Abstract

This research aims to analyze the regulation and implementation of fulfilling the rights of children from mixed marriages to obtain Indonesian citizenship based on Law Number 12 of 2006. Normative-empirical research with legislative, conceptual and sociological approaches in qualitative descriptive analysis. Data used are primary, secondary and literature research materials and field research. The conclusions are; First, Law Number 12 of 2006 grants limited dual citizenship status to children born from mixed marriages after its enactment on August 1, 2006. However, to ensure legal certainty, children born from mixed marriages before the law was enacted are required to register themselves. Second, the terminology 'child with dual citizenship' in the Law implies that if another country, based on its regulations, recognizes a child from a mixed marriage as its citizen, then they fall under this category. Meanwhile, there isn't any country that explicitly, based on its provisions, does not recognize children from mixed marriages as its citizens. Third, the process of fulfilling the citizenship rights of children born from mixed marriages is burdened upon the individual concerned. Consequently, any negligence in administrative processes, requirements, and procedures can lead to the loss of Indonesian citizenship. Fourth, the implications of losing Indonesian citizenship for children from mixed marriages can have legal and sociological impacts.

Abstract

This research aims to analyze the laws and regulations on the electronic-based government system in Mataram City as an effort to improve fast, efficient and affordable public services and to describe the implementation of applications in public services in Mataram City and formulate relevant solutions. Normative-empirical research with legislative, conceptual and sociological approaches in qualitative descriptive analysis, the data used are primary, secondary and literature research materials and field research. Dto conclude; First, SPBE in the government system is needed in order to provide better service to the community, which in principle has been regulated in Presidential Regulation Number 95 of 2018 concerning Electronic-Based Government Systems. And second, the Mataram City Regional Government is committed to implementing electronic-based public services, namely with the issuance of Regional Regulation Number 3 of 2020 concerning the Implementation of Electronic-Based Government Systems and Mataram Mayor Regulation Number 20 of 2024 concerning Guidelines for the Implementation of SPBE. And through Diskominfo, it has managed 14 information technology services with each service application effectively

Abstract

This study aims to analyse the factors that influence the occurrence of corruption, collusion, and nepotism in private higher education foundations; Analyze the supervision and control mechanisms implemented by foundations to prevent corruption, collusion, and nepotism and determine the legal construction of the role and function of foundations in private higher education institutions that are free from corruption, collusion, and nepotism based on Good University Governance (GUG). This research is an empirical-normative legal study, complemented by empirical data. The research was conducted for 1 (one) month, starting from March 20 to April 20, 2025. The respondents were 5 (five) representatives of the foundation's management, the vice chairman of the academic institution, lecturers, and employees. The results of this study indicate that the practice of Corruption, Collusion, and Nepotism in private higher education foundations is caused by several primary factors such as lack of transparency and accountability, the dominance of certain families or groups, weak supervision, low leadership ethics, inconsistency of regulations with practices, internal political competition, and economic motives. To overcome this, foundations must implement strict monitoring and control mechanisms, including open recruitment, establishing internal monitoring units and external audits, transparency of financial reports, applying sound governance principles, and enforcing codes of ethics and whistleblowing systems. In the legal context, the role and function of foundations must be constructed based on the principles of Good University Governance (GUG), which makes foundations not only legal entities that organise education, but also motors of governance that are integrated, transparent, and accountable by applicable laws and regulations Keywords: Role and Function of Foundations, Corruption, Collusion, Nepotism (KKN), Good University Governance (GUG)

Abstract

The position and authority of a Notary is crucial in ensuring legal clarity for individuals while undertaking legal activities. The behavior and actions of a Notary are very susceptible to abuse of their professional position, which can have negative consequences for society. In order to mitigate community losses, the establishment of a regulatory entity to oversee notaries is important. The research use the normative law research method to identify a legal rule, legal principles, and legal doctrines that can address the current legal difficulties. According to the findings of the research on the Enhancement of Authority of the Notary Regional Supervisory Council in the Development and Oversight of Notaries, the Notary Supervisory Board is empowered to conduct administrative oversight, and sanctions serve as legal repercussions for the decisions made by the Supervisory Board against a Notary who breaches the regulations pertaining to the execution of their duties in the position of a Notary, as stipulated in Legislation regarding the role and responsibilities of a Notary.

Abstract

ABSTRACT Purpose of the Study: This paper aims to analyze the judicial consideration of judges in Decision No. 273/Pdt.g/2021/PA.Bkt from the perspective of benefit and justice for all parties in the murabahah and its legal consequences.  Methodology: This research used the literature review method. It used the descriptive qualitative analysis, which was conducted by profoundly reading the decision, analyzing the case, examining the appropriateness of the legal basis, and how to define them. Results: The legal considerations of judges in Decision No. 273/Pdt.g/2021/PA.Bkt are: (1) the resolution of disputes on sharia economy is the absolute authority of the Religious Court; (2) the judge assembly must maintain the legal interests and rights of the plaintiff from the actions of the defendant to undergo an auction, as well as avoiding the losses and harm that may befall the plaintiff; (3) there was an emphasis on good intentions, benefit, and justice for all parties but the judges punished the defendant to undergo rescheduling, restructuring, and reconditioning. Applications of this study: It can inspire judges to create legal reasoning that supports the aspect of legal certainty. It can inspire banks and customers to emphasize the aspects of good intention, benefit, and justice in implementing contracts. Novelty/ Originality of this study: It explained the legal consideration of judges that emphasized the aspect of mediation through contract renegotiation based on the positive law and relevant sharia principles. Keywords: Judicial consideration, murabahah contracts, banks, good intention, benefit, justice.  ABSTRAK  Tujuan: Tulisan ini bertujuan untuk menganalisis pertimbangan yuridis hakim dalam Putusan No. 273/Pdt.g/2021/PA.Bkt dari perspektif kemanfaatan dan keadilan bagi semua pihak dalam murabahah dan akibat hukumnya.  Metodologi: Penelitian ini menggunakan metode literature review. Analisis yang digunakan adalah deskriptif kualitatif, yang dilakukan dengan membaca putusan secara mendalam, menganalisis kasus, memeriksa kesesuaian dasar hukum, dan bagaimana mendefinisikannya.  Hasil: Pertimbangan hukum hakim dalam Putusan Nomor 273/Pdt.g/2021/PA.Bkt adalah: (1) penyelesaian sengketa ekonomi syariah merupakan kewenangan mutlak Peradilan Agama; (2) majelis hakim harus menjaga kepentingan hukum dan hak penggugat dari tindakan tergugat untuk menjalani lelang, serta menghindari kerugian dan kerugian yang mungkin menimpa penggugat; (3) ada penekanan pada itikad baik, kemanfaatan, dan keadilan bagi semua pihak tetapi hakim menghukum terdakwa dengan penjadwalan ulang, penataan ulang, dan rekondisi.   Aplikasi penelitian ini: Dapat menginspirasi hakim untuk menciptakan penalaran hukum yang mendukung aspek kepastian hukum. Hal tersebut dapat menggugah bank dan nasabah untuk mengedepankan aspek itikad baik, manfaat, dan keadilan dalam pelaksanaan kontrak.  Kebaruan/Orisinalitas: Dijelaskan pertimbangan hukum hakim yang menekankan aspek mediasi melalui renegosiasi kontrak berdasarkan hukum positif dan prinsip syariah yang relevan.  Kata kunci: akad murabahah, bank, itikad baik, kemanfaatan, keadilan

Abstract

ABSTRACT  Purpose of study: This study aims to analyze the conflict of norms in the Regulation of the Minister of Manpower Number 18/2022 and Government Regulation Number 36/2022 on the Minimum Wage Determination Method. As a result of the conflict, losses will be borne by business actors on the increasing minimum wage based on Government Regulation Number 36/2021 and the Regulation of Minister of Manpower Number 18/2022. This creates legal uncertainty for business actors and laborers. Methodology: This study was conducted using the normative (doctrinal) research method with the approach of legislation and legal reasoning. Data sources were taken from primary legal materials, secondary legal materials, and tertiary legal materials using descriptive analysis and analytical critical thinking. Results: The Regulation of the Minister of Manpower contradicts the Law on Manpower in conjunction with Law on Job Creation. The conflict rose because the Manpower Law in conjunction with the Job Creation Law, has limited some of the additional advances of the Wage Determination Law to only the Government Regulation level. Special subjects are: 1) the procedure of the minimum wage regulation; and 2) the formula of the minimum wage calculation. On the judicial review, the judges declared the objection to the judicial review of the petitioner unacceptable. The lawsuit was deemed premature because the Regulation in lieu of Job Creation Law has not reached inkracht (permanent legal force). Applications of this study: This will be useful and beneficial for the development of legal science, especially aspects of legal reasoning involving court decisions. The results are also practical for businesses and laborers when using the methods of determining the legal and fair minimum wage. Novelty/Originality of this study: Judge's Legal reasoning in decision number 72 P/HUM/2022 on Minimum wage was not one of the objection points of the petitioners or the answer to them. A judicial decision outside of a lawsuit, or so-called ex parte decision, is a decision taken by the court without involving the parties to the trial. Keywords: Characteristics of Judge's Decision, Judicial Review, Minimum Wage Method  ABSTRAK  Tujuan: Untuk menganalisis pertentangan norma pada Permenaker Nomor 18/2022 dengan PP Nomor 36/2021, materi pokoknya terkait metode penetapan upah minimum. Akibat pertentangan tersebut, maka kerugian bagi pelaku usaha terhadap perbandingan kenaikan upah minimum berdasarkan PP 36/2021 dengan Permenaker 18/2022. Hal tersebut berdampak kepada ketidakpastian hukum bagi pelaku usaha dan pekerja. Metodologi: Metode penelitian normative doctrinal, dengan pendekatan Perundang-undangan, dan pendekatan penalaran hukum. Sumber data berasal dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Menggunakan analisis deskriptif analitis dan critical thinking. Temuan: Ketentuan Permenaker bertentangan dengan UU Ketenagakerjaan juncto UU Cipta Kerja. Pertentangan tersebut, karena UU Ketenagakerjaan juncto UU Cipta Kerja telah membatasi beberapa pengaturan lanjutan dibawah UU terkait pengupahan hanya pada tingkat PP. Berlaku materi muatan yaitu: 1) tata cara penetapan upah minimum; dan 2) formula perhitungan upah minimum. Pada uji materiil, putusan Hakim, Menyatakan permohonan keberatan hak uji materiil dari Para Pemohon tersebut tidak dapat diterima. Gugatan dianggap masih premature, karena Perpu Cipta Kerja belum incrah. Kegunaan: Berguna dan bermanfaat bagi pengembangan ilmu hukum, khususnya aspek penalaran hukum dengan objek kajian putusan pengadilan. Berguna bagi pelaku usaha dan pekerja dalam pemilihan metode penetapan upah minimum, yang berkepastian hukum dan berkeadilan Kebaruan/Orisinalitas: Legal reasoning hakim pada putusan nomor 72 P/HUM/2022 tentang Upah Minimum, bukan merupakan salah satu poin keberatan para pemohon maupun poin jawaban dari termohon. Putusan Hakim, diluar gugatan atau disebut ex parte decision, yaitu keputusan yang diambil oleh pengadilan tanpa melibatkan para pihak dalam persidangan.   Kata Kunci: Karakteristik Putusan Hakim, Uji Materiil, Metode Upah Minimum

Abstract

The decision is a written legal text made by an authorized judge, and its legal product is categorized as a crown. However, despite being considered a crown, a judge's decision is not exempt from examination by legal scholars. The optics used in the examination process are based on various perspectives, including hermeneutics as the fundamental basis for interpreting the text (decision). Substantively, hermeneutics has three main streams of thought, namely as a theoretical (methodological), philosophical, and critical hermeneutics, each with different understandings. Hermeneutics as a method focuses more on the effort to capture and reveal the meaning of the text, while philosophical hermeneutics goes beyond that and emphasizes "capturing meaningful meaning," implying that the meaning of the text can be continuously produced through a dialectical process. On the other hand, critical hermeneutics focuses on the aspect of disclosing the meaning of the author's ideological interests. This research aims to examine the legal reasoning in Decision No. 272 / PDT.G / 2017 / PN.BDG regarding the Government Procurement Contract Guarantee Claim from the perspective of Hans Georg Gadamer's Hermeneutic Circle. The research type is normative doctrinal, using secondary data sources consisting of primary, secondary, and tertiary legal materials with a conceptual approach, statutory approach, and case study. The research findings suggest that the process of claiming a bank guarantee through the judicial institution can be carried out by the Procurement Committee (PPK) as long as they obtain authorization from the Budget User, who is the owner of the work (bouwheer). This is due to the hybrid nature of government procurement contracts, which distinguishes them from private contracts, and the clarity of the scope of authority of the Budget User serves as the establishment of formal justice, acting as a bridge (epistemology) toward substantive justice.

Abstract

Law Number 20 of 2023 concerning State Civil Apparatus (ASN) is a new regulation that aims to transform state apparatus management through strengthening the merit system and applying the principle of distributive justice. This study aims to analyze the regulation of ASN functions and authorities, examine the implementation of ASN duties, and formulate an ideal concept for the implementation of ASN functions and authorities based on distributive justice within the BKPSDM of Mataram City. This study uses an empirical juridical method with a qualitative approach. Data was collected through interviews, observation, and documentation studies. The results of the study show that the implementation of Law Number 20 of 2023 has been running normatively, but has not been optimal in realizing distributive justice due to the limited number of ASN, workload imbalances, and the uneven distribution of career development and performance rewards. This study recommends strengthening the merit system, optimizing supervision, and establishing a bureaucratic culture oriented towards fairness and professionalism.
