Abstract

The halal food industry in its development in the metaverse era has great and promising potential. Especially for Indonesia as a country with the largest Muslim population in the world. This is a challenge for the Indonesian government in welcoming the development of the halal food industry and making Indonesia the center of the world's halal industry. The research method used is empirical juridical with a qualitative approach. The results of this research show that in welcoming the development of the halal food industry, support from Bank Indonesia and the Government is needed, in the form of regulations, especially in accommodating provisions and fatwas related to the halal food industry so that it enters the legal hierarchy and has sufficient power.

Abstract

Kosmetik menjadi kebutuhan utama bagi konsumen baik laki-laki maupun perempuan. Hal ini dijadikan peluang bisnis bagi pelaku usaha untuk berlomba-lomba memberikan inovasi sesuai dengan kebutuhan konsumen salah satunya yaitu kosmetik dengan sistem share in jar, namun pada kenyataannya kosmetik dengan sistem share in jar sangat berpotensi membahayakan keselamtan konsumen. Rumusan masalah dalam artikel ini Apa bentuk perlindungan hukum terhadap konsumen atas penggunaan produk kosmetik dengan sistem share in jar tanpa label pada kemasan dan Apa upaya penyelesaian yang dapat dilakukan oleh konsumen yang mengalami kerugian akibat penggunaan produk kosmetik dengan sistem share in jar tanpa label pada kemasan. Metode pendekatan yang digunakan yaitu yuridis normatif. Hasil studi menunjukan bahwa Pertama konsumen yang mengalami kerugian mendapatkan perlindungan eksternal sebagaimana yang telah diatur dalam Pasal 196 dan 197 Undang-Undang No. 36 Tahun 2009 tentang Kesehatan. Kedua, upaya penyelesaian yang dapat dilakukan oleh konsumen yang mengalami kerugian akibat penggunaan kosmetik share in jar tanpa label pada kemasan berdasarkan Pasal 45 UUPK dapat melalui 2 (dua) cara, yakni melalui jalur pengadilan (litigasi) dan jalur luar pengadilan (non litigasi).  Kata Kunci: Perlindungan Hukum, Konsumen, Share in jar  Cosmetics are a major need for both male and female consumers. This is used as a business opportunity for business actors to compete to provide innovation according to consumer needs, one of which is cosmetics with a share in jar sistem, but in reality cosmetics with a share in jar sistem have the potential to endanger consumer safety. The formulation of the problem in this article What is the form of legal protection for consumers for the use of cosmetic products with a share in jar sistem without a label on the packaging and what are the solutions that can be taken by consumers who experience losses due to the use of cosmetic products with a share in jar sistem without labels on the packaging. The approach method used is normative juridical. The results of the study show that firstly, consumers who experience losses receive external protection as regulated in Articles 196 and 197 of Law no. 36 of 2009 concerning Health. Second, the settlement efforts that can be made by consumers who experience losses due to the use of share in jar cosmetics without labels on packaging based on Article 45 of the UUPK can be in 2 (two) ways, namely through court (litigation) and out-of-court (non-litigation) channels.  Keywords: Legal Protection, Consumers, Share in jar REFERENCES Barkatullah, Abdul Halim.2020. Abstract

The approach to buying and selling land rights that is most often used by PPAT has problems, especially the trading of land rights related to sales and purchases that have been completed with a sale and purchase deed, but the sale and purchase deed does not immediately appear again. for registration at the Land Association Office. This results in uncertainty regarding the position of land objects, so that problems arise for land buyers to seek legal protection and find ways to resolve this. The research focus in this thesis is: First, finding legal certainty for land buyers whose sale and purchase deeds are not registered at the land office. Second, exploring efforts to identify questions if there are land sellers and buyers whose sale and purchase deeds are not registered at the land office. This exploration regulates juridical examination. The methodology used is a legal methodology, which is used to analyze legal guidelines relating to halal guarantees for land buyers whose sale and purchase deeds are not registered at the land office; The conceptual approach used to examine the legal certainty regarding buyers of land whose sale and purchase is not considered in the legal office, as well as the case approach for establishing legal restrictions in order to investigate the legal issues in this research. The results of the first thesis research, legal certainty regarding land buyers whose sale and purchase deeds are not registered with the land office is not valid according to law, because the buyer who carries out the sale and purchase does not become the owner until his position is large enough as long as he is proven to be the owner in the case of an exchange of privileges to him. the territory has been registered at the Land Office. Secondly, the effort to resolve disputes between sellers and buyers of land whose sale and purchase deeds have not been registered at the land office is, to obtain legal certainty, the buyer requests validation by making a lawsuit to the District Court, so that this agreement can then be used as reason for registering the exchange of land rights with the nearest Land Office, thereby providing legal certainty to the injured party as the land owner. The process, then the parties make a deed of sale and purchase to PPAT based on proof of sale and purchase receipts and the results of the ratification decision from the District Court to also be used as a condition for registering the exchange of land rights based on the will from the seller to the buyer, and in the future there is a need for legal reform prospects. to handle the problem. Considering the consequences of this inspection, there are several ideas given, specifically: First, it is necessary to add new rules or articles in PP Number 18 of 2021 which regulate the maintenance and updating of data after land registration, because in PP Number 18 of 2021 it only explains the meaning of Land Registration only in the General Definition in point number 9. Second, there needs to be increased preventive action that must be carried out by the PPAT before accepting applications for making land deeds by the parties, by applying precision and accuracy in reading the files submitted by the parties. The buyer is advised to be more careful, careful and understand more about the procedures for buying and selling land as stipulated in Government Regulation Number 18 of 2021 and to immediately change the name or register the rights at the local land office. This is so that land disputes do not occur in the future and it is detrimental for the buyer to obtain legal certainty.

Abstract

Introduction: The background of this research is that there are still many food products that have not been halal certified, even though the government through the Halal Product Guarantee Agency (BPJPH) has provided convenience in registering halal products online with free assistance. Especially in this metaverse era, where technology has developed rapidly so that the use of digital technology should be able to encourage development through the halal industry.Purposes of the Research: The purpose of this study, firstly, is to know and understand the meaning of halal in both Islamic law and the Civil Code. Second, understanding the halal industry in the metaverse era in terms of the theory of utilitarianism and Maqashid Sharia.Methods of the Research: This study uses a normative juridical method with a legal-statutory approach and a conceptual approach.Results of the Research: The results of this study are: First, that halal in Islamic Law and the Civil Code have different contexts, but have a similar meaning, namely referring to something that is permitted and not prohibited by law. Second, the halal industry based on utilitarianism has utility value both for business actors who register their food products, as well as for the general public as consumers. Furthermore, based on Maqashid Sharia, halal food is included in the category of protecting the soul (nafs) and protecting the mind (aql).

Abstract

Pandemi Covid-19 membuat PT. Perusahaan Listrik Negara (PT. PLN) menerapkan kebijakan pembayaran tagihan listrik pasca bayar dengan sistem perhitungan rata-rata pemakaian 3 bulan terakhir dan membebankan kelebihan daya pada bulan berikutnya. Kebijakan pengalihan biaya ini dilakukan secara sepihak, serta berimbas buruk pada rumah tangga, pengusaha kecil hingga industri besar. PT. PLN berdalih bahwa kebijakan Pembatasan Sosial Berskala Besar (PSBB) membuat pelaku usaha tidak dapat melakukan pemeriksaan KWH meter. Namun dalih tersebut tidak dapat dibenarkan, mengingat pada saat PSBB, sektor layanan dasar tetap berjalan, termasuk sektor layanan listrik. Lebih lanjut, realitas ini dapat dikatakan sebagai bentuk bisnis yang tidak lazim. PT. PLN dianggap telah lalai melaksanakan tugasnya dalam melakukan pencatatan meteran pada pengguna tenaga listrik pasca bayar. Terlebih, PT. PLN tidak memberikan informasi kepada konsumen tentang adanya kebijakan ini. Puncaknya, fenomena ini memberikan ketidakadilan pada konsumen. Topiknya adalah konsumen mengalami kerugian akibat tidak adanya informasi atas pengalihan biaya tenaga listrik pascabayar yang dilakukan PT. PLN (Persero) secara sepihak. Sehingga konsumen mencari upaya penyelesaian sengketa untuk mendapatkan hak-hak sebagai konsumen dan mendapatkan perlindungan hukum.

Abstract

Penelitian bertujuan untuk menemukan PPAT Sementara yang dapat dipertanggungjawabkan secara hukum dalam pembuatan akta yang cacat hukum, memastikan akta yang dibuat memiliki nilai kepastian hukum, serta menemukan konsep kedepan terkait akibat hukum dan tanggung jawab PPAT Sementara. Tipe penelitian yang digunakan adalah yuridis-normatif dengan fokus analisis terhadap peraturan perundang-undangan dan literatur ilmiah. PPAT Sementara memiliki tugas yang sama dengan PPAT namun seringkali kurang mendapat pelatihan formal, menyebabkan risiko cacat hukum dalam pembuatan akta. Dalam kasus cacat hukum, pihak yang dirugikan dapat mengambil tindakan hukum seperti melaporkan pelanggaran kepada pihak yang berwenang atau menggugat ke pengadilan untuk membuka akta. kata kunci: PPAT Sementara, tanggung jawab hukum, Akta cacat hukum.

Abstract

Pengalihan BPHTB menjadi pajak daerah dituangkan dalam UU PDRD yang kemudian dilakukan efesiensi melalui regulasi mengenai lingkup hubungan keuangan pemerintah pusat dan pemerintah daerah dalam UU HKPPPD. Ketentuan ini memodifikasi pajak BPHTB mengenai saat terutangnya BPHTB ditetapkan pada tanggal dibuat dan ditandatanganinya perjanjian pengikatan jual beli untuk jual beli. BPHTB dipungut berdasarkan adanya perolehan hak atas tanah, sementara PPJB secara asas belum mengalihkan hak. Tujuan penelitian ini adalah memperoleh analisis mengenai pengenaan BPHTB pada PPJB. Metode penelitian dengan menggunakan tipe penelitian yuridis normatif dengan mengkaji berbagai aturan hukum dan konsep-konsep teoritis. Pendekatan masalah dalam penelitian ini menggunakan pendekatan perundang-undangan, pendekatan historis dan pendekatan konseptual. Hasil dari penelitian ini adalah pengenaan BPHTB pada PPJB belum memenuhi unsur kepastian hukum. Subjek BPHTB, objek BPHTB, dasar pengenaan BPHTB dan definisi BPHTB adalah pajak atas perolehan hak atas tanah dan bangunan akibat perbuatan hukum peralihan atau pemindahan hak. Pemungutan pajak dalam Pasal 49 huruf a adalah kabur norma sehingga belum memberikan kepastian hukum dan pengaturan tersebut tidak dapat dilaksanakan, bahwa yang berhak menurut hukum dapat memperoleh hak-haknya (adil).

Abstract

This paper aims to discuss the doctrine of res ipsa loquitur as an unlawful act in medical malpractice and its implications on the balance of protection for patients and medical personnel after the enactment of the Health Law. The urgency of this paper lies in examining the applicability of the res ipsa loquitur doctrine in relation to Articles 310 and 440 of the Health Law. The application of the res ipsa loquitur doctrine in proving medical malpractice cases is strategic in determining the existence or absence of unlawful acts due to negligence. The res ipsa loquitur doctrine makes it easier for patients as plaintiffs to prove negligence through a reverse burden of proof mechanism by medical personnel. Although not a formal piece of evidence, the res ipsa loquitur doctrine can be used as a relevant legal basis, especially when supported by medical records, to assess the conformity of medical actions with professional standards and operational procedures. The legal relationship in therapeutic transactions, which is asymmetrical in nature, requires proportional protection, both in relation to the provisions of Article 310 of the Health Law, which encourages non-litigation dispute resolution, and in relation to Article 440, which opens up criminal law channels for serious negligence in medical services. Therefore, the application of the res ipsa loquitur doctrine in criminal law must be strictly limited through a restorative justice approach as a fair alternative with balanced protection interests for patients and medical personnel.

Abstract

Perkembangan teknologi digital telah merevolusi sistem transaksi dan hubungan hukum di Indonesia, terutama dalam praktik perjanjian yang kini banyak dilakukan secara elektronik melalui berbagai platform digital. Perubahan ini menuntut adaptasi hukum perjanjian yang semula berbasis konsep konvensional menjadi lebih responsif terhadap dinamika teknologi modern. Penelitian ini bertujuan menganalisis perkembangan hukum perjanjian di Indonesia dalam menghadapi era digitalisasi dengan fokus pada kesesuaian norma KUHPerdata, Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), serta regulasi turunannya terhadap praktik kontrak elektronik. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa meskipun kontrak elektronik telah diakui sah secara hukum, masih terdapat tantangan dalam implementasinya seperti perlindungan konsumen, keabsahan tanda tangan digital, serta penyelesaian sengketa lintas yurisdiksi. Penelitian ini menegaskan pentingnya reformasi hukum perjanjian agar lebih adaptif terhadap perkembangan teknologi dan mampu memberikan perlindungan hukum yang komprehensif, sehingga menciptakan ekosistem transaksi digital yang adil, pasti, dan berkelanjutan

Abstract

The issue of food security in Indonesia through the Department of Agriculture has been designated as a policy priority in agricultural development. This is due to the lack of adequate food availability for the community as shown d by the continued import of staple food ingredients from other countries, especially rice that is the main food source for the Indonesian people. The price of rice is increasing due to the decline in rice harvest area and also driven by the impact of El Nino, so that efforts are needed to maintain food security. This research is based on the concept of mudharabah bil mukhabarah which combines the rules of Islamic law and positive law in Indonesia that are applied to agricultural cooperation as an effort to maintain food security. The research method used in this research is a normative legal research type with a statutory and conceptual approach. The results of the research are that cooperation based on a mudharabah bil mukhabarah agreement combines three parties, namely (1) the Government (BULOG) as a provider of capital in the form of fertilizer, superior plant seeds and agricultural equipment, (2) the land owner who provides agricultural land, and ( 3) Cultivator farmers who manage agricultural land using the expertise, energy and time they have. The harvest results in this collaboration are sold back to BULOG and the profits are distributed to the parties according to the ratio agreed at the beginning of the agreement, so that food supplies can be met with fairness, transparency and sustainability in every transaction and relationship between the parties in maintaining national food security.
