Abstract

Consumers who are Muslim basically have concerns to buy food that does not have an official halal logo from the institution that has the right to issue. Indonesian consumers who are predominantly Muslim will be more focused on the halal logo listed on a packaging product. However, the logo must first be submitted to BPJPH by the entrepreneur. After the entrepreneur gets the halal certificate, then the halal logo can be placed on the product label. Researchers in this writing use this type of normative legal research. In the type of research the writer uses normative law as it support. After the establishment of the BPJPH based on the provisions of the presidential regulation in accordance with Article 5 of the UUJPH, the authority of the BPJPH is clearly stated in Article 6. The procedures specified in the explanation of UUJPH, the researcher can also elaborate on the procedure of obtaining Halal certificate which starts with: the request is submitted by the applicant to get a halal certificate to BPJPH. After that the document inspection is carried out by BPJPH, then testing and the inspection is carried out by LPH which has accreditation from BPJPH in collaboration with MUI. Furthermore, the fatwa trial was conducted by MUI to legalize the halal status of a product in the form of a Decision on Halal Product Determination signed by MUI.

Abstract

The purpose of this research is to undertake a legal analysis of the anti-corruption procurement process for government goods and services through the use of good governance. The research approach employed in this study is a normative juridical one, which involves studying legislative rules and examining corrupt activities that occur in the sphere of procurement of goods and services. The sources of law in this study are material law sources and traditional legal sources. Based on the analysis of legal authorities, it can be concluded that the criminal act of corruption in the procurement of government goods and services has violated the regulations in Article 2 paragraph (1) of Law No. 31 of 1999 and Law No. 20 of 2001 on Corruption. The implementation of good governance in preventing corruption in the procurement of goods and services is seen from two aspects, namely internal and external aspects. Internal elements include improving the quality of internal resources in government organizations and increasing accountability and transparency. In contrast, external elements increase community participation, legitimacy, and anti-corruption socialization through various media.

Abstract

Corporate crime in protecting K3 workers/laborers in the workplace is very structured. The corporation is always profit-oriented as much as possible without regard to social aspects. This situation makes it easy for corporations to disobey the applicable laws and regulations. This study aims to determine the application of criminal offenses for corporate offenders if negligent in providing protection of health, work safety for workers. The research method used in this study is normative research. The analysis technique used is qualitative analysis with the support of secondary data in the form of a Law document. The results showed that the application of criminal acts against corporate perpetrators who violated the Manpower Act in particular OHS was not optimal and was not yet effective. This finding is proven by the absence of protection from work accident cases because the Occupational Health Safety Act (OHS Law) is still dysfunctional and cannot be enforced (dysfunctional and non-enforceable). In connection with that, all cases of work accident cases do not use OHS Law as the basis for the indictment, the basis for prosecution, or the basis for a criminal prosecution, but instead, use the articles in KUHP and other special laws outside the unusual KUHP

Abstract

The purpose of this study is to analyze the perspective of Indonesian criminal law about legal protection of witnesses and victims in the perspective of criminal cases. The research method used is to use normative juridical legal research methods. the use of normative juridical legal research methods is carried out with a statute approach and a case approach to obtain results so that they are expected to obtain the results they want to achieve. The results of this study are that legal protection for witnesses and / or victims of trafficking in persons has not been implemented properly. The rights of victims have not been accommodated in the process of investigation, investigation and justice. The legal protection provided does not view witnesses and / or victims as victims, but rather as witnesses to complete evidence and disclose criminal acts to the extent that they provide information before the trial. In the PSK Law which guarantees and protects the rights of witnesses and / or victims of trafficking in human trafficking to provide freedom and security and comfort to witnesses and / or victims in investigations, investigations, prosecutions and trials. In law enforcement, it turns out that witnesses and / or victims still do not get their rights before the law as witnesses and / or victims

Abstract

Pancasila is the basis of the state in Indonesia. Countries have several types of legal rules enforced according to the crime rate of the offender. Mistakes in responding to state law lead to wrong actions. The purpose of this study is to increase legal awareness of the people in Indonesia through preventive action, namely that criminals are expected not to commit crimes because they have received a deterrent effect from punishment. Research method with normative juridical. Data analysis techniques through analysis of electronic journals, e-books and reference searches through Google Scholar. The results of the study show that the types of punishment in Indonesia have different levels according to the treatment of the crime. The heaviest consequence in serving the Death Penalty. On the basis of errors in acts of corruption and other cases. The death penalty can apply to life imprisonment, shot to death based on the judge's decision.

Abstract

The purpose of this research is to examine the new Criminal Code (KUHP) introduced in 2023. The research methodology used is a juridical-empirical approach, employing a descriptive research design to provide an overview of the newly enacted KUHP by the President on January 2nd, 2023. The problem-solving approach in this study is descriptive, aiming to describe and analyze the new KUHP. To address the research problem, secondary data analysis was conducted through an extensive review of literature, including relevant legal materials and legislation. The research then proceeded to analyze the collected data using qualitative methods, drawing insights from the existing literature and legal provisions. The findings of this research indicate that the endorsement of the new KUHP by the President and the People's Consultative Assembly (DPR RI) marks a significant milestone in the development of the criminal justice system in Indonesia. With these changes, it is expected that law enforcement will become more effective, justice will be better upheld, and human rights will be protected more comprehensively. Looking towards the future, the amendments to the KUHP should continue to address emerging challenges to remain relevant and provide significant benefits to Indonesian society. In conclusion, the enactment of the new KUHP is a crucial step in strengthening the criminal justice system in Indonesia. However, effective implementation, monitoring, and periodic review remain challenges that need to be addressed. Through the commitment and collaboration of all stakeholders, it is hoped that the new KUHP will serve as an effective instrument in promoting justice, protecting human rights, and enhancing law enforcement in Indonesia.

Abstract

Penelitian yang berjudul tanggungjawab Notaris sebagai penerima titipan Sertifikat hak atas tanah setelah perjanjian pengikatan jual beli dibatalkan pengadilan (Studi Kasus Putusan Mahkamah Agung Republik Indonesia Nomor 3176 K/Pdt/2013), berfokus pada permasalahan apakah Notaris sebagai penerima titipan Sertifikat hak atas tanah akan menyerahkan Sertifikat tersebut ketika perjanjian ikatan jual beli dibatalkan oleh putusan pengadilan yang telah mempunyai kekuatan hukum tetap (inkracht van gewijsde) dan bagaimana akibat hukum apabila Notaris menyerahkan atau tidak menyerahkan Sertifikat yang ada padanya setelah ada putusan pengadilan mempunyai kekuatan hukum tetap. Dari hasil penelitian diketahui bahwa berdasarkan ketentuan Pasal 1694-1739 KUHPerdata dan UUJN beserta peraturan pelaksanaannya, Notaris berkewajiban secara hukum dan berdasarkan kode etik untuk menyerahkan Sertifikat hak atas tanah kepada Pemiliknya apabila akta pengikatan jual beli yang dilakukan kedua belah pihak dibatalkan oleh putusan pengadilan yang berkekuatan hukum tetap (inkracht van gewijsde). Akibat hukum apabila Notaris tidak menyerahkan Sertifikat hak atas tanah yang dititipkan kepadanya setelah adanya putusan pengadilan yang berkekuatan hukum tetap (inkracht van gewijsde) adalah Notaris yang bersangkutan dapat digugat oleh pihak yang merasa dirugikan baik secara perdata, pidana maupun administrasi.

Abstract

Era digital telah membawa transformasi signifikan dalam berbagai aspek kehidupan, termasuk dalam sektor ekonomi. Perkembangan teknologi informasi dan komunikasi telah menciptakan model ekonomi baru yang lebih dinamis, terbuka, dan terintegrasi secara global. Dalam konteks ini, hukum memainkan peran strategis sebagai instrumen pengendali dan pengarah pembangunan ekonomi agar tetap berada dalam koridor kepastian, keadilan, dan keberlanjutan. Artikel ini mengkaji bagaimana hukum dapat berfungsi sebagai landasan normatif dalam mengatur aktivitas ekonomi digital, mencegah praktik yang merugikan kepentingan publik, serta mendorong inovasi dan investasi yang sehat. Pendekatan yang digunakan adalah yuridis-normatif dengan analisis terhadap berbagai regulasi terkait ekonomi digital, perlindungan data, hak kekayaan intelektual, serta transaksi elektronik. Hasil kajian menunjukkan bahwa keberadaan sistem hukum yang adaptif dan responsif menjadi kunci dalam menciptakan ekosistem ekonomi digital yang inklusif dan kompetitif. Abstract

Labor law is a strategic instrument in regulating the relationship between workers and employers, as well as ensuring social justice in the workplace. Its aim is to create a balance of interests among all involved parties and to guarantee the protection of workers’ fundamental rights, such as the right to fair wages, humane working hours, social security, occupational safety and health, and the right to organize and engage in collective bargaining. The existence of this law is not only crucial for the protection of labor rights but also significantly contributes to economic stability and growth. This article aims to examine the extent to which labor law can create a fair, productive, and sustainable employment ecosystem in the context of national economic development. The method used is a juridical-normative and empirical approach through secondary data analysis and literature review. The findings show that the effective implementation of labor law can enhance productivity, reduce industrial conflict, and encourage investment through the creation of legal certainty. Therefore, labor regulatory reform and institutional strengthening are key prerequisites for sustainable economic development. In addition, labor law contributes to the creation of legal certainty and a conducive business climate. Labor regulation certainty is one of the key indicators in the Ease of Doing Business index. Legal reforms such as the Job Creation Law (UU Cipta Kerja) demonstrate efforts to align regulations with the needs of the business sector, although their effectiveness still needs to be tested in practical implementation.

Abstract

Investment plays a crucial role in promoting economic growth and maintaining national economic stability, especially in the context of globalization, which demands legal certainty and a conducive investment climate. This study is driven by the need to evaluate the effectiveness of Law Number 25 of 2007 concerning Investment as a legal instrument for strengthening the foundation of national economic development. The main issue examined is how the normative role of the Investment Law contributes to creating a healthy and sustainable investment climate. This research employs a normative juridical method using the statute approach and conceptual approach, focusing on the analysis of applicable regulations and relevant legal doctrines. The results of the study indicate that, normatively, the Investment Law provides legal certainty for investors. However, its implementation still faces several challenges, including regulatory overlap across sectors and weak institutional coordination. Therefore, regulatory harmonization and institutional strengthening are essential to ensure that the law effectively supports sustainable economic growth and national stability.
