Abstract

This study examines notarial deeds as authentic instruments that possess perfect evidentiary power and play an essential role in ensuring legal certainty for the public. Problems arise when a notary dies while the protocols and deeds they have created remain in circulation and continue to be used in various legal relationships. This situation creates a normative legal gap regarding accountability for the misuse of deeds after the notary’s death, particularly within a notarial administration system that is gradually transforming toward digitalization. Digitalization improves efficiency, accelerates document distribution, and expands access to notarial services, but it also increases risks of misuse, manipulation, and unauthorized use of deeds due to insufficient control mechanisms. The existing supervisory system, which is still focused on individual notaries, is unable to effectively address risks arising after the termination of office due to death, resulting in suboptimal legal protection for related parties. This study aims to analyze weaknesses in the post-death notary supervision and liability system and to formulate a reconstructed supervision and accountability model in the digital notarial administration system. The research employs a normative legal method with statutory, conceptual, and systematic approaches. The findings identify normative gaps, weak protocol supervision, and the absence of an integrated national digital system. The proposed reconstruction includes shifting liability from personal to institutional responsibility, establishing institution-based supervision, and developing a digital system equipped with authentication, audit, and access control mechanisms.

Abstract

Lindiana, et al. Rice Cultivation Images by Local Farmers in Pemulutan District, Ogan Ilir, South Sumatra. JLSO 5(2):153-158. Plans and efforts in increasing rice productivity at riparian wetlands can be commenced by introducing relevant technologies; however, the selected technologies should be based on real needs or problems faced by local farmers. As a pre-requisite, if the needs and problems are not comprehensively understood, government intervention to introduce new technology may not be effective since the technology may not be relevant or affordable to local farmers. Objectives of this research are to analyze characteristics of the wetlands, farmer’s adoption capacity, and technological preferences. The research was conducted in five villages at Pemulutan District. Qualitative Grounded Theory and Quantitative Survey were employed through dialogues with 100 local farmers.  Results of the research indicated that any effort to increase riparian wetland productivity should consider the unpredictability of flood occurrences and prolonged drought. These unfavorable conditions have limited local farmers to only grow rice once per year. Local farmers were almost solely depending on rice and cultivation of other crops were rarely observed, except limited vegetables grown on elevated border of paddy fields.

Abstract

Notary is an official who owns the authority to produce authentic deed.  Authentic deed is a perfect evidence because it is created in such perfect form based on legal constituation and is made by authorized official who owns goverment trust.  An authentic deed has to obtain several elements as requered by the law.  One main requirement is the presence of “Penghadap”.  “Penghadap” is legit requirement of an agreement and is stated inside the body of an authentic deed.  Therefore presence of a “Penghadap” becomes very vital in determingning authenticity of a deed.  Studi in a case Kekuatan Hukum Akta Otentik Notaris Tanpa dihadiri  Penghadap (Studi Kasus Putusan MPWN Nomor: 03/PTS/MJ.PWN PROVINSI SUMATERA SELATAN/VIII/2014)” showed firstly, that notary TI created copy establishment of LBH Kesehatan stated all the elements were not available and did not signed the deed.Secondly, MPW gave written senction toward notary TI on doing ethical violation,thirdly the deed of establishment is cancelled for law because the “Penghadap” were not presence in the process of deed establishmentKeywords : Notary, Deep, Pengha
