Abstract

Di masa modern saat ini, teknologi mulai semakin maju, dan usaha ekonomi kreatif mulai bermunculan. Namun dengan keterbatasan ekonomi apakah memungkinkan para debitur yang hendak mengajukan pinjaman kredit menjadikan tanah warisan sebagai jaminan pinjaman kredit kepada perbankan. Syarat untuk mengajukan kredit kepada bank untuk objek hak atas tanah yang masih menjadi harta warisan harus dibalik nama terlebih dahulu. Tanah Warisan yang dapat dijadikan sebagai jaminan dengan di bebani hak tanggungan adalah tanah warisan yang telah melalui prosedur turun waris. Masyarakat belum mengetahui bahwasannya objek warisan hak atas tanah harus dibalik nama terlebih dahulu sebelum dijadikan jaminan atas kredit. Pada penelitian ini penulis ingin mengkaji tentang proses pencairan kredit terhadap jaminan yang akan dijadikan sebagai objek dari kredit tresebut. Jenis penelitian menggunakan hukum yuridis normatif. Penelitian ini menggunakan data primer dan sekunder yang bersumber dari undang-undang, karya ilmiah, dan hasil. Dari hasil observasi, para ahli waris melakukan proses turun waris melalui kantor notaris dengan memenuhi persyaratan – persyaratan yang dibutuhkan untuk didaftarkan berkasnya di Kantor Pertanahan untuk menghasilkan nama para ahli warisdalam sertipikat tanah, setelah selesai proses turun waris, maka akan dilanjutkan dengan pembebanan hak tanggungan. Kekuatan hukum berdasarkan pada Undang-Undang Nomor 5 Tahun 1960 tentang Undang-Undang Pokok Agraria dalam pasal 19, yang berbunyi untuk memperoleh kekuatan hukum maka sertipikat hak atas tanah harus didaftarkan dan diatur lebih lanjut dalam Peraturan Pemerintah Nomor 24 Tahun 1997 tentang pendaftaran tanah pasal 3 dijelaskan terkait tujuan pendaftaran.

Abstract

Money laundering is an attempt to hide or disguise the origin of money/funds or assets resulting from criminal acts through various financial transactions so that the money or assets appear as if they came from legal/legal activities. Data obtained based on the Anti-Money Laundering and Terrorism Statistical Bulletin by the Center for Financial Transactions and Analysis Services in June 2019, there were 459,951 Suspicious Financial Transaction Reports during the period January 2003 to June 2019 received by PPATK. Types of research used in the study This is a normative juridical research that is used to review the legislation. It is useful for academic purposes which is used for academic purposes and can be used to compose academic works. With the new provisions, the implementation of regulations for KUPVA BB operators and Payment System Service Providers (PJSP) has been integrated. The new regulations have also been harmonized with the government's efforts to combat money laundering and terrorism financing, as well as recommendations and guidelines provided by the international Financial Action Task Force on Money Laundering (FATF). The obligation to report Money Changers and early monitoring by PPATK as an effort to combat money laundering is a preventive measure in preventing money laundering crimes. The new regulations have also been harmonized with the government's efforts to combat money laundering and terrorism financing, as well as recommendations and guidelines provided by the international Financial Action Task Force on Money Laundering (FATF).
