Abstract

In addition to getting wages, there are other variables that also appear to be related to the performance of workers/labourers, namely bonuses. Work agreement contains a bonus calculation clause, then the bonus becomes mandatory and becomes the right of the worker/worker. However, if it is not contained in the work agreement, then the entrepreneur may consider that the bonus is something that is not mandatory. This of course creates a different perception between workers, employers and the government in interpreting bonuses. Whether the bonus is part of the workers/labor's rights or is the bonus only an award whose payment really depends on the good faith of the entrepreneur. This paper presents the discourse by explaining from socio-legal research because it is a study of law using a legal science approach and social science approach using a field approach. This paper reveals that the bonus arrangement itself is an important component in the working relationship between the employer/employer and the worker/labourer. Because in principle, bonuses are one way to increase company productivity.

Abstract

Pengelolaan sampah dewasa ini masih menjadi problem yang belum terselesaikan. Penelitian ini bertujuan untuk mengkaji permasalahan dalam pengelolaan sampah plastik di Bengkulu guna mendukung Kawasan Wilayah Pesisir. Hasilnya terdapat beberapa peraturan perundang-undangan yang mempunyai korelasi dengan pengelolaan sampah plastik di Indonesia yaitu UU Perlindungan dan Pengelolaan Lingkungan Hidup, UU Pengelolaan Sampah dan beberapa undang-undang lainnya termasuk Jakstrada Kota Bengkulu yang bertujuan menumbuhkan kesadaran bagi masyarakat akan lingkungan hidup yang baik dan sehat di Provinsi Bengkulu. Penelitian ini juga mengemukakan Kebijakan Pengelolaan Sampah Plastik yang ideal untuk mendukung Kawasan Wisata Wilayah Pesisir Provinsi Bengkulu.

Abstract

Penelitian ini menganalisis kewenangan Kementerian Agama dalam penyelenggaraan pendidikan dasar dan menengah berdasarkan UU No. 20 Tahun 2003 dengan bingkai teori kepastian hukum. Latar belakangnya adalah kebutuhan mengatasi dualisme pengaturan antara satuan pendidikan yang dibina Kemenag dan kementerian teknis lain, meski berada dalam satu sistem nasional dan wajib memenuhi Standar Nasional Pendidikan (SNP). Penelitian menggunakan metode yuridis normatif dengan statute approach dan conceptual approach, serta analisis preskriptif-analitis. Hasil menunjukkan bahwa UU 20/2003 memberikan kepastian hukum formal (pengakuan jenis keagamaan dan kesetaraan bentuk MI/MTs/MA/MAK), namun kepastian material menuntut demarkasi kewenangan yang lebih terang pada regulasi turunan agar tidak terjadi tumpang tindih standar, akreditasi, kurikulum, kualifikasi pendidik, dan data. Disarankan penerbitan regulasi pelaksana bersama yang memetakan domain kekhasan vs domain SNP, harmonisasi data pendidikan, SOP mobilitas dan rekognisi hasil belajar lintas satuan setara, serta penguatan mekanisme koordinasi dan akuntabilitas agar penyelenggaraan oleh Kemenag berjalan pasti, terukur, dan setara dalam satu sistem pendidikan nasional.

Abstract

This research aimed to provide a conceptual idea regarding legal options in resolving disputes of democratic regional head elections in Indonesia with two proposed options. The first option included revising the Election and Regional Election Law to grant authority to the Constitutional Court (MK) and Election Supervisory Agency (Bawaslu) for adjudicating disputes. The second option proposed implementing the Fifth Amendment to the 1945 Constitution to reconstruct the Constitutional Court as an election court correlating with the primary role of upholding regulations. These proposed options would grant the Constitutional Court the authority to examine and adjudicate substantial matters related to the constitutionality of elections. Furthermore, the analysis used normative legal research including statutory, comparative, and conceptual methods.

Abstract

This study examines the relationship between customary law communities and the ideology of Pancasila within Indonesia’s legal philosophy. Article 18B Paragraph (2) of the 1945 Constitution affirms state recognition of customary law communities and their long-standing social, legal, and cultural systems. However, challenges persist in integrating customary law into the national legal framework, including normative disparities and conflicts of interest. Using a normative juridical method with philosophical, statutory, and case approaches, and drawing on secondary data through literature review, this research finds that the intersection between legal philosophy and Pancasila reflects the value of social justice. Pancasila provides a philosophical and constitutional foundation for recognising and protecting customary law communities while promoting national unity and sustainable development, thereby affirming its role in upholding diversity, justice, and humanity.

Abstract

Bureaucracy, from a societal perspective, is often perceived as complex, slow, and inefficient. Despite these criticisms, bureaucracy remains a fundamental component of governance and plays a crucial role in societal functioning. As such, bureaucratic reform has been a prominent focus of policy discussions for several decades. A technology-driven government system, coupled with a bottom-up approach, has the potential to enhance efficiency, transparency, and accountability in public administration. However, in practice, such reforms have been largely confined to central government institutions and select agencies. This study aims to explore the integration of technology within the bureaucratic system in Indonesia, with a focus on its comprehensive implementation across government structures. Employing a normative research methodology, the study emphasizes the need for the government to take proactive steps in developing a skilled workforce in information technology. The authors also recommend strategically mapping positions that can integrate technological expertise throughout government departments. Furthermore, the study proposes a comprehensive examination of the potential for replacing executive positions with artificial intelligence (AI) to streamline and simplify bureaucratic processes.  In addition to technological advancements, bureaucratic reform must be accompanied by legal reform, particularly in the areas of data security and the protection of personal information. This includes redefining bureaucratic and personal data categories to ensure robust safeguards. The Personal Data Protection Law should play a pivotal role in integrating these data types and ensuring their protection. Moreover, the Telecommunications Act and the Personal Data Protection Act should foster collaboration between the government and technology companies to develop effective security solutions. Lastly, strengthening the Ombudsman as a public service oversight institution is essential to ensuring transparency and accountability in the implementation of bureaucratic and technological reforms.

Abstract

The stagnation of human rights enforcement in Indonesia's Reformation Era has highlighted a critical imbalance: the current system prioritizes punishing perpetrators of serious human rights violations over addressing the recovery and well-being of victims. This research introduces The Constitution of Peace as a transformative, victim-centered model for resolving serious human rights violations outside the courtroom, aligning with the principles and soul of the 1945 Constitution. The proposed model comprises three innovative approaches: first, mediation facilitated by the National Human Rights Commission to foster dialogue and accountability; second, the provision of compensation, restitution, and assistance to victims through the Witness and Victim Protection Agency, ensuring tangible support for recovery; and third, an official apology by the relevant authority, accompanied by the fulfillment of economic, social, and culpability obligations. Together, these measures aim to correct the limitations of the current retributive framework by prioritizing restorative justice and victim empowerment. By embracing these victim-oriented solutions, this model not only addresses the legal and moral obligations enshrined in the 1945 Constitution but also fosters reconciliation and societal healing. The research underscores the transformative potential of the Constitution as a foundation for peace, justice, and the resolution of entrenched human rights challenges. It calls for a paradigm shift from punitive measures to a more holistic approach, ensuring that justice serves both the dignity of victims and the broader goal of national harmony.

Abstract

The development of information technology has accelerated the growth of electronic commerce (e-commerce) transactions in Indonesia, which provides convenience for consumers but also increases the risk of violations of their rights. This research aims to analyze the legal protection available to consumers in the context of e-commerce, highlighting existing regulations and challenges in their implementation. The method used in this research is a normative juridical approach, which issued Law Number 8 of 1999 concerning Consumer Protection (UUPK) and Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) as the main legal framework. Even though there are regulations governing consumer protection, there are still several limitations, such as the definition of business actors which only applies in the territory of Indonesia and guarantees of effective settlement. Apart from that, transaction security issues and consumers' low understanding of their rights are also obstacles. This research aims to provide recommendations to strengthen legal protection for consumers, so as to create a safer and more reliable e-commerce ecosystem.

Abstract

Penelitian ini dilakukan karena banyaknya protes dari masyarakat sipil atas Rancangan Undang-Undang (RUU) Penyiaran yang muncul di publik atas Inisiatif Dewan Perwakilan Rakyat (DPR). RUU tersebut dikhawatirkan masyarakat sipil karena beberapa pasalnya berpotensi mengurangi independensi pers dan dipandang membatasi jurnalisme kegiatan investigatif serta Profesi Jurnalis Investigasi. Penelitian ini merupakan penelitian hukum normatif, dengan pendekatan analitis dan konseptual, yang berdasarkan bentuknya merupakan tipe penelitian deskriptif. Kesimpulan Penelitian ini, Desain Legislasi RUU Penyiaran yang Menguatkan Profesi Jurnalis Investigasi, yaitu: pertama, Menyusun RUU Penyiaran Berdasarkan Prinsip Partisipasi Publik Bermakna; dan kedua, Memberikan Jaminan Perlindungan Hukum Bagi Profesi Jurnalis Investigasi. Agar berhasil membentuk regulasi yang legitimate penelitian ini menyarankan DPR dan Presiden harus menggunakan kewenangan konstitusionalnya dalam pembentukan Undang-Undang untuk tidak menyetujui pasal-pasal yang mengancam kebebasan pers pada umumnya dan profesi jurnalis pada khususnya, termasuk jurnalis investigasi.
