Abstract

Penelitian ini bertujuan untuk mengetahui perbedaan dalam prosedur penyelesaian kasus perceraian di Pengadilan Agama Arga Makmur dan melalui pengadilan wilayah di Distrik Mukomuko, dan untuk mengetahui penerapan kepastian hukum dan efektivitas dalam persidangan Pengadilan Agama Arga Makmur di Mukomuko Distrik dalam pandangan hukum positif dan hukum Islam. Jenis penelitian ini adalah penelitian lapangan dengan pendekatan yuridis normatif. Teknik pengumpulan data adalah wawancara dan dokumentasi. Sedangkan teknik analisis data yang digunakan adalah kerangka berpikir induktif, yaitu cara berpikir dengan menarik kesimpulan dari data tertentu. Hasil dari penelitian ini adalah: 1) Perbedaan dalam prosedur penyelesaian kasus perceraian di Pengadilan Agama Arga Makmur dan melalui pengadilan bergerak di Distrik Mukomuko, yaitu dalam prosedur untuk mengimplementasikan pengadilan sirkuit penyelesaian kasus yang didengar di balai desa di bidang pemohon, sementara dalam hal biaya dan waktu persidangan tidak menemukan perbedaan dan penyelesaian kasus perceraian melalui persidangan secara umum di kantor pengadilan; 2) Penerapan kepastian hukum dan keefektifan sidang keliling Pengadilan Agama Arga Makmur di Kabupaten Mukomuko dalam pandangan hukum positif dan hukum Islam adalah efektivitas penyelesaian kasus perceraian melalui sistem pengadilan keliling oleh Arga Makmur Pengadilan Agama dalam upayanya membantu orang miskin agar menjadi efektif hanya dalam hal waktu perjalanan dan biaya transportasi saja, untuk prosedur pelaksanaan dan lainnya tetap sama, tidak ada perbedaan yang ditemukan seperti penyelesaian kasus perceraian melalui persidangan pada umumnya di kantor pengadilan. Relevansi sistem kebijakan untuk menyelesaikan kasus perceraian di Indonesia adalah bahwa pengadilan wilayah dalam konteks kasus perceraian tidak tepat, karena pada dasarnya perceraian dilarang. Dan jika prosedur perceraian difasilitasi, lebih banyak orang di Indonesia akan bercerai.

Abstract

Tulisan ini menjelaskan regulasi poligami di lima negara Islam, khususnya tentang sebab-sebab kebolehan dan pelarangannya. Metode yang umum digunakan untuk pembaruan hukum keluarga di lima negara tersebut, tampaknya lebih dominan menggunakan metode extra-doctrinal reform dan sedikit dengan intra-docrinal reform, itupun masing-masing dengan modifikasi dan tekanan yang berbeda-beda. Secara vertikal, keberanjakan hukum keluarga pada kelima negara di atas dari kitab-kitab fikih mazhab cukup tinggi. Yang tertinggi adalah Iran, disusul Malaysia, lalu Somalia, dan terakhir Indonesia. Semakin rinci dan banyak sebab yang disebutkan untuk kebolehan poligami karena keadaan istri, berarti semakin longgar dan besar peluang poligami. Sedangkan Tunisia melarang poligami secara mutlak.

Abstract

Abstract : The aims of this study are: First, to describe the division of inheritance in polygamous marriages according to Islamic law. Second, to describe the division of inheritance in polygamous marriages according to positive law. The third is knowing the study of the maslahah mursalah aspect of the inheritance of siri polygamous marriages. This type of research is library research with a normative juridical approach. This study concludes: First, the position of inheritance from siri marriages according to positive law, that is, does not have legal force and the position of the wife of a siri marriage cannot be recognized by the State and is not recorded in the state administration. The status of the husband or wife who is carrying out the marriage is not recorded in the population register, so that the child born cannot obtain a birth certificate, even if the biological father dies later, the child cannot claim his inheritance rights. According to Islamic law, the validity of a marriage lies in the adequacy of the conditions and pillars of marriage without the need to register a marriage before the state or an authorized official. Siri marriage becomes valid if the terms and pillars of syar'i are met. So that children born from unregistered marriages are considered valid and have the right to receive recognition from their father and their father's family and to receive inheritance rights and maintenance from their parents. Therefore, the child is still valid as the child of the heir. Second, in the view of maslahah mursalah, the problem of dividing inheritance in the case of siri marriages is included in the daruriyyat level because it relates to protecting lives and assets. In this regard, inheritance is a form of maintenance of human souls and assets. Muslims in Indonesia have an obligation to comply with the laws and regulations that apply in Indonesia. To avoid harm from the consequences of an unregistered marriage, the government determines marriage registration as a legal requirement for a marriage which has implications for children's rights. Because of that, Muslims in Indonesia are obliged to follow the laws and regulations that have been established for the benefit of family life.Keywords: Inheritance, Siri Marriage Abstrak: Tujuan penelitian ini adalah : Pertama, untuk mendeskripsikan kedudukan perkawinan siri menurut hukum Islam. Kedua, untuk mendeskripsikan implikasi warisan pada perkawinan siri pada hukum positif di Indonesia dan hukum Islam. Jenis penelitian ini adalah penelitian kepustakaan (library researh) pendekatan yuridis normatif. Penelitian ini menyimpulkan : Pertama, harta warisan merupakan wujud pemeliharaan terhadap jiwa dan harta manusia. Umat islam di Indonesia memiliki kewajiban memenuhi hukumdan peraturan yang berlaku di Indonesia. Untuk menghindari mudaharatdari konsekuensi sebuah perkawinan siri, maka pemerintah menentukan pencatatan nikah sebagai syarat sahnya sebuah peerkawinan yang berimplikasi kepada hak anak. Karena itulah maka umat Islam di Indonesia wajib mengikuti peraturan perundang-undangan yang telah ditetapkan untuk kemaslahatan hidup berkeluarga. Sementara, kedudukan hak waris dari pekawinan siridalam pandangan Islam jelas bahwa pernikahan siri adalah sah, dengan sahnya pernikahan siri menurut Islam maka hal tersebut berkorelasi dengan keberadaan harta peninggalan dan atau harta warisan yang ditinggalkannya. Apabila nikah siri benar-benar ada dan dilaksanakan oleh pasangan suami isteri maka hak-hak waris sudah melekat kepada anak yang dilahirkannya, dalam arti anak yang dilahirkan dalam pernikahan siriadalah mempunyai hak waris yang harus dilindungi oleh hukum sepanjang tidak ada penghalang-penghalang untuk mendapatkan harta warisan. Kedua, kedudukan waris dari perkawinan sirimenurut hukum positif yaitu tidak memiliki kekuatan hukum dan kedudukan isteri kawin Siri tidak dapat diakui oleh Negara dan tidak tercatatkan pada administrasi Negara. Status suami atau istri yang melakukan perkawinan tidak tercatat dalam daftar kependudukan, sehingga anak yang dilahirkan tidak dapat memperoleh akta kelahiran, bahkan kelak apabila ayah kandungnya meninggal, anak tersebut tidak dapat menuntut hak warisnya.  Menurut Hukum Islam, sahnya perkawinan terletak pada kecukupan syarat dan rukun nikah tanpa perlu melakukan suatu pencatatan pernikahan dihadapan negara atau pejabat yang berwenang. Perkawinan siri menjadi sah jika syarat dan rukun syar’inya terpenuhi. Sehingga anak yang dilahirkan dari perkawinan siri  dianggap sah dan berhak mendapatkan pengakuan dari ayah dan keluarga ayahnya serta mendapatkan hak waris dan nafkah dari orang tuanya.  Oleh karena itu, anak tersebut tetaplah sah sebagai anak dari pewaris.Kata Kunci : Warisan, Perkawinan Siri

Abstract

This paper aims at analyzing the form of restorative justice implemented in a customary court in Rejang Lebong District, and maqāṣid al-sharī‘ah review of the customary court. This type of research is qualitative with sociological-juridical approach. Data sources were literature, observation, in-depth interviews and documentation. The data analysis technique used qualitative descriptive analysis. This study showed that the form of restorative justice applied in the process customary court in Rejang Lebong prioritizes deliberation and peace between the parties. In terms of sanctions, compensation is based on the request of the victim and the consent of the perpetrator coupled with customary fines. Although there is a provision for customary fines, in practice, the judge determines the amount according to the ability of the perpetrator. In terms of  maqāṣid al-sharī‘ah, the process prioritizing deliberation and peace is relevant to the objective of evading mafsadat, which is to reduce the anger and resentment of the victim or their family. Based on the form of sanctions applied, there is a benefit to maintain the existence of religion, property, soul, offspring, and honor. The sanctions prioritizing restoration, harmonious relations, deterrent effects, and learning for the community, have mutual functions of zawajir and ta'dib. This customary justice model that combines restorative justice and local wisdom can possibly be an alternative dispute resolution to non-litigation case settlement.

Abstract

The debate on wishing Merry Christmas to non-Muslims has become a major focus in discussions among Muslims in Indonesia. The diverse perspectives on this issue reflect the tension between religious principles and the complex socio-cultural demands of a multicultural society. This study examines M. Quraish Shihab's views on the ruling of wishing Merry Christmas to non-Muslims, focusing on his inclusive interpretation, tolerance, and respect for religious diversity. This research employs a qualitative approach and uses hermeneutical analysis to explore the Qur'anic texts that form the basis of Quraish Shihab's views. The findings show that Quraish Shihab supports the practice of wishing Merry Christmas, considering it permissible in the context of strengthening social relationships, provided it is done with a clear intention and without acknowledging theological aspects that contradict Islam. A comparison with the views of other scholars, such as Ibn Taymiyyah, Yusuf al-Qaradawi, and Ahmed Kutty reveals a variety of opinions on this issue. The study concludes that Quraish Shihab's inclusive approach in his interpretation has made a valuable and positive contribution to understanding and applying Islamic values in a pluralistic society like Indonesia, while also emphasizing the importance of interfaith dialogue and maintaining harmonious social relationships.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana konsep Perlindungan Anak Dalam Undang-Undang Nomor  17  Tahun 2016 Tentang Perlindungan Anak Korban Kekerasan Seksual ?. Bagaimana ketentuan Perlindungan Anak Dalam Undang-Undang Nomor 17 Tahun 2016 tentang perlindungan anak korban kekerasan seksual perspektif Fikih Siyasah Dusturiyah?. Metode penelitian adalah penelitian normatif atau penelitian kepustakaan dengan melakukan pendekatan perundang-undangan dan pendekatan konsep. Pengumpulan data menggunakan teknik membaca, mengutip informasi. Hasil penelitian ini menunjukkan bahwa Konsep perlindungan anak menurut Undang-Undang Nomor 17 Tahun 2017 tentang perlindungan anak adalah segala kegiatan untuk menjamin dan melindungi anak dan hak-haknya agar dapat hidup, tumbuh, berkembang, dan berpartisipasi, secara optimal sesuai dengan harkat dan martabat kemanusiaan, serta mendapat perlindungan dari kekerasan dan diskriminasi. Anak sering menjadi korban kekerasan terutama kekerasan seksual, oleh sebab itu pemerintah menambahkan aturan yang akan menjadi sanksi tegas bagi pelaku tersebut. Sanksi yang dimaksud yaitu sudah tertera dalam Undang-Undang Nomor 17 Tahun 2016 tentang perlindungan anak pasal 81, 81A dan 82. Ketentuan Perlindungan Anak Perspektif Fikih Siyasah  dusturiyah selain berpedoman pada Al-Qur’an dan Hadits, juga berpedoman pada hukum yang berlaku di Negara tersebut sehingga untuk menyelesaikan permasalahan tentang perlindungan anak akan diselesaikan dengan semua sanksi yang berlaku.

Abstract

This research aims to describe the wali mujbir concept according to Imam Shafi'i in the book of al-Umm, then analyze the maqasid sharia in it and the relevance of its application in the modern era. This type of research is qualitative in the form of normative legal research using library research methods. Source data was taken through documentation. As for data analysis, it was used as thematic and inductive with a historical and philosophical approach. The research results concluded that the wali's right to ijbar, according to Imam Shafi'i is the father's right to force his daughter to marry or forbid her daughter from marrying a man as a form of protection and responsibility under certain conditions. Wali mujbir are divided into two groups: (a) for girls who are not yet adults, their father has the absolute right to ijbar without having to ask for his consent; (b) for adult girls who are 15 years old or have already had a period, although her father can marry her off without asking for her consent. There is a recommendation to consult with the girl, although this recommendation is optional. In the view of the maqasid sharia, the walis's ijbar aims to safeguard the interests of the girl child so that she can obtain an equal husband, maintain the religious quality of the girl and her future offspring, safeguard her welfare, safeguard her safety from potential abuse by her future husband, and maintain the good quality of offspring from a healthy husband, and complete with all five senses. By holistically understanding the wali's ijbar rights according to the context, the implementation of wali mujbir remains current and relevant to the dynamics of modern society.

Abstract

Understanding wealth (al-mal) in the Qur’an includes food (tha`am), soil (ardhun), and money (dirham). Meaning of senonim with al-mal is qintharah, tsamarun, kanzun, khaza’in, maghanim, al-anfal, mata`, al-khair, and al-turath. According to the Koran, Alloh is the absolute owner of wealth. Wealth as private asset is intended for direct human character and attitude to look for, own, and use it on the right path. Wealth as belonging together meant that all humans have the opportunity to look for wealth, no one is given the right to strict circulation of wealth in the human environment and in every one’s wealth there are parts of others. Function of wealth as a provision for worship, support life, as a test of faith, the support to be a leader, and one of the jewelry of life. Obtaining wealth should not be by way of vanity, its use must be balanced, the management must be careful, honest, sincere, and transparent and able to provide benefits to the community.

Abstract

The purpose of this study was to determine the strategy of the Police in the Directorate of General Criminal Investigation of the Bengkulu Regional Police in preventing and prosecuting land mafia figures in Bengkulu City and how the perspective of Fiqh Siyasah on the strategy of the Police in the Directorate of General Criminal Investigation of the Bengkulu Regional Police in preventing and prosecuting land mafia figures in Bengkulu City. The type of field research, namely the object of research directly at the Directorate of General Criminal Investigation of the Bengkulu Regional Police using a qualitative approach. The research methods used were observation, interviews and documentation. The results of the study showed that the Strategy implemented by the Bengkulu Regional Police, Directorate of General Criminal Investigation in preventing and prosecuting land mafia figures has succeeded in reducing and narrowing the room for movement for land mafia figures and also the police's efforts to increase public insight have helped the public avoid the enticements and modes used by land mafia figures. Then by forming a Land Mafia Task Force consisting of the National Land Agency (BPN), the High Prosecutor's Office and the Police, it has succeeded in creating good collaboration between agencies so that there is a reduction in land mafia cases in the city of Bengkulu. Meanwhile, according to Islamic jurisprudence, land mafia or land fraud is strictly prohibited, individuals who commit fraud are classified as people who are unjust, the police strategy that has been carried out is in accordance with the principles of the court (al-qadha) and peace (ishlah). Thus, the settlement of disputes carried out by the Bengkulu Regional Police is in accordance with Islamic Law.

Abstract

Modern society's awareness of the importance of a healthy lifestyle has brought new ideas not only limited to diet and sleep but also exercise. In this case, exercise is believed to be important in realizing physical and mental health. However, some groups limit the practice of exercise to archery, swimming, and horseback riding, as referred to the hadith delivered by the prophet. This study aims to analyze the concept of sports in the Prophetic traditions as a basis for developing a holistic sports education program, as well as to examine the permissibility of the Prophetic sports tradition through the contextualization of hadith in the modern era. Through a qualitative approach based on literature study, the author uses a collection of literature and relevant sources of information as research sources. In analyzing the data, the author uses the stages proposed by Miles & Huberman, namely data identification, data reduction, data presentation, and conclusion drawing. From two questions; how is the contextualization of sports hadith in realizing physical and mental health, and how is the application of hadith about sports in the development of sports education programs, the results show that the concept of sports in the prophet's traditions is not seen from the form of sports alone, such as swimming, archery and horse riding, but rather on the aspect of its purpose and usefulness. Philosophically, the purpose and benefits of sports education in children through the context of archery and horse riding during the Prophet's time are more directed at the form of children's education so that they become individuals who understand the goals and objectives of life, calmness, concentration, and strategies in achieving these goals, including mastery of modern technological means that support the ease of physical activity in facilitating towards every goal of life.
