Abstract

Permasalahan yang sering terjadi adalah Perjnajian Pengikatan Jual Beli tidak dapat ditingkat menjadi Akta Jual Beli dikarenakan Pihak Penjual meninggal dunia dan sebahagian dari ahli warisnya meminta pembatalan terbahadap PPJB tersebut. Berdasarkan ketentuan ahli waris para pihak dikemudian hari menggantikan hak dan kewajiban yang meninggal dunia. Ketentuan yang diatur dalam Pasal 1318 KUHPerdata tersebut, yakni para ahli waris ab intestato hanya merupakan satu kategori dari golongan yang memperoleh hak karena titel umum. Ketentuan tersebut diatur dalam Pasal 833 ayat (1) KUHPerdata tentang ahli waris ab intestato. Penelitan ini menggunakan metode yuridis empiris. Hasil penelitian yang diperoleh yaitu 1. Kedudukan hukum ahli waris dalam PPJB yang dibatalkan secara sepihak oleh ahli waris, Hak dan kewajiban pewaris secara otomatis menjadi hak dan kewajiban ahli waris, sekalipun ahli waris tersebut tidak mengetahui adanya pewarisan, Ahli waris menempati kedudukan si meninggal dalam hal yang menyangkut atas segala barang, segala hak, dan segala piutang dari pewaris, sekaligus berkewajiban membayar utang dan kewajiban-kewajiban pewaris. 2. Akibat hukum pembatalan PPJB secara sepihak oleh ahli waris pengembalian pada posisi semula sebagaimana halnya sebelum terjadi perjanjian yang diatur dalam Pasal 1451 dan 1452 BW. Pihak yang merasa dirugikan atas pembatalan dapat menuntut penggantian biaya (kosten), ganti rugi (schaden), dan bunga (interesten) karena tidak terpenuhinya suatu perikatan. Sedangkan pihak lainnya yang telah terlanjur menerima prestasi dari pihak lain wajib mengembalikannya. 3. Perlindungan hukum terhadap pembeli dalam hal PPJB yang secara sepihak dibatalkan oleh ahli waris bahwa pihak pembeli memiliki kekuatan pembuktian dari akta PPJB yang dibuat oleh notaris dihadapan pengadilan. Pihak pembeli dapat mengajukan tuntutan untuk para ahli waris melaksanakan akta jual beli.

Abstract

This study investigates the implementation of the obligation to allocate 20% of plantation land to farmers from a jurisdictional perspective by using a case study of PT. Wanasari Nusantara in Kuantan Singingi Regency, Riau Province. The obligation, stipulated under the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 26 of 2007, aims to empower local communities and foster regional economic development. Employing an empirical legal research methodology, this study analyzes legal frameworks and qualitative data gathered through stakeholder interviews. The findings indicate that the company has not fully complied with its obligations, largely due to inadequate oversight and a lack of transparency in the management and expansion of Land Use Rights (Hak Guna Usaha or HGU). From the perspective of spatial planning law, land allocation policies are vital to ensure equitable access to land resources. However, these policies require stronger regulatory frameworks and enforcement mechanisms to achieve their objectives. The study concludes by recommending a comprehensive revision of supervision mechanisms and an enhanced governmental role to ensure effective implementation of land allocation policies. This approach is essential for achieving distributive justice and promoting sustainable social and economic development.

Abstract

The affirmative policy allowing the State to do more to the unrepresented group within the framework of equality and justice is enshrined in Article 28 H (2) of the Constitution of the Republic of Indonesia of 1945 which states that everyone is entitled to special facilities and treatment for equal opportunities and benefits in order to equity and justice. In the government procurement through providers, the Papua Special Autonomy Act forms the basis for the affirmative policy to be established. The study aims to analyze the existence of affirmative policy of government procurement through providers and to examine the content of the article according to the hierarchy of the regulations. The study uses a normative and descriptive approach, legal research to describe and test applicable norms or provisions. Research results: First: the affirmative policy of government procurement through providers requires the existence of the participation of papuan economic operator directly in government procurements through providers in the territory of Papua, where the criteria of Papuan economic operator have also been set out in the regulations. Secondly, in the content of Article 2 of the Papua Governor Regulation Number 46 of 2021 on Government Procurement in Papua Province, it is explained that the scope of application of the governor's regulation includes the government procurement financed by the State Budget Funds. This is contrary to the content of article 4 Paragraph (1) letter a of the Regulation of the Minister of Public Works and Housing No. 1 of 2023 on the Guidelines for the Supervision of the Maintenance of Construction Services Implemented by the Provincial Government, the District, and the City which explains that the authority of the local government of the provinces, the districts and the towns in supervising the maintenance of the construction services, including the process of government procurement, is limited only to the activities of construction financed with the Regional Budget Funds.

Abstract

Opportunities for oil palm plantations and the oil palm processing industry are still in high demand, both to meet domestic and foreign markets. This condition is a promising business opportunity for the company. Even in times of economic crisis, it has proven to be able to survive and continue to grow. In this study, first, the authority of the local government in processing oil palm plantation licensing in Kampar Regency is in terms of issuing location permits, issuing plantation business permits and supervising plantation activities, but at the implementation stage there have been procedural violations in the field of oil palm plantation licensing in Kampar Regency, which indicators can be seen from the stages that have been exceeded or not implemented in the process of issuing oil palm plantation licenses. Second, the factors that hinder the granting of oil palm plantation permits in Kampar Regency are complex and changing requirements, licensing regulations that are often updated and the addition of new requirements make the licensing process longer and more complex, this is often a complaint from business actors, overlapping authorities, land conflicts, environmental considerations, pressure from the community, limited human resources, budget, and infrastructure in the local government can be hindering the effectiveness of the implementation of supervision and control over plantation activities. And corrupt practices in the licensing process are often suspected by the public, this can slow down or even stop the licensing process.

Abstract

In order to realize levies that reach targets, of course there must be good management and supervision from the regional government, whether it is the Transportation Agency as the manager and collector of levies, the DPRD as the legislative function that prepares and establishes regional regulations. The problems that the author raises are; First; How is the supervision carried out by the Sungai Banyak Government in achieving the revenue target from collecting parking fees on the side of public roads? Second; What is the parking levy collection system on the side of the third public road; How to enforce the law against collecting parking fees that do not have an official permit. This research was also carried out using an empirical juridical approach, namely research based on field research as primary data and to complement and support field data, library data was needed as secondary data. Primary data was obtained through interviews with informants from the Transportation Department, Satpol PP, DPRD, Bakeuda, Parking Attendants and the Parking User Community and secondary data was obtained through literature study. All data obtained from field research and literature will be analyzed qualitatively and described descriptively. Based on the research results, it was concluded that the supervision carried out by several related parties was not effective, as can be seen from the failure to achieve the levy target for the parking sector. The levy collection system is not carried out in accordance with the provisions, seen from withdrawals that do not use tickets and deposits of levy proceeds are not carried out every day. Law enforcement against violators is not effective, as can be seen from the large number of illegal parking lots and illegal fees at official and unofficial parking points.

Abstract

In order to protect the rights of indigenous peoples in Indonesia and the Philippines, this study aims to examine the connection between substantive justice and the FPIC framework. Since Indonesia has not officially adopted Free, Prior, and Informed Consent (FPIC), there is a major difference between the two countries' legal systems in this respect. On top of that, it's a part of the Philippines' Indigenous Peoples' Rights Act (IPRA). Methods used in the study include conceptual frameworks, legal philosophy, comparative procedures, comparative approaches to policy and law, and normative (doctrinal) approaches to analysis. In spite of difficulties, the Philippines demonstrates a more thorough application of FPIC, but the results reveal that Indonesia's implementation is shallow and does not effectively protect the rights of indigenous groups. Separate bodies, such as the National Commission for the Rights and Protection of Indigenous Peoples (KNHPMA), should be established in Indonesia so that FPIC may be formally incorporated into laws, according to the paper. By fully integrating FPIC in Indonesia, we may achieve equity, inclusivity, and sustainable development based on respect for local knowledge. This might reduce agricultural disputes and improve the protection of indigenous peoples' human rights.

Abstract

Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan program strategis nasional yang bertujuan memberikan jaminan kepastian hukum atas tanah melalui sertifikasi dan mendorong tertib administrasi pertanahan di seluruh Indonesia. Salah satu lokasinya adalah kawasan sempadan Danau Maninjau, Sumatera Barat, yang ditetapkan sebagai Danau Prioritas Nasional. Meskipun memiliki nilai ekologis dan ekonomi strategis, larangan penerbitan sertifikat tanah di kawasan sempadan ini menimbulkan ketidakpastian hukum dan ketidakpuasan masyarakat adat. Konflik antara pelestarian lingkungan dan pengakuan hak atas tanah menjadi tantangan utama dalam pelaksanaan PTSL. Penelitian ini menggunakan pendekatan yuridis empiris dengan metode deskriptif analitis. Hasil penelitian menunjukkan kendala utama meliputi evaluasi lokasi PTSL yang belum memadai, prosedur pendaftaran tanah yang ambigu, dan ketidaksinkronan peraturan pusat serta daerah terkait pengakuan hak ulayat. Namun, tanah ulayat tetap dapat diakui selama tidak bertentangan dengan fungsi konservasi. Penelitian ini memberikan rekomendasi untuk penyusunan regulasi yang lebih jelas dan implementatif serta memperkaya studi hukum agraria terkait pengelolaan sumber daya alam dan hak masyarakat adat, demi mewujudkan kepastian hukum yang berkeadilan di kawasan sempadan Danau Maninjau.

Abstract

Penelitian ini membahas penguasaan tanah dengan Hak Guna Bangunan (HGB) oleh Persekutuan Komanditer (Commanditaire Vennootschap/CV) di Kabupaten Kampar berdasarkan Surat Edaran Menteri Agraria dan Tata Ruang/BPN Nomor 2/SE-HT.02.01/VI/2019. HGB secara hukum hanya diberikan kepada warga negara Indonesia dan badan hukum yang berdiri berdasarkan hukum Indonesia. Namun, kebijakan tersebut menimbulkan permasalahan hukum karena CV bukan merupakan badan hukum. Penelitian ini bertujuan untuk menganalisis kedudukan hukum CV sebagai pemegang HGB, proses pemberian HGB kepada CV, serta kepastian hukum atas kebijakan ini. Metode penelitian yang digunakan adalah yuridis empiris, dengan mengamati implementasi kebijakan di masyarakat. Hasil penelitian menunjukkan bahwa pemberian HGB kepada CV bertentangan dengan Undang-Undang Pokok Agraria Nomor 5 Tahun 1960 dan Peraturan Pemerintah Nomor 40 Tahun 1996, sehingga menciptakan ketidakpastian hukum. Kesimpulan penelitian ini menyarankan perlunya revisi peraturan agar kebijakan tersebut sesuai dengan norma hukum yang lebih tinggi.

Abstract

Beberapa tanah aset PT Kereta Api Indonesia (Persero) yang berada di Kelurahan Guguk Malintang, Kecamatan Padang Panjang Timur Kota Padang Panjang yang tidak difungsikan lagi secara optimal, dikarenakan sebagian rel-rel kereta api tersebut telah tertimbun oleh bangunan masyarakat sekitar mengakibatkan sebagian tanah aset PT Kereta Api Indonesia (Persero) banyak yang telah digunakan oleh masyarakat disekitarnya. Penelitan ini menggunakan metode yuridis empiris, dengan menggunakan data sekunder dan data primer adapun alat pengumpul data dalam penelitian ini menggunakan wawancara. Hasil Penelitian adalah Perlindungan hukum yang diberikan oleh PT Kereta Api Indonesia upaya yang dilakukan oleh PT. KAI dalam melindungi aset-asetnya yang berupa tanah baik sudah disertifikatkan maupun belum disertifikatkan.

Abstract

Land acquisition plays an important role in development and requires the involvement of a notary to ensure the legality of the transaction. However, in practice, notaries can be involved in corruption crimes, such as falsifying documents and inflating prices. This study analyzes the criminal liability of notaries in the case of corruption in land acquisition of UIN Imam Bonjol Padang Campus with a normative juridical approach and case studies. The results of the study show that notaries who abuse their authority can be subject to criminal sanctions. Therefore, strict supervision and stricter regulations are needed to prevent corruption in land procurement and maintain the integrity of the notary profession
