Abstract

Intellectual Property Rights protection system is territorial. Registration and law enforcement must be done separately in each relevant jurisdiction. In the brand regime, this system is often a challenge for brand law enforcement. In practice, a brand with a well-known trademark often used without permission even registered by an unauthorized party only because the trademark is not registered in that country. Even this condition occurs in the ASEAN region. Take Vietnam, for example, in Vietnam it would be very easy to find the use of famous brands without permission by certain parties very freely because the trademark was not registered in Vietnam. The Madrid Protocol, which is a refinement of the Madrid Agreement, since its inception in 1989 is an alternative in building an international registration system. This system offers convenience for brand owners to get protection for their brands worldwide (Protocol member countries) with only one application and one procedure through WIPO International Berau to proceed to destination countries

Abstract

The Notary Supervisory Council (MPN) is here to improve services and legal protection for the public who use notary services. However, nowadays, there are more and more irregularities committed by notaries in carrying out their duties and positions, both administrative in nature and resulting in material losses to the public who use notary services. The imposition of sanctions is an effort by MPN, especially the Regional Supervisory Council (MPW) in order to provide sorrow for notaries who violate and appeal to other notaries. There were 40 violations in the implementation of notary duties and positions in the 2016-2020 period, during this period the increase and decrease in the level of violations of notary duties and positions in the Banten area was inconsistent. The implementation of sanctions imposed by MPW has not been optimal, as evidenced by the results of the study, namely an increase and decrease in the level of violations of notary duties and inconsistent positions in the region. In addition, there are several obstacles encountered by MPW as a body that supervises notaries, namely the lack of cooperation between notaries and MPW in enforcing the UUJN and the Notary Code of Ethics, the indifferent attitude shown by the notary during the examination session and the busyness of each MPW member in their respective offices. each relevant agency. Some solutions that can be done are routinely conducting socialization in terms of increasing notary professionalism, strengthening relations between notaries and MPW as well as conducting internal, external, repressive and preventive supervision.

Abstract

Traditional knowledge is an embodiment of a tradition in each country, traditional knowledge in Indonesia must be in accordance with and in line with the values contained in the ideology of Pancasila as the basis for living as a nation state in Indonesian society, the problem in this paper is how the values of Pancasila are contained in the study of knowledge traditional. Pancasila as the basis of the state implies that Pancasila is used as the basis for administering the state. Pancasila as the basis of the state means that the entire implementation and administration of government must reflect the values of Pancasila and must not conflict. The values in a traditional knowledge are actually in harmony with the values contained in Pancasila.

Abstract

Pembangunan Teknologi Informasi dan Komunikasi (TIK) diharapkan memberikan perubahan mendasar dalam kehidupan masyarakat, meningkatkan pemberdayaan individu, dan memperkuat interaksi sosial serta partisipasi masyarakat sipil. Pemerintah berupaya menjadikan TIK sebagai sarana untuk meningkatkan kualitas hidup warganya, termasuk di pedesaan. Namun, di pedesaan Indonesia, penyebaran internet tidak sejalan dengan literasi digital yang dibutuhkan. Ini mengakibatkan masyarakat desa rentan terhadap praktik pinjaman online ilegal yang berpotensi merugikan. Terpencilnya daerah seperti Pekon Sukabumi, Batu Brak, Lampung Barat, menambah kerentanannya. Dalam konteks ini, pengabdian masyarakat melalui sosialisasi bertujuan meningkatkan pemahaman warga tentang legalitas dan risiko pinjaman online. Masyarakat akan diberi kesadaran untuk lebih bijak dalam memilih opsi pinjaman, dengan preferensi kepada lembaga pembiayaan konvensional yang lebih terpercaya. Selain itu, pengabdian akan membantu warga memahami tahapan pengaduan jika terkena dampak negatif dari pinjaman online ilegal.

Abstract

The pandemic of Covid-19 and the urgent global needs to immediately obtain an effective drugs or Covid-19 vaccines have impacted the competition of pharmaceutical inventions and the patent registration of drugs or Covid-19 vaccines. However, this circumstance raise pro and cons. There is concern that there will be a conflict between the economic interests of the patent holder and public interest. Patent rights granted to the inventors or pharmaceutical companies has caused difficulties of the State to provide medicines or vaccines to the public since the production and distribution of it has been fully under their control. In this regard, the government use and compulsory license mechanisms are believed to be the most likely policies by the Government for balancing the use of exclusive rights and the economic interests of patent holders. It allow the Government to access and exploit patented inventions without prior consent from the patent holder, but at the same time the patent holder still get the protection and their rights.

Abstract

Courts that accommodate dispute resolution are still not optimal in implementing fair decisions for the parties. Not only has it not created justice, but it has not been able to resolve the dispute quickly. In the end, there was a backlog of cases, so the simple, fast, low-cost justice principle was difficult to realize. Alternative Dispute Resolution is one of the efforts that can be implemented to assist the court in reducing the number of cases piling up, one of which is in the form of negotiations as regulated in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. In principle, negotiations are concerned with implementing the Principle of Deliberation and Consensus as implied in the Preamble to the 1945 Constitution as stipulated in the Alternative Dispute Resolution Act. The problematic legal issues in its implementation are compiled in this article, analyzing the weaknesses of Negotiation as an Alternative for Resolving Business Law Disputes in Indonesia as well as the context for the Implementation of Pancasila Values. The type of research used is normative juridical with descriptive research type. The results that will be discussed explain the technical weaknesses of Alternative Dispute Resolution through Negotiations, which are generally linked to business law events in Indonesia in applying Pancasila values, especially the values of Humanity and Deliberation to Consensus. This writing concludes that Alternative Dispute Resolution must continue to be pursued in resolving disputes and in minimizing the weaknesses of the process, including opinions are submitted systematically, politely, and creatively, looking for common ground wisely, viewing the other party as family to create a family atmosphere, and accommodating Pancasila values as a guide to implementing written law.

Abstract

Kepemilikan rumah adalah hal yang menggembirakan bagi sebuah keluarga yang menginginkan tempat tinggal baru. Bermacam-macam cara kepemilikan rumah kredi perumahan rakyat diantaranya dengan mengabil alih dari kredit yang masih berjalan. Pembelian rumah dapat dilaksanakan secara lunas dan secara angsuran atau kredit. Pembelian juga dapat dilaksanakan melalui over kredit yaitu perpindahan kepemilikan rumah dipindah alihkan pada pihak lain dengan perjanjian dan meneruskan angsuran kredit ke bank yang masih tersisa. Pada penelitian ini akan membahas terkait kebutuhan hukum yang harus diperjelas terhadap tanggung jawab pada penjualan secara over kredit. Aturan terkait dengan rumah over kredit perumahan rakyat bersubdisi tidak diatur secara jelas. Penelitian dilaksanakan secara normatif empiris yaitu berdasarkan aturan hukum dan pustaka yang mendukung. Penelitian secara empiris akan dilaksakan wawancara kepada pihak depeloper/ pengembang perumahan subsidi. Masalah yang akan dibahas adalah bagaimana aturan hukum pada perjanjian over kredit, bagaimana akibat hukum pada perjanjian secara over kredit perumahan. Aturan hukum pada perjanjian over kredit tidak secara jelas diuraikan karena berdasarkan perjanjian tidak bernama dan disasarkan perikatan bersyarat. Komitmen yang dibangun melalui perjanjian yang dilaksanakan pihak-pihak. Alasan dilaksanakannya over kredit diantaranya adalah keinginan pemilik pertama yang ingin melepaskan kewajibannya dan memindahkan ke pihak lain. Akibat hukum pada perjanjian secara over kredit perumahan rakyat bersubsidi timbul hak kewajiban anatara para pihak.

Abstract

PurposeThe aim of this research is to analyze the urgency of establishing the LPPDP in strengthening personal data protection laws in Indonesia through a comparison of laws and practices in Hong Kong and Singapore and to determine the opportunities and challenges of establishing the LPPDP in Indonesia. MethodologyThe research uses normative legal research methods with a statutory approach, a conceptual approach and a comparative approach. ResultThe results show that the existence of an independent LPPDP will strengthen the personal data protection law effectively and comply the adequate level of protection with other developed countries. Thus, the President must immediately establish LPPDP regarding the minimum requirements for the DPA's establishment in international practice. ContributionLaw Number 27 of 2022 concerning Personal Data Protection (UU PDP) has directly mandated the establishment of a data protection authority which determined by the President. The LPPDP has projected to become an authority that acts as a supervisor and law enforcer for personal data protection in Indonesia, the LPPDP must be able to perform its functions, duties, and authorities independently. LimitationHowever, instead of achieving this noble goal, there are several recommendations that can be applied in establishing the formation of LPPDP, whether in the form single supervisory authority or ministry based-models.

Abstract

Artificial Intelligence (AI) technology has ushered the world into a new era in which machines exhibit certain aspects of human intelligence. One such capability of AI is its ability to generate written responses based on commands or inquiries posed by humans, facilitated by natural language processing (NLP). This output raises legal concerns regarding copyright ownership and the ethical considerations surrounding intellectual property. This research examines the ethical dimensions of intellectual property in relation to AI-generated writing and analyzes the status of copyright ownership for works produced by AI. The study employed a normative legal method, employing statutory, case-based, and conceptual approaches. The data sources included primary, secondary, and tertiary legal sources. The findings indicate that, in its current implementation, AI-generated written works conflict with the ethical values of intellectual property due to the infringement of moral rights associated with copyright (right of attribution and right of integrity). Copyright ownership of AI-generated works for outputs that do not meet this standard, ownership is classified as public property under the principle of the public domain (open to the public). Consequently, developers and users of AI platforms cannot be regarded as copyright owners, as the requisite originality is absent, and AI, as a machine, cannot be deemed a creator due to the absence of human agency. The legal framework governing AI and its copyright remains inadequately defined under national legislation, resulting in insufficient legal protection against AI utilization. So, regulations regarding artificial intelligence are needed to handle this.

Abstract

Perkembangan teknologi digital menuntut perlindungan hak cipta yang adaptif, namun Indonesia belum secara spesifik mengatur mekanisme notice-and-takedown dan larangan circumventing sebagaimana diatur dalam DMCA Section 512 dan 1201 di Amerika Serikat. Tujuan dari penelitian ini adalah untuk menganalisis secara komparatif prinsip-prinsip dalam DMCA dengan ketentuan dalam UU Hak Cipta Indonesia serta mengevaluasi kemungkinan adopsinya ke dalam sistem hukum nasional. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan perbandingan hukum. Hasil penelitian menunjukkan bahwa DMCA menawarkan model perlindungan hak cipta digital yang lebih progresif dan operasional, khususnya dalam hal penghapusan konten ilegal secara cepat serta perlindungan teknologi digital. Implikasinya, prinsip-prinsip dalam DMCA dapat menjadi acuan dalam pengembangan regulasi Indonesia untuk memperkuat sistem perlindungan hak cipta digital yang lebih adaptif, adil, dan efektif
