Abstract

ABSTRAKSI Sistem perbankan memegang peranan yang sangat penting dalam perekonomian seiring dengan fungsinya sebagai lembaga intermediasi, yaitu menyalurkan dana dari pihak yang berkelebihan dana kepada pihak-pihak yang membutuhkan dana. Apabila sistem keuangan tidak bekerja dengan baik, maka perekonomian menjadi tidak efisien dan pertumbuhan ekonomi yang diharapkan tidak akan tercapai. Salah satu masalah krusial dalam sistem keuangan yang dapat menjadi sumber instabilitas keuangan, yakni menyangkut terjadinya ketidaksamaan informasi (asymmetric information), yakni suatu situasi dimana satu pihak yang teribat dalam kesepakatan keuangan tidak memiiliki informasi yang akurat dibanding pihak lain. Pasal 34 UU BI mengamanatkan pembentukan Lembaga Pengawas Jasa Keuangan (LPJK) paling lambat pada tahun 2010. Amanat Pasal 34 tersebut sejak awal penyusunannya telah mengandung kontroversi dan perdebatan. Berdasarkan Pasal 34 UU BI fungsi BI dalam mengawasi bank dialihkan kepada LPJK. Pengalihan fungsi pengawasan bank dari bank sentral di negara yang industri keuangannya didominasi oleh industri perbankan tentunya menimbulkan perdebatan dan memicu kontroversi. Abstract

A reality that Indonesia recognize as one of the state which have applying the ugly good corporate governance principal either in privat and public sector, especially on banking sector. Pricewaterhouse Cooper study show that Indonesia under sequence with China and India with value 1,96 to principal applying good corporate governance. To corrected, various effort even also do to start with reform legislation, reform of bureaucracy, socialization of applying Good Corporate Governance till founding various institution utilize to support applying Good Corporate Governance, good policyy from Bank of Indonesia and Institution-institution which of initiative by stakeholders and share holders.

Abstract

The development of hybrid products in new forms such as financial technology (fintech) and the emergence of business conglomerates of banks and financial institutions in Indonesia to be sociological juridical factors required independent independent institutions to supervise in the field of microprudential and regardless of the central bank of Bank Indonesia. Juridically the formation of Financial Supervisory Auhtority (FSA) in Indonesia, called the Financial Services Authority based on OJK Act number 21 of 2011 is a mandate of Article 34 of Law no. 23 of 1999 concerning Bank Indonesia as amended by Act no. 3 of 2004 which indirectly undermines the independence of Bank Indonesia. This leads to the need for an integrated regulation that supersedes the regulation in the field of supervision of financial institutions, especially the existing banks. The construction of a legal pathology approach for analyzing the development of regulatory and supervisory models of banking institutions in Indonesia was established through comparison with supervisory models in other countries, analyzing typologies of highly regulated banking institutions in Indonesia, regulatory mapping of regulations related to banking supervision with due regard to theoretical implications and practical implications To realize the principle of good banking governance.

Abstract

The purpose of this paper is to overcome future problems, Law No. 4 of 1996 concerning Mortgage on Land and Objects Related to Land and Law No. 37 of 2004 concerning Bankruptcy and Postponement of Obligation to Pay Debts. Preventive and Repressive Legal Protection actions, however, a problem or conflict of law arises which regulates the time limit which is the source of problems between the Mortgage Law and the Bankruptcy Law, thus confusing stakeholders. The Bankruptcy Law provides a time limit of 2 months or 90 (days) after the bankruptcy decision is given and must be given to the Curator. but it is felt that it does not provide sufficient time for the Creditor of the Mortgage Holder. Because the creditor rights holders have protected their rights by the Mortgage Law which is written in article 21 of the Mortgage Law. Within 2 months, it does not mean that the creditor has to complete the execution, but within that period the creditor has started the execution process. due to the process that must be passed by the Mortgage Holder to sell the Mortgage Object.How to cite item: Risvian, MK., Widhiyanti, HN Dewantara, R (2022). Abstract

Regional development banks (BPDs) are a realisation of regional governments’ commitment to carry out the objectives of the Banking Law to improve the area. BPDs have an important role in moving the regional economies, but regulatory obstacles arise when norms conflict in terms of regulating share ownership by regions. Therefore, synchronisation is needed to realise legal certainty. This article aims to suggest reformulations to the regulation of share ownership of BPDs to give legal certainty. The article adopts a normative juridical law research method with statutory, conceptual and analytical approaches. The results of the study indicate there are inconsistencies in the provisions governing the share ownership of BPDs. There are juridical implications for the emergence of rights, obligations and legal relations due to inconsistent arrangements. Regulatory reformulation of BPD share ownership by regional governments should be carried out by adopting the concept of norms, resulting in consistent regulation.

Abstract

The digital era demands transformation of all sectors, including the sector of economic law. The concept of economic law that is demanded to transform and transplant itself is the legal concept in the digital founding of companies. Companies no longer possess conventional schemes; they have transformed in terms of management patterns, market reach, and even organizational structure toward digital concepts, and therefore the law must be adaptive with these developments. The research for this article has the objective of forming new legal paradigms in the founding of companies. It takes the form of a normative legal research with usage of the philosophical and statute approaches. The results of the research showed that the adoption of concepts from the New Paradigm Theory of Kuhn requires a new legal paradigm with a new legal regime, because the old legal regime is not adaptive to the new form of companies with the conception of an enterprise form utilizing a technological approach through the aid of Regtech.

Abstract

The application of information technology platforms that appear in business transactions in Indonesia is a pattern of business models that cannot be avoided. One of the rapidly growing technology companies is an online loan service.The ease of borrowing funds through these services supports business growth. In contrast to the banking sector, which is regulated by a series of strict government regulations and the determination of interest rates that have been determined by looking at economic conditions. The absence of regulation in the legislation makes AFPI set the limit for determining the maximum interest rate, but the determination of interest rates by AFPI is suspected to lead to cartel actions. There is a close relationship between fair business competition and consumer protection. This research is a normative juridical research with a statutory approach and a comparative approach. In this case, the setting of interest rate limits will reduce consumers’ rights to get competitive prices. The existence of conscious parallelism by the AFPI on the LPMUBTI services can be categorized as a price fixing agreement. It is because the determination of the maximum interest rate limit is not regulated through direct government regulations.

Abstract

AbstractEconomic democratic principles as a basis for the formulation of economic regulation in the national economy plays a role in strengthening democratic governance and steering regulator goes into the national economy. Government is not stable, in the sense that is able to distribute the rights and obligations of each economy in a fair economy, then the economy is genuinely democratic will not be realized. In the State of Indonesia shows the process of democratization that took a half-hearted and not shown in a positive direction for strengthening governance. Economic reforms needed in Indonesia is reforming its economic system, namely the renewal rules are likely to seek welfare rules only become better ensure economic justice through increased equitable distribution of development outcomes according to the concept of social economy. Results interpretation of economic and legal experts as the economy that is democratic, then the implementation of best practices in system or economic system should be more democratic with the full participation of the people. The results show the concept of economic democracy principles in Article 33 paragraph (4) NRI Know 1945 Constitution explicitly that the obligation can be analyzed in the operational structure of institutional economics views of business ownership shall be fairly based on the constitution. Countries represented the State Owned Enterprises (SOEs) and the Regional Owned Enterprises (enterprises) is the main implementing actors are given the authority to manage the vital sectors in the economy that controls the lives of many people in accordance with Article 33 of the constitution. This indicates the importance of strengthening state institutions in managing the resources of nature, especially that dominate the lives of many people, so it is not depend on foreign capital.  Key words: reconceptualization, economic democracy, constitution  AbstrakAzas demokrasi ekonomi sebagai dasar perumusan regulasi di bidang perekonomian nasional berperan dalam penguatan pemerintahan demokratis yang menjadi pengatur dan pengarah berjalannya ekonomi nasional. Pemerintahan yang belum stabil, dalam artian mampu mendistribusikan hak dan kewajiban ekonomi masing-masing ekonomi secara adil, maka ekonomi yang benar-benar demokratis tidak akan dapat terwujud. Di Negara Indonesia saat ini menunjukkan proses demokratisasi yang berlangsung setengah hati dan belum  menunjukkan arah yang positif bagi penguatan pemerintahan. Reformasi di bidang ekonomi yang diperlukan Indonesia adalah reformasi dalam sistem ekonominya, yaitu pembaharuan aturan main yang cenderung mencari kesejahteraan semata menjadi aturan main yang lebih menjamin keadilan ekonomi melalui peningkatan pemerataan hasil-hasil pembangunan sesuai konsep ekonomi sosial. Hasil interpretasi dari para ahli ekonomi dan hukum sebagai perekonomian yang bersifat kerakyatan, maka pelaksanaan sistem atau best practices dalam sistem ekonomi harus lebih demokratis dengan partisipasi penuh dari rakyat. Hasil penelitian menunjukkan  konsep asas demokrasi ekonomi di dalam Pasal 33 ayat (4) UUD NRI Tahu 1945 secara eksplisit dapat dianalisis bahwa adanya kewajiban dalam operasional struktur kelembagaan ekonomi dilihat dari kepemilikan usaha diatur secara adil berdasarkan konstitusi. Negara yang diwakili Badan Usaha Milik Negara (BUMN) maupun Badan Usaha Milik Daerah (BUMD) merupakan actor pelaksana utama  yang diberikan kewenangan untuk mengelola sektor-sektor vital dalam perekonomian yang menguasai hajat hidup orang banyak sesuai Pasal 33 konstitusi. Hal ini mengindikasikan pentingnya penguatan institusi negara dalam mengelola sumber-sumber  kekayaan alam terutama yang menguasai hajat hidup orang banyak, sehingga tidak tergantung pada modal asing. Kata kunci: rekonseptualisasi, azas demokrasi ekonomi, konstitusi

Abstract

Perlindungan nasabah bank dimaksudkan agar nasabah mempunyai hak untuk melakukan pengaduan dan dapat menyelesaikan sengketa dibidang perbankan. Peraturan perundang-undangan yang mengatur perlindungan nasabah dalam sektor perbankan belum optimal dalam melindungi nasabah. Dana masyarakat yang dihimpun serta data pribadi nasabah di Bank belum mendapat perlindungan secara maksimal oleh hukum, dan masih ada peluang untuk disalahgunakan oleh pemilik bank. Perlindungan hukum terhadap nasabah sangat diperlukan sebagai sarana utama untuk mengatasinya. Tujuan dari Tulisan ini adalah bahwa analisis ekonomi hukum dapat dijadikan suatu pendekatan untuk menjawab permasalahan hukum terhadap peraturan perbankan dalam melindungi nasabah. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan yakni bahan hukum primer, Peraturan perundang-undangan yang berkaitan dengan fokus penelitian, dan bahan hukum sekunder yaitu data kepustakaan yang dapat berupa buku-buku, referensi, makalah, jurnal, hasil penelitian.  Bahan dikumpulkan melalui studi dokumen dan studi pustaka, kemudian dianalisis menggunakan analisis deskriptif dengan menggunakan interpretasi hukum, untuk kemudian diambil kesimpulan secara deduktif. Hasil penelitian menunjukkan bahwa analisis hukum ekonomi terhadap peraturan perbankan dalam perlindungan hukum nasabah bahwa peraturan perundang-undangan yang mengatur sektor perbankan masih belum optimal dalam memberikan perlindungan hukum kepada nasabah bank, dan peraturan tersebut masih kurang mendukung aktivitas perbankan yang efisien. Peraturan perbankan yang ada saat ini masih terlalu banyak membuka peluang untuk disalahgunakan oleh pemilik bank dan belum memadai dalam mengakomodir perkembangan kegiatan perbankan.

Abstract

Forex (Foreign Exchange) is better known in Indonesian as Forex trades between two currencies from two countries by many States Parties, institutions and individuals. Forex trading between market players that lasts Open 5 days a week, 24 hours a day. inner consistency Forex trading operations based on Article 1338 of the Legislative Code Civil. These provisions are less effective because there are still many brokers illegal brokers, unlicensed and unscrupulous companies with the intention of misleading investors. Due to the futures trading law Commodity has not yet implemented a complete forex trading system.Speaking of validity foreign exchange investment contract based on article 1320 of the civil code on the conditions of validity of the contract, foreign exchange as the object of the contract, not contrary to the objective conditions which have legal consequences, null and void history and characteristics of book iii of the civil code which regulates the commitment is open, so it is allowed to make one agreements other than those provided for in the civil code, provided that they are not contrary with the law, public order and good morals. This research advising the government and the legislator to make regulations related toforeign exchange  investment regulations to prevent things that are not legal protection desired and guaranteed for investors
