Abstract

Indonesia is a lawful welfare state, which means that the government has a duty and responsibility in realizing the social justice and the general welfare of the people. Paragraph (1) of the 1945 Constitution, stated that The State must ensure the implementation of equality in the standing before the law. Nowadays it seems only the lower class that must obey the law, while the upper class seems to be immune to the law. They are hiding from the law behind the layers of their own money. As if the law can be sold using money, even for those who commit major crimes, corruption for example. While the lower classes who commit minor crimes can be imprisoned. Our country is a country of law, then the law should be enforced, for all people and not just for Reviews those who have the money. To realize the implementation of the idea of a lawful welfare state then the State should guarantee the right of every person to reach justice. In other words, the State must guarantee the implementation of legal aid to the impoverished or Reviews those who cannot afford so that none has no access to justice that is mandated by the constitution. Legal aid advocacy for the impoverished in the concept of a lawful welfare state is certainly to be important in realizing the ideals of the lawful welfare state that achieve social justice and general welfare of the people. Therefore, it is important to know the concept of advocacy suitable for the impoverished in a welfare state.

Abstract

Anak yang melakukan tindak pidana memiliki hak menyelesaikan perkara di luar pengadilan melalui mekanisme diversi dalam kerangka keadilan restoratif. Salah satu isu yang muncul adalah tuntutan ganti rugi oleh korban. Penelitian ini bertujuan menganalisis proses penyelesaian perkara pidana anak di Kejaksaan Negeri dalam wilayah Kejaksaan Tinggi Riau, khususnya terkait kemampuan anak memenuhi ganti rugi serta peran orang tua atau wali, serta manfaat penerapan keadilan restoratif berdasarkan Undang-Undang Nomor 11 Tahun 2012. Metode yang digunakan adalah pendekatan hukum sosiologis dengan data primer, sekunder, dan tersier melalui wawancara dan studi pustaka, yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa anak tidak memiliki kemampuan ekonomi untuk memenuhi ganti rugi secara mandiri, sehingga kewajiban tersebut umumnya ditanggung oleh orang tua atau wali. Penerapan keadilan restoratif memberikan manfaat bagi pelaku berupa kesadaran, tanggung jawab, dan pemahaman dampak perbuatan, serta bagi korban berupa kesempatan menyampaikan perasaan, memperoleh kompensasi, dan pemulihan rasa aman. Ke depan, diperlukan penguatan regulasi teknis terkait ganti rugi, peningkatan kapasitas jaksa sebagai fasilitator diversi, serta skema kompensasi dari negara untuk menjamin perlindungan yang seimbang bagi pelaku anak dan korban.

Abstract

This research investigates the revitalization of customary law in buffalo farming practices (Jalangan) in Menaming Village, Rokan Hulu, with the aim of fostering sustainable governance and agriculture. The buffalo farming system in Menaming Village is deeply rooted in traditional practices that combine grazing and caging methods, reflecting the community’s cultural values and environmental stewardship. These practices are designed to minimize the exploitation of natural resources, positioning Rokan Hulu as a region with significant potential to support local livelihoods while contributing to national economic development. The study highlights the vital role of customary law, recognized in Indonesia's Constitution, in maintaining these traditional practices and promoting sustainable livestock management. Key strategies such as converting manure into organic fertilizer, utilizing organic materials for fuel, adopting pesticide-free animal feed, and implementing rotational grazing systems are central to the community's approach. These practices reduce environmental degradation, maintain ecological balance, and enhance livestock health and productivity, all while creating economic benefits, improving farmers’ incomes, and fostering social cohesion. The novelty of this research lies in its demonstration of how customary law can be revitalized and integrated into contemporary governance frameworks to address modern challenges in sustainable agriculture and environmental conservation. This study contributes to the discourse on law reform by proposing that customary law be formally recognized and adapted within Indonesia's legal system as a dynamic tool for promoting sustainable development, empowering local communities, and preserving cultural heritage. The research underscores the urgency of adapting these traditional frameworks to ensure long-term ecological sustainability and community resilience.
