Abstract

This research aimed to make description on alternative way to press terrorism in Indonesia. Some approaches are adopted, especially by the government, to eliminate the terrorists, namely: a firm approach by attacking the terrorists, legal remedy by bringing them before the court and giving punishment. However, such efforts still not able to maximally pressing the terrorism. Terror in Jalan Thamrin Jakarta in the early 2016 showed that terrorism still cannot be pressed. This research aimed to give additional approaches in combating terrorism by using local wisdom. Bali as one of tourist destination in Indonesia, had twice experiences of terrorist attack with many casualties. Bali has a lot of local wisdoms which meanings can be explored. Some of it are menyama braya, mesegeh ritual, okokan arts performance and Tat Twam Asi. Therefore, there are several methods and steps which can be used to press the terrorism by exploring the meanings contained in such local wisdoms. All of that local wisdoms contains the meanings of cooperation, alertness and togetherness. The terrorists are expected to stop their terrorism attack by implementing such local wisdoms.

Abstract

The regulation on community rights to land ownership is worth investigating considering that the development of law and policy issues of national land is apparently in line with the strategic value of land in the development. Thus, the reconstruction on state law and customary law in the regulation of community rights over the land is important so that the community rights are not neglected by the dominance of the right to control the land by the state. The management of village land in Bali (the land owned by the village called as druwe) is a concrete example that can be mentioned as the subject of land rights. Without having a clear law reference, it is then possible for the customary community to face difficulties in the control of their rights to the land owned by the customary village (desa pakraman). The community also does not have the legal protection that is strong enough to be used to defend their rights. This study is a normative juridical research that makes all of the problems are referred to judicial review as a system of norms that are used to give the prescriptive justification concerning the legal event. Results of the research showed that the land policy concerning the customary law community is governed by Article 3 of Act No. 5 of 1960 on the Basic Rules of Agrarian involving the recognition of indigenous peoples' rights although it is still limited. There is, even, a denial of the right to the land by other regional regulations related to land and natural resources. The rights of indigenous peoples, including druwe village land in Bali is set in accordance with to the concept of state law and customary law complementary without dominating one another. State law can be resolved all problems through the legal structure. Based on the theoretical aspects, settlement of land issues in the conception of state law and customary law can be thoroughly observed by putting the appropriate concepts and principles of the national land law that is still based customary law. Abstract

The goals of this research is to analyze the function of the Land Bank as a land management institute in Indonesia and the legal consequences of land acquisition by the Land Bank through purchases. The Land Bank as an institution authorized to manage land has one function to acquire land, one of which is through the purchase process. However, the purchase was not explained further, causing uncertainty regarding the land rights that can be purchased because according to law, the state cannot have Ownership Rights on Land. This research is a normative legal research using a conceptual approach and a statute approach. This research indicate that the functions of the land bank are regulated in Article 3 of PP 64/2021, namely planning, land acquisition, procurement, management, utilization, and distribution of land. This function is carried out by the Land Bank on the basis of the Management Right which is delegated as the implementation of the state's right to control the Land. The land acquisition function carried out by the Land Bank, based on PP 64/2021 can be carried out through the Purchase method. The legal consequences of land acquisition through the purchase are limited by the Management Rights it owns, that above the Management Rights can only be attached with the with Use Rights, Building Use Rights, and Cultivation Rights, so the Ownership Rights cannot be attached or owned by the Land Bank. Tujuan dari penelitian ini adalah untuk menganalisis fungsi Bank Tanah sebagai lembaga pengelolaan tanah di Indonesia serta akibat hukum dari perolehan tanah yang dilakukan Bank Tanah melalui pembelian. Bank Tanah sebagai lembaga yang diberi kewenangan untuk mengelola tanah memiliki salah satu fungsi untuk memperoleh tanah yang salah satunya adalah dengan proses pembelian. Namun, pembelian tersebut tidak dijelaskan lebih lanjut sehingga menimbulkan ketidakjelasan terkait hak atas tanah yang dapat dilakukan pembelian karena menurut hukum, negara tidak dapat memiliki Hak Milik atas Tanah. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan konsep dan pendekatan perundang-undangan. Penelitian ini menunjukkan bahwa fungsi Bank tanah diatur dalam Pasal 3 PP 64/2021 yaitu perencanaan, perolehan tanah, pengadaan, pengelolaan, pemanfaatan, pendistribusian tanah. Fungsi tersebut dijalankan oleh Bank Tanah atas dasar Hak Pengelolaan yang dilimpahkan sebagai implementasi hak menguasai negara atas Tanah. Fungsi perolehan tanah yang dijalankan Bank Tanah, berdasarkan PP 64/2021 dapat dilakukan melalui cara Pembelian. Akibat hukum perolehan tanah melalui pembelian tersebut adalah terbatasi oleh Hak Pengelolaan yang dimilikinya bahwa diatas Hak Pengelolaan tersebut hanya dapat dilekatkan Hak Pakai, Hak Guna Bangunan, dan Hak Guna Usaha, sehingga Hak Milik tidak dapat dilekatkan atau dimiliki Bank Tanah.

Abstract

Secara sosiologis kita menghadapi kenyataan bahwa telah muncul masyarakat global yang sangat berpengaruh dan telah menyusup keseluruh pelosok Bali. Bali sebagai daerah tujuan wisata tidak bisa terlepas dari fenomena bahwa Bali sudah menjadi bagian dari masyarakat dunia. Oleh karena itu Bali harus dapat meyediakan fasilitas kepariwisataan untuk memenuhi kebutuhan wisatawan. Situasi tersebut mengakibatkan Bali berkomunikasi dengan budaya luar, bahkan proses itu terjadi dengan begitu cepat tanpa melalui suatu perencanaan. Desa Pakraman sebagai salah satu komponen dalam struktur kemasyarakatan Bali juga mengalami berbagai perubahan, disamping karena dinamika internalnya, juga karena pengaruh lingkungan luar. Problematik aturan hukum (awig-awig/perarem) yang dihadapi Desa Pakraman sekarang ini dan diwaktu yang akan datang akan semakin kompleks. Persoalan-persoalan hukum di era sekarang ini serta perubahan sosial yang begitu cepat perlu direspon dan diantisipasi.Situasi Global dengan muatan pariwisatanya, secara langsung maupun tidak langsung menuntut perlunya pengkajian atau revisi terhadap awig-awig/perarem supaya tidak ditinggalkan oleh masyarakat yang bergerak begtu cepat. Dengan demikian awig-awig/perarem akan dapat menjalankan fungsinya baik sebagai kontrol sosial, maupun sebagai rekayasa sosial. Adanya awig-awig/perarem yang sudah sesuai dengan perkembangan masyarakat dan jaman, akan dapat meminimalisir terjadinya konflik dalam masyarakat. Desa Pakraman adalah kesatuan masyarakat hukum adat di Provinsi Bali, yang mempunyai hak otonomi. Salah satu isi dari otonomi desa pakraman adalah hak untuk membuat aturan (awig-awig/pererm), yang berlaku bagi masyarakat itu sendiri, baik dalam bentuk yang tertulis maupun tidak tertulis, yang lahir, hidup, tumbuh, dan berkembang, sesuai dengan rasa keadilan dan kepatutan dalam masyarakat (mempunyai sifat luwes dan dinamis). Dengan adanya sifat yang luwes dan dinamis tersebut dapat dimengerti bahwa awig-awig/perarem dimasa lalu tidak selalu sesuai dengan kebutuhan masyarakat masa kini, dan di masa yang akan datang, karena rasa keadilan dan ukuran kepatutan juga mengalami perubahan.

Abstract

The purpose of the service is to be able to compile awig-awig, the regulations used in the Subak organization that are the foundation of sustainable environmental development. It is important to be carried out in the context of spatial planning around Subak, therefore it is maintained and there is no easy change of land function that affects the existence of Subak. This service activity was carried out using lecture, discussion and question and answer methods when taking an inventory of the problems faced by Subak Pulagan Gianyar and then making awig-awig arrangements related to spatial planning around Subak. The target focus in the management of Subak is the apparatus of Subak officers and the members of Subak Pulagan Gianyar so that it is expected to have guidelines for the functional customary law community in Bali in determining the rules within the Subak organization. The realization of the service was carried out through reviewing the act of compiling the substance of awig-awig Subak, mainly in the palemahan (environment) section and was warmly welcomed by Subak Pulagan officers. This was responded well because it was realized by the local members of subak that preserving this world’s cultural heritage is the foundation for maintaining their natural environment in a sustainable manner.

Abstract

This study aimed to find out the analysis of customary village (Desa Adat) law enforcement in Joint Decree (SKB) Sampradaya Non-Dresta. The method used was a normative legal research method using a statutory and history approach. The customary village is the closest government system to its territory. It has the autonomy to regulate and manage its household. The existence of Sampradaya, especially Hare Krishna Bali is the duty of the customary village to keep realizing the customary village kasukerta (harmony). If there is a violation of the Sampradaya ritual in the customary village territory, it will be the responsibility of each customary village. In addition, the results of violantion can be reported to the Customary Village Council (MDA), a party that can cooperate with the customary village. The issuance of SKB by PHDI and MDA cannot be intended as something that bond the customary village because it has an authoritative authority as the constitution of customary village autonomy.

Abstract

This article aims to determine the principles and regulations of international trade and to analyze the regulation for imposing security measures on imports of fabric products. The method used in this study is a normative juridical legal research type, with a statutory approach or statute approach to analyze legal issues. This research finds that the principle of International Trade adopted by the Indonesian state/Government is essentially aimed at protecting domestic products to maintain a healthy trade climate. International Trade is regulated by General Agreement on Tariffs and Trade, General Agreement on Trade in Services, The Agreement on Trade-Related Aspects of Intellectual Property Rights and Dispute Resolution of the World Trade Organization. Furthermore, in regards to the imposition of security measures on the import of fabric products in Indonesia, it is regulated in the Minister of Finance Regulations and its amendments. However, the Ministerial Regulation felt to be contradictory to the Minister of Trade’s Regulation. So, it is considered less effective because it will only burden local entrepreneurs/companies who need material products from abroad, on one hand the volume of imports has been limited and on the other hand there is an additional imposition of import duty as a result of security measures.

Abstract

Kajian hukum tentang penggunaan obat tradisional tanpa izin edar, terutama dalam konteks obat herbal, adalah isu yang relevan dan kompleks. Isu ini dapat dipandang dari perspektif hukum pidana untuk membangun keberlanjutan dan keamanan dalam peredaran obat herbal. Tujuan penelitian ini adalah mendalam tentang bagaimana peraturan dan hukum dapat berkontribusi secara positif terhadap pengembangan industri obat tradisional yang berkelanjutan, serta memberikan perlindungan yang memadai bagi masyarakat yang menggunakan produk-produk tersebut. Metode yang digunakan adalah jenis penelitian normative. Penelitian hukum normative adalah penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka, data sekunder atau penelitian hukum kepustakaan. Hasil penelitian Peraturan dan hukum yang ketat dalam industri obat tradisional memiliki peran penting dalam memastikan keamanan, kualitas, dan transparansi produk yang beredar. Proses izin edar yang ketat dan pengawasan yang tepat dapat membantu mengurangi risiko produk berkualitas rendah atau berbahaya. Peraturan dapat mewajibkan produsen dan penjual untuk memberikan informasi yang jelas dan akurat kepada konsumen melalui label produk. Hal ini membantu konsumen membuat keputusan yang bijaksana berdasarkan informasi yang mereka terima.

Abstract

ABSTRAK Tujuan studi ini adalah mengkaji optimalisasi digitalisasi lontar dalam upaya perlindungan hukum obyek pemajuan kebudayaan di Kabupaten Badung yang dilakukan oleh Dinas Kebudayaan. Studi ini mempergunakan metode penelitian hukum empiris dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan kasus. Hasil studi memperlihatkan bahwasanya Digitalisasi Lontar merupakan bentuk perlindungan hukum obyek pemajuan kebudayaan yang sesuai dengan Undang-Undang Nomor 5 Tahun 2017 Tentang Pemajuan Kebudayaan, serta sesuai dengan Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2020 Tentang Penguatan dan Pemajuan Kebudayaan Bali. Dinas Kebudayaan Kabupaten Badung mengadakan program pelatihan nyurat lontar di beberapa sekolah dasar wilayah Kabupaten Badung serta program digitalisasi lontar sejak tahun 2012 untuk melaksanakan amanat dari undang-undang serta peraturan daerah terkait. Kata Kunci: lontar, digitalisasi lontar, obyek pemajuan kebudayaan, dinas kebudayaan kabupaten badung ABSTRACT The purpose of this study is to examine the optimization of lontar digitization as an effort to legally protect the cultural advancement object in Badung Regency conducted by the Department of Culture. This study uses empirical legal research methods with an approach to legislation and case study. The results of the study show that the Digitalization of Lontar is a form of legal protection for the object of cultural advancement in accordance with Law Number 5 of 2017 on the Advancement of Culture, as well as in accordance with Bali Provincial Regulation Number 4 of 2020 on Strengthening and Advancement of Balinese Culture. The Department of Culture of Badung Regency has conducted lontar writing training programs in several elementary schools in the region of Badung Regency and lontar digitization programs since 2012 to implement the mandates of relevant laws and regulations. Abstract

The full use of technology in running a digital bank makes things easier for customers but is vulnerable to cybercrime in the banking sector which can harm customers. This research places the main focus on forms of legal protection efforts for customers who deposit at digital banks against the occurrence of cybercrime in the banking sector. Legal problems, namely regarding the legal relationship between deposit customers and digital banks in banking sector cyber crime issues as well as legal protection efforts for deposit customers in digital banks in banking sector cyber crime issues. The type of research applied is normative legal research using statutory, conceptual and analytical approaches to examine the problems discussed. The research results show that the legal relationship between digital banks and customers who deposit funds is a relationship of trust (fiduciary relationship) contained in the funds deposit agreement. Legal protection for deposit customers in cases of cyber crime includes: 1) Preventive legal protection in the form of preventing losses for deposit customers in accordance with the provisions of the Banking Law, POJK Number 12/POJK.03/2018, as well as related legal instruments; and 2) Repressive legal protection in the form of dispute resolution efforts which can be implemented in 2 (two) ways, namely Non-Litigation and Litigation dispute resolution. Efforts to resolve non-litigation disputes, namely: 1) Making a complaint to PUJK; 2) Make a complaint to the OJK. Meanwhile, the litigation effort is to file a civil lawsuit.
