Abstract

Nagari Sumaniak has so much potential in various aspects that it can be developed. This potential has been utilized well, but there is still some potential that has not been fully utilized. In the aspect of governance, it was identified that the Sumaniak government had difficulties in drafting nagari regulations due to the lack of information obtained by the nagari governments related to the preparation of nagari regulations. Meanwhile, the readiness of human resources (governments) is needed as actors in the regions in carrying out government affairs. For this reason, it is necessary to increase the capacity of the nagari governments in drafting nagari regulations through legal drafting training for the nagari governments. The aim of this activity is to increase the understanding and ability of the nagari governments through drafting regulations in the nagari. The activity was carried out in 2020-2021 at Nagari Sumaniak. The target of this activity is the entire Nagari government in Sumaniak. The method used in this activity is the PRA (Participatory Rural Appraisal) method to prepare a CAP (Community Action Plan). Activities are carried out through various stages, such as FGD / brainstorming with nagari governments, revision and drafting of nagari regulations, as well as training related to legal drafting for nagari governments. From the various activities that have been carried out, it can be seen that there is motivation throughout the nagari governments to make a real contribution in providing ideas and support in the preparation of the nagari. Then, increase the capacity of the nagari governments in preparing the nagari after the training. All resources are committed to being able to assist in the development of the nagari. It is recommended for the nagari government to always carry out regular training and improve its quality and capacity in carrying out work professionally. Then, it is hoped that the local governments can provide further understanding to the community, especially regarding the nagari governments in making a nagari regulations.

Abstract

This research discusses the challenges of implementing Free, Prior, and Informed Consent (FPIC) for indigenous peoples in national legal arrangements in Indonesia. FPIC is a principle that gives indigenous peoples the right to give consent to policies that affect their territories and resources freely, prior to full information, and without pressure. Although the FPIC rights of indigenous peoples are implicitly described and regulated in various national regulations, such as the 1945 Constitution, Forestry Law, Village Law, and environmental regulations slot zeus, these arrangements do not necessarily guarantee the protection of indigenous peoples' rights over their customary territories. Explicit legal arrangements are needed to guarantee indigenous peoples' FPIC rights over their customary territories. This is because in its implementation, the application of FPIC rights still faces various challenges such as conflicts of interest with the State's Right to Control (HMN), low understanding in the field, and gender injustice being the main obstacles. This study uses a normative juridical approach to identify differences between international and national legal arrangements, and offers recommendations to improve the protection and implementation of FPIC in Indonesia. The research emphasizes the importance of explicit legal arrangements to achieve justice, prosperity and harmony between indigenous peoples and the government.

Abstract

Pola kepemilikan tanah pusako di Sumatra Barat tidak bersifat individual, melainkan milik komunal yaitu milik suku, kaum, dan nagari. Tanah ulayat kaum merupakan pusako yang diwariskan secara turun-temurun, yang haknya berada pada perempuan, namun sebagai pemegang hak atas tanah ulayat kaum adalah mamak kepala waris. Tanah ulayat merupakan tanah milik komunal yang tidak boleh dan tidak dapat didaftarkan atas nama satu atau beberapa pihak saja. Perubahan pandangan ini mulai terlihat dalam penguasaan tanah pada masyarakat di Sumatra Barat khususnya terhadap tanah ulayat kaum. Masyarakat mulai menjual tanah ulayat kaum sehingga terjadi penyimpangan adat yang mana tanah ulayat tidak boleh diperjualbelikan. Rumusan masalah penelitian ini: 1. Mengapa terjadi peralihan tanah ulayat kaum di Kota Padang? 2. Bagaimana proses peralihan tanah ulayat kaum di Kota Padang? 3. Apa kendala yang terjadi saat peralihan tanah ulayat kaum di Kota Padang?. Penelitian ini menggunakan metode yuridis empiris. Hasil penelitian yang diperoleh yaitu: 1. Alasan terjadinya peralihan tanah ulayat kaum di Kota Padang dikarenakan 1) untuk menutupi hutang gadai, 2) untuk kebutuhan ekonomi dan prosesnya dipermudah karena tanah ulayat kaum tersebut telah bersertipikat, 2. Proses peralihan tanah ulayat kaum di Kota Padang dengan cara pemohon memenuhi berkas diperlukan sebagai syarat peralihan atas tanah pada Kantor Pejabat Pembuat Akta Tanah yang berwenang sehingga tercapainya peralihan tersebut ke atas nama pemegang hak selanjutnya.

Abstract

This study aims to analyze the digital transformation in police call center services in Indonesia, by emphasizing the main aspects of public trust, user satisfaction, and institutional reputation. The rapid development of information and communication technology, the Indonesian National Police (Polri), continues to strive to digitalize public services to improve the effectiveness and quality of services. Polri's 110 call center service serves as a vanguard in public communication and response to security events, making it a strategic area in digital transformation. Research that has been done before to systematically examine the relationship between digitization and these three variables is still very limited. Most existing studies focus more on the technical aspects of information systems or procedural evaluation, without considering the social and institutional perspectives of digital change. Using a systematic literature review (SLR) approach based on the PRISMA protocol, this study aims to map the relevant literature and explore the linkages between digital transformation and these dimensions. PRISMA-based SLR method was chosen to provide a comprehensive overview of the dynamics of digitization in the National Police call center services. This research analyzes various studies, both from international and local contexts, to develop a more integrative conceptual framework regarding the influence of digitalization on people's perception of police institutions. This study will uncover the aspects that affect the success and challenges faced in the digitization of call center services as well as their impact on the relationship between the public and the National Police. Research shows that digitization of police call center services has significant potential in strengthening public trust, increasing user satisfaction, and improving the reputation of institutions. However, the success of this digital transformation is highly dependent on the ability of the National Police to ensure that the system implemented is responsive, transparent, and easily accessible to the public. This study also emphasizes the importance of a governance-based trust-based approach in building trust in institutions, which is relevant in the era of rapid digital interaction. It is expected that the results of this study can provide strategic recommendations for the National Police in designing a more effective digital transformation policy, as well as strengthening the legitimacy of institutions in the eyes of the public.

Abstract

Based on Presidential Instruction No.9/2025 the President ordered each village to form a Merah Putih Village Cooperative. Therefore, the Government of Nagari Kudu Gantiang in collaboration with the Department of State Administration Law, Faculty of Law, Andalas University conducted community service related to the establishment of the Merah Putih Nagari Cooperative. This activity aims to assist and socialize the formation of the Nagari Merah Putih Cooperative in Nagari Kudu Gantiang as an effort to strengthen the community-based economy. The method used is in the form of socialization and assistance in the formation of the Nagari Merah Putih Cooperative in Nagari Kudu Gantiang. The result of this service is that the Nagari Merah Putih Cooperative of Nagari Kudu Gantiang has been established as a revitalization of the Kudu Gantiang Village Unit Cooperative (KUD) which has not carried out its business activities for a long time.

Abstract

The problem of land registration in the Kampung Tua area of Batam City reflects the complex dynamics between the historical recognition of local communities and the formal agrarian legal system that applies in Indonesia. Until now, most of the land in Kampung Tua does not have a land rights certificate, even though it has been controlled by the community for generations. The dualism of authority between the Batam City Government and the Batam Business Agency (BP), as well as the insynchronization of regulations and spatial data, are the main obstacles in the process of legalizing people's rights. This research aims to analyze the land registration process in Kampung Tua, identify the types of rights granted to the community, and uncover obstacles and formulate strategic solutions in the context of local land policies. The method used is juridical-empirical, with a descriptive qualitative approach through document studies and in-depth interviews with relevant agencies, such as BPN, BP Batam, City Government, and community leaders. The results of the study show that the clarity of the legal status of land in Kampung Tua is very urgent to provide protection of community rights and encourage agrarian justice. It is necessary to strengthen single authority, prepare contextual technical regulations, and socialize legal procedures to the public in a more participatory manner.

Abstract

Penelitian ini mengkaji pengaturan anggaran negara untuk bantuan keuangan partai politik dengan fokus pada perbandingan sistem presidensial dan parlementer di negara-negara Asia Tenggara. Latar belakang penelitian mengidentifikasi permasalahan rendahnya transparansi dan akuntabilitas partai politik di Indonesia dalam pengelolaan keuangan, serta kekaburan norma dalam regulasi yang menyebabkan celah praktik koruptif. Tujuan penelitian adalah mengkaji pengaturan bantuan keuangan yang ideal, mekanisme pengawasan yang efektif, dan reformasi regulasi yang diperlukan untuk memperkuat transparansi dan akuntabilitas keuangan partai politik. Metode penelitian menggunakan pendekatan yuridis normatif dengan tiga pendekatan utama: perundang-undangan, konsep, dan perbandingan, melalui studi kepustakaan untuk mengumpulkan data sekunder. Pembahasan penelitian menguraikan perbandingan pengaturan bantuan keuangan partai politik di negara-negara Asia Tenggara dengan sistem presidensial (Filipina, Timor Leste) yang cenderung terpusat dengan dominasi eksekutif dan sistem parlementer (Malaysia, Thailand, Singapura) yang lebih terdesentralisasi dengan peran kunci parlemen. Penelitian juga membahas potensi penggunaan APBN sebagai sumber tunggal keuangan partai politik untuk meningkatkan transparansi dan akuntabilitas. Kesimpulan penelitian menunjukkan bahwa pendanaan melalui APBN berpotensi meningkatkan transparansi, namun memerlukan reformasi regulasi komprehensif, penguatan lembaga pengawas, dan mekanisme pelaporan efektif.

Abstract

Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan program strategis nasional yang bertujuan memberikan jaminan kepastian hukum atas tanah melalui sertifikasi dan mendorong tertib administrasi pertanahan di seluruh Indonesia. Salah satu lokasinya adalah kawasan sempadan Danau Maninjau, Sumatera Barat, yang ditetapkan sebagai Danau Prioritas Nasional. Meskipun memiliki nilai ekologis dan ekonomi strategis, larangan penerbitan sertifikat tanah di kawasan sempadan ini menimbulkan ketidakpastian hukum dan ketidakpuasan masyarakat adat. Konflik antara pelestarian lingkungan dan pengakuan hak atas tanah menjadi tantangan utama dalam pelaksanaan PTSL. Penelitian ini menggunakan pendekatan yuridis empiris dengan metode deskriptif analitis. Hasil penelitian menunjukkan kendala utama meliputi evaluasi lokasi PTSL yang belum memadai, prosedur pendaftaran tanah yang ambigu, dan ketidaksinkronan peraturan pusat serta daerah terkait pengakuan hak ulayat. Namun, tanah ulayat tetap dapat diakui selama tidak bertentangan dengan fungsi konservasi. Penelitian ini memberikan rekomendasi untuk penyusunan regulasi yang lebih jelas dan implementatif serta memperkaya studi hukum agraria terkait pengelolaan sumber daya alam dan hak masyarakat adat, demi mewujudkan kepastian hukum yang berkeadilan di kawasan sempadan Danau Maninjau.

Abstract

Penelitian ini membahas penguasaan tanah dengan Hak Guna Bangunan (HGB) oleh Persekutuan Komanditer (Commanditaire Vennootschap/CV) di Kabupaten Kampar berdasarkan Surat Edaran Menteri Agraria dan Tata Ruang/BPN Nomor 2/SE-HT.02.01/VI/2019. HGB secara hukum hanya diberikan kepada warga negara Indonesia dan badan hukum yang berdiri berdasarkan hukum Indonesia. Namun, kebijakan tersebut menimbulkan permasalahan hukum karena CV bukan merupakan badan hukum. Penelitian ini bertujuan untuk menganalisis kedudukan hukum CV sebagai pemegang HGB, proses pemberian HGB kepada CV, serta kepastian hukum atas kebijakan ini. Metode penelitian yang digunakan adalah yuridis empiris, dengan mengamati implementasi kebijakan di masyarakat. Hasil penelitian menunjukkan bahwa pemberian HGB kepada CV bertentangan dengan Undang-Undang Pokok Agraria Nomor 5 Tahun 1960 dan Peraturan Pemerintah Nomor 40 Tahun 1996, sehingga menciptakan ketidakpastian hukum. Kesimpulan penelitian ini menyarankan perlunya revisi peraturan agar kebijakan tersebut sesuai dengan norma hukum yang lebih tinggi.

Abstract

Beberapa tanah aset PT Kereta Api Indonesia (Persero) yang berada di Kelurahan Guguk Malintang, Kecamatan Padang Panjang Timur Kota Padang Panjang yang tidak difungsikan lagi secara optimal, dikarenakan sebagian rel-rel kereta api tersebut telah tertimbun oleh bangunan masyarakat sekitar mengakibatkan sebagian tanah aset PT Kereta Api Indonesia (Persero) banyak yang telah digunakan oleh masyarakat disekitarnya. Penelitan ini menggunakan metode yuridis empiris, dengan menggunakan data sekunder dan data primer adapun alat pengumpul data dalam penelitian ini menggunakan wawancara. Hasil Penelitian adalah Perlindungan hukum yang diberikan oleh PT Kereta Api Indonesia upaya yang dilakukan oleh PT. KAI dalam melindungi aset-asetnya yang berupa tanah baik sudah disertifikatkan maupun belum disertifikatkan.
