Abstract

The authority of the State in the acquisition of land rights for the public interest in Indonesia is derived from the State's Right to Control. Because of that, on the basis of that authority, the state has the right to take over citizens' land with the provision of providing proper compensation. To provide legality for this authority, the State issued Law of the Republic of Indonesia Number 2 of 2012 concerning Land Procurement for Public Interests. Implementation of Forms of Compensation according to Law no. 2 of 2012 concerning Land Acquisition for Development for the Public Interest, clearly states that Compensation is a proper and fair compensation to the entitled party in the land acquisition process. Assessment of the value of Compensation is carried out plot per plot of land, including: land, above-ground and underground space, buildings, plants, objects related to land, and other losses that can be assessed. Based on the assessment of the amount of Compensation, the provision of Compensation can be given in the form of: money, replacement land, resettlement, share ownership and other forms.

Abstract

With the issuance of Law no. Law No. 3 of 2020 replaces Law No. 4 of 2009 concerning Mineral and Coal Mining. It is hoped that it will position the Indonesian state as the sovereign party over its natural resources. Therefore, it is necessary to formulate the problem, namely how to study the legal politics of Law No. 3 of 2020 concerning Mineral Mining. And Coal towards the obligation to process and refine mining products domestically. The research method is normative with several approaches, namely the Conceptual Approach and the Statute Approach. From the results of the author's research, it was found that the government considers it necessary to increase the added value of minerals through domestic mineral resource processing and refining activities, as intended in Article 103 and Article 170 of Law Number 3 of 2020 concerning Mineral and Coal Mining, so the government then promulgate Government Regulation (PP) No. 96 of 2021 which is an amendment to PP No. 1 of 2014 concerning Implementation of Mineral and Coal Mining Business Activities. One of the important regulations in this PP is the obligation to carry out 100% mineral refining domestically so that there will be no more exports of raw minerals by mining companies. The aim of banning exports of raw minerals is to increase fiscal added value while creating jobs. Because mining companies are required to build processing plants or smelters in the country. In this way, new job opportunities will be opened for the Indonesian people

Abstract

Management of public funds in infrastructure projects in Indonesia is an important aspect that influences national development. This article aims to analyze the application of these principles in the management of public funds. The research method used is normative research, which includes literature studies, legal document analysis, and case studies to evaluate the effectiveness of regulations in increasing transparency and accountability. The discussion includes an analysis of the legal norms governing the management of public funds as well as the challenges faced in their implementation. The research results show that although Law no. 2 of 2017 provides a clear legal framework, there are still weaknesses in implementing the principles of transparency and accountability, which could potentially lead to misuse of funds. The conclusion of this article emphasizes the need to strengthen regulations and more effective monitoring mechanisms to ensure efficient and responsible use of public funds, as well as increase public trust in the management of public funds.

Abstract

This study aims to analyze the legal protection of Geographical Indications (GI) for Kain Tenun Bima under Law No. 20 of 2016 concerning Trademarks and Geographical Indications, with a focus on the registration mechanism. Kain Tenun Bima, or Tenun Mbojo, is a cultural heritage of the Bima community, possessing high cultural and economic value. However, as of June 2024, this fabric has not yet been registered as a GI, leaving it vulnerable to counterfeiting and misuse by unauthorized parties. The research employs a normative method with a descriptive-analytical approach, examining primary data such as UU No. 20 Tahun 2016 and secondary data from journals, books, and government documents. The findings reveal that Kain Tenun Bima meets all GI criteria, including geographical origin, natural and human factors, and unique characteristics. GI registration offers legal, economic, and cultural benefits, such as protection against counterfeiting, increased market value, and preservation of cultural heritage. The GI registration process involves administrative and substantive stages by the Direktorat Jenderal Kekayaan Intelektual (DJKI),, requiring comprehensive documentation of the product's uniqueness. Challenges in registration include a lack of legal understanding and coordination among stakeholders. Therefore, collaboration between the government, weaving communities, and academics is essential to accelerate the GI registration for Kain Tenun Bima, ensuring legal protection and sustainability as a regional cultural and economic asset.

Abstract

The transformation of government services from manual systems to digital platforms through e-government in Indonesia is a response to the advancement of information and communication technology (ICT) and the demand for bureaucratic efficiency. Presidential Instruction No. 3 of 2003 marked the initial milestone in e-government development, which has since evolved into various digital public services such as OSS, SatuSehat, and Satu Data Indonesia. This study employs a normative legal method using statutory, conceptual, and normative gap analysis approaches. The focus of the research is directed at two main aspects: the regulation of personal data protection within regional e-government systems and the normative weaknesses in ensuring the security and confidentiality of citizens’ data. The discussion reveals that despite the enactment of the Personal Data Protection Law (PDP Law), its implementation at the regional level faces significant challenges, including overlapping regulations, lack of technical standards, weak oversight, and ineffective sanctions. Regional governments often lack clear operational guidelines, resulting in disparities in data protection across regions. The study concludes that personal data protection must be an integral part of digital governance system design. Regulatory reform, institutional capacity building at the regional level, and the establishment of effective oversight mechanisms are strategic steps to ensure comprehensive protection of citizens’ privacy rights in the digital era.
