Abstract

Aceh Singkil memiliki sumber daya alam potensial yang kontribusinya di bidang pertanian dan perkebunan menempati urutan pertama terhadap perekonomian masyarakat. Sehingga pemerintah memberikan perhatian lebih di sektor pertanian dengan memberikan pupuk subsidi bagi petani dari kalangan menengah ke bawah. Namun ternyata kebijakan yang dilakukan oleh pemerintah terkait penyaluran pupuk subsidi tidak berjalan sebagaimana mestinya. Berbagai permasalahan seperti kelangkaan pupuk dan tingkatan harga yang berbeda menjadi hal yang lumrah terjadi. Kajian ini menjawab tujuan penelitian yaitu bagaimana ketersediaan pupuk subsidi dan sistem pengalokasiannya untuk petani di Aceh Singkil, tingkat harga yang ditetapkan Dinas Tanaman Pangan, Hortikultura dan Peternakan Aceh Singkil pada penjualan pupuk subsidi di kios-kios resmi pengecer, dan kebijakan pemerintah Aceh Singkil terkait mekanisme jual beli pupuk subsidi dalam perspektif tas’ir al-jabari. Penelitian ini menggunakan metode kualitatif melalui pendekatan sosio-yuridis dan bersifat deskriptif analisis melalui pengumpulan data primer yang diperoleh di lapangan dan data sekunder yang diperoleh dari penelitian kepustakaan. Hasil penelitian menunjukkan bahwa ketersediaan pupuk subsidi di Kabupaten Aceh Singkil masih belum mencukupi 100% dari kebutuhan petani (hanya berkisar di antara 30% sampai dengan 40% saja) disebabkan oleh faktor, yaitu: jumlah alokasi yang terbatas, kurangnya kesadaran petani dalam pendaftaran e-RDKK, penjualan pupuk subsidi kepada pihak lain, dan ketidaksesuaian antara alokasi dengan jumlah RDKK. Tingkatan harga di kios pengecer masih beragam, karena ada pihak yang mengambil keuntungan sebanyak Rp.15.000,00 sampai Rp.20.000,00 dari ketetapan HET (Harga Eceran Tertinggi) pemerintah. Sistem pengalokasiannya juga masih kondisional.Kebijakan yang dibuat oleh pemerintah Aceh Singkil terkait mekanisme jual beli pupuk subsidi juga belum sesuai dengan konsep tas’ir al-jabari karena bertolak belakang dengan tujuan awalnya, yaitu menetapkan harga yang adil serta mengurangi tingkat kelangkaan demi kemaslahatan bersama.

Abstract

One of the financial institutions that contribute effectively to channeling business capital financing is the Sharia Consumer Cooperative Mitra Niaga Sejahtera located in Lambaro Aceh Besar. This institution is supervised by the Sharia Supervisory Board which is tasked with overseeing the operations and practices of LKS in order to adhere to sharia principles. This research examines murabahah financing and looks at the extent of the supervision of the Sharia Supervisory Board at the Mitra Niaga Sejahtera Sharia Consumer Cooperative. So that it raises questions about the murabahah financing mechanism based on the DSN MUI Fatwa Review. In this study the authors used a type of qualitative research and produced data in the form of descriptive analysis. Data collection techniques using interview techniques in the field and documentation. The results of the research obtained that the initial mechanism to become a member / prospective member of murabahah financing is by submitting application for murabahah business capital financing with predetermined conditions, ensuring that murabahah financing is on target, checking the pillars such as contracts, parties to the transaction, objects, objectives and benefits of the financing.

Abstract

There are often various customs of marriage customs in society. From these marriage habits, some are not contrary to Sharia but there are also the opposite. For this the customs/customs of marriage need to be traced using the review of 'urf, so that it is thus identified whether it belongs to 'urf shahih or 'urf fasid. From that, this study formulated two problems, including how the marriage habits carried out by a small number of Gampong Padang residents and what 'urf reviews these marriage habits are. To answer these two formulations, the author uses a library research method with several approaches, namely the case approach, legislation, and the 'urf theory approach. The result obtained from this study is that there is a small percentage of Gampong Padang residents who hand over the fate of their marriage to someone who is held under the name waled / walidi. After collecting several waled people then determined a mate against them. After the arranged marriage proceeds to the stage around sawa mountain, to the tomb of ureung malem for the ritual summoning of ancestral spirits and sirri marriage. Based on these data, researchers categorize the marriage habit into two forms of 'urf, namely shahih and fasid. What is included in the urf shahih is the arranged marriage and marriage of sirri, the arranged marriage is done voluntarily and so is the sirri marriage carried out according to the marriage. Meanwhile, what is included in the 'urf fasid is to surround the sawa mountain and to the tomb of the mountain malem for ancestral spirit summoning rituals, because it contains shirk and adultery. It should not be a custom that is fasid because a concept of custom can be done if it does not conflict with the syara'.

Abstract

As the activities of the Sharia economy develop, the number of Sharia economic dispute cases submitted to the Religious Court has increased. One of the cases decided by the Kudus Religious Court is the Breach of Contract Lawsuit with Decision Number 1/P.dt.G.S/2019/PA.Kds. The Supreme Court issued Regulation Number 14 of 2016 concerning Procedures for the Settlement of Sharia Economic Disputes, which includes simple lawsuits and ordinary lawsuits. Simple lawsuits are further regulated in Supreme Court Regulation Number 2 of 2015, which was later amended to Supreme Court Regulation Number 4 of 2019 concerning Procedures for the Settlement of Simple Lawsuits. This regulation aims to ensure that the resolution of Sharia economic disputes is simpler, faster, and less costly. This research aims to analyze the process and mechanism for resolving simple Sharia economic dispute lawsuits at the Kudus Religious Court, examine the judges' considerations in deciding Sharia economic dispute cases, and identify challenges in resolving Sharia economic disputes. The type of research used is field research with a qualitative approach, utilizing primary, secondary, and tertiary data. The results of the study show that the process and considerations of the judges in Decision Number 1/P.dt.G.S/2019/PA.Kds are in accordance with applicable regulations. However, the resolution of the case takes quite a long time. Therefore, judges in the Religious Courts are required to have competence in Sharia economic law to handle cases more effectively and efficiently.

Abstract

In Indonesia, the procedure made for the Islamic community is that the marriage must be officially registered with the competent authority and published in accordance with the Marriage Law Number 1 of 1974 and must meet the requirements and pillars so that the marriage is valid. However, some people in North Singkil District still carry out their marriages that are not officially registered and the marriages are carried out through a guardian judge who is not appointed by the Minister of Religion or an official appointed by him, who is known in the community as a wild qadi. The formulation of the problem in this study is why people marry through illegal qadi, what are the obstacles and efforts of the North Singkil Religious Affairs Office in minimizing marriage through illegal qadi. In this study the authors use field research (field research). Based on the results of the study, the reasons why the people of North Singkil married through illegal qadi were because they were pregnant out of wedlock, avoiding administrative procedures, because of dishonest intentions, lack of education and understanding about marriage, and not old enough. The obstacles faced by KUA in minimizing marriages through cadiliar are: the lack of public awareness and understanding of the law, the absence of a firm sanction for those who marry through illegal qadi, and there are still many clerics who are willing to marry off on the grounds of avoiding adultery without registering their marriages with the KUA. The efforts made by the North Singkil KUA are to disseminate information to the public about the importance of registered marriages, conduct counseling on the registration of marriages and happy families through Islamic religious educators., as well as providing an explanation of marital problems at the time of the marriage ceremony.

Abstract

Government Regulation Number 54 of 2007 concerning the Implementation of Child Adoption explains that the age of prospective adoptive parents is at least 30 (thirty) years old and the highest is 55 (fifty five) years. In the Determination of the Banda Aceh Syar'iyah Court Number 120/Pdt.P/2019 it is stated that a single parent who wants to adopt a child is 59 years old, which according to applicable legal provisions does not meet the requirements or has passed the age limit in the requirements for child adoption. In this case, the Banda Aceh Syar'iyah Court rejected the Petitioner's application, then the Petitioner submitted an application to the cassation level, so that the Supreme Court's decision Number 777 K/Ag/2019 was granted. This study aims to explain the legal considerations by the judges of the Supreme Court in granting Decision Number 777 K/Ag/2019 concerning Child Adoption, to explain the juridical review of Decision Number 777 K/Ag/2019 regarding the cancellation of the first-degree determination. The research method that the author uses is a qualitative descriptive analysis, which consists of primary data materials and secondary data. The results of the study explained that the Supreme Court granted the appeal by using clear legal arguments that were against the legislation. The panel of judges of the Supreme Court granted the request by looking at the advantages and benefits for the adopted child who is the nephew of the single parent. Thus, there was jurisprudence used by judges for the case of Decision Number 777 K/Ag/2019 which is a source of material law. The Supreme Court has issued its decision with legal considerations, the rule of law may be set aside. Juridically, the decision of the Supreme Court is in accordance with the rules in force in Indonesia. With this decision, it can be used as jurisprudence for further judges to handle the same case.

Abstract

In the Regulation of the Supreme Court of the Republic of Indonesia No. 5 of 2019 concerning Guidelines for Adjudicating Applications for Marriage Dispensation, article 15 letter (d) states that examining a child for whom a marriage dispensation is requested may seek a recommendation from a psychologist or professional Social Worker Doctor/Midwife, Social Welfare Personnel, Integrated Service Center for the Protection of Women and Children (P2TP2A). , Indonesian/Regional Child Protection Commission (KPAI/KPAD). However, in reality the implementation of the Banda Aceh Syar'iyah Court's decision with Case number 5/Pdt.P/2021/Ms.Bna, the Judge granted the petition for a marriage dispensation by the applicant without fulfilling the conditions stated in article 15 in letter (d). In addition, in the community, parents who marry off their children have not reached the age stipulated by law, and without a recommendation letter from a doctor, even though it is very important for the reproductive health of the prospective bride. The question in this thesis research is the first dispensation for marriage according to PERMA No. 5 of 2019 concerning guidelines for adjudicating applications for dispensation for marriage against underage women, and the second consideration of the judges of the Banda Aceh syar'iyah court in granting requests for dispensation for marriage to underage women. This study uses a qualitative method. The results of the study found that the marriage dispensation according to PERMA No. 5 of 2019 regarding guidelines for adjudicating applications for dispensation for marriage is that the application can be submitted for those who are not of the age in accordance with statutory regulations no. 16 of 2019 regarding amendments to law no. 1 of 1974. And the judge's consideration in granting the application for dispensation for marriage without fulfilling the conditions stipulated in PERMA No. 5 of 2019 in article 15 letter d because these conditions are supporting conditions, this can be seen from the age of the applicant because of concerns that occur in the reproduction of the woman because she is still a minor.

Abstract

The present article aims to examine the legality of non-cash sales agreements. In the context of non-cash sales transactions, there exists a significant potential for harm to befall entrepreneurs in their capacity as sellers. This is primarily attributable to the potential for substantial price escalations. The present study adopts a qualitative, legal-empirical approach. The findings of this study indicate that the agreements reached by the parties regarding the purchase and sale of construction materials on a cash basis in Indra Jaya Pidie District include the recording of the identities of the parties involved, the details of the construction materials purchased, the agreed price of the construction materials, and the payment terms selected, such as 3 months, during which the buyer must settle the payment. However, it has been observed that certain purchasers have deviated from the terms of the agreement, a development that has the potential to occasion financial losses for Mulia Baru Store. Conversely, the new business store requires buyers to pay down to conduct cash transactions. Furthermore, buyers must consent to the imposition of a penalty in the event of non-compliance with the stipulated terms of payment.

Abstract

This study discusses the acquittal verdict handed down by the Stabat District Court against Terbit Rencana Perangin Angin, former Regent of Langkat, in the case of the Crime of Human Trafficking (TPPO) as regulated in Law Number. 21 of 2007. The formulation of the problems raised in this study include: (1) What are the Legal Considerations for the Acquittal Verdict for the Crime of Human Trafficking? (2) What are the Judge's Considerations According to Law Number. 21 of 2007 for the Acquittal Verdict on the Eradication of the Crime of Human Trafficking? This study uses a qualitative method with a normative legal and empirical legal approach which aims to understand and analyze how the law is applied in the acquittal verdict based on the Stabat District Court decision Number 555/Pid.Sus/2023/PN Stb. This study aims to analyze how the judge's considerations for the acquittal verdict according to Law Number. 21 of 2007. This decision has received a lot of criticism because it is considered not to reflect justice for victims who experience exploitation, physical and psychological violence, and economic losses. And the analysis was conducted on Decision No. 555/Pid.Sus/2023/PN Stb and compared it with similar cases. The results of the study indicate that the judge's consideration in acquitting the defendant was based on the lack of valid evidence and the failure to fulfill the elements of proof as regulated in Article 183 of the Criminal Procedure Code. This study recommends the need for reform in the system of evidence and protection of victims of TPPO so that substantive justice can be realized.

Abstract

Mayoritas ulama ( jumhur ) berpendapat bahwa apabila kerugian atau kerusakan dalam akad ijarah terjadi murni karena faktor di luar kemampuan pekerja, maka tanggung jawab sepenuhnya berada di tangan pemilik usaha. Hal ini sejalan dengan asas keadilan, dimana seseorang tidak boleh dimintai pertanggungjawaban atas sesuatu yang berada di luar kemampuannya. Akan tetapi apabila kerugian tersebut timbul akibat kelalaian atau kealpaan dari pihak pekerja, maka pekerja wajib menanggung akibat kelalaiannya tersebut. Dalam penelitian ini, penulis membuat tujuan penelitian dalam rumusan masalah yang difokuskan untuk menjawab tiga hal penting yaitu: bagaimana pelaksanaan akad konsinyasi antara produsen kue Adee Kak Nah dengan pemilik outlet, bagaimana polis pertanggungan terhadap produk yang rusak dan kadaluarsa, dan bagaimana tinjauan akad ijarah 'ala al-'amal terhadap pertanggungan tersebut. Jenis penelitian yang dilakukan menggunakan penelitian kualitatif dengan menggunakan metode deskriptif. Sumber data yang digunakan adalah data primer dan data sekunder. Dari hasil penelitian dapat disimpulkan bahwa perjanjian konsinyasi ini dilakukan secara lisan, dengan kesepakatan bahwa pertanggungan atas produk yang rusak dan kadaluarsa sepenuhnya ditanggung oleh pihak consignee (pemilik outlet). Pihak produsen tidak memberikan pertanggungan karena menurut mereka hal tersebut merupakan kelalaian dari pihak outlet. Namun kenyataannya produk yang rusak tidak hanya disebabkan oleh kelalaian consignee saja, beberapa produk yang didapatkan terkadang terdapat cacat yang baru diketahui pada saat produk tersebut dikemas untuk konsumen akhir. Dengan diterapkannya pertanggungan tersebut, maka terjadi wanprestasi lagi yaitu keterlambatan pembayaran hasil penjualan kepada produsen.
