Abstract

Abstract

This study aims to examine in-depth how the community of Kwangenrejo Village, Kalitidu District, Bojonegoro Regency, fosters harmony and religious tolerance in a multireligious society. Using a descriptive qualitative method and an ethnographic approach, data was collected through observations, in-depth interviews, and document studies to capture the social dynamics comprehensively. The findings reveal that harmony in Kwangenrejo Village is formed naturally and deeply rooted in the daily lives of the community. First, social interactions such as mutual cooperation, helping one another, and cross-religious visits during religious holidays reflect tangible harmony. Second, the process of building harmony is supported by an inclusive informal educational environment, such as children's involvement in their respective religious activities. Third, values of moderate Islamic education, such as tasamuh (tolerance), tawazun (balance), and ukhuwah (brotherhood), serve as a crucial foundation that fosters openness, mutual respect, and the promotion of peace amidst diversity. These findings affirm that interfaith harmony can be realized through collective awareness, values-based education, and social practices in daily life.

Abstract

The study aims to determine the implementation of mappaje practices in Tolowe Ponre Waru Village, Wolo District, Kolaka Regency, and analyze the practices based on the perspective of muamalah fiqh in Islamic economic law. This study explores the practice of mappaje from a jurisprudence-based perspective. The primary focus of this research is to understand how this practice is carried out, its underlying values, and its alignment with the principles of jurisprudence-based principles. This study uses a qualitative research method with an empirical approach. Data collection techniques are carried out through observation, interviews, and documentation of mappaje actors, community leaders, and local religious leaders. The data obtained were analyzed descriptively qualitatively by linking field facts and muamalah fiqh provisions. The results show that mappaje practices in Tolowe Ponre Waru Village is carried out through several stages, namely initial offers and communication, inspection and assessment of plant conditions, and implementation of a verbal sale and purchase agreement based on an agreement between both parties. This practice is carried out of mutual consent and has become a local custom. From the perspective of Islamic jurisprudence (fiqh) of muamalah (contractual transactions), mappaje is essentially permissible as long as it meets the pillars and conditions of a sale and purchase, does not involve any element of fraud, and minimizes the element of gharar through clarity of agreement and honesty between the parties. Therefore, mappaje is acceptable under Islamic economic law if implemented in accordance with the principles of justice, benefit, and prudence. Keywords: Fiqh of Muamalah; Gharar;  Mappaje, Sale and Purchase.

Abstract

This study aims to examine how ushul fiqh methodology is practiced in bahtsul masail activities at Mambaus Sholihin Islamic Boarding School, Suci, Manyar, Gresik, and to explore its implications for Islamic legal education in the pesantren context. This research employed a qualitative field approach through direct observation of bahtsul masail sessions and in-depth interviews with teachers and students involved in the discussions. The findings indicate that bahtsul masail follows a flexible but recognizable procedural pattern, beginning with problem formulation, followed by the exploration of classical legal sources, argumentative exchange, and collective decision making. Legal reasoning in the forum is not limited to the reproduction of juristic opinions, but involves the practical use of ushul fiqh tools such as identifying legal causes, analogical reasoning, and the application of legal maxims, although these tools are rarely stated explicitly. The study also shows that bahtsul masail plays a central role in shaping students’ methodological understanding of Islamic law. However, junior students often experience difficulty in tracing the reasoning process behind legal conclusions. This study concludes that bahtsul masail provides an effective learning space for internalizing ushul fiqh, while stronger integration with formal instruction is needed to enhance conceptual clarity and broader participation

Abstract

This study examines the gap between the normative guarantee of voting rights for persons with mental disabilities and their implementation in elections, despite Constitutional Court Decision Number 135/PUU-XIII/2015, which affirms that mental disorders do not automatically eliminate a person’s capacity to vote. It aims to analyze the implementation of this decision from a siyasah perspective through a case study at the Southeast Sulawesi Provincial Mental Hospital. The research employs an empirical juridical method with a qualitative approach. Data were collected through observation, in-depth interviews, and documentation involving hospital staff and the Kendari City General Election Commission. Data analysis was conducted through reduction, display, and conclusion drawing. The findings reveal that the implementation of voting rights for persons with mental disabilities still faces administrative and institutional obstacles. Voter registration remains incidental and unsustained, the absence of special or mobile polling stations limits access for inpatients, and the assessment of voting capacity is not supported by standardized operating procedures or adequate dissemination. These findings indicate that the main problem lies in technical governance rather than in the legal foundation itself. From a siyasah perspective, this condition reflects the incomplete realization of justice, trust, public welfare, and non-discrimination. The study highlights the importance of viewing mental hospitals as spaces for the exercise of political rights. Its implications include strengthening inter-institutional coordination, formulating joint standard operating procedures, conducting periodic voter registration, providing accessible polling mechanisms, and developing more inclusive, fair, and sustainable electoral policies for persons with mental disabilities at the local level.

Abstract

This study aims to analyze the internalization of Islamic values through the eco-pesantren program in environmental conservation at Jauharul Maknun Islamic Boarding School, Lasem Dukun Gresik. This research employs a qualitative approach with a case study design. Data collection techniques include observation, in-depth interviews, and documentation. Data analysis uses the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. The results show that the eco-pesantren program is implemented through waste management, environmental greening, routine cleanliness activities, and waste utilization. The internalization process of Islamic values is carried out through role modeling, habituation, teaching, direct practice, and reinforcement through rules and pesantren culture. This program has a positive impact on students' behavior, including increased religious awareness, the formation of clean and healthy living habits, and greater environmental concern. Therefore, the eco-pesantren program is proven to be effective as a medium for internalizing Islamic values in environmental conservation and in shaping students’ ecological character.

Abstract

This study aims to analyze the role of non-formal Islamic education in mitigating social conflict within a pluralistic community in Balongtunjung Village, Gresik Regency. The background of this study is rooted in the high potential for social friction within a heterogeneous community, which necessitates a values-based preventive approach. The study employs a qualitative approach with a case study design to deeply understand the naturalistic social-religious dynamics at play. Data were collected through observation, in-depth interviews, and documentation of religious figures and community members involved in religious activities. Data analysis was conducted interactively through the stages of data condensation, data presentation, and drawing conclusions using triangulation techniques to ensure the validity of the findings. The results of the study indicate that non-formal Islamic education, through Friday sermons, majelis taklim, and religious study sessions, serves as an effective social mechanism in mitigating potential conflicts and strengthening social cohesion. From a conflict theory perspective, these practices function as a safety valve that prevents the escalation of open conflict. Meanwhile, within the framework of social capital, non-formal education contributes to building trust, social networks, and reciprocal norms that support the creation of social harmony. These findings confirm that non-formal Islamic education serves not only as a means of transmitting religious values, but also as a strategic instrument in building sustainable community-based peace.
