Abstract

The aim of this research is to provide insight to readers regarding what is meant by abortion as discussed in Ath-tabari's view in the book Jami-al-Bayan fi Ta'wil. Abortus provocatus medicinalis is an abortion carried out based on medical reasons/considerations. Meanwhile, abortion provocatus criminalis is an abortion carried out intentionally in violation of applicable legal provisions. Medically defines abortion as a pregnancy that terminates before the gestational age reaches 20 weeks and then results in the death of the fetus. When the fetus is alive or born safely after 20 weeks and before 38 weeks, it is called premature birth because the minimum period of pregnancy is 6 months and 20 weeks means not yet 6 months. The research method in this research is to use a type of library research method, namely by searching for data from various literature related to sexual violence and its prevention. Using content analysis methods, this research describes interpreters' interpretations of how the Koran prohibits sexual violence and provides ways to prevent it. The conclusion of this research is that the view of Islamic Sharia generally prohibits the practice of abortion. This is not permitted for several reasons, namely Islamic Sharia came in order to maintain Adhdharuriyyaat al-khams, abortion is completely contrary to the main purpose of marriage and the act of abortion is a negative attitude towards Allah SWT. The act of abortion is a negative attitude towards God. One will find many people who have abortions because they are driven by fear of being unable to carry the burden of life, educational costs and all matters related to counseling and child care. These are all negative attitudes towards Allah.

Abstract

In this research the focus is on how is shiqaq resolved? Then in this research we also discuss how in the household if there is syiqaq then there must be steps taken to resolve it, and in this research the researcher wants to examine how restorative justice is implemented regarding syiqaq in the household, and the researcher also examines how to implement restorative justice syiqaq in this household in Qs. An-nisa verse 34 in the thoughts of Wahbah Az-Zuhaili. The method used in this research is a qualitative method. This type of research is library research, meaning that this research focuses on literature by analyzing the content of the literature related to the research. The data collected in this research is by looking for cases of syiqaq in society and then collecting them as reinforcement in the research, then the researcher examines the implementation of restorative justice by taking examples from the community and comparing them with Islamic laws to see whether they are in line with or not. no, after that the researcher took the interpretation of Wahbah Azzuhaili in Qs. An-nisa verse 34 which relates to research. After all the data has been collected, the researcher begins the research. The sources for this research are books, journals, theses, articles discussing restorative justice, syiqaq and referring to Al-munir's interpretation. The conclusion of the research is that Wahbah Az-Zuhaili's view is that in the family it is the man who has the duty to educate his wife to be better, but in this case there are several types of wives, namely wives who obey their husbands, and there are wives who are obedient to their husbands. who disobeys her husband. If the wife disobeys her husband then the husband can advise, scold, separate the bed and even the husband can hit his wife on condition that it does not leave scars, wounds and bruises on her body, and if that happens then the wife can ask for protection from the family or even the court but as far as possible to maintain the marriage because Allah does not recommend divorce. In this research, the contribution of this research is to clarify whether this application is in line with the Islamic view which is strengthened by Az-Zuhaili's Thought.

Abstract

In living life, humans must be able to understand the Qur’an. For this reason, interpretation is needed from the ulama to explain in detail the meaning of the verses of the Qur'an, because people who do not receive guidance, guidance, and direction from Allah SWT are people who are at a loss. One aspect that is also important in society is ishlah. Allah SWT has decreed that fellow believers must be affectionate towards each other, and must not fight, let alone be enemies that lead to war. However, as time goes by, it cannot be denied that disputes can grow and occur, this is the location and function of the ishlah that Allah SWT has created. determine that all disputes no matter how big or small are resolved in a just and peaceful manner so that each conflicting party feels grateful and accepts wholeheartedly all the decisions that Allah SWT has made. assign to all humans. This research uses descriptive analytical methods so that readers can understand how Sayyid Qutb responds to the terms of Allah SWT, and assign it to society, especially to believers.

Abstract

This thesis aims to examine and critique the concept of gender in feminist interpretations of the Qur’an through a comparative (muqarran) study of contemporary exegeses. The study’s background highlights a shift in the meaning of “gender” from a biological category of sex to a social construct that can alter perceptions of a person’s sex, and the impact of this shift on the interpretation of Qur’anic verses concerning women specifically issues of leadership (Qur’an, an-Nisaʾ 4:34), polygyny (an-Nisaʾ 4:3), and inheritance distribution (an-Nisaʾ 4:11). The author analyzes contemporary tafsirs as an effort to clarify and counteract distortions in the interpretation of these Qur’anic verses related to the concept of gender. This research uses a qualitative method with a library-based approach and comparative (muqarran) analysis to contrast different interpretations. The study maps the methods and interpretive tendencies of feminist exegetes such as Amina Wadud, Zaitunah Subhan, and Nasaruddin Umar, and compares them with contemporary tafsirs including Tafsīr al-Munīr by Wahbah az-Zuhailī, Tafsīr al-Azhar by Buya Hamka, and Tafsīr al-Misbāḥ by Quraish Shihab. The findings identify several critiques of feminist interpretations of the gender concept: (1) feminist readings consistently emphasize that women are discriminated against by men in Islamic teachings and the Qur’an—portraying Islam as perpetuating patriarchal culture—which may create the misconception that Islam is discriminatory toward women; (2) there are misconceptions about the concept of gender from an Islamic perspective, such as treating gender as a form of relativism that precludes absolute truth, and using the gender concept to justify sexual deviations (e.g., the increasing visibility of LGBT cases); and (3) several negative social impacts of feminist exegesis on Muslim communities, for example: declining marriage rates due to women’s reluctance to accept male leadership in the household, widespread rejection and moves to prohibit polygyny, and resistance to Qur’anic inheritance rules. The thesis concludes by underlining the need for critical reading of feminist gender concepts in Qur’anic interpretation and for comparing them with other contemporary tafsirs. Such balanced readings—attending both to text and context—can correct conceptual and practical deviations in the discourse on gender among Muslim communities, and prevent Islam from being perceived as discriminatory toward women. Islam, in fact, upholds the dignity and worth of every human being, both male and female, and is rahmatan lil-ʿālamīn.

Abstract

Walimatul 'urs is a form of Sunnah propagation recommended by the Prophet Muhammad SAW as an expression of gratitude for the implementation of the marriage contract. The main purpose of walimatul 'urs is to announce the marriage, strengthen ties of kinship, and build togetherness in society. Therefore, Islam permits entertainment in the implementation of walimah as long as it does not conflict with the principles of sharia. The use of Gordang Sambilan in walimatul 'urs in Panyabungan, as a traditional Mandailing musical ensemble, has sacred and symbolic value that is closely related to local identity and culture. In the context of walimah, Gordang Sambilan serves to enliven the atmosphere and express gratitude; however, its use must still be reviewed from the aspects of purpose, intention, and implementation procedures to align with Islamic teachings. This study uses a qualitative method with a descriptive approach. Data were collected through literature review, observation, in-depth interviews, and documentation. Data analysis was carried out through a process of reduction, presentation, and inductive drawing of conclusions based on relevant theories. Research findings indicate that the use of the Gordang Sambilan during walimatul 'urs (religious gatherings) in Panyabungan involves a number of deviations, such as summoning ancestral spirits, trance, and the consumption of alcoholic beverages by some performers. These practices contradict Islamic law, particularly the principle of monotheism, which prohibits all forms of supplication and dependence on anything other than Allah SWT.
