlindungan hukum terhadap anak sebagai pelaku tindak pidana dalam Sistem Peradilan Pidana Anak dapat dilihat dari proses hukum, mulai dari tahap penyidikan, penangkapan dan penahanan, penuntutan, persidangan, dan pembinaan. Pada pelaksaanaan dalam memberikan perlindungan lebih mengutamakan konsep diversi untuk tercapainya keadilan restoratif (restorative justic) yang berlaku pada anak umur dibawah 12 (dua belas) tahun dan tidak melakukan pengulangan kejahatan (residivis). Dalam hal ini hambatan yang didapat pihak penyidik dalam memberikan perlindungan yaitu penegak hukum yang kurang dibekali pemahaman tentang kasus anak, faktor hukum yang belum memberikan alternatif mengenai mekanisme dalam penerapan diversi dan faktor sarana dan prasana yang belum memadai. Kata Kunci: Perlindungan Hukum, Anak Sebagai Pelaku, Penganiayaan, Penyidikan
