Abstract

Anak perlu mendapatkan perlindungan karena anak merupakan generasi yang berharga bagi negara di masa depan. Setiap anak memiliki hak yang sama tanpa adanya pengecualian. Permasalahan-permasalahan HAM anak secara umum menggambarkan bahwa persoalan pemenuhan dan perlindungan atas Hak Anak masih menjadi catatan tersendiri bagi negara ini. Selain itu persoalan pemenuhan Hak Anak ini tidak hanya berkaitan dengan tanggung jawab tunggal negara melainkan juga membutuhkan peran serta orang tuanya, masyarakat sekitar dan lembaga masyarakat untuk mengadvokasinya. Terlebih masa depan bangsa ini berada di tangan anak muda. Maka menjaga anak dari segala kerentanan dari pelanggaran hak asasinya adalah suatu keniscayaan apabila kita menginginkan masa depan Indonesia yang lebih baik lagi.

Abstract

Setiap anak mempunyai harkat dan martabat yang patut dijunjung tinggi Hak-haknya, anak harus mendapat kesempatan seluasnya untuk tumbuh dan berkembang secara optimal baik fisik, mental, sosial, maupun sipiritual, termasuk dalam hal ini anak yang berhadapan dengan Hukum juga memilik hak yang harus dilindungi oleh Negara, untuk mewujudkan perlindungan hak asasi anak Balai Pemasyarakatan memiliki peranan strategis dalam melindung hak-hak anak berhadapan dengan hukum, salah satu perlindungan hak anak adalah adanya pendampingan pada saat anak dihadapkan dalam persidangan anak di pengadilan sehingga anak terjamin hak-haknya selama persidangan berlangsung. Prapenelitian yang dilakukan di Balai Pemasyarakatan Kota Padang ditemukan bahwa tidak semua anak yang berhadapan dengan hukum pada proses Persidangan di Pengadilan Negeri Kelas 1A Padang di dampingi oleh Pembimbing Kemasyarakantan padahal, setiap anak yang berhadapan dengan hukum wajib di dampingi oleh Pembimbing Kemasyarakatan sehingga dalam hal ini penulis fokus untuk melihat proses pelaksanan pendampingan tersebut.

Abstract

Genocide as the most serious crime is specifically regulated in international law. The regulation of genocide is contained in the Convention on the Prevention and Punishment of the Crime of Genocide 1949. Specific intent or dolus specialis is the main element in proving genocide. This special intention distinguishes genocide from other crimes. However, the existence of this special intent is often a source of controversy in international law enforcement practice. The lack of clarity in defining and proving special intent often causes difficulties in the judicial process, and can result in injustice for victims. This article discusses two problem formulations, firstly how the concept of dolus specialis is applied in proving the crime of genocide and secondly how the law enforcement of acts of genocide in the perspective of international law. This article uses normative juridical method. The results of this study show that special intent focuses on the perpetrator's intention to destroy a particular group, for example a statement by a high-ranking official indicating an intention to commit genocide, but in practice this is difficult to prove. Law enforcement against acts of genocide can be held accountable to the state and individuals concerned. Keywords : Keywords : Genocide, Intent, International Law Enforcement

Abstract

To support the implementation of the implementation of political party activities cannot be separated from the existence of large financial support. In the process of traveling political parties, political party funds come from contributions from party politicians, legitimate contributions in accordance with legal provisions; as well as financial assistance from the APBN and APBD from the government. Through the funds generated, an accountable and transparent report is needed to the public in order to create legal certainty and prevent acts of corruption originating from the party's funds. So through this research the authors underline the 2 (two) formulation of the problem that is important to be discussed. First, what is the urgency of disclosing political party financial information in preventing cultural practices of corruption in Indonesia? And Second, how is the accountability of political party financial funds sourced from APBN and APBD funds in Indonesia? This research uses the type of normative juridical research. The data used in the research comes from primary legal materials, secondary legal materials and literature studies from various literatures. The results of this study note that the form of political party financial reporting must record all sources of receipt of funds for the party and not only be accountable for funds originating from the APBN and APBD, then with regard to sanctions there must be strict action taken by the government not only the imposition of administrative sanctions imposed against a party.

Abstract

Forcible transfers or forced displacements due to an international or non-international war often happen and cause suffering to those who become displaced by loss of their homes and livelihoods and survival resources. As an example of the current situation, there are many civilians from Gaza, especially Palestinians, who have had to leave their homes and have to seek shelter. Alarmingly, some of them have fled to refugee camps that have been housing Palestinian refugees since the 1948 and 1967 conflicts with limited conditions. While, it is commonly known that evacuation should only be temporary. This fact invites us to discuss and answer the following questions: 1) How is the rule of international humanitarian law or the law of war regarding the transfer of population and civilians in time of war?; 2) How could the displacement of civil population and civilian in time of war amount to genocide or ethnic cleansing?; and 3) How is the law enforcement against the violations of international humanitarian law on the transfer of civilian population? It is expected that the answers of these questions could be a reference to comment any news of displacement due to armed conflict. To answer these questions, normative research is conducted by literature study for collecting secondary data from international treaties and other sources of international law such as customary international law, court rulings, expert opinions and information or news from the field, including the implementation of international law in Indonesian national legislation. Analysis of data for taking conclusion is carried out qualitatively, and the reporting is made in an explanatory descriptive manner. The results showed that the international humanitarian law system has contained sufficient rules containing certain prohibitions and obligations for parties to the conflict. There are several prohibitions against deportation and forcible transfer of population. There are several obligations to prevent the forcible transfer or forced displacement of population. There are several obligations to strive for the safety and fulfillment of basic needs of civilians in the event of evacuation and to ensure that the displaced civilians can immediately return to their places of origin. In circumstances, acts that cause forcible transfers or forced displaced civilians might be categorized as war crimes, crimes against humanity and/or genocide. Concerning the violations of the international humanitarian law relating the forcible transfer of civilian population due to war, the state is obliged to carry out the law enforcement against the persons involved who are under its jurisdiction. In addition, no State shall be allowed to absolve itself of any liability incurred by itself in respect of breaches referred to the rules discussed

Abstract

Sale and purchase binding agreement, of course, a notary can provide legal counseling, namely by explaining to the parties, that the binding sale and purchase agreement made should be based on a land certificate, because the ownership of a certificated land right has been registered at the Land Office which has legal certainty, protection law and can prove himself as the holder of the land rights. However, in practice, the binding sale and purchase agreement in Kampar Regency is made using a letter of compensation (SKGR) so it is very straightforwardproblems to occur which can cause losses. The method used is empirical juridical which emphasizes the reality in the field associated with legal aspects or applicable laws and regulations regarding the object of research. The binding sale and purchase agreement should be made using a land certificate instead of using a letter of compensation and based on its authority the notary should be able to provide legal counseling to the parties before the binding sale and purchase agreement is made so that the urgent sale and purchase agreement can be carried out properly.

Abstract

The development of science also has a significant impact on the development of good health service provision. One of the developments in the field of health services is the renewal of electronic medical records. Where the benefits of electronic medical records are of course as a basis or guide to knowing and analyzing diseases and knowing the treatment, care and medical action that must be given to patients, as well as improving the quality of service to protect medical personnel in the promotion of optimal public health. Then this electronic medical record can also be used as a type of evidence to be able to make light of a certain legal event. The medical legal basis for electronic records is evidence based on Law Number 29 of 2004 concerning Medical Practice and Law Number 11 of 2008 concerning Information and Electronic Transactions. Then this research is a normative research or library research that will examine the urgency of proving electronic medical records based on a legal perspective in Indonesia.

Abstract

Pasal 51 piagam PBB mengatur hak menggunakan kekuatan bersenjata untuk membela diri bagi suatu negara. Berdasarkan pasal ini, penggunaan kekuatan bersenjata untuk membela diri bagi negara adalah sah. Namun ketentuan ini dinilai kurang jelas dalam mengatur batasan penggunaan kekuatan bersenjata untuk pertahanan diri. Oleh karena itu, legalitas penggunaan senjata ini sebagai pertahanan diri juga perlu ditinjau kembali dari ketentuan yang tertuang dalam Space Treaty 1967. Penelitian ini bertujuan untuk mengetahui legalitas penggunaan kekuatan bersenjata untuk pertahanan diri dan upaya menjaga perdamaian dan keamanan internasional serta penggunaan senjata pencegat rudal berbasis ruang angkasa. ruang menurut Piagam PBB dan Perjanjian Luar Angkasa 1967. Metode yang digunakan adalah yuridis normatif yang merupakan penulisan hukum sastra. Hasil kajian menunjukkan bahwa penggunaan pencegat rudal berbasis antariksa sebagai upaya pertahanan diri adalah sah baik berdasarkan Pasal 51 Piagam PBB maupun Pasal III Perjanjian Antariksa 1967, namun berdasarkan ketentuan Pasal yang kurang jelas. 51 Piagam PBB, ada batasan hukum penggunaan senjata ini sebagai alat pertahanan diri. Legalitas penggunaan senjata tersebut terbatas pada penggunaannya untuk mencegat rudal yang sudah aktif atau sedang terbang di wilayah negara yang bertindak sebagai aktor pertahanan diri dan di wilayah yang tidak ada kedaulatannya. Selain itu, berdasarkan resiko atau akibat dari pencegatan rudal tersebut, khususnya rudal dengan hulu ledak nuklir untuk pertahanan diri negara dan negara lain, maka upaya pencegatan rudal tersebut melalui penggunaan pencegat rudal berbasis antariksa dapat dilegalkan sebagai upaya pertahanan diri.

Abstract

Kesehatan merupakan salah satu unsur kesejahteraan bagi manusia, yang harus diwujudkan sesuai cita-cita Bangsa Indonesia yang tertera dalam UUD45, Universal Declaration of HumanRights (UUDHR), UUKesehatan, UUPraktik Kedokteran, UU Rumah sakit, KUHperdata dan ketentuan terkait lainnya. Pelayanan kesehatan merupakan alat yang digunakan untuk menyelenggarakan upaya kesehatan, baik promotif, preventif, kuratif maupun rehabilitative, yang dilakukan oleh Pemerintah, Pemerintah Daerah, dan/atau masyarakat. Praktik kedokteran merupakan rangkaian kegiatan yang dilakukan oleh dokter … terhadap pasien dalam melaksanakan upaya kesehatan. Hal ini merupakan hubungan hukum berupa persetujuan yang disebut persetujuan terapeutik. Persetujuan ini memiliki sifat yang khusus karena objek yang diperjanjikan adalah upaya atau terapi untuk penyembuhan pasien. Menariknya ini untuk diteliti dengan rumusan masalah, Bagaimana pelaksanaan persetujuan tindakan kedokteran dalam pemenuhan hak pasien di Semen Padang Hospital? Metode penelitian digunakan yuridis empiris, dan hasil yang ditemukan ternyata persetujuan ini memang persetujuan khusus, yang disebut inspaning verbintenis, dan pelaksanaannya di Semen Padang Hospital (SPH) telah sesuai ketentuan terkait. Setiap perjanjian terapeutik selalu didahului dengan informed Consent (IC) yang merupakan alat bukti terjadinya persetujuan terapeutik baik dilakukan lisan atau tertulis. Di SPH IC selalu dilakukan meskipun dalam kondisi gawat.

Abstract

Soil is one part of the earth that has a close relationship with human life, it can even be said that every human being is related to land. Article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia stipulates that: Earth, air and the natural resources contained therein are controlled by the State and used for the greatest prosperity of the people. However, land disputes still arise in the community, therefore this thesis takes the title of land ownership dispute resolution at the Solok City Land Office (a case study of land disputes between PT Gelora Ganto Sejahtera and Syamsu Tulus). In this writing, the problem formulation is 1. How to settle land disputes at the Solok City Land Office. 2 How is the authority of the Solok City land office in resolving land disputes. 3. What are the results of land dispute resolution at the Solok City Land Office. In writing this research, the method used is empirical juridical. Empirical juridical research is an approach by looking at a legal reality in society. The research conducted in this paper is descriptive analytical in nature, namely a form of research that aims to describe the applicable laws and regulations, associated with legal theories and the practice of implementing positive law. Disputes are situations and conditions in which people experience factual conflict or release according to their warnings. Land disputes can be resolved in 3 (three) ways, namely: a) Settlement by deliberation. b) Settlement through the judiciary, namely submitted to the general court in a civil or criminal manner. Based on this research, there is a land rights dispute that has been issued with a building use rights certificate in the name of PT. GGS entered. Then Samsyu Tulus objected that the settlement was carried out at the Solok City Land Office, then the settlement was not reached so that it entered the litigation route or went to court, from this research it was concluded that the Land Dispute Settlement in Solok City could be carried out on the basis of public complaints. The results of the mediation that have been agreed upon will result in changes to data, which can be in the form of a decision to cancel land rights, cancel certificates and also change data on certificates, measurement papers, land books and/or other public registers.
