Abstract

The recognition of living law in society, as stipulated in Article 2 of Law Number 1 of 2023 on the Indonesian Penal Code (KUHP), appears to be a progressive step toward respecting legal pluralism in Indonesia. However, this recognition is conditional and places customary law in a subordinate position to state law. This article critically examines how Article 2 of the KUHP systematically narrows the space for customary law and disregards the sociological reality of living legal traditions. This study employs a normative juridical research method, focusing on the analysis of statutory provisions, legal doctrines, and relevant academic literature. Customary law, which has long been effective in resolving social conflicts, is marginalized due to its perceived incompatibility with formalistic and universal legal principles. This article proposes a deliberative approach as an alternative through equal and dialogical engagement between state and customary legal systems, emphasizing affirmative recognition that respects the autonomy of local legal communities. In doing so, recognizing customary law should not be a limiting instrument but a means to strengthen contextual justice within Indonesia’s diverse society.

Abstract

Kemajuan eksponensial teknologi informasi dan komunikasi pada era Society 5.0 mengharuskan adanya transformasi tata kelola pendidikan. Lembaga pendidikan agama Islam semakin didorong untuk mengadopsi mekanisme manajemen yang komprehensif dan terintegrasi. Penelitian ini bertujuan untuk mengeksplorasi secara analitis konsep, tantangan, serta peluang strategis seputar implementasi Management Information System (SIM) di entitas pendidikan Islam. Menggunakan pendekatan kualitatif melalui literature review yang ekstensif, riset ini menganalisis secara cermat jurnal akademik kontemporer, buku teks otoritatif, dan dokumen kebijakan resmi pemerintah. Hasil penelitian mengungkapkan bahwa integrasi SIM—seperti Education Management Information System (EMIS) dan e-Raport—secara signifikan mengoptimalkan efisiensi administratif, memperkuat akuntabilitas institusional, dan mengakselerasi proses pengambilan keputusan berbasis data (data-driven). Namun, transisi digital ini sangat terhambat oleh tantangan sistemik, termasuk disparitas infrastruktur, kesenjangan digital (digital divide), kompetensi sumber daya manusia yang tidak memadai, serta resistensi kultural atau technophobia di kalangan pendidik tradisional. Sebaliknya, proliferasi kebijakan digital dan munculnya kepemimpinan berbasis kebaikan (kindness-based leadership) menawarkan peluang substansial untuk memodernisasi pendidikan Islam. Studi ini menyimpulkan bahwa kesuksesan implementasi SIM menuntut sintesis holistik antara infrastruktur teknologi yang tangguh dengan nilai-nilai fundamental Islam seperti amanah dan adab, yang pada akhirnya memupuk lembaga pendidikan yang tangguh dan kompetitif di lanskap digital kontemporer.

Abstract

This research aims to improve production efficiency and product quality in the papaya sauce processing SMEs in Tuah Madani Village, Pekanbaru City, through the provision of an efficient papaya sauce mixer machine grant. These SMEs face challenges in the production process, still relying on manual methods, which lead to inconsistencies in product quality and low production capacity. This community service activity consists of two stages: socialization and the implementation of the papaya sauce mixer machine. The results of the socialization show an increase in participants' understanding of the machine technology, as measured through pre-test questionnaires. The average response indicated that 78% of the community agreed that the SMEs faced challenges such as reliance on manual stirring, limited knowledge of machines, inconsistent product quality, and difficulty in increasing production capacity. The post-test results revealed that 92% of the community agreed that the SMEs are now using a more efficient papaya sauce mixer machine, reducing dependence on manual labor, speeding up the production process, increasing both capacity and product quality, and receiving training on how to operate and maintain the machine effectively. Through the application of this technology, it is expected that the SMEs in Tuah Madani can enhance their product competitiveness, increase production capacity, and strengthen economic resilience amidst increasingly intense market competition. This technology is also expected to boost the economic activities of SMEs in a more effective and efficient manner.

Abstract

Criminal law policy about criminal punishment is one of the most important substances in Criminal law making and reform. Even, the regulation of criminal punishment is assumed as one of indicators in measuring the development and civilization of a nation.  The current Penal Code of Indonesia (PCI) or KUHP that is the heritage of Dutch colonial is much influenced by Classical School and placed imprisonment as priority.  The consequence is that in one hand the high rate of imprisonment and over-capacity in the prison on the other hand. Such a condition will result in problems such as the diffulties conducting rehabilitation and providing the budgeting.  In its development, modern criminal law, especially from the the idea of utilitariansme, tries to find various alternatives to imprisonment, especially Monetary Punishment.  Even though PCI has adopted regulation on monetary punishment, the existing system still places imprisonment very dominant.  The Indonesian legislator which is currently hearing the Bill of PCI to replace the current PCI should foster the function of monetary punishment so that it results in the utility for the people. This article is discussing about how criminal law policy   about the monetary punishment regulated in Bill of PCI.  This study applies normative legal research and put stressing in (content analysis). The result of this study shoes that Bill of PCI has not yet placed monetary punishment as first priority in criminal punishment. There are some regulations that make it is not possible for monetary punishment is more selected in criminal enforcement. Therefore, Bill of PCI should be more accommodative in optimizing financial punishment in   realizing criminal punishment for the benefit of the people.

Abstract

Perdagangan dan impor pakaian bekas dilarang berdasarkan Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan dan Undang-Undang Nomor 17 Tahun 2006 tentang Kepabeanan karena menimbulkan dampak negatif terhadap perekonomian nasional, kesehatan masyarakat, serta lingkungan. Kota Batam sebagai wilayah perbatasan dan jalur strategis perdagangan internasional menjadi daerah rawan masuknya barang ilegal, termasuk pakaian bekas impor, yang praktik peredarannya masih banyak ditemukan di lapangan. Penelitian ini bertujuan untuk menganalisis penegakan hukum terhadap pelaku usaha pakaian bekas impor oleh Bea Cukai dan Kepolisian di Kota Batam serta mengidentifikasi kendala yang dihadapi dalam proses penegakan hukum tersebut. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan perundang-undangan dan sosiologis, melalui studi kepustakaan dan wawancara dengan aparat Bea Cukai dan Kepolisian. Hasil penelitian menunjukkan bahwa penegakan hukum belum berjalan efektif. Bea Cukai telah melakukan pengawasan dan penindakan rutin terhadap masuknya barang ilegal, namun masih terdapat hambatan dalam pengawasan di wilayah perbatasan. Sementara itu, Kepolisian Kota Batam belum melakukan penindakan langsung terhadap pelaku usaha pakaian bekas impor. Kendala utama meliputi tingginya permintaan masyarakat, keterbatasan sumber daya aparat, serta kurangnya koordinasi antarinstansi. Oleh karena itu, diperlukan penguatan pengawasan di pintu masuk perdagangan, peningkatan kerja sama antarinstansi, dan sosialisasi kepada masyarakat guna meningkatkan efektivitas penegakan hukum dan menekan peredaran pakaian bekas impor

Abstract

The loading and unloading process is one of the most vital activities in port operations and plays a significant role in ensuring the smooth flow of national logistics. However, in practice, various forms of inefficiency are still frequently encountered, such as high ship waiting times, low utilization of loading and unloading equipment, and imbalances in labor scheduling and cargo flow in the yard area. These conditions increase turnaround times and hinder port productivity. To address these issues, an analytical approach is needed that can comprehensively model system behavior so that the causes of inefficiency can be precisely identified and tested through improvement scenarios without disrupting actual operations. This study aims to analyze the efficiency level of the ship loading and unloading process at the Port of Tanjung Emas Semarang by applying the Discrete Event Simulation (DES) method using Arena software. The model was developed to describe the flow of activities from ship arrival, through the service process using cranes, to the distribution of cargo to the storage area. Model validation was carried out by comparing simulation results with actual data. The results showed that the combination scenario of adding cranes and adjusting shift schedules provided the most significant efficiency improvement, with a reduction in ship dwell time of up to 20%, waiting time of up to 30%, and an increase in crane utilization of up to 83%. These findings confirm that DES is effective as an analytical tool and basis for operational decision-making at ports.

Abstract

Changes in the correctional facility system were marked by the passage of Law Number 22 of 2022 Concerning Correctional Institutions. One of the things that are regulated is regarding detainee services as the correctional function. This arrangement is of course interesting to analyze because so far correctional facilities have only been synonymous with fostering convicts, which is the final stage in the criminal justice system. Services for detainees at the detention center are related to the ongoing criminal justice process because legally the responsibility for detention is still on the law enforcement agencies that carry out the detention. This paper aims to analyze the relationship between the regulation of detainee services in the Correctional Law and the integrated criminal justice system in Indonesia. This study uses a normative juridical method with a statutory and conceptual approach, especially regarding the correctional system and integrated criminal justice system. The results of the discussion and analysis show that there are strict and clear arrangements regarding the administration of detainee services as a function of a correctional facility. This is a form of legal certainty and at the same time affirms the existence of correctional facilities as an integrated criminal justice subsystem. As part of the criminal justice system, correctional facilities do not only work at the end of a series of criminal justice processes through the function of fostering convicts and criminal children but also when the criminal justice process is in operation or progress.

Abstract

The application of the living law concept within Indonesia’s criminal law system, as regulated in the new Criminal Code (KUHP), opens a new dimension in recognizing customary law and social norms that exist within society. This concept seeks to create a legal system that is more responsive to social and cultural diversity, while accommodating local norms within the criminal justice process. However, the recognition of living law also raises significant issues, particularly with respect to the principle of legality in criminal law, legal uncertainty, and the potential for abuse of power by law enforcement authorities. This study aims to analyze the problems associated with the implementation of living law as a basis for criminalization under the KUHP, using a normative juridical approach and relying on both primary and secondary legal sources. The discussion includes the identification of challenges arising from the ambiguity in the acceptance and proof of customary norms in legal practice, as well as these norms’ impact on legal certainty and the protection of human rights. Furthermore, this article proposes alternative approaches to the application of living law that are more selective and firmly grounded in the principles of justice and human rights. The findings indicate that although living law can enhance respect for legal pluralism, its implementation must go through strict and transparent verification mechanisms to prevent legal uncertainty and discrimination. Therefore, clear regulations are needed regarding the recognition and limitations of living law norms within the criminal justice system, along with a more restorative approach to dispute resolution.
