THE GORONTALO RELIGIOUS COURT JUDGES RESPONSE TOWARD THEIR ABSOLUTE COMPETENCE IN RESOLVING SHARIAH ECONOMY DISPUTES Mardiana, Andi; Darwis, Rizal

Abstract

Post the first amendment of Religious Courts Bill that provides wider authority toward Religious Courts in investigate and decide Islamic economics disputes has responses, whether support or pessimistic, especially among Religious Court judges themselves. This paper examines the Gorontalo Religious Courts judges response about their authority in resolve Shariah economy disputes. This paper is a qualitative descriptive research and the data was collected using observation, interviews and document reviews. The finding of this study revealed that the Gorontalo Religious Courts judges response well to trust laws in handling disputes Shariah economy. In other words, in principle, they are ready to handle disputes Islamic economics. Readiness, such as: the handling disputes Shariah economy is Religious Courts judges authorities and it is a professional responsibility as a judge; Religious Courts formed a special judge to handle falling out or cases of Shariah economy, and Religious Courts judges provides knowledge of Shariah economy without trainings or workshops. -----Pasca amandemen pertama undang-undang Peradilan Agama yang memberikan perluasan kewenangan penyelesaian sengketa ekonomi syari’ah telah memberikan berbagai tanggapan dari berbagai kalangan, khususnya hakim-hakim Pengadilan Agama. Tulisan ini mengkaji respon para hakim di Pengadilan Agama Gorontalo terhadap kewenangan tersebut. Penelitian ini adalah deskriptif kualitatif dengan metode pengumpulan data melalui observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa hakim Pengadilan Agama Gorontalo merespon baik terhadap amanah undang-undang dalam menangani sengketa perekonomian syari’ah. Dengan kata lain pada prinsipnya mereka telah siap menangani sengketa ekonomi syariah. Kesiapan itu antara lain: penanganan sengketa ekonomi syariah adalah sebuah tanggung jawab profesi sebagai hakim; Pengadilan Agama membentuk majelis hakim khusus menangani sengketa atau perkara ekonomi syari’ah, dan hakim-hakim Pengadilan Agama dibekali dengan pengetahuan tentang perekonomian syari’ah melalui pelatihan-pelatihan.

Abstract

This article describes the concept of children fiqh in Indonesia with discussions covering status and child care. A child can legitimately be said to have a blood relationship with her/his father if she/he was born in a legitimate marriage. If the child is born illegitimately; then, she/he cannot be attributed to his/her father, except his/her mother alone. In the case of child care, most scholars have differed fiqh perspective. Many fiqh scholars stated that women has the authority to care for and educate children is more appropriate care for and educate children because their feminine nature. However, Hanafi and Maliki schools of thought argued that nurturing, caring and educating children is the right caregiver (mother or a representative). Associated Muslim scholars contended that the right of al-hadhanah is the rights of the two parents. Wahbah al-Zuhailiy argued that the rights of alhadhanah belong to association between mother, father and children. If a dispute arises among these three parties; then, the priority is focused on the rights of the cared-child.

Abstract

This article examines the thoughts of Imam Malik on the masalahat problems in Islamic law. In using al-mashlahat al-mursalah, Imam Malik genuienly provided three limitations or conditions, namely: the existence of a match between the concerns that are considered with maqashid al-shari'ah; the mashlahat relates to matters which are ma'qulat (rational) which according to syara are based on the maintenance of the mashlahat; and the results of al-mashlahat al-mursalah are returned to the maintenance of the dzharuriy (primary) case according to syara and negate the narrowness in religion. The laws contained in Islamic law are oriented towards maintaining the benefit of the mukallaf and rejecting obedience, in order to realize a harmonious life that brings peace and happiness to humans.

Abstract

This study examines the transformation of meaning in the Bugis society’s mappasikarawa culture, which has undergone significant shifts in values due to modernity. It employs a dialectical approach between the Qur’an and local cultural context as al-urf to map the dynamic relationship between universal Islamic values and local wisdom. Using a qualitative analytical-critical method, data was gathered through in-depth interviews, participant observation, and document analysis in Bugis regions. Findings show that mappasikarawa serves not only as a symbolic ritual but also integrates Qur’anic values sakinah, mawaddah, and rahmah. Thus, a contextual reinterpretation based on maqaṣid al-shariah and hifz al-nafs is essential to maintain its relevance and harmony with Islamic law.
