Abstract

Most of the people of Sungai Salak Village, Tempuling Subdistrict work as farmers. Farming incoconut groves is the biggest choice because of this region. The crops are sold using the bonded system,namely the debt repayment system with these harvests that have been carried out for generations by thecommunity in Sungai Salak Village. Farmers who owe to the tauke must make debt payments to the tauke,namely by cutting the coconut payment from the tauke to the farmers, deducted from the sale of theircoconut harvest at a low price. using a bonded system between coconut farmers and a tauke in TempulingSubdistrict, Indragiri Hilir Regency has given justice or injustice between the two parties. Second, to find aresolution so that the implementation of a sale and purchase agreement using the bonded system givesjustice.This type of research can be classified into the type of juridical social research, because in thisstudy the author immediately conducts research on the location or place under study in order to provide acomplete and clear picture of the problem under study.Based on the results of the problem research there are two main things that can be concluded.First, unequal rights and obligations where the cheap price of coconut for the price of coconut that is set isRp. 1,800 to Rp. 2,300, - the price is below the market price of coconut in Indragiri Hilir which is Rp. 3,810/ kilogram. Farmers do not participate in determining coconut tariffs. Second, the Resolution for theImplementation of the Sale and Purchase Agreement Using this Bonded System Gives Justice This is that itwould be good for the Government to study in other countries that have succeeded in overcoming injusticedue to the implementation of agreements like this. regulated in regulations in the form of laws or higherregulations. Author's suggestion, First, there needs to be a special regulation made by the governmentregulating the implementation of a sale and purchase agreement using the bonded system. For the positionof both the farmer and the tauke to be equally strong and the rights and obligations carried out properly andcorrectly. Abstract

Pengaturan dan pengawasan terhadap lembaga keuangan bank dan lembaga keuangan non-bank di Indonesia sekarang ini dilakukan oleh lembaga baru yang bersifat independen yang dinamakan Otoritas Jasa Keuangan (OJK) berdasarkan Undang-Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan yang merupakan amanat dari Pasal 34 Undang-Undang Nomor 3 Tahun 2004 Tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 1999 Tentang Bank Indonesia. Terkait pengawasan perbankan yang sebelumnya dijalankan oleh Bank Indonesia, saat ini beralih kepada OJK. Akan tetapi, pengaturan dan pengawasan bank ini tidak sepenuhnya lepas dari Bank Indonesia. Dimana OJK bertugas mengatur dan mengawasi perbankan dalam lingkup mikroprudensial sedangkan Bank Indonesia mengatur dan mengawasi perbankan dalam lingkup makroprudensial. Hal ini berarti, Bank Indonesia masih tetap mempunyai tanggung jawab dalam hal pengaturan dan pengawasan perbankan. Pengalihan tugas Bank Indonesia kepada OJK ini menjadi suatu kajian yang menarik karena terdapat dua lembaga yang mengatur dan mengawasi perbankan saat ini. Dimana kedua lembaga tersebut sama-sama menyandang status sebagai lembaga yang independen yang dituntut harus lepas dari segala bentuk campur tangan pihak lain.Kata Kunci : Pengaturan - Pengawasan - Perbankan - Bank Indonesia - Otoritas Jasa Keuangan

Abstract

If one of the parents dies, the guardianship of children who are immature by law is held by the parent who lives the longest, if one of the husband or wife dies, the husband or wife who lives the longest along with their offspring who are heirs. from the inheritance. If the minor is possessed by the inheritance of the inheritor, the parent who lives the longest is the guardian of the child regarding the care of the child and his assets. In this case related to guardianship issues that occur in Kelurahan Kandis Kota. The purpose of writing this thesis is, first, to find out whether guardianship based on Article 345 KHUPerdata in Kandis Kota Kelurahan, Second, factors that cause guardian neglect in the management of the inheritance of minors in Kandis Kota Kelurahan.This type of research can be classified as sociological research, because in this study the authors directly conduct research at the location or place under study. This research was conducted in the Kelurahan Kandis Kota, while the population and sample were all parties related to the problems examined in this study, data sources, used, primary data, secondary data, and tertiary data, data collection techniques in this study with observation , interviews and literature studies.From the results of the research there are a number of things that can be concluded, first, the determination of guardianship based on Article 345 KHUPerdata that if one of the two parents dies, the parents who live the longest automatically become the guardian of the law for their children while what happens in this problem is the living parent the longest i.e. the mother does not become the guardian of her children. Second, the factors that cause guardian neglect in the management of the inheritance of minors based on the problems studied are due to conflicts in the family between birth mother and uncle and aunt so that the children's rights are ignored and the lack of responsibility of the guardian himself against the inheritance of minors.Keywords: Guardianship, Minors, Responsibility

Abstract

Marriage is defined as an agreement between men and women to be married. Organizing marriagesin some communities, sometimes ignoring the true will of the candidate who will marry, even in many cases,the future bride and groom will only find out who he will marry with at the time the marriage will take place. It is often the case that marriages take place according to the wishes of the marriage, but are contrary tothe wishes of the other parties, for example the family, both male and female families or polygamousmarriages that are carried out illegally. The consequence of this situation caused no happiness in thehousehold and forced the marriage bond to be decided or canceled. Cancellation of marriage is regulated inarticles 22 up to and including 28 of the marriage law of 1974. Cancellation of polygamous marriage willcause legal consequences and losses for some parties, especially the second ex-wife.The type of research that is used normative legal research, namely research that is carried out byresearch of primary and secondary legal materials. The author conducts research with a view to attractinglegal principles (Rechtsbeginselen) that can be made against written positive legislation and unwrittenpositive legislation. In this study, the author discussed more about the principles of law, in particular theprinciple of justice in the case of the cancellation of the marriage experienced by the second ex-wife . In thiscase to describe the factors, efforts that can be made to seek justice, and legal protection for the second exwifewho is not regulated in the marriage law.The results of the investigation into this problem were the result of the law of canceling polygamousmarriages for the second ex-wife only in the form of the cancellation of the polygamous marriage. But thereare no legal consequences for the rights of the second ex-wife, none of the laws and regulations in Indonesiaregulate this issue. According to article 28D of the Constitution of 1945, the second ex-wife has the right toobtain justice. The country is immediately guided to form a new rule to regulate the rights and obligations ofthe second ex-wife. Because there are no rules that apply, the second ex-wife can make legal efforts throughnon-court cases in the form of negotiation and mediation or take legal action through legal proceedings inthe form of a civil claim for compensation against the former spouse of a polygamous marriage that wascanceled.Keywords: Marriage - Cancellation - the second wife - right

Abstract

Overlap the land permit granted by the Government of Pelalawan result of indigenous people communal land taken without regard to the rights of the local population. In issuing licenses, many customary rights of indigenous peoples are disadvantaged. Because in practice the country has not fully provide legal protection of the rights of indigenous peoples, as in the case of customary land disputes and conflicts/communal, indigenous peoples still in a weak position associated with the policies issued by the state. Need for Local Regulation in Pelalawan governing the legal protection of the rights of indigenous peoples, so that indigenous land disputes and conflicts/customary in Pelalawan can be minimized.

Abstract

As you can see, the community has made lending and borrowing activities something that is very much needed to support the development of their economic activities and to improve their standard of living. Lenders who have excess money or excess funds are willing to provide loans to those who need it. On the other hand, the borrower is based on a specific need or purpose to borrow the money.The problem that the writer makes the basis of this research is how the implementation of the transfer of mortgage rights at PT. Bank Rakyat Indonesia branch of Duri Desa Sintong Pusaka, Tanah Putih Subdistrict, What are the factors that caused the transfer of underhand mortgage rights at PT. Bank Rakyat Indonesia, branch of Duri Desa Sintong Pusaka, Tanah Putih Subdistrict and, What are the legal consequences arising from the Underhand Transfer of Mortgage Rights.This type of research can be classified into the type of empirical or sociological research, because in this study the author directly conducts research at the location or place under study in order to provide a complete and clear picture of the problem under study. This research was conducted at PT. Bank Rakyat Indonesia, data sources used are: primary data and secondary data, data collection techniques in this study with observation, interviews and literature review.The results of this study are first. The implementation of the transfer of security rights must be carried out in accordance with Law Number 4 of 1996 concerning Mortgage Rights that the transfer can be carried out if the creditor knows and the transfer must be registered at the land office and must have a deed of transfer of mortgage rights, the two factors causing the transfer of Mortgage Rights are below hands are: Economic factors, Unable to make repayments, Ignorance of applicable rules, The amount of costs to be incurred, Looking for more profit. And thirdly, the legal consequences arising from the transfer of mortgage rights under the hand according to Article 11 paragraph 1 of the Mortgage Rights Law states that the transfer must include the names and identities of the parties and their domicile, while the transfer under the hands does not state this so the legal consequences arise. is null and void because the provisions of the article are compelling.Keywords: Mortgage, Debtor, Creditors

Abstract

Gold Pawn is one of the BRI Syariah Syariah products which is included in thecategory of financing based on al-qardh (giving), the funds must be returned by the customerto the bank at the same time or in installments up to the due date and implemented byapplying the prudent bankking principle ) as well as the principle of getting to knowcustomers (know customers). In practice, in the procedure for settlement of collateral itemsdue at BRI Syariah Bank, contact the Customers whose loan maturity is due, the 4th day afterthe maturity of the loan. Purpose Writing this thesis, namely: First, to find out the procedurefor auctioning the object of the gold pawning agreement between customers and BRI SyariahBank Pekanbaru Branch. Second, to find out the legal protection of customers auctioning theobject of the gold pawning agreement at BRI Syariah Bank Pekanbaru Branch.This type of research can be classified as a type of sociological legal research,because in this study the authors directly conduct research on the location or places that arestudied to provide a complete and clear picture of the problem under study. This researchwas conducted at BRI Syariah Bank Pekanbaru Branch, while the population and samplewere all sections related to this research, the data sources used were primary data,secondary data and tertiary data, data collection techniques, namely interviews andliterature studies.From the results of research and discussion it can be concluded that, in the goldauction procedure at PT. BRI Syariah Bank Pekanbaru Branch has not used Minister ofFinance Regulation No. 93 /PMK.06/2010 concerning Bidding Implementation Guidelines.The bank still uses the guidelines for conducting auctions made by the directors of PT. BankBRI Syariah Pusat. Which in Article 2 of the PMK 2010 states that: Every auction must becarried out by and / or in front of the Auction Officer. The legal protection of customers asconsumers is listed in the Civil Code in Article 1155 which states that collateral itemsauctioned will be auctioned before the public and in accordance with applicable regulationsso as not to cause harm to customers.Keywords: Auction of Gold Pawn Agreement Objects at BRI Syariah Bank.

Abstract

Along with the era of free trade, nowadays various types of cosmetics are circulating in the market with various uses from various brands as well. Cosmetic products, which are the result of the development of the pharmaceutical industry, have now developed into one of the basic needs of the community along with the development of people's lifestyles. Business actors are competing to produce various kinds of beauty products with various uses for the community to attract as many consumers as possible . Human desire to always look more beautiful, beautiful and perfect. There is still a sale of refill perfume in Pekanbaru City that does not include this composition label, which can endanger consumers in using the refill perfume. The dangers arising from using this refill perfume can cause irritation to the skin with perfume levels that are not in accordance with what has been set by the BPOM besides that it can also cause inflammation of the skin cells so that it can cause skin cancer.The problems that the authors make the basis for in this study are how legal protection for consumers related to the use of refill perfumes that do not include composition labels in the city of Pekanbaru and how are business actors responsible for refill perfume products that do not include composition labels in the city of Pekanbaru.This type of research can be classified into the type of empirical or sociological research, because in this study the author directly conducts research at the location or place under study in order to provide a complete and clear picture of the problem under study. This research was conducted in Pekanbaru CityThe results of this study are first. Protection for consumers related to the sale of cosmetic products without material composition regulated in the UUPK is contained in Article 4 letter c. The right to information is important for consumers, because with information consumers can choose the desired product and avoid losses due to misuse of the product. Providing information is also an obligation of business actors as regulated in Article 7 letter b. In addition to protection through rights and obligations, protection of consumers can also be protected by actions that are prohibited by business actors as regulated in Article 8 letter IUUPK. Second, responsibility is the obligation of business actors if consumers feel disadvantaged. Regarding the responsibilities of business actors regulated in Article 19 UUPK. Abstract

The armed conflict that occurred in Wamena in Papua caused many victims,including children. So the need for special legal protection for children who are in conflictsituations. As in article 60 of Law Number 35 Year 2014 concerning Amendments to LawNumber 23 of 2002 concerning Child Protection, it states: children in an emergency situationas referred to in article 59 paragraph (2) letter a consist of: a. Children who become refugeesb. Children victims of riots; c. Child victims of natural disasters; and d. Children in situationsof armed conflict. Based on the main ideas above, it can be formulated several problems,namely whether the form of criminal acts committed against children in the area of armedconflict in Indonesia and how the legal protection of children from criminal acts in the areaof armed conflict in Indonesia.The writing of this thesis uses the normative legal research method by collectingdata by library research, namely by examining library materials or secondary data in theform of primary legal materials namely related regulations, secondary legal materials namelyrelated documents and tertiary legal materials which is a guide to primary and secondarylegal materials or research on legal systematics. The secondary data that has been compiledare then analyzed using qualitative methods to obtain results, which are forms of protectionfor children in conflict areas, that is, doing things that can accelerate the conducive situationin the field, besides the government in particular, and other supporting elements to furtheroptimize efforts to restore children's health and post traumatic psychological handling inchildren. The conclusion from the results of the study, namely the legal protection of childrenin armed conflict areas in Indonesia who get violence such as murder, sexual harassment orrape is still not working properly, because there are still many children who are victims.Where the rules regarding legal protection of children in conflict areas are still general innature which are civilians. Where the Indonesian government should make special rulesregarding the protection of children in areas of armed conflict.
