Abstract

Mendalilkan kepada beberapa hasil penelitian, Indonesia dikelompokkan sebagai salah satu produsen sampah plastik di laut, sehingga situasi ini perlu mendapatkan peran nyata secara integratif dan serius. Artikel ini bertujuan menganalisis penggunaan model Penta Helix sebagai salah satu upaya integratif guna memerangi sampah plastik di laut Indonesia melalui kajian dari masing-masing elemen pembentuk model Penta Helix. Masing-masing elemen sebagai penyusun model Penta Helix yaitu elemen Pemerintah, elemen Lembaga Swadaya Masyarakat, elemen Sektor Swasta, elemen Perguruan Tinggi, dan elemen Masyarakat Madani. Artikel ini disusun menggunakan metode penelitian hukum normatif. Artikel ini berkesimpulan bahwa target penurunan sampah plastik di laut perlu didukung melalui sinergi semua elemen pemangku kepentingan yang menjadi unsur pembentuk model Penta Helix. Mendasarkan analisis dari masing-masing elemen model Penta Helix dapat disimpulkan bahwa elemen peran Lembaga Swadaya Masyarakat sudah bagus. Elemen peran pemerintah cukup baik kendatipun masih ada beberapa kelemahan. Tiga elemen tersisa yaitu peran perguruan tinggi; peran sektor swasta; dan peran masyarakat madani tampaknya perlu mendapatkan perhatian khusus dan perlu ditingkatkan lagi. Artikel ini berpendapat, jika masing-masing elemen pembentuk model Penta Helix dipergunakan dengan terukur dan terintegrasi maka selain target penurunan sampah laut akan lebih cepat terealisasi, dalam jangka panjang juga bermanfaat untuk menjaga ekosistem laut secara berkelanjutan.

Abstract

External Representation is a learning strategy that is applied to convey the subject matter of teaching to students by using various modes of representation. The mode of representation consists of verbal representations, images, graphics, and mathematics. The application of the RE approach because learners experience learning obstacles to be able to understand newton's law of straight motion that is only conveyed verbally and mathematically. The purpose of this research is to train and improve students' cognitive skills in the domains of C1 (remembering), C2 (understanding), C3 (applying), and C4 (analyzing) in learning Physics. The research method used is a quasi-experimental design with a non-equivalent control group design. The subjects of this study were selected by purposive sampling. The students of class X Mathematics and Natural Sciences in a high school in West Bandung regency were 30 students in the experimental class and 30 students in the control class. Measurement of cognitive skills using multiple choice instruments on pre-test and post-test. Analysis to see the increase in students' cognitive skills using normalized gain analysis. The results obtained that the experimental class students have increased to the moderate category with a <g>= 0.41 and students in the control class have a moderate category with a value of <g>= 0.36 from each cognitive domain skill that is trained.

Abstract

Occupational Safety and Health (OSH) is a crucial aspect of the geothermal energy industry to ensure worker safety and prevent occupational diseases. This study examines the implementation of legal protection for OSH at PT Geo Dipa Energi (Persero) Unit Dieng, focusing on the company's Health, Safety, and Environment (HSE) policies, compliance with labor regulations, and workplace risk management. PT Geo Dipa Energi enforces various safety measures, including HSSE (Health, Safety, Security, and Environment) mandatory procedures, OSH training programs, and social security coverage through BPJS Employment and BPJS Health. The findings indicate that the company’s OSH management aligns with national regulations and international standards such as ISO 45001. However, several challenges persist, including a lack of discipline in using personal protective equipment (PPE), potential exposure to toxic gases such as hydrogen sulfide (H₂S), high noise levels from machinery, and inadequate ventilation. These factors pose significant risks to workers’ health and productivity. To address these challenges, PT Geo Dipa Energi has implemented the Hazard Observation (OrBa) program, which encourages employees to actively identify and report workplace hazards. This initiative aims to foster a stronger safety culture and enhance proactive risk management. By continuously improving its OSH strategies, PT Geo Dipa Energi is committed to ensuring a safer, healthier, and more compliant work environment, ultimately minimizing workplace hazards and improving operational sustainability.

Abstract

The online buying and selling of songbirds in Surakarta has grown significantly with the rise of e-commerce, offering convenience, efficiency, and broader market access. Consumers can easily browse and purchase birds through various online platforms without geographical limitations. However, this type of transaction also presents several risks, including fraud, uncertainty about the bird’s quality, and potential issues during shipping, such as injury or death. Legal protection for consumers engaging in online transactions is regulated under Law No. 8 of 1999 on Consumer Protection (UUPK) and Law No. 11 of 2008, amended by Law No. 19 of 2016, on Electronic Information and Transactions (UU ITE). These regulations outline the rights and obligations of both business actors and consumers to ensure fair and secure transactions. Despite the benefits of online transactions, challenges such as lack of transparency, unreliable sellers, and logistical issues remain prevalent. Consumers are advised to conduct transactions with reputable sellers, such as members of bird enthusiasts’ communities, to reduce the risk of fraud. Additionally, in cases of consumer losses, dispute resolution mechanisms are available through e-commerce complaint services or institutions such as the Consumer Dispute Settlement Agency (BPSK), Consumer Protection Organizations (LPKSM), and the Indonesian Consumers Foundation (YLKI). As online commerce continues to evolve, strengthening consumer protection mechanisms is essential to creating a more secure and reliable marketplace for songbird enthusiasts.

Abstract

This research analyzes the challenges and factors influencing the delayed implementation of carbon tax in Indonesia using a qualitative descriptive approach through literature review and document analysis. The research findings indicate that the challenges and factors affecting the delay in carbon tax implementation can be seen from various aspects. This study has shown that the challenges in the carbon tax implementation process include the balance between environmental goals and economic well-being, public awareness and acceptance, infrastructure readiness and emission monitoring, as well as weak law enforcement in carbon tax policy determination. Various factors influencing the delay in carbon tax implementation include dependence on fossil energy sources, resistance from affected industries, the absence of a carbon tax roadmap, and unclear carbon exposure thresholds. With this research, it is hoped to provide an in-depth understanding of Indonesia's unique challenges in addressing climate change and offer insights needed to design effective policies for reducing carbon emissions and achieving environmental protection goals while considering existing socio-economic impacts.

Abstract

The struggles of indigenous peoples in both New Zealand and Indonesia to gain legal recognition remain ongoing. This study focuses on two central aspects. Firstly, it examines the historical-legal journey of indigenous peoples in their quest for legal acknowledgment. Secondly, it makes a comparative analysis with New Zealand, highlighting the potential contributions that indigenous peoples can provide to their respective countries. The study follows a legal research methodology, linking existing issues with authoritative sources and real-world situations. The findings reveal that in New Zealand, indigenous peoples possess a legal standing, albeit not entirely comprehensive. Conversely, Indonesian regulations do not provide strong legal support for indigenous people's rights. Despite their limited rights, indigenous peoples in New Zealand have made significant contributions to the nation's development. Additionally, the article contends that given their fundamental role in the founding of the Indonesian State, it is time for indigenous peoples to receive proper recognition for their substantial contributions to the nation's development.DOI: https://doi.org/10.22304/pjih.v10n3.a3

Abstract

Tapping in a human rights perspective is a form of limitation of the right to privacy. As an effort to guarantee human rights protection, tapping as a part of The Interception of Communication Bill arrangements must be following the principles of human rights restrictions. Some of the anomalies in The Interception of Communication Bill appear in vague forms and open up the broad ways of potential violations of individual rights. For this reason, the principles of legality and prudence as a form of control over government actions need to offset the urgency of tapping. Data collection methods use discussions and interviews to enrich and test secondary data findings. This research stipulates that The Interception of Communication Bill use tapping as an induced instrument in criminal law enforcement. At the same time, tapping is regulated regardless of the readiness of the legal apparatus; this naturally raises technical problems in the matter of implementation and opens the door to abuse of authority. Furthermore, based on the need for comprehensive regulation, it is necessary to look at a comprehensive regulatory scheme in the legal system. The functional control that is in line with the tapping mechanism needs to look at the character of the Indonesian criminal justice system.

Abstract

The digital economic system has changed the pattern of relationships between service providers and consumers in conducting transactions. Starting from the opportunity given by the Supreme Court to online taxi service providers as part of Micro, Small, and Medium Enterprises (from now on MSMEs), application services such as Go-Jek and Grab are now becoming new spaces for national economic growth. This study will specifically answer how the judicial review process becomes a form of incremental policy, which is very important for business continuity in the industrial era 4.0. This paper can fill the research gap regarding policy alternatives response in supporting the development of the digital economy in Indonesia. This paper will be portrayed using doctrinal research methods and statutory approaches in descriptive and prescriptive styles. As a result, this paper demonstrates that the Supreme Court, as the judiciary institution, plays a central role in responding to changing societal needs. The rationality of business actors in the theory of economic analysis of law has led them to step up and look for responsive policy alternatives. This condition is proven by the judicial review decision on Case Number 37 P/HUM/2017, which was then able to save MSME actors during the COVID-19 pandemic. The development of an incremental policy model is a form of government response to support national economic growth in the digital era, which demands rapid change.

Artikel ini berpendapat, jika masing-masing elemen pembentuk model Penta Helix dipergunakan dengan terukur dan terintegrasi maka selain target penurunan sampah laut akan lebih cepat terealisasi, dalam jangka panjang juga bermanfaat untuk menjaga ekosistem laut secara berkelanjutan.

Abstract

Presidential Decree (pronouncement) is made in respons to state emergency. The issue discussed here refers to the question who, when and how state emergency occurs justifying the issuance of such pronouncement.  A different issue in Indonesia is the impact such pronouncement has on democracy, considering that the decree itself it made, arguably, to save democracy in the first place. This has been experienced by Indonesia when the President issued such decree in the past. In addition, using comparative method, the author looks at the use and experience of other countries and how such approach impact democracy.
