Abstract

The Civil Service Police Unit (Satpol PP) plays a strategic role in maintaining public order as a regional government apparatus, requiring discretionary authority when legal provisions do not fully regulate field situations. This study analyzes the legal framework, implementation, and accountability limits of Satpol PP’s discretion from the perspective of General Principles of Good Governance (AUPB). Using a normative legal method with statutory, conceptual, and case approaches, this research examines legal materials through qualitative and interpretative analysis. The findings show that Satpol PP’s discretionary authority has a sufficient constitutional and administrative basis but lacks clear operational standards. Its implementation still faces procedural weaknesses, limited documentation, and insufficient consideration of social justice values. The exercise of discretion is limited by legality, procedure, proportionality, and justice principles, with accountability mechanisms available through internal supervision, administrative review, the Ombudsman, and the State Administrative Court. Strengthening rights-based procedures aligned with AUPB is recommended to ensure lawful, accountable, and humane public order enforcement.

Abstract

Indonesia’s commitment to the rule of law requires waste management policies to be implemented under clear and consistent legal frameworks. However, increasing waste problems have highlighted the need to strengthen the legislative and oversight functions of Regional People’s Representative Councils (DPRD). This study aims to examine the normative regulation of these functions, analyze the harmonization of relevant legislation, and formulate legal measures to improve their effectiveness in waste management. The research employs a normative juridical method using statutory and conceptual approaches based on library research, with qualitative prescriptive analysis. The findings reveal that Law Number 23 of 2014, Law Number 17 of 2014, Law Number 18 of 2008, and Law Number 13 of 2022 are generally harmonized in regulating governmental authority. Nevertheless, legal gaps remain, particularly the absence of specific oversight indicators for waste management and the lack of explicit DPRD authority in supervising waste policies. Strengthening regulatory provisions and institutional capacity is therefore necessary to enhance the effectiveness of the DPRD’s legislative and oversight functions in addressing waste management issues.

Abstract

This study analyzes the juridical review of the defendant in the criminal offense of sexual intercourse with a child based on Decision Number 324/Pid.Sus/2024/PN Tbh and examines the judges’ legal considerations in rendering the verdict. The research uses a normative legal method with statutory and case approaches. Primary, secondary, and tertiary legal materials are analyzed qualitatively using a descriptive method. The findings show that the law enforcement process was conducted in accordance with the Indonesian Code of Criminal Procedure, the Indonesian Criminal Code, and Law Number 17 of 2016 concerning Child Protection. The criminal offense was proven through valid evidence, including witness testimonies, the victim’s testimony, the visum et repertum, and the defendant’s statement. The judges’ decision reflected the principles of legality, legal certainty, and justice. However, the continued occurrence of child sexual intercourse cases indicates that repressive law enforcement alone is insufficient, highlighting the need to strengthen criminal law policies and child protection measures.

Abstract

Law enforcement against theft is a primary responsibility of the Indonesian National Police in maintaining public order and ensuring legal certainty. This study examines the law enforcement process carried out by the Kateman Sector Police in handling theft cases and identifies the obstacles encountered in its implementation. Using an empirical legal research method with a sociological approach, the study collected primary data through interviews with investigators and secondary data from legislation, books, journals, and relevant documents. Data were analyzed descriptively using a qualitative method. The findings show that law enforcement is conducted through receiving reports, investigations, evidence collection, suspect identification, and submission of case files to the public prosecutor in accordance with applicable laws. However, its implementation is constrained by limited human resources, inadequate facilities, difficulties in obtaining evidence, low public participation, and increasingly sophisticated criminal methods. Strengthening police capacity, improving facilities, and enhancing cooperation between the police and the community are essential to achieving more effective, professional, and fair law enforcement.

Abstract

This study aims to determine the implementation of the Village Consultative Body (BPD)'s oversight function regarding accountability for village financial use in Kembang Mekar Sari Village, Indragiri Hilir Regency, based on Law Number 6 of 2014 concerning Villages. The factors influencing the suboptimal implementation of the BPD's oversight function, as well as the legal and governance implications of this suboptimal oversight function, are discussed. This study employed a sociological legal research approach with an empirical approach. The research location was Kembang Mekar Sari Village, Indragiri Hilir Regency. The data used consisted of primary data obtained through interviews with the BPD Chairperson, Village Head, and community leaders, as well as secondary data obtained from laws and regulations, books, and scientific journals related to village governance and village financial management. Data analysis was conducted qualitatively using descriptive analytical methods. The results indicate that the implementation of the BPD's oversight function regarding village financial use in Kembang Mekar Sari Village has been carried out through BPD involvement in village budget (APBDes) discussions, supervision of village development implementation, and evaluation of village budget accountability reports. However, its implementation has not been optimal because supervision remains administrative and formal. Factors contributing to this lack of oversight include the limited quality of human resources within the Village Consultative Body (BPD), minimal training and development, low community participation, social and cultural kinship within the village, and a lack of transparency in the use of village finances. This suboptimal oversight has legal and governance implications for village governance, including increased potential for maladministration and budget misuse, weak implementation of transparency and accountability principles, and declining public trust in the village government.

Abstract

The authority of the Village Government in resolving land purchase conflicts among village communities in Kembang Mekar Sari Village, Indragiri Hilir Regency, is based on Law Number 6 of 2014 concerning Villages. The research questions include the regulation of village authority, the constraints in handling land purchase conflicts, and the village government's efforts to resolve these conflicts. The research used a sociological legal research approach with a descriptive analytical approach. Data were obtained through interviews with the Village Head, village officials, community leaders, and a literature review of laws and legal literature. The results indicate that the Village Government plays a role as a mediator in resolving land purchase conflicts through deliberation and a family approach. However, the implementation of this authority is not optimal due to the absence of a Village Regulation specifically governing the mechanism for resolving land conflicts. The obstacles faced include poor community land administration, limited village authority, and a lack of community legal understanding. The village government's efforts include mediation, land law socialization, land administration restructuring, and plans to establish a Village Regulation concerning community dispute resolution.

Abstract

This study examines the implementation of village authority in regulating guests arriving in Kembang Mekar Sari Village, Indragiri Hilir Regency, based on Law Number 6 of 2014 concerning Villages. This research is motivated by the suboptimal implementation of guest regulation within the village and the absence of specific regulations in the form of Village Regulations (Perdes) governing the reporting obligation for guests arriving and staying in the village. This study aims to determine the implementation of village government authority in regulating guests, the factors influencing its implementation, and the village government's efforts to overcome obstacles to the implementation of guest regulation in Kembang Mekar Sari Village, Indragiri Hilir Regency. The type of research used is sociological legal research with a descriptive analytical nature. Data sources consist of primary and secondary data. Primary data were obtained through interviews with the Village Head, village officials, RT/RW heads, community leaders, and residents of Kembang Mekar Sari Village, Indragiri Hilir Regency. Secondary data were obtained through a literature review of laws and regulations, books, and journals related to the research. Data analysis was conducted qualitatively using deductive inference. The results indicate that the Village Government's authority to regulate guests has been implemented through an appeal to the community to report guests who stay more than 24 hours to the Head of the local RT/RW. However, this implementation has not been optimal due to the absence of a Village Regulation specifically governing the mechanism for regulating guests, resulting in informal implementation and lack of clear legal certainty. Factors influencing the implementation of guest regulation include legal factors, village government officials, community awareness, facilities and infrastructure, and the community's legal culture. The village government's efforts to overcome these obstacles include community outreach, increased coordination with the RT/RW, enhanced neighborhood security, guest administration data collection, and plans to establish a Village Regulation regarding guest regulation as a form of implementing village-scale local authority.

Abstract

Waste management is part of the local authority at the village level within the framework of village autonomy. However, the implementation of waste management in Kembang Mekar Sari Village, Indragiri Hilir Regency, still faces various obstacles, both legal and factual. This study aims to determine the regulation of village authority in waste management, analyze the problems faced by the village government, and examine legal and policy efforts in optimizing waste management. This study used an empirical legal research method with a sociological legal approach. Data were obtained through literature review and interviews, then analyzed descriptively and qualitatively. The results indicate that village authority in waste management is regulated in Law Number 6 of 2014 concerning Villages and other related regulations. However, its implementation has not been optimal due to the absence of Village Regulations on waste management, low public awareness, limited facilities and infrastructure, and minimal budget support. Possible measures include the establishment of Village Regulations, increasing community participation, strengthening waste management institutions, and collaborating with local governments to create a clean and sustainable village environment.

Abstract

This study aims to analyze the perspective of evidence in the crime of indecent acts (cabul) based on a police report at the Concong Sector Police, and to identify the obstacles encountered in the evidentiary process. This research employs an empirical (sociological) legal research method with a descriptive-analytical approach, using primary data obtained through interviews with investigators, the suspect, the victim, and witnesses, supported by secondary data from statutes, legal literature, and prior research. The findings indicate that evidence in cases of indecent acts against minors is built primarily upon witness testimony, including the unsworn statement of the child victim under Article 171 of the Criminal Procedure Code, which is strengthened when consistent with other witness statements, expert testimony in the form of a medical examination report (visum et repertum), and the statement of the suspect, in accordance with the minimum evidentiary standard of Article 183 and Article 184 of the Criminal Procedure Code. However, the evidentiary process faces several obstacles, namely the private and non-witnessed nature of the offence, the psychological vulnerability of the child victim in providing testimony, the time gap between the incident and medical examination, and the reluctance of the community to report such cases. Therefore, strengthening victim-sensitive investigative techniques and multidisciplinary cooperation between investigators, medical personnel, and psychologists is essential to achieve legal certainty and justice for the victim.

Abstract

Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk meningkatkan pemahaman masyarakat mengenai kepemilikan tanah dan keabsahan administrasi pertanahan berdasarkan perspektif Hukum Administrasi Negara, Hukum Perdata, dan Hukum Pidana. Kegiatan dilaksanakan di Desa Danau Pulai Indah, Kecamatan Kempas, Kabupaten Indragiri Hilir melalui metode penyuluhan hukum, diskusi interaktif, observasi, dan dokumentasi. Materi yang disampaikan meliputi pentingnya pendaftaran tanah, prosedur administrasi pertanahan, perlindungan hukum terhadap hak atas tanah, serta konsekuensi hukum yang timbul akibat pelanggaran di bidang pertanahan. Hasil kegiatan menunjukkan bahwa sebelum penyuluhan sebagian masyarakat masih memiliki pemahaman yang terbatas mengenai legalitas kepemilikan tanah dan prosedur administrasi pertanahan. Setelah kegiatan berlangsung, peserta menunjukkan peningkatan pemahaman mengenai pentingnya kepastian hukum, tertib administrasi pertanahan, serta perlindungan hak atas tanah melalui mekanisme hukum yang berlaku. Kegiatan ini memberikan kontribusi dalam meningkatkan kesadaran hukum masyarakat sekaligus memperkuat sinergi antara perguruan tinggi, pemerintah desa, dan masyarakat dalam mewujudkan sistem administrasi pertanahan yang tertib, transparan, dan memberikan kepastian hukum.
