Abstract

Salah satu upaya yang dilakukan oleh Kementrian Hukum dan HAM Republik Indonesia pada program asimilasi dimasa Covid 19 dengan mengeluarkan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 32 Tahun 2020 tentang Syarat dan Tata Cara Pemberian Asimilasi, Pembebasan Bersyarat, Cuti Menjelang Bebas, dan Cuti Bersyarat Bagi Narapidana dan Anak Dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19. Pembebasan terhadap narapidana dilakukan dengan pertimbangan rawannya penyebaran Covid-19. Melalui penelitian ini melihat apakah implementasi peraturan tersebut pada Rumah Tahanan Tanjungbalai Karimun telah sesuai atau ditemukan permasalahan baru. Penelitian ini menggunakan metode deskriptif analitis dan pendekatan perundang-undangan. Hasil penelitian ini menunjukan bahwa implementasi asimilasi pada Rumah Tahanan Tanjungbalai Karimun di masa pandemi Covid-19 telah sesuai dengan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 32 Tahun 2020 tentang Syarat dan Tata Cara Pemberian Asimilasi, Pembebasan Bersyarat, Cuti Menjelang Bebas, dan Cuti Bersyarat Bagi Narapidana dan Anak Dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19.

Abstract

Pemilihan kepala daerah secara langsung dan serentak merupakan bentuk nyata pelaksanaan otonomi daerah karena rakyat bisa memilih secara langsung para pemimpin yang dikehendakinya. Oleh karena itu pemerintah telah menyiapkan perangkat perundang-undangan untuk mendukung kegiatan pemilihan kepala daerah secara langsung tersebut. Permasalahan yang dibahas dalam penelitian ini adalah bagaimana pelaksanaan serta permasalahan yang terjadi dalam Pemilihan kepala daerah secara langsung dan serentak serta upaya yang bisa dilakukan untuk menyelesaikan problematika tersebut untuk mewujudkan pemilihan yang lebih demokratis dan ideal bagi daerah. Metode penelitian berupa penelitian hukum empiris yang bersifat deskriptif dengan pendekatan socio legal research. Hasil penelitian menunjukan bahwa pelaksanaan pemilihan kepala daerah secara langsung dan serentak pada tahun 2015, 2017 dan 2018 masih ditemukan berbagai permasalahan dari sejak tahapan dimulai sampai pada hasil Pemilihan, untuk itu perlu dilakukan pembaharuan perundang-undangan Pemilihan kepala daerah berdasarkan prinsip-prinsip demokrasi yang rasional agar pelaksanaan pemilihan kepala daerah berikutnya dapat terlaksana lebih demokratis sesuai aspirasi masyarakat dan kondisi daerah.   The direct and simultaneous election of regional heads is a tangible form of implementing regional autonomy because the people can directly elect the leaders they want. Therefore, the government has prepared legislation to support the direct election of regional heads. The problems discussed in this study are how the implementation and problems that occur in direct and simultaneous regional head elections and the efforts that can be made to resolve these problems to realize a more democratic and ideal election for the region. The research method is in the form of descriptive empirical legal research with a socio legal research approach. The results of the study show that the implementation of direct and simultaneous regional head elections in 2015, 2017 and 2018 still found various problems from the stage starting to the election results, for this reason it is necessary to reform the legislation on regional head elections based on rational democratic principles. so that the implementation of the next regional head election can be carried out more democratically according to the aspirations of the people and regional conditions.

Abstract

Legislative elections are elections to choose members of the DPR, DPD and DPRD. Elections of 2014 refers to the Law No. 8 of 2012 that the implementation of voting takes place on Wednesday, April 9, 2014. In each stage of the implementation of the election can not be separated from the existence of the phenomena observed and found to be studied. In the 2014 legislative elections this phenomenon to the attention of the author is the repeat voting. Of the 546,278 polling stations inside and outside the country, as many as 779 polling stations have to hold repeat polls including Tanjungpinang. As for the problem of this research is related to policy organizer re-election in voting in Tanjungpinang. The research method used is descriptive analytical research through a qualitative approach. Sources of data obtained through primary data is the main data obtained directly from informants through interviews with commissioners and staff KPU secretariat Tanjungpinang and secondary data is data obtained from literature books, legislation, internet and other scientific work. From the research it can be concluded that the author Tanjungpinang KPU vote again at the polling place that TPS 275/36 by reason of ballots confused. In the implementation of revoting, Election Commission Tanjungpinang based on the electoral law, regulations and the Commission Circular. In principle the setting because of the re-voting ballots are not dealt with explicitly swapped in the laws or regulations of KPU. Abstract

The Constitution contains the main rules that guarantee the rights of citizens from arbitrary actions rather than the ruler and the implementation of community interest. There is a written Constitution and there are unwritten. Constitution is the constitution tertulis.Negara Indonesia has three written constitution. The written constitution of Indonesia, namely the Constitution of 1945 (UUD 1945) applies padatanggal August 18, 1945 until December 27, 1949), which consists of 16 Chapters and 37 Articles, the Constitution of the Republic of Indonesia (RIS Constitution or the Constitution of 1949) or The Constitution also called RIS dated December 27, 1949 - August 17, 1950 consists of 6 chapters and each chapter consists of several sections, Constitution while 1950 (Provisional Constitution / Constitution 1950) dated August 17, 1950 - July 5, 1959 consists of 6 chapters and each chapter consists of several sections. On July 5, 1959 President Sukarno issued a decree that dissolved the constituent assembly and declared void 1945. In May 1988, there were reforms that have an impact on the changes (amendments) to the 1945 Constitution. The first amendment dated October 19, 1999, both dated August 18, 2000, the third of November 9, 2001, and the fourth date of August 10, 2002. As the embodiment of the aspirations of the people who are less satisfied with the amendments, the Assembly established a "Constitutional Commission" assigned to conduct a comprehensive assessment of the 1945 changes. Abstract

Money politics is a gift or promise to bribe someone so that the person does not exercise their rights in a certain way during the general election. The purchase can be in the form of goods or money, as found by researchers regarding the phenomenon of money politics which is still widespread in three regions, namely , Kijang Bintan, Kawal Bintan, and Lingga, people who are still relatively ignorant and have economic constraints are one of the factors in society being entangled in giving and receiving political money. Apart from damaging democracy due to forms of fraud, this problem has a negative impact on the givers and recipients who have clearly violated the provisions of the election law and violated criminal provisions. However, this problem is still difficult to resolve due to the lack of supervision and firm action. This research uses empirical legal research. This research is a legal research method that uses empirical facts taken from people's behavior, both verbally obtained from interviews and behavior carried out through direct observation. The theory used in this research is not to use critical legal theory, in order to find the problems that occur, as well as reveal how much the public understands money politics. So from these problems it can be drawn with the title Review of Community Understanding of Money Politics

Abstract

Corruption is an extraordinary crime that should be eradicated. The increase in corruption cases is still stagnant despite various efforts to reduce the number of corruptions. As a country that has ratified the United Nations Convention Against Corruption (UNCAC) through Law No. 7/2006 on the Ratification of the UN Convention Against Corruption, Indonesia should have the same legal standing in matters regulated in UNCAC, including the issue of confiscation of criminal proceeds. The main objective of the Asset Forfeiture Law is how to recover state losses (asset recovery), so that the losses suffered by the state are not significant. This research is conducted to examine and discuss the influence of legal politics in combating corruption through the establishment of the Asset Forfeiture Bill. The research method used in this research is normative juridical, by analyzing applicable legal norms supported by doctrines that develop in law. The results showed that legal politics influenced the ratification of the Asset Forfeiture Bill. The Asset Forfeiture Bill is important to be ratified immediately in order to provide a deterrent effect for corruptors

Abstract

That the purpose of this research is to find out about the concept of criminology in the circulation of non-tax cigarettes in Non-Free Trade Areas (outside the Area) as well as to know how the role of the government in minimizing the problem. That this article uses the method of juridic research normative and makes an approach to the law. The sources of data used for this research to be valid are laws, books, journal articles, as well as web pages with similar topics in this article about non-tax cigarettes. The results of this study can be concluded that the criminology of non-tax cigarette trafficking perpetrators is divided into three main parts: criminal biology, which is the reason for the perpetrator, criminal sociology that is the background of circularity that can be the driving force of the non-tariff cigarette traffic and criminal policy that is an action that gives the effect that no other perpetrates follow the traffic and the role of the government in minimizing the circulation of cigarettes is by carrying out both direct and indirect surveillance. In addition, the government can also socialize to the public about tax obligations.

Abstract

This research analyses the suitability of permits for using mangrove wood in Karimun Regency for charcoal making, which has been going on for a long time. This charcoal was traded for local and foreign needs even before Indonesian Independence. However, it was only in 2010 that the official IUPHHK-HTR permit was enacted to regulate this activity.This study aims to analyze the suitability of forest area functions in community plantation forest permit areas based on the provisions of forestry laws and regulations, calculate the area of degraded/deforested as well as reforested forest cover using satellite image interpretation results, and identify institutions involved in processing mangrove wood into charcoal. The results showed that 59.55% of the forest area followed the permit, but there was deforestation of 802.29 ha (27%) and degradation of 72.53 ha (32.44%). On the other hand, reforestation efforts of 1,446.32 hectares were also carried out.This research was conducted using normative or doctrinal legal and overlay methods. The methods used in this research consist of normative or doctrinal legal research methods and overlay methods. Normative legal research focuses on the scope of legal conceptions, legal principles, and legal rules governing the suitability of forest area functions and granting social forestry licenses for community plantation forests. At the same time, the overlay method combines information from various maps. Various parties are involved in mangrove charcoal management, ranging from the Ministry of Environment and Forestry, Kepulauan Riau Provincial Government, Karimun Regency Government, and Wana Jaya Karimun Cooperative to 30 business license holders and charcoal collectors.This research recommends evaluating mangrove IUPHHK-HTR policies to ensure forest sustainability and balance between utilization and sustainability

Abstract

Ekosistem mangrove penting bagi wilayah kepulauan untuk melindungi pantai dari bahaya gelombang tinggi yang mengakibatkan banjir dan erosi pantai. Namun, mangrove hanya dapat tumbuh pada kondisi sesuai kriteria ekologi ekosistem mangrove. Pelestarian ekosistem mangrove perlu diintegrasikan kedalam perencanaan tata ruang kota pesisir. Menyusun rencana tata ruang kota pesisir di pulau kecil harus adaptif terhadap perubahan lingkungan dengan berbasis pada ekologi ekosistem pesisir. Penelitian ini bertujuan untuk membandingkan hasil analisis kesesuaian habitat mangrove dengan rencana pola ruang RDTR Kota Tanjungpinang. Kesesuaian habitat ekosistem mangrove di Kota Tanjungpinang berdasarkan kriteria ekologi mangrove diperoleh luas lahan yang sangat sesuai yaitu seluas 1227,87 Ha, sesuai 2651,52 Ha, dan kriteria cukup sesuai dengan luas 412,84 Ha. Zona budidaya antara lain berupa zona perumahan, perdagangan jasa, perkantoran, industri pada rencana peruntukan ruang RDTR Kota Tanjungpinang berada pada lahan yang memiliki kesesuaian habitat ekosistem mangrove berdasarkan kriteria ekologi.
