Abstract

The doctor's service at a hospital, becomes the future cycle of the hospital itself in the middle of society. The impact of a service and the acceleration of services performed by doctors and other medical personnel will have an impact, both positive and negative, on the image of the hospital. Legal questions that may arise from the hospital service when the medical action that should be performed by the doctor responsible for the patient but carried out by the general practitioner. Medical action carried out by a caregiver against a patient will be a legal issue for doctors and hospitals when such action is detrimental to the patient, while such an action is a fulfilment of the duty that should be performed by the Patient Responsible Doctor.

Abstract

Notaries in carrying out their duties for the general public are required to be under the supervision of an institution that is neutral, impartial, and independent. The purpose of this supervision is so that the Notary seriously carries out the duties of his office in accordance with applicable rules and codes of ethics in order to maintain the security of the public who make deeds to the public. Notary Public. Another aim is to avoid Notaries who are irresponsible and do not comply with the Notary's code of ethics. The establishment of a supervisory institution is referred to in Article 1 point 6 of the UUJN which states that the Notary Supervisory Council, hereinafter referred to as the Supervisory Council, is a body that has the authority and obligation to carry out guidance and supervision of Notaries. In Solok City in 2022 there will be eight Notaries, whereas in the examination carried out by the Solok City Regional Supervisory Council in 2022 only four Notaries were examined. Based on this, researchers are interested in conducting further research by analyzing: 1) the implementation of the authority of the Regional Notary Supervisory Council in examining Notary Protocols in Solok City. 2) the obstacles and efforts of the Regional Notary Supervisory Council in carrying out inspections of Notary Protocols in Solok City. This research is descriptive analytical, using an empirical juridical approach. Using primary data as the main material with a study of secondary legal materials. Based on research, it was found that: the implementation of the authority of the Solok City MPD in examining Notary protocols has carried out guidance and supervision related to the implementation which was carried out in 2022, there were around four out of eight Notaries who were not examined. The problem with MPD is that when MPD carries out inspections, several Notaries are not in their offices at the time of the inspection. Which results in Notaries not being checked by the MPD. Efforts made by the MPD were to summon the Notary concerned to appear at the Regional Office of the Ministry of Law and Human Rights to have the protocol checked by the Chair of the MPD and notaries who were not examined were made a priority in the examination for the following year.

Abstract

In the healthcare service process, hospitals often face legal issues. This involves actions by hospitals that tend not to meet the expectations of patients or their families. The issues addressed in this research are: first, how is the legal certainty of hospital immunity rights regulated in health laws? Second, how is legal protection provided to patients who suffer losses due to negligence or errors by hospitals related to immunity rights under health laws? The research method used is a Juridical Normative/doctrinal approach that examines legislative approaches with literature study data collection techniques. The findings of this research conclude that: firstly, hospitals have been granted adequate legal immunity protection as stated in Article 192 paragraphs 1 and 2, where hospitals are immune as long as they do not violate laws and ethical codes, using immunity to carry out their duties. Secondly, hospitals are responsible for negligence by healthcare personnel causing patient harm, thus hospitals operate according to operational and healthcare service standards to minimize negligence resulting in patient harm. The hospital's responsibility towards patients suffering losses is governed by Article 193 of the Health Law.

Abstract

Bentuk upaya negara dalam memberikan pelayanan kesehatan kepada warga negara Indonesia diwujudkan melalui penyelenggaraan Program Jaminan Kesehatan Nasional (JKN) yang dikelola oleh Badan Penyelenggara Jaminan Sosial Kesehatan (BPJS Kesehatan). Pemerintah terus berupaya meningkatkan mutu pelayanan kesehatan dengan melakukan pembaruan aturan dan kebijakan, salah satunya adalah perubahan skema kelas rawat inap yang sebelumnya terbagi menjadi kelas 1, 2, dan 3 menjadi kelas rawat inap standar. Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaturan Kelas Rawat Inap Standar BPJS Kesehatan serta hak pasien dalam menentukan pelayanan kesehatan yang diperlukan dalam konteks Kelas Rawat Inap Standar tersebut. Metode yang digunakan adalah penelitian hukum normatif, yaitu dengan menganalisis peraturan perundang-undangan dan data hukum sekunder lainnya untuk menarik kesimpulan. Hasil penelitian menunjukkan bahwa Kelas Rawat Inap Standar merupakan standar minimum pelayanan yang diterima oleh peserta BPJS Kesehatan berdasarkan 12 kriteria yang harus dipenuhi oleh rumah sakit menuju kelas tunggal. Penerapan standar ini mencerminkan prinsip sosial dan ekuitas dalam penyelenggaraan jaminan kesehatan nasional. Namun, pelaksanaan ini dinilai belum sepenuhnya sesuai dengan tanggung jawab negara dalam menyediakan fasilitas pelayanan kesehatan yang layak, sehingga setiap individu dapat mencapai derajat kesehatan yang optimal. Pasien, sebagai penerima layanan kesehatan, memiliki hak untuk memilih fasilitas kesehatan yang diperlukan secara mandiri dan bertanggung jawab, sebagaimana diatur dalam undang-undang tentang kesehatan.

Abstract

This study discusses the issue related to the notary's obligation to affix the signature and fingerprint of the appearer on the deed minutes as regulated in Article 16 paragraph (1) letter c of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 on Notary Positions. The problem arises when the appearer is a person with physical disabilities who is unable to affix their signature or fingerprint. The purpose of this study is to analyze the regulation regarding the use of signatures and fingerprints on notarial deeds, the legal consequences if the deed minutes are not signed or do not contain the appearer's fingerprint, and alternative substitutes for signatures and fingerprints for persons with disabilities. This research uses a normative juridical method with a descriptive analytical approach and secondary data obtained through library research. The results show that the use of signatures and fingerprints on notarial deeds serves as a form of legal protection and prudence, functioning as additional evidence for the notary and the parties involved. Legally, the absence of a signature or fingerprint on the deed minutes does not invalidate the authenticity and legality of the deed, as long as the appearer's statement is acknowledged by the notary. For persons with physical disabilities, substitutes for signatures and fingerprints can include surrogates, footprints, or lip prints, which are legally accepted as means of individual identification. Thus, the notary can still fulfill administrative obligations without diminishing the authentic value of the deed.
