Abstract

Currently there is a pretrial decission No.5/Pid.Pre/2018/PN BTM which cancels the determination of the suspect with the consideration that the evidence for the determination of the suspect has been distorted by the investigation period which is considered too long, it’s necessary to analyze the construction flow of the judge's legal considerations and normative juridical examination as well as the legal consequences of the decission against the investigator. This research used descriptive analytical method using a normative approach (legal research) to obtain secondary data and an empirical approach (juridical sociological) to obtain primary data through observation (observation). The results showed that pretrial judges form a new legal method regarding the distorted value of evidence based on the period of investigation in which this consideration was no longer on the assessment of formal aspects, from this decission Investigators if they want to re-determine someone as a suspect must use two different pieces of new evidence. For this reason, the Supreme Court is expected to establish special rules regarding mechanisms and clear boundaries for pretrial judges in establishing the rule of law, besides that a clear definition of deviant and/or fundamentally deviant decissions is needed and the annulling mechanism to anticipate legal smuggling.

Abstract

Discipline of the State Civil Apparatus has been regulated in Law of the Republic of Indonesia Number 20 of 2023 concerning the State Civil Apparatus. In this regulation, the State Civil Apparatus consists of Civil Servants and Government Employees with Employment Agreements who are appointed by civil service development officials and entrusted with duties in a government position or entrusted with other state duties and are given income based on statutory regulations. The purpose of this regulation is intended to serve as a guideline in enforcing State Civil Service Discipline. However, the reality in the field is that violations of State Civil Apparatus Discipline, especially at SMAN 15 Batam, still occur frequently and repeatedly. This research aims to find out how the law regulates the enforcement of discipline towards State Civil Apparatus in the SMAN 15 Batam environment, how the implementation of law enforcement regarding the application of discipline towards the State Civil Apparatus in the SMAN 15 Batam environment and the obstacles faced by SMAN 15 Batam in enforcing discipline against State Civil Apparatus and alternative problem solving in the form of rewards and punishments. The research method used is a qualitative method with a normative and empirical juridical approach that analyzes statutory regulations relevant to the discipline of the State Civil Service. The data sources for this research were obtained from secondary data and primary data. Primary data was collected through interviews and observations, while secondary data was obtained from previous literature, books, journals and case studies. The results of the research show that so far the process of imposing punishment has only taken the form of a verbal warning delivered directly by the school principal. Verbal warnings are a form of light disciplinary punishment. Verbal warnings are given by considering the background of the Civil Servant disciplinary violation and the impact of the violation. Based on these results, the suggestion put forward is that it is hoped that all State Civil Servants will increase awareness of ASN discipline as well as understand and carry out obligations and avoid prohibitions in accordance with applicable laws and regulations. State civil servants must be more responsible for themselves and in carrying out ASN duties so that the objectives of ASN discipline can be realized well. For example, arriving at school early to avoid unexpected obstacles. In the future, enforcement of discipline in the State Civil Service must really be carried out properly and the process of imposing punishments must be stricter against perpetrators of violations of discipline by the State Civil Service so that it can provide a deterrent effect for undisciplined ASN.

Abstract

Interfaith marriage in Indonesia represents a complex legal challenge characterized by significant regulatory ambiguity and constitutional tensions. This juridical research investigates the existing legal vacuum surrounding interfaith marriage, examining the critical gaps in current legislation that impede comprehensive legal protection for interfaith couples. Utilizing a normative juridical approach with legislative and conceptual analysis, the study explores the intricate intersections between religious diversity, individual rights, and legal frameworks.The research reveals substantial deficiencies in the current legal system, highlighting the absence of specific regulations governing interfaith marriage. Key findings demonstrate the urgent need for a comprehensive legislative framework that balances religious pluralism, constitutional principles, and individual human rights. The study identifies critical challenges, including conflicts between existing legal provisions, social perceptions, and constitutional guarantees of religious freedom.Methodologically grounded in progressive legal theory and human rights principles, the research provides a critical analysis of the existing legal landscape. Comparative insights from international jurisdictions underscore the necessity of legal reform. The findings recommend the development of nuanced legislation that respects individual choice while maintaining social harmony.The study concludes that Indonesia requires a transformative approach to interfaith marriage regulation, emphasizing legislative reforms, public education, and the establishment of robust legal mechanisms that protect individual rights within the context of religious and cultural diversity.

Abstract

Perlindungan adalah suatu cara atau proses atau perbuatan untuk melindungi. Perlindungan memiliki makna adalah hak yang didapatkan oleh setiap orang dalam wilayah suatu negara yaitu berupa hak untuk mendapatkan atau memperoleh keamanan dan kenyamanan, sehingga masyarakat merasa tenang dan damai. Perlindungan hukum tenaga kerja alih daya dalam kesejahteraan pekerja bidang tenaga pengamanan.Hal ini menarik penulis untuk meneliti bagaimana pengaturan hukum tentang perlindungan kesejahteraan tenaga kerja alih daya di bidang jasa pengamanan di PT. Putra Tidar Perkasa dan bagaimana implementasi faktor, kendala, dan solusi perlindungan kesejahteraan tenaga kerja alih daya di bidang jasa pengamanan di PT. Putra Tidar Perkasa. Metode yang digunakan dalam penelitian ini adalah normatif empiris, dengan jenis penelitian deskriptif, dimana dalam penelitian ini akan diuraikan bagaimana tentang perlindungan kesejahteraan tenaga kerja alih daya di bidang jasa pengamanan di PT. Putra Tidar Perkasa yang diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Ditambah lagi dengan telah disahkannya Undang Undang Omnimbus Law yakni Undang Undang Nomor 11 Tahun 2020 dengan beberapa peraturan pelaksananya mulai dari Peraturan Pemerintah Nomor 35, 36 dan 37 yang mengatur tentang perlindungan terhadap hak pekerja. Sumber data dalam penelitian ini menggunakan penelitian kepustakaan, lapangan dan metode wawancara, serta data sekunder dan data primer. Analisis data menggunakan analisis kualitatif.Undang-Undang atau aturan telah ditetapkan oleh Pemerintah namun dalam pelaksanaannya masih terdapat banyak kendala yang mempengaruhi pemenuhan atas perlindungan kesejahteraan. Terlebih sesuai dengan BAB X yang membahas tentang perlindungan, pengupahan dan kesejahteran. Terutama pada Pasal 88 tentang pengupahan dan Pasal 99 tentang jaminan sosial tenaga kerja. Hasil penelitian menunjukkan bahwa, PT. Putra Tidar Perkasa telah melaksanakan aturan perundangan pada Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan termasuk Undang Undang Omnimbus Law serta peraturan pelaksanaannya terkait dengan ketenaga kerjaan telah di implementasikan dengan cukup patuh meskipun terdapat kendala dengan pengawasan dari instansi terkait dalam hal ini Dinas Tenaga Kerja Kota Batam. Karena itu penulis menyarankan agar lebih meningkatkan sistem pengawasan dalam pemenuhan perlindungan kesejahteraan ini.

Abstract

The purpose of this study is to find out how the legal review of the sale and purchase agreement through e-commerce and to find out the time and validity of the agreement in the electronic sale and purchase agreement. The data collection method used is primary legal materials, namely laws and court decisions. Secondary legal materials are various literatures, expert opinions, legal dictionaries. Non-legal materials such as the Big Indonesian Dictionary and economic books. The results of the research conducted that the validity of online buying and selling agreements by parties with different legal systems, remains valid. This can be seen even though the different legal systems of the agreement occur because of a prior agreement between the parties, where when they want to enter into an e-commerce contract the parties can determine the choice of law and the choice of which forum is the basis for implementing e-commerce as well as being a second agreement. parties in the event of a dispute in the future. If a choice of law is not made, then to determine the applicable law, the principle/theory (the most characteristic) in Civil Law must be used.

Abstract

This community service activity aims to provide an understanding of maritime law to fishermen and coastal communities in Setokok Village, Bulang District, Batam City, specifically regarding the supervision of foreign vessels in Indonesian waters. The methods used were direct outreach with a participatory approach, group discussions, and case simulations. This activity involved 85 participants consisting of fishermen, community leaders, and village officials. The results of the activity showed an increase in participants' understanding of the rights and obligations of fishermen, procedures for reporting foreign vessels, and the importance of maintaining the sovereignty of Indonesian waters. This activity had a positive impact in the form of increased awareness of maritime law and community participation in monitoring water areas.

Abstract

Currently, the development of innovation regarding concrete mortar mix design technology is being widely researched. The innovation in making mortar is the use of additives. This research aims to determine the effect of adding additives on the workability and compressive strength of mortar. The additive used is a High Performance Superplasticizer with the trademark Sika Viscocrete 8670 MN. The fine aggregate used is ex sand. Batang Hari River. The sand category used is coarse sand, based on ASTM C33. The mortar test object is in the shape of a cube with dimensions of 5x5x5 cm. The test specimens consisted of Normal Mortar (MN), Mortar with 0.6% Sika Viscocrete (MS 0.6%), and Mortar with 1.4% Sika Viscocrete (MS 1.4%). The compressive strength testing method refers to SNI 03-6825-2002 concerning Testing Methods for Compressive Strength of Portland Cement Mortar. The results of testing organic dirt in the coarse sand of the Batanghari River are unwashed sand at number 3, and sand that has been washed and soaked with 3% NaOH at number 2 on the organic plate. The compressive strength test results at 8 hours of MN were 6.97 MPa, MS 0.6% was 6.70 MPa and MS 1.4% was 7.73 MPa. The compressive strength at 1 day of age for MN was 14.68 MPa, MS 0.6% was 16.27 MPa, and MS 1.4% decreased to 14.28 MPa. The compressive strength at 7 days of MN was 19.93 MPa, MS 0.6% was 25.33 MPa, and MS 1.4% was 26.95 MPa. Compressive strength at the age of 28 days, MN's compressive strength value is superior, namely 31.53 MPa, MS 0.6% is 28.72 MPa and MS 1.4% is 28.80 MPa. The research results show that to maintain the workability of mortar mixtures that use high performance superplasticizer additives, it is necessary to reduce water. At 28 days, normal mortar has superior compressive strength compared to mortar that uses high performance superplasticizer as added material.

Abstract

This study aims to examine: (1) the legal framework of mahar (dowry) in marriage according to Islamic jurisprudence, and (2) the legal implications of using stolen property as mahar, analyzed through the principle of maslahah (public interest). This research employs a library-based methodology, drawing from primary and secondary sources including classical and contemporary fiqh works, Qur’anic exegesis, and scholarly articles. Data collection follows systematic steps of editing, organizing, and concluding, followed by comparative-verificative analysis. Findings reveal that in Islamic law, ownership of wealth is divine in nature (milkiyyah ilahiyyah), carrying moral and legal obligations. Using stolen property, even without direct involvement in theft, is strictly prohibited if its unlawful origin is known. All major Islamic schools agree that stolen property remains the rightful possession of its original owner and must be returned or compensated. Regarding marriage, the majority of scholars assert that the contract remains valid if its other pillars and conditions are met, but the haram mahar is void and must be replaced with an equivalent lawful dowry (mahar al-mithl). The tarjih approach supports this position to uphold the validity of the contract, preserve public interest, and prevent greater harm (mafsadah). The study concludes that the use of haram wealth in dowry is a violation of Islamic principles with moral and social consequences, requiring repentance, restitution, and lawful substitution.

Abstract

This study examines the complex challenges surrounding criminal acts perpetrated against Indonesian migrant workers and evaluates the effectiveness of current law enforcement mechanisms and legal protection frameworks. The research analyzes both domestic and international legal instruments designed to protect migrant workers, with particular focus on their implementation and practical outcomes. Through a comprehensive assessment of case studies, legal documents, and enforcement data, this study reveals significant gaps between established legal protections and their actual enforcement. Key findings indicate that Indonesian migrant workers frequently face various forms of criminal exploitation, including physical abuse, fraud, human trafficking, and unlawful confinement, while working abroad. The study identifies several systemic barriers to effective legal protection, including jurisdictional complexities, limited access to legal resources, inadequate bilateral agreements, and weak enforcement mechanisms in both sending and receiving countries. Furthermore, the research highlights the critical role of government agencies, diplomatic missions, and non-governmental organizations in providing legal assistance to victimized workers. The study concludes by proposing concrete recommendations for strengthening the legal protection framework, enhancing international cooperation in law enforcement, improving access to justice for migrant workers, and developing more robust preventive measures against criminal exploitation.

Abstract

The determination of minimum wage is one of the instruments of state policy to realise social justice for workers, especially in guaranteeing a decent income and protecting weak economic groups. The Wage Council, as a tripartite institution consisting of elements of government, employers, and labour unions, has a strategic role in formulating minimum wage recommendations to regional heads. This research is motivated by the reality that although legal arrangements on the role of the Wage Council have been regulated in various regulations, the implementation in the field, especially in Batam City, has not fully reflected the principles of social justice as referred to in Articles 27 and 28D of the 1945 Constitution. This research aims to juridically analyze the role and function of Wage Council in the process of determining minimum wage for workers in Batam City, assess the obstacles faced, and provide solutions based on the theoretical approach of justice, legal system, and legal certainty. The research methods used are normative juridical and empirical juridical, with primary data obtained through interviews with government elements, trade unions, and employers, as well as secondary data in the form of legislation and legal literature. The results show that normatively the role of the Wage Board has a clear legal basis, but in its implementation there are still obstacles such as imbalance in bargaining position, political intervention, and weak supervision of the application of wage structures and scales. Solutions offered include strengthening regulations based on legal certainty, increasing the technical capacity of Council members, and participatory strategies that involve workers more actively. The research recommends institutional reform and strengthening transparency to ensure a fairer and more sustainable wage system.
