Abstract

Termination of employment is regulated in Articles 150 to Article 170 ofLaw Number 13 of 2003 concerning Employment, Process for resolving disputesbetween mediators from the Riau Province Manpower and TransmigrationService. , conciliation, arbitration and settlement in the Industrial RelationsCourt. The settlement of the mediation is not reached peace, because the result ofthe mediation. The main problem is how to implement termination of employmentat the mediation level in the context of resolving industrial relations disputes atthe Manpower and Transmigration Office of Riau Province and what are theobstacles in resolving disputes over termination of employment at the mediationlevel in the context of resolving industrial relations disputes according to the Law.The study took a sample from a population and used interviews as a meansof collecting basic data. The nature of descriptive research is to describe thecurrent state of the subject or object of research based on the facts that appear asthey are. Implementation of the settlement of disputes over termination ofemployment (PHK) at the mediation level at the Office of Manpower andTransmigration of Riau Province, namely the mediator acts as a neutral andarbiter of parties, helping to solve problems and finding solutions to the disputesencountered. mediation and mediation stage, at the pre-mediation stage themediator collects background information and facts of the dispute, at themediation stage, the mediator carries out mediation according to his capacity tobe able to produce the right solution so that termination of employment can beavoided and is impartial and neutral in resolving disputes.Barriers to the Implementation of Dispute Settlement Termination at themediation level at the Manpower and Transmigration Service, namely: it isdifficult to find the presence of the leadership of PT.Indosurya Pekanbaru branchor central, due to the reason the leadership is not always in the office when youwant to be met, the distance traveled by the parties because the location of themediation place is far from their place of origin, the handling is not completed bythe mediator, there is no agreement with proof of signing the agreement file. Theexistence of different points of view, reluctance to understand what is conveyed bythe mediator, does not accept the opinion of the mediator.Keywords: Settlement-Industrial Law Disputes-Employees

Abstract

The need for private transportation in the midst of a pandemic that has notended, has an impact on used car sales which are slowly but surely rising again.This used car buying and selling activity will of course begin with an agreementbetween the two parties that is included in the contents of the agreement. Usuallythe form of an oral agreement or written agreement signed on stamp duty by bothparties. In a broad sense, an agreement means any agreement that is caused as alegal consequence as agreed by the parties. In connection with the buying andselling of used cars, problems often occur that do not only originate from businessactors, but also from buyers who are interested in a used car in a showroom, oneof which the author has built in the following research.This type of research can be classified in the type of descriptive qualitativeresearch, because in this study the author directly conducts research on thelocation or place under study in order to provide a complete picture and explainthe problem under study. This research was conducted at the Sky MotorShowroom Pekanbaru, while the population and sample were all parties relatedto the problems studied in this study, the data sources used were primary data,primary data, secondary data and tertiary data. Data collection techniques in thisstudy by observation, interviews and literature study.The results of this study are the car buyer has defaulted, the sale andpurchase agreement becomes invalid because the car buyer does not pay thedown payment as agreed in the agreement. According to the provisions of Article1243 of the Civil Code, compensation due to non-fulfillment of a new obligationthat is required if the debtor after being declared negligent in fulfilling hisengagement continues to neglect it, or something that must be given or done canonly be given or done within the time period that has passed. The loss wasdeclared obliged to be replaced by the debtor starting from the time he wasnegligent on January 20, 2022 which should have been repaid on January 19,2022. Abstract

Riau Province has a large area of oil palm plantations. Of the land area of 2.32 million hectares, 1.53 million hectares are oil palm plantations owned by the community. In 2019, there were 51 cases of natural resource conflicts in Riau Province, of which the plantation sector was the most with 40 cases (78.40 percent). This study applied a qualitative descriptive method to understand the phenomenon of plantation land conflict that aimed to: (1) identify the factors that cause conflicts in oil palm plantations in Riau Province; (2) identify current policies related to the handling of plantation conflicts and (3) recommend policy suggestions that better protect the interests of the community from an Islamic perspective. This study concluded as follow: (1) the causes of land conflicts identified are non-legal factor which is related to the management of land use and access, and legal factor which is related to judicial and regulation overlap; (2) Regarding the current policies related to plantation land conflicts, the development of oil palm plantations is basically in line with the mandate of the 1945 Constitution that natural resources are controlled by the state and used for the prosperity of the people.; (3) to protect the community interests in plantation land, this study recommends policy based on Islamic guidelines in land ownership. Islamic law classifies ownership into individual property rights (al-milkiyah al-khassah), collective property rights (al-milkiyyah al-'ammah) and state property rights (al-milkiyah al-daulah). This classification protects the community's property rights individually and collectively because investors cannot dictate the state to take over community ownership. Islam also has rules for activating inactive land and distributing it to people who can manage it, which will be the solution to unauthorized land use that is prone to conflict.

Abstract

Customary inheritance is part of customary law relating to norms or rules in determining the amountof assets, both material and immaterial that can be handed over to their descendants and also regulateswhen, how and how the process of transferring assets, both material and immaterial. Nias is a followerof Patrilineal culture, where the position of the father (male) has the main position in the lineage.Generally, in the customs of the Patrilineal community, the person who can inherit the inheritance isthe person who continues the lineage. The implementation of inheritance distribution to the indigenouspeople of Nias in Harefanaese Village experienced a shift from the customary rules that should be,where currently there are several families who have given inheritance to their daughters even though itis in the form of small items but there are also those who have given inheritance in the form of land.Even though there are customary provisions that regulate inheritance issues, there are stillproblems/conflicts that occur due to the implementation of inheritance distribution. The objectives ofthis study are as follows: First, to determine the implementation of inheritance distribution toindigenous peoples in Harefanaese Village, North Nias Regency, Second, to determine the settlement ofinheritance distribution disputes among indigenous peoples in Harefanaese Village, North NiasRegency. This research is a sociological law research. That is, this research directly observes thespaciousness, the research location is Harefanaese Village, North Nias Regency. The samplingtechnique is a purposive sampling technique. The research data collection uses primary data andsecondary data. The data collection technique in this study is interviews and literature review and isconcluded by qualitative. Can be drawn; first, that the implementation of the distribution that took placein Harefanaese Village, experienced many shifts from the customary rules that should have been, wherecurrently there are several families who have given inheritance to their daughters, secondly, thesettlement of inheritance distribution disputes to indigenous peoples in Harefanaese Village, North NiasRegency, namely by holding consultations.Keywords: Inheritance-Customary-Dispute Resolution

Abstract

Article 1313 of the Civil Code provides the formulation of "a contract oragreement, an agreement is an act by which one or more people bind themselvesto one or more other people." The occurrence of a default between the creditorand the debtor in the heavy equipment rental cooperation agreement which iscarried out verbally in which in the agreement the creditor must provide a heavyequipment to the debtor to be rented out to a third party, providing profit sharingfrom the existing heavy equipment rental. The purpose of this study is first, todetermine the cause of the occurrence of default in the verbal agreement ofcreditors and debtors in heavy equipment rental cooperation. Second, to find outthe efforts to resolve the default of the verbal agreement on the rental agreementbetween the creditor and the debtor.This type of research is a sociological research, because the authordirectly conducts research on the location of the place being studied in order toprovide a complete and clear picture of the problem under study.The results of the research and discussion show that first, the occurrenceof default between creditors and debtors in the heavy equipment rentalcooperation agreement which is a default or breach of promise and a statement ofnegligence in accordance with Article 1238 of the Civil Code. Second, how tosolve the problem by using a subpoena, negotiation and also a lawsuit filed at theDistrict Court. Third, the result of the lawsuit filed is stipulating that the debtorhas defaulted so that he is punished to compensate for the losses suffered by thecreditor. In the heavy equipment rental cooperation agreement between creditorsand debtors, there should be a written agreement not just a statement and moreemphasis on articles related to how to calculate the distribution of profits fromheavy equipment rental and further clarify what are the rights and obligations ofeach of the creditors and debtor. So that the creditors or those who provide heavyequipment for rental are more assertive in carrying out the contents of theagreement and taking action against debtors who violate the agreement inaccordance with the law and apply a comprehensive compensation system. Abstract

The problem of land disputes that often occur is due to the absence ofclear land boundaries and the non-fulfillment of the rights of indigenous peoples.The purpose of this thesis writer: First, to find out the causes of the communalland boundary dispute between Nagari Canduang Koto Laweh, CanduangDistrict, and Nagari Koto Tinggi, Baso District, Agam Regency. Second, to findout the settlement of communal land boundary disputes between NagariCanduang Koto Laweh, Canduang District, and Nagari Koto Tinggi, BasoDistrict, Agam Regency.This research is classified as a sociological research type, because theauthor directly conducts research on the locations or points examined to providea complete and clear picture of the problems examined. This research wasconducted in Nagari Canduang Koto Laweh, Canduang District and Nagari KotoTinggi, Baso District, Agam Regency, while the sample population was all partiesrelated to the problems studied in this study, data sources used, primary data andsecondary data, data collection techniques in this study by interviewing literaturereview and data analysis.From the research, there are two things that can be concluded. First, thefactors causing the dispute over customary land boundaries between NagariCanduang Koto Laweh and Nagari Koto Tinggi are unclear land boundariesbetween nagari. Disputes over customary land boundaries also occur due to non-fulfillment of the rights of indigenous peoples. Second, efforts to resolve landboundary disputes between Nagari Canduang Koto Laweh and Nagari KotoTinggi are customary, namely through deliberations, discussing about 7 times thepoint of boundary of Nagari land, but there is no result. Settlement of landboundary disputes is handed over to a third party, namely the Agam RegionalGovernment The author's suggestion, to both parties, namely Nagari Koto Tinggiand Nagari Canduang Koto Laweh, should better understand the benchmarkboundaries that have existed from the time of their ancestors to safeguard therights of indigenous peoples within them and to the Pemda Agam as a third partythat mediates disputes over the nagari boundaries in order to provide legalcertainty and protect the rights of indigenous peoples.Keywords: Land Boundary Dispute – ADR

Abstract

Pembentukan Holding BUMN, termasuk Holding Perkebunan Nusantara merupakan upaya dalam rangka meningkatkan nilai tambah BUMN. Terbentuknya Holding Perkebunan Nusantara mengakibatkan terjadinya perubahan status badan hukum BUMN, khususnya dalam hal ini terhadap PT Perkebunan Nusantara V. Ketentuan terkait pembentukan Holding Company pada BUMN belum diatur secara jelas dan spesifik dalam bentuk Undang-Undang.Pasca terbentuknya Holding Perkebunan Nusantara, mengakibatkan hilangnya status BUMN Persero di PTPN V dan kedudukannya menjadi anak perusahaan BUMN, yang ditandai dengan terjadinya restrukturisasi organisasi perusahaan, perubahan komposisi dan jenis saham, yaitu menjadi 90% saham dimiliki oleh PTPN III (Persero) dan 10% saham dimiliki oleh negara, dengan  klasifikasi kepemilikan saham istimewa atau dwiwarna. Adanya pengendalian induk terhadap anak perusahaan dalam konstruksi perusahaan grup mengakibatkan dualitas pada anak perusahaan, yaitu selaku badan hukum mandiri dan badan usaha yang tunduk di bawah pengendalian induk perusahaan.Namun, masih terdapat multitafsir atau perbedaan pendapat terkait dengan kedudukan dari keuangan BUMN, apakah keuangan BUMN termasuk dalam lingkup keuangan negara, atau sebaliknya keuangan BUMN bukan merupakan keuangan negara. Disharmonisasi hukum ini antara lain ditandai dengan adanya perbedaan dalam ketentuan perundang-undangan, pandangan atau pendapat para ahli, dan putusan pengadilan. Berdasarkan prinsip Separate Legal Entity dan transformasi kekayaan negara, pada hakikatnya telah terjadi perubahan status hukum kekayaan negara menjadi kekayaan BUMN ataupun anak perusahaan Holding BUMN yang terpisah dari pemegang sahamnya, namun masih tetap mempunyai hubungan dengan negara dikarenakan status negara selaku pemegang saham dengan hak istimewa. Jenis penelitian yang digunakan dalam tulisan ini adalah penelitian hukum yuridis normatif, yaitu deskriptif analitis. Menggunakan data sekunder meliputi bahan hukum primer, sekunder, tersier yang dikumpulkan dengan penelitian kepustakaan, dan selanjutnya dianalisis dengan metode kualitatif. Penelitian ini dilakukan di PT Perkebunan Nusantara V yang berlokasi di Kota Pekanbaru, Provinsi Riau.

Abstract

Implementation of legal protection for wages of workers/laborers in employmentrelations is urgently needed, bearing in mind that the socio-economic position ofworkers/laborers is very weak, especially during the Covid 19 pandemic. Manycompanies have ignored workers' rights, including the fulfillment of wages whileundergoing self-isolation which means workers are in the process of healing whose rightsare protected under the provisions of Article 40 of Government Regulation Number 36 of2021 concerning Wages which mandates that every worker/laborer who does not workdue to illness, his wages are still paid in full.This research is classified as a sociological research type, because it directlyconducts research on the locations or points examined to provide a complete and clearpicture of the problems examined. This research was conducted in Pekanbaru City withsources from the Riau Province Manpower and Transmigration Office, while the samplepopulation was Covid-19 survivors who experienced wage deductions while undergoingindependent isolation. Sources of data used, primary data and secondary data, datacollection techniques in this study by interviews, literature review, and data analysis.The results of this study are as follows: First, that the implementation of legalprotection against wage deductions experienced by workers who are survivors of Covid19byemployersinseveralcasesinPekanbaruhasnotbeenfulfilledinaccordancewiththeprovisions of Article 40 of Government Regulation Number 36 of 2021 concerningWages. In practice, 8 out of 21 employers have deducted survivor workers' wages fromthe basic wages, because workers undergo independent isolation for 15 days. Second,efforts to resolve disputes between workers and employers can be carried out throughbipartite negotiations. If viewed from the concept of dispute resolution theory,negotiations must proceed equally, must not proceed as normal internal negotiations bynot considering the condition of workers who experience illness. It is necessary to beaware that employers/employers and workers in implementing work agreements must bein accordance with legal protection based on Article 40 of the Government Regulation onWages which mandates that every worker/laborer who is not working due to illness, hiswages must still be paid in full and understand the concept of dispute resolution and thebipartite negotiation mechanism in accordance with the provisions of Article 6 of LawNumber 2 of 2004 concerning the Settlement of Industrial Relations Disputes also inorder to produce mutually beneficial agreements for both parties, in particular workersmust join a trade union.

Abstract

This research focuses on strategies to increase the marketing efforts of fish from the cultivation of floating net cages through the use of social media "Facebook" as a medium to promote fish production in floating net cages in Kampung Panjang Village, North Kampar District. The purpose of this study is to increase the potential of Kampung Panjang Village through marketing fish farming products on the Floating Net Cage (KJA) by providing knowledge and practice to Village-Owned Enterprises (BUMDes) so that they are able to reach as many customers as possible effectively and efficiently. The method used is a discussion and practice method consisting of two stages, namely the preparation stage and the implementation stage of activities. The results of the research are expected that business actors will be able to be skilled in marketing fish from the cultivation of floating net cages in Kampung Panjang Village through the use of "Facebook" and get convenience in the marketing process and can continue to develop their business in the midst of intense competition in the current digitalization era.

Abstract

Non-perfomance of contract is a condition where one or both parties bound in an agreementnot carrying out obligations or achievements according to what is written in the agreementthat has been agreed upon. In this case, the seller or the housing developer named PT.Cahaya Meranti Internasional (CMI), committed a Non-perfomance of contract against thebuyer (member of the Meranti Islands community). In this case, the seller does not return thefunds deposited to them, while based on the agreement the funds deposited by the buyershould be returned up to 100% excluding administrative fees if the mortgage applicationsubmitted is rejected by the bank. This study aims to determine the Implementation of theHousing Purchase Agreement between the Seller and the Buyer and to find out the legalremedies for the Housing Buyer in Requesting a Refund Against the Seller who Admitted Non-perfomance of contract.The type of research used by the writer is sociological research where the writerdirectly conducts research at the location or place under study to provide a complete andclear picture of case. The population and sample in this study are Marketing Supervisors atPT. CMI and Housing Buyers in the Meranti Islands.The results of the analysis in this study show that the implementation of the housingbuy and purchase agreement between the seller and the buyer is not carried out properly inaccordance with the agreement. The failure in following the agreement was caused by Non-perfomance of contract comitted by the seller, in which case the seller should return the fundsthat have been deposited in full if the buyer submits a cancellation, if the reason for thecancellation is due to a refusal of credit from the Bank. Until now, the seller has not fulfilledits obligation in returning the initial deposit from the buyer, which has resulted significantlosses experienced by the buyer. As a solution, the buyer have used legal efforts in form ofthe dispute resolution method outside the court for requesting a refund from the seller, PT.CMI, who admitted the Non-perfomance of contract. Moreover, the buyer has made efforts tonegotiate with the assistance and mediation from the Meranti Resort Police.
